and </after-quoted-block></quoted-block></paragraph><paragraph id="HE1A644F3B4CB46C9B2D420E854F8EEEB" commented="no"><enum>(2)</enum><text>in subparagraph (C)—</text><subparagraph id="H714379E1FE0C4417B3025246B7F501D2"><enum>(A)</enum><text>by striking <quote>or a State dislocated worker unit</quote> and inserting <quote>a State dislocated worker unit</quote>; and</text></subparagraph><subparagraph id="HAB9D7F7C9AE842548DD32169925F6F10" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end before the period the following: <quote>, or workforce intermediaries, including labor-management organizations that carry out re-employment and training services</quote>. </text></subparagraph></paragraph></section><section id="H1336D5AFEC1242D8A2414B4724566792"><enum>102.</enum><header>Group eligibility requirements</header><subsection id="H8DC0F12572A048B7B3F78617E4891871"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 222(a)(2) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272(a)(2)</external-xref>) is amended—</text><paragraph id="H2A485A5D802C40FBBCDCEA37B865387A"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text><subparagraph id="H25A25AC176FB4439868C0AC5D251CBA1" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by inserting <quote>or failed to increase</quote> after <quote>absolutely</quote>; and</text></subparagraph><subparagraph id="H8ECBA3214ECE414A96E7B00AB03CDFE4"><enum>(B)</enum><text>in clause (iii)—</text><clause id="HE2508D97D0F34E98AACCB05428029132"><enum>(i)</enum><text>by striking <quote>to the decline</quote> and inserting <quote>to any decline or absence of increase</quote>; and</text></clause><clause id="HDF023AD080B04CC2AB1D784B1E22C786"><enum>(ii)</enum><text>by striking <quote>or</quote> at the end;</text></clause></subparagraph></paragraph><paragraph id="H9B06FEFAB8DD40B19F3658327FB42E4A"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B)(ii), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HBC91D18B604C4B099D6B3DC494AABE4B" commented="no"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HDD55EE2F8E7C48D893B0484B9A7DE6E4"><subparagraph id="H3242329D346D403CADBD9F663B8F2196" indent="up1" commented="no"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H69E6634DCFD84B26B7440E1072B4EAD8"><enum>(i)</enum><text display-inline="yes-display-inline">the sales or production, or both, of such firm have decreased;</text></clause><clause id="HB41E5C38FD6244A6A11EF1DFFB9F6A17" indent="up1" commented="no"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HAC4921E09A7B4BB3844643CA7DAD500E"><enum>(I)</enum><text>exports of articles produced or services supplied by such workers’ firm have decreased; or</text></subclause><subclause id="H2E45361A11364753BB863B61863ACEDD" indent="up1"><enum>(II)</enum><text>imports of articles or services necessary for the production of articles or services supplied by such firm have decreased; and </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H1DF9B18FFC004915AC2C448FC4E36A8C" indent="up1"><enum>(iii)</enum><text>the decrease in exports or imports described in clause (ii) contributed to such workers’ separation or threat of separation and to the decline in the sales or production of such firm.</text></clause></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="HBB0B1917C32A43F0B1A55FDC35DE0C64"><enum>(b)</enum><header>Repeal</header><text display-inline="yes-display-inline">Section 222 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272</external-xref>) is amended—</text><paragraph id="HC499BE45249C45899A8F1F31471602C6"><enum>(1)</enum><text>in subsections (a) and (b), by striking <quote>importantly</quote> each place it appears; and</text></paragraph><paragraph id="HFA2F2A319FF14EAEA6BBCE48821FCA89"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)—</text><subparagraph id="HF00F4115BF3D4BB786D94A4943141BAF"><enum>(A)</enum><text>by striking paragraph (1); and</text></subparagraph><subparagraph id="H4F1AC8ADD0834B5182CCA6760A658368" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>by redesignating paragraphs (2) through (4) as paragraphs (1) through (3), respectively. </text></subparagraph></paragraph></subsection></section><section id="idA118ECED0D224FAEA97D1A7317EA56A9"><enum>103.</enum><header>Eligibility of staffed workers and teleworkers</header><text display-inline="no-display-inline">Section 222 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEED31B4350754DDFA22502BB3A61866C"><subsection id="idDC6A0C87749440388A5E827DA27A2B21"><enum>(f)</enum><header>Treatment of staffed workers and teleworkers</header><paragraph id="id536A0345974D4A2289F0730E51DC2387"><enum>(1)</enum><header>In general</header><text>For purposes of subsection (a), workers in a firm include staffed workers and teleworkers.