which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Transportation to carry out a highway formula modernization study, and for other purposes.</official-title></form><legis-body><section id="id692373aceee94087a3f2feadeff06b96" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Highway Formula Modernization Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="id27C76B76B58B4A16A2FD6C6BBFF05D12"><enum>2.</enum><header>Highway formula modernization study</header><subsection id="id686a0dac905f4a64b6d3684ae39bf93f"><enum>(a)</enum><header>In general</header><text>The Secretary of Transportation (referred to in this section as the <quote>Secretary</quote>), in consultation with the State departments of transportation and representatives of local governments (including metropolitan planning organizations), shall conduct a highway formula modernization study to assess the method and data used to apportion Federal-aid highway funds under subsections (b) and (c) of section 104 of title 23, United States Code, and issue recommendations relating to that method and data.</text></subsection><subsection id="iddc69e93f573a40e0856f699b11161c99"><enum>(b)</enum><header>Assessment</header><text>The highway formula modernization study required under subsection (a) shall include an assessment of, based on the latest available data, whether the apportionment method described in that subsection results in—</text><paragraph id="id2fc0a384d12048ce9d3b9e618a88e9ec"><enum>(1)</enum><text>an equitable distribution of funds based on the estimated tax payments attributable to—</text><subparagraph id="idbccad6a6c19e454ba26b20874ee0da66"><enum>(A)</enum><text>highway users in the State that are paid into the Highway Trust Fund; and</text></subparagraph><subparagraph id="idcf9b80d4256040f88a368a1891b7c6d5"><enum>(B)</enum><text>individuals in the State that are paid to the Treasury, based on contributions to the Highway Trust Fund from the general fund of the Treasury; and</text></subparagraph></paragraph><paragraph id="id1f94107cae8c49069dd0bb41d724b36a"><enum>(2)</enum><text>the achievement of the goals described in section 101(b)(3) of title 23, United States Code.</text></paragraph></subsection><subsection id="id4a65b4f5cb244d9a938bd274634d03f2"><enum>(c)</enum><header>Considerations</header><text>In the assessment under subsection (b), the Secretary shall consider the following:</text><paragraph id="idcb9b6f63657142789a90bd429c559c51"><enum>(1)</enum><text>The factors described in sections 104(b), 104(f)(2), 104(h)(2), 130(f), and 144(e) of title 23, United States Code, as in effect on the date of enactment of SAFETEA–LU (<external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>; 119 Stat. 1144).</text></paragraph><paragraph id="idc62f103ee6ac4aa89fd60eb39f767c40"><enum>(2)</enum><text>The availability and accuracy of data necessary to calculate formula apportionments under the factors described in paragraph (1).</text></paragraph><paragraph id="id008574fb92a04a7b9be01ab7c0cc0231"><enum>(3)</enum><text>The measures established under section 150 of title 23, United States Code, and whether those measures are appropriate for consideration as formula apportionment factors.</text></paragraph><paragraph id="id200cff726c18433a932f32173c88c484"><enum>(4)</enum><text>Any other factors that the Secretary determines are appropriate.</text></paragraph></subsection><subsection id="id65f262bd30174a93936ca6ae99073097"><enum>(d)</enum><header>Recommendations</header><text>The Secretary, in consultation with the State departments of transportation and representatives of local governments (including metropolitan planning organizations), shall develop recommendations on a new apportionment method, including—</text><paragraph id="id86ed0b88ca79404696a32c4edd2d8da1"><enum>(1)</enum><text>the factors recommended to be included in the new apportionment method;</text></paragraph><paragraph id="id0083f0affd9544e3b2b44ca1fcd99fea"><enum>(2)</enum><text>the weighting recommended to be applied to the factors recommended under paragraph (1); and</text></paragraph><paragraph id="id58876998e8e6440b8c5ea65c038ff507"><enum>(3)</enum><text>any other recommendations to ensure that the new apportionment method best achieves an equitable distribution of funds described under subsection (b)(1) and the goals described in subsection (b)(2). </text></paragraph></subsection></section></legis-body></bill>
