which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Indian Health Care Improvement Act to authorize a special behavioral health program for Indians, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native Behavioral Health Access Improvement Act of 2021</short-title></quote>.</text></section><section id="id51359623f35644f3aad9f6cf762df35f"><enum>2.</enum><header>Special behavioral health program for Indians</header><subsection id="id752AA93669414612A01E897D4B0D9FDD"><enum>(a)</enum><header>In general</header><text>Subtitle A of title VII of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1665">25 U.S.C. 1665 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id148693EE3A654928976C1F7DFD044281"><section id="id7f2d2c7b98d342b0afc3f1b5d73d945b"><enum>716.</enum><header>Special behavioral health program for Indians</header><subsection id="idb20c6faeb8e84beea89c363bf1414874"><enum>(a)</enum><header>Definition of eligible entity</header><text>In this section, the term <term>eligible entity</term> means—</text><paragraph id="id505C62253198402090F4C45B20FA1CB1"><enum>(1)</enum><text>any health program administered directly by the Service;</text></paragraph><paragraph id="id019992A377AF4B77ABEF0436E0C12E9F"><enum>(2)</enum><text>a Tribal health program; and</text></paragraph><paragraph id="id87C6C963BD2F49D087BD1013BAE562EF"><enum>(3)</enum><text>an urban Indian health program operated by an urban Indian organization pursuant to a grant or contract with the Service under title V.</text></paragraph></subsection><subsection id="idDDDB00848ACF47ECA2D1FA74BCECB9A1"><enum>(b)</enum><header>Formula grants</header><paragraph id="id2D49F354F6484C09BC9E847753B80C9A"><enum>(1)</enum><header>In general</header><text>The Director of the Service (referred to in this section as the <quote>Director</quote>) shall award grants to eligible entities, in amounts determined pursuant to the formula described in paragraph (2), to be used by the eligible entity to provide services for the prevention of, treatment of, and recovery from mental health and substance use disorders.</text></paragraph><paragraph id="id4D8871EEFF3A48739916ECBF72A0C095"><enum>(2)</enum><header>Formula described</header><text>The Director, in consultation with Indian Tribes and urban Indian organizations, shall develop a formula to determine the amount of a grant under paragraph (1).</text></paragraph></subsection><subsection id="idfe24ab1ae32b4143af3d2a2a5803d8a4"><enum>(c)</enum><header>Technical assistance and program evaluation</header><paragraph id="id6c1137e4efbb44349be538db085a0770"><enum>(1)</enum><header>In general</header><text>The Director shall—</text><subparagraph id="idf3f7086072534b508fbf8b469b59e12e"><enum>(A)</enum><text>provide technical assistance to grantees under this section; and</text></subparagraph><subparagraph id="id8f5e343e5b5a4342b3a58fd7d90031d7"><enum>(B)</enum><text>collect and evaluate information on the program carried out under this section.</text></subparagraph></paragraph><paragraph id="id8de322605566447e929fe31d6b01e6d8"><enum>(2)</enum><header>Consultation</header><text>The Director shall consult with eligible entities for purposes of developing evaluation measures and data submission and reporting requirements for purposes of the collection and evaluation of information under paragraph (1)(B).</text></paragraph><paragraph id="id1be7963723a541ce9e10ea8b48c57bff"><enum>(3)</enum><header>Data submission and reporting</header><text>As a condition on receipt of a grant under this section, an applicant shall agree to submit data and reports consistent with the data submission and reporting requirements developed under paragraph (2).</text></paragraph></subsection><subsection id="idc730c089a2134f5fa01dc4d2474a1813"><enum>(d)</enum><header>Funding</header><text>For the purpose of making grants under this section, there is authorized to be appropriated, and there is appropriated, out of any money in the Treasury not otherwise appropriated, $200,000,000 for each of fiscal years 2022 through 2026.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8BA4D02D3BDF4297AD4147CF93450F33"><enum>(b)</enum><header>Technical amendment</header><text>Section 4(26) of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603(26)</external-xref>) is amended by striking <quote>(<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>)</quote> and inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)</quote>.</text></subsection></section></legis-body></bill>