</text></paragraph><paragraph id="idC584628D6F05471CBF9356110AC46A84"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="idB3D5A8C5D53547EBAB71D03AFB72EDF7"><enum>(A)</enum><header>Staffed worker</header><text>The term <term>staffed worker</term> means a worker who performs work under the operational control of a firm that is the subject of a petition filed under section 221, even if the worker is directly employed by another firm.</text></subparagraph><subparagraph id="id0237AD05BAB747B4979D78EAD1F31C74"><enum>(B)</enum><header>Teleworker</header><text>The term <term>teleworker</term> means a worker who works remotely but who reports to the location listed for a firm in a petition filed under section 221.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id22494BAEAF184259A22DA47F51233466"><enum>104.</enum><header>Application of determinations of eligibility to workers employed by successors-in-interest</header><text display-inline="no-display-inline">Section 223 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2273">19 U.S.C. 2273</external-xref>) is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id86DEFF7D556E4D84AA5CF110B4AD6627"><subsection id="id47EACF59BCC7449B9A572DD6025619FF"><enum>(f)</enum><header>Treatment of workers of successors-in-Interest</header><text>If the Secretary certifies a group of workers of a firm as eligible to apply for adjustment assistance under this chapter, a worker of a successor-in-interest to that firm shall be covered by the certification to the same extent as a worker of that firm.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idF8C3F152FF2F4843B6F9DAEF9E027443"><enum>105.</enum><header>Notifications to political subdivisions of certain certifications</header><text display-inline="no-display-inline">Section 223 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2273">19 U.S.C. 2273</external-xref>), as amended by section 104, is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFBFF9E311E91480288FFAA9C9802A35D"><subsection id="id426C87CFF2B9421C890D6502CF093869"><enum>(g)</enum><header>Notifications to political subdivisions of certain certifications</header><paragraph id="id02E656EE0B384B279609A9844DC4D059"><enum>(1)</enum><header>Notification to Secretary of Commerce</header><text>Upon issuing a certification or certifications of eligibility under subsection (a) pursuant to one or more petitions filed under section 221 covering more than 1,000 workers within a political subdivision during a calendar year, the Secretary shall notify the Secretary of Commerce. </text></paragraph><paragraph id="id0690EDC13B0D4DF48B0483DD083F93EE"><enum>(2)</enum><header>Notification to political subdivisions</header><text>Upon receiving a notification under paragraph (1) with respect to a political subdivision, the Secretary of Commerce, acting through the Assistant Secretary of Commerce for Economic Development, shall—</text><subparagraph id="id8159773647314047BED16287629D43C5"><enum>(A)</enum><text>notify the political subdivision of economic assistance grants, loans, and other financial assistance available from the Economic Development Administration; and</text></subparagraph><subparagraph id="id3DE847FFCED941FEA47830A3BAD2B183"><enum>(B)</enum><text>if the political subdivision applies for any such assistance and meets the requirements for receiving the assistance, provide the political subdivision with priority for receiving that assistance.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id2E7E217842B7446B8AED0ADF06A41C31"><enum>106.</enum><header>Pilot program for expanded eligibility</header><text display-inline="no-display-inline">Section 223 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2273">19 U.S.C. 2273</external-xref>), as amended by section 105, is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBE9FDBB4BBBA4B5E8D30AF363D86604E"><subsection id="idA75325DDA63649698223A1846A107AA0"><enum>(h)</enum><header>Pilot program for expanded eligibility</header><paragraph id="idC064072484E44F2BA7B59922D3CE4316"><enum>(1)</enum><header>In general</header><text>The Secretary of Labor may establish a pilot program under which the Secretary may certify under subsection (a) as eligible to apply for adjustment assistance under this subchapter groups of workers who do not meet the eligibility requirements under section 222.