<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2222</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210624">June 24, 2021</action-date><action-desc><sponsor name-id="S397">Mr. Braun</sponsor> (for himself and <cosponsor name-id="S355">Mr. Cruz</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 5, United States Code, to lower the standard for removing employees who disclose tax return information without authorization, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Taxpayers’ Privacy Act</short-title></quote>.</text></section><section id="id148546FFF3784748A6BFAB87FBD0B296"><enum>2.</enum><header>Increase of penalty for unauthorized disclosure of taxpayer information</header><subsection id="idA914A2C2A8B74328A649DE5C972D4338"><enum>(a)</enum><header>In general</header><text>Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/26/7213">section 7213(a)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>$5,000</quote> and inserting <quote>$250,000</quote>.</text></subsection><subsection id="id191CA3269D8241C7A90F321FC047DC42"><enum>(b)</enum><header>Disclosures by tax return preparers</header><text>Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/26/7216">section 7216</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>$1,000 ($100,000 in the case of a disclosure or use to which section 6713(b) applies)</quote> and inserting <quote>$250,000</quote>.</text></subsection><subsection id="idAFC7C483091E47BCB69D978C1CFF12E2"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to disclosures made on or after the date of the enactment of this Act.</text></subsection></section><section id="idEFFF2C31745E433CADA49C6758C36F79"><enum>3.</enum><header>Removal</header><subsection id="idA896BA1F9AF44567B09CED4015BD1C31"><enum>(a)</enum><header>In general</header><text>Section 7701(c)(1)(A) of title 5, United States Code, is amended by inserting <quote>or in the case of an action involving a removal from the service for an alleged violation of <external-xref legal-doc="usc" parsable-cite="usc/26/7213">section 7213(a)(1)</external-xref> of the Internal Revenue Code of 1986,</quote> after <quote>described in section 4303,</quote>.</text></subsection><subsection id="id4B93E26F99F04CCA8B81A5805CB3A778"><enum>(b)</enum><header>Rule of construction</header><text>The amendments made by subsection (a) may not be construed to permit an officer or employee of the United States to submit an appeal to the Merit Systems Protection Board if that individual is dismissed from office or discharged from employment upon conviction for a violation of <external-xref legal-doc="usc" parsable-cite="usc/26/7213">section 7213(a)(1)</external-xref> of the Internal Revenue Code of 1986.</text></subsection></section></legis-body></bill>