</text></paragraph><paragraph id="id1619F213B436471085F58132A0D1D267"><enum>(2)</enum><header>Requirement</header><text>The Secretary may not provide to workers covered by a certification of eligibility under paragraph (1) benefits that are reduced relative to the benefits received by other workers under this subchapter.</text></paragraph><paragraph id="id18276DAB82934140AC2C531B2571AE5E"><enum>(3)</enum><header>Notification to Congress</header><text>Before implementing the pilot program under paragraph (1), the Secretary shall submit to Congress a report that includes—</text><subparagraph id="id3AA3707A0D084B6C98FCF01ED8C07708"><enum>(A)</enum><text>a detailed plan for the program; and</text></subparagraph><subparagraph id="id805C422818B64D898ECADD26FB0AD06B"><enum>(B)</enum><text>a justification for each requirement under section 222 to be waived under the program.</text></subparagraph></paragraph><paragraph id="id309F21A28C6E4BB2A6C963694ABD61D0"><enum>(4)</enum><header>Termination</header><text>The pilot program under paragraph (1) shall terminate at such time as the Secretary considers appropriate.</text></paragraph><paragraph id="idD6BEAF86E4C041A097061F0E92B6C1DE"><enum>(5)</enum><header>Report required</header><text>Not later than 90 days after the termination under paragraph (4) of the pilot program under paragraph (1), the Secretary shall submit to Congress a report on the outcomes for the workers who participated in the program.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H6527F6C9B82E41B9BEC2E6248C628C9A"><enum>107.</enum><header>Provision of benefit information to workers</header><text display-inline="no-display-inline">Section 225 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2275">19 U.S.C. 2275</external-xref>) is amended—</text><paragraph id="HFBAD5C6071FB428392608931D3FB789B" commented="no"><enum>(1)</enum><text>in subsection (a), by inserting after the second sentence the following new sentence: <quote>The Secretary shall make every effort to provide such information and assistance to workers in their native language.</quote>; and</text></paragraph><paragraph id="HB8C9EDAB25DB48EC921BE4401612F431"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HC03B50C9486E42639DAF7C46B2CEB9E9" commented="no"><enum>(A)</enum><text>by redesignating paragraph (2) as paragraph (3);</text></subparagraph><subparagraph id="H4B9C522CE7F84088BE7910314317CF1A" commented="no"><enum>(B)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block id="H051C413EA2FE43BF8CA7EDF903EAE012" style="OLC"><paragraph id="H9058D971D42F42948D9E3F97F0F87CC7" commented="no" indent="up1"><enum>(2)</enum><text>The Secretary shall provide a second notice to a worker described in paragraph (1) before the worker has exhausted all rights to any unemployment insurance to which the worker is entitled (other than additional compensation described in section 231(a)(3)(B) funded by a State and not reimbursed from Federal funds).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HAFA423A1A1CB449480061DBA07755349" commented="no"><enum>(C)</enum><text>in paragraph (3), as redesignated by subparagraph (A), by inserting <quote>print or digital</quote> before <quote>newspapers</quote>; and</text></subparagraph><subparagraph id="H0BA5FA8F8B2045848D600AA020862D27"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block id="H0EB02711DD51402CACABFB1E60996BE5" display-inline="no-display-inline" style="OLC"><paragraph id="HE085B0C390E6464E98DA944790781CF7" indent="up1"><enum>(4)</enum><text>For purposes of providing outreach regarding the benefits available under this chapter to workers covered by a certification made under this subchapter, the Secretary may take any necessary actions, including the following:</text><subparagraph id="H8317FEE91CBC4E96987912B53840E7DB"><enum>(A)</enum><text>Collecting the email addresses and telephone numbers of such workers from the employers of such workers to provide outreach to such workers.</text></subparagraph><subparagraph id="H2F636F8D1EF04D4AB0AA035441B4DE8B"><enum>(B)</enum><text>Partnering with the certified or recognized union, a community-based worker organization, or other duly authorized representatives of such workers.</text></subparagraph><subparagraph id="H13846D9990EA463585F799881B09875F"><enum>(C)</enum><text>Hiring peer support workers to perform outreach to other workers covered by that certification.</text></subparagraph><subparagraph id="H04028B00C47A4DF286EB19763716A13A" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>Using advertising methods and public information campaigns, including social media, in addition to notice published in print or digital newspapers under paragraph (3).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></subtitle><subtitle id="idDF57CD4E0A354195A39690A42EA41B34" style="OLC"><enum>B</enum><header>Program Benefits</header><section id="H8DD2B8D4D6354CA49A19CD2DB1B52C7A"><enum>111.</enum><header>Modification of qualifying requirements for workers</header><subsection id="H029B95BD75E84FABA949A9E36891A507"><enum>(a)</enum><header>In general</header><text>Section 231(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2291">19 U.S.C. 2291(a)</external-xref>) is amended—</text><paragraph id="HBC648E52953E4DF197C85C756DC1E454"><enum>(1)</enum><text>by striking paragraph (2);</text></paragraph><paragraph id="HB263DACD83294F15B9CDAD7BA8D553AC"><enum>(2)</enum><text>by redesignating paragraphs (3), (4), and (5) as paragraphs (2), (3), and (4), respectively; and</text></subparagraph></paragraph><paragraph id="id38CD0C785FDE4605A6ECF610B6BE6002"><enum>(2)</enum><text>by amending subsection (f) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA5CAD16AA7C14182AADE3928295CD067"><subsection id="idddf50963326e45a0a381e4a9ec8b410b"><enum>(f)</enum><header>Payment of trade readjustment allowances To complete training</header><text>Notwithstanding any other provision of this section, in order to assist an adversely affected worker to complete training approved for the worker under section 236 that includes a program of prerequisite education or remedial education (as described in section 236(a)(5)(D)), and in accordance with regulations prescribed by the Secretary, payments may be made as trade readjustment allowances for up to 26 additional weeks in the 26-week period that follows the last week of entitlement to trade readjustment allowances otherwise payable under this chapter.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idC8178BDE4A1048E99E52FEDDC975A277"><enum>(b)</enum><header>Payment to workers in on-the-Job training, customized training, or apprenticeship programs</header><text>Section 233(d) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2293">19 U.S.C. 2293(d)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id286696FB9B69461DA4C5DDB6E2E56549"><subsection commented="no" display-inline="no-display-inline" id="IDC1AF57E29D7C405D82DBD64E29CFD224"><enum>(d)</enum><header>Payment to workers in on-the-Job training, customized training, or apprenticeship programs</header><paragraph commented="no" display-inline="no-display-inline" id="id654A043AB8484E16B4B965ADD3D546F6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2) and notwithstanding any other provision of this chapter, a trade readjustment allowance may be paid under this part to an adversely affected worker for any week during which the worker is receiving on-the-job training or customized training, or is participating in a registered apprenticeship program, under section 236.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9A85978E90724F77890493F634DFCA68"><enum>(2)</enum><header>Income limitation</header><text display-inline="yes-display-inline">The Secretary shall reduce the amount of the trade readjustment allowance otherwise payable to a worker under paragraph (1) to ensure that the sum of the income of the worker from the on-the-job training, customized training, or apprenticeship program described in that paragraph and the trade readjustment allowance paid to the worker under that paragraph does not exceed $55,000 during a year.</text></paragraph><paragraph id="HA6EF2BADF8BB4E2193E0B5D0EE906389"><enum>(3)</enum><header>Adjustment of income limitation for inflation</header><subparagraph id="H5B9E4F0C52CE4E13A69A701900A81BE8"><enum>(A)</enum><header>In general</header><text>The Secretary of Labor shall adjust the income limitation under paragraph (2) on October 1, 2021, and at the beginning of each fiscal year thereafter, to reflect the percentage (if any) of the increase in the average of the Consumer Price Index for the preceding 12-month period compared to the Consumer Price Index for fiscal year 2020.</text></subparagraph><subparagraph id="HCECCCA08F52F4365B4629CAF464729B5"><enum>(B)</enum><header>Special rules for calculation of adjustment</header><text>In making an adjustment under subparagraph (A), the Secretary—</text><clause id="HC5AF34E9C75E48D4B7B1419707FD4488"><enum>(i)</enum><text>shall round the amount of any increase in the Consumer Price Index to the nearest dollar; and</text></clause><clause id="H61DD415C76EF4F468D2B772A822E95D3"><enum>(ii)</enum><text>may ignore any such increase of less than 1 percent.</text></clause></subparagraph><subparagraph id="H41EC7AAC49AF4B3090132A6ED4D727A6"><enum>(C)</enum><header>Consumer Price Index defined</header><text>For purposes of this paragraph, the term <term>Consumer Price Index</term> means the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HB6FDB26CB230418CA9F3E6DE876759F4" section-type="subsequent-section"><enum>113.</enum><header>Automatic extension of trade readjustment allowances</header><subsection id="HC6ABB3F7E65D4A71A0C4833399542DCF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part I of subchapter B of chapter 2 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2291">19 U.S.C. 2291 et seq.</external-xref>) is amended by inserting after section 233 the following new section:</text><quoted-block style="OLC" id="H7CBE4F4A13D04529B1B086CFED5110FD" display-inline="no-display-inline"><section id="HCF575AD89E02448E9B1F93C0F428089E"><enum>233A.</enum><header>Automatic extension of trade readjustment allowances</header><subsection id="H953A7060F9A342F29298C254EFDF914B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding the limitations under section 233(a), the Secretary shall extend the period during which trade readjustment allowances are payable to an adversely affected worker who completes training approved under section 236 by the Secretary during a period of heightened unemployment with respect to the State in which the worker seeks benefits, for the shorter of—</text><paragraph id="H725338A0BAA54720AEC473B2FAD5F43F"><enum>(1)</enum><text>the 26-week period beginning on the date of completion of such training; or</text></paragraph><paragraph id="H3E8229DF3B1940C09226A7619608A4BC"><enum>(2)</enum><text display-inline="yes-display-inline">the period ending on the date on which the adversely affected worker secures employment.</text></paragraph></subsection><subsection id="H5A2F97C2BB4D47E481EE7D6271FF3F6B"><enum>(b)</enum><header>Job search required</header><text display-inline="yes-display-inline">A worker shall be eligible for an extension under subsection (a) only if the worker is complying with the job search requirements associated with unemployment insurance in the applicable State.</text></subsection><subsection id="H019B878D75D04B56A34B09FDEE81AAF3"><enum>(c)</enum><header>Period of heightened unemployment defined</header><text>In this section, the term <term>period of heightened unemployment</term> with respect to a State means a 90-day period during which, in the determination of the Secretary, either of the following average rates equals or exceeds 5.5 percent:</text><paragraph id="H6C3C2EB6A3694D678015B63E22021A64" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The average rate of total unemployment in the State (seasonally adjusted) for the period consisting of the most recent 90 days for which data for all States are published before the close of such period.</text></paragraph><paragraph id="H5B26C8BD72ED48AAB565A680B8C33AB2" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The average rate of total unemployment in all States (seasonally adjusted) for the period consisting of the most recent 90 days for which data for all States are published before the close of such period.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6097D118A1CA4693A707B0EBE72FD4D3"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Trade Act of 1974 is amended by inserting after the item relating to section 233 the following:</text><quoted-block style="OLC" id="HC597CC3F822242BDBCD58F0047631569" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 233A. parsable-cite="usc/19/2295">19 U.S.C. 2295</external-xref>) is amended—</text><paragraph id="H699590C1645E4F88B9D45E90149B2B84"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph ability to successfully place participants into suitable employment</quote>; </text></subparagraph></paragraph><paragraph id="H77A1E1A07F7E4E138384791A1B1F1548" commented="no"><enum>(2)</enum><text>by redesignating paragraph (8) as paragraph (9); and</text></paragraph><paragraph id="HCCA2374730474B5AA4EC4EEF56947188" commented="no"><enum>(3)</enum><text>by inserting after paragraph (7) the workers</header><text display-inline="no-display-inline">Section 236 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2296">19 U.S.C. 2296</external-xref>) is <term>pre-apprenticeship</term>, with respect to a program, means an initiative or set of strategies that is designed to prepare individuals to enter and succeed in an apprenticeship program registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></subtitle><subtitle id="id38B8A08481BF427DB2F14D89753B31CF" style="OLC"><enum>C</enum><header>Other Matters</header><section id="H9821817F8E324DAFB0D12D198657E387"><enum>121.</enum><header>Agreements with States</header><subsection id="HA1AA8F57EFD24A7B91E0773280D31BC1"><enum>(a)</enum><header>Coordination</header><text display-inline="yes-display-inline">Section 239(f) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2311">19 U.S.C. 2311(f)</external-xref>) is amended—</text><paragraph id="H4F73F003D970487B824BC3D6469DC8E4" display-inline="no-display-inline"><enum>(1)</enum><text>by striking provides a living wage, basic benefits that increase economic security, and develop the skills, networks, and experiences necessary to advance along a career path;</text></subparagraph><subparagraph id="H20DD3727347D4C8EAFCB3B4C2DEBAFD5" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">work to assist workers from underserved communities to establish a work history, demonstrate success in the workplace, and develop the skills that lead to entry into and retention in unsubsidized employment;</text></subparagraph><subparagraph id="H902AD62512864C759EEED56D9DE973E0"><enum>(C)</enum><text display-inline="yes-display-inline">facilitate joint cooperation between representatives of workers, employers, and communities, especially in underserved rural and urban regions, to ensure a fair and engaging workplace that balances the priorities and well-being of workers with the needs of businesses; and</text></subparagraph><subparagraph id="H472F577BCB674301AE60326A6CD6AAC4"><enum>(D)</enum><text display-inline="yes-display-inline">have a proven track record in adequately serving individuals who face the greatest barriers to employment, including people with low incomes, people of color, immigrants, and formerly incarcerated individuals.</text></subparagraph></paragraph><paragraph id="HEDA8AAEB9A524257B25A0FD5965DE3BB" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Each cooperating State agency shall seek, including through agreements and training programs described in this subsection, to ensure the reemployment of adversely affected workers upon completion of training as described in section 236.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA2ADE44D96C04012A4A1D88C9AE95C57"><enum>(b)</enum><header>Administration</header><paragraph id="HC54F8639760C4FD2AB06976644AAEE8D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 239(g) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2311">19 U.S.C. 2311(g)</external-xref>) is display-inline="yes-display-inline">review each layoff of more than 5 workers in a firm to determine whether trade played a role in the layoff and whether workers in such firm are potentially eligible to receive benefits under this chapter,</text></paragraph><paragraph id="HC463D32EF3524F21A8D9F295F485DD87"><enum>(2)</enum><text display-inline="yes-display-inline">perform outreach to firms to facilitate and assist with filing petitions under section 221 and collecting necessary supporting information,</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HAC60B638ACC34CD5874BB056DDF4A3F6"><enum>(C)</enum><text>in paragraph (3), as so redesignated, by striking <quote>who applies for unemployment insurance of</quote> and inserting <quote>identified under paragraph (1) of unemployment insurance benefits and</quote>; (9).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HDD2BF6913E924680BBCC5CAAB408BFD1"><enum>(2)</enum><header>Limitations on administrative expenses and employment and case management services</header><text>Section 235A of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2295a">19 U.S.C. 2295a</external-xref>) is amended—</text><subparagraph id="HC8572A4F043248AC87121A52A54B952C"><enum>(A)</enum><text>by striking <quote>Of the funds</quote> and inserting <quote>(a) <header-in-text id="H4FEAD1FF3A524E8D977FFBF04D7CF63B"><enum>(c)</enum><header>Performance measures</header><text display-inline="yes-display-inline">Section 239(j)(2) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2311">19 U.S.C. 2311(j)(2)</external-xref>) is amended—</text><paragraph id="HA49E86BD8C6643A4952A46A8D94A1FBD"><enum>(1)</enum><text>by amending subparagraph (B) to read as follows:</text><quoted-block style="OLC" id="H9DC6A00310034797B8DA63EBBFDF747C" display-inline="no-display-inline"><subparagraph id="H6B1752D5BDA8497388D8A04937AD9E57"><enum>(B)</enum><header>Additional indicators and analytics</header><text display-inline="yes-display-inline">The Secretary and a cooperating State or cooperating State agency—</text><clause id="H918AAB4C60454554B8CA97B4013926ED"><enum>(i)</enum><text display-inline="yes-display-inline">shall conduct a comparative analysis between the median earnings of workers described in subparagraph (A)(i)(I) and the distributions of earnings across the workforce in the affected economic region; and</text></clause><clause id="H4C89DA6B05E84A3CAE547B34F27B46DF"><enum>(ii)</enum><text display-inline="yes-display-inline">may agree upon additional indicators of performance for the trade adjustment assistance program under this chapter, as appropriate.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HC8707AC2424144E5806F1CCA8389CC25"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H1E3F0511F7414CA3B7B437A92A512CA7" display-inline="no-display-inline"><subparagraph id="HC8DF8AD06ABB47078A87209FFF003FCA" commented="no"><enum>(C)</enum><header>Dashboard</header><text display-inline="yes-display-inline">The Secretary shall require each cooperating State and cooperating State agency to perform workforce analytics for the purpose of creating a dashboard that includes different measures of job quality for reemployment and training activities provided under this chapter.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4B334A15A29442A8AFFADBCC826E4906" commented="no"><enum>(d)</enum><header>Staffing</header><text display-inline="yes-display-inline">Section 239 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2311">19 U.S.C. 2311</external-xref>) is amended by striking subsection (k) and inserting the following: </text><quoted-block style="OLC" id="HE36FE0BB5CA841C39FE0358EC4D64D61" display-inline="no-display-inline"><subsection id="H063F562553ED4FD09AFD17420F72B78F"><enum>(k)</enum><header>Staffing</header><text display-inline="yes-display-inline">An agreement entered into under this section shall provide that the cooperating State or cooperating State agency shall require that any individual engaged in functions to carry out the trade adjustment assistance program under this chapter shall be a State employee covered by a merit system of personnel administration.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id1462B1402F25407FA04CB4F1CAEE35F5"><enum>122.</enum><header>Eligibility criteria for reemployment trade adjustment assistance</header><subsection id="idFC02EBF81B144B5D84A9BA2E9BDBC350"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 246(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2318">19 U.S.C. 2318(a)</external-xref>) is amended—</text><paragraph id="id13EAFBFB608443C18C1FD6CBC83ED740"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3)(B)(ii), by striking <quote>$50,000</quote> and inserting <quote>$55,000</quote>; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBFAD56613DD442498EC6026C0A82AF17"><enum>(2)</enum><text>in paragraph (4)(A), by striking <quote>the earlier of</quote> and all that follows and inserting <quote>the date on which the worker obtains reemployment described in paragraph (3)(B).</quote>; and</text></paragraph><paragraph id="H6DA322E94AC742BEB9AEE0A01D09198F"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block id="HEB6A01F3890241EFA70669A5991E437A" display-inline="no-display-inline" style="OLC"><paragraph id="H44F7AAE8E60548E6AA4807A5D84429E0"><enum>(8)</enum><header>Adjustment of salary limitation and total amount of payments for inflation</header><subparagraph id="HD528BEBCB48B4235966CFCC9C695B3BD"><enum>(A)</enum><header>In general</header><text>The Secretary of Labor shall adjust the salary limitation under paragraph (3)(B)(ii) and the amount under paragraph (5)(B)(i) on October 1, 2021, and at the beginning of each fiscal year thereafter, to reflect the percentage (if any) of the increase in the average of the Consumer Price Index for the preceding 12-month period compared to the Consumer Price Index for fiscal year 2020.</text></subparagraph><subparagraph id="HAF8D5A9F8E694515B750DB6D6DA3C153"><enum>(B)</enum><header>Special rules for calculation of adjustment</header><text>In making an adjustment under subparagraph (A), the Secretary—</text><clause id="H8475CF60FEDA43338C203830B4F8BC3B"><enum>(i)</enum><text>shall round the amount of any increase in the Consumer Price Index to the nearest dollar; and</text></clause><clause id="HD7E7D60F3E9E4D6FBBC20ABF14B2213F"><enum>(ii)</enum><text>may ignore any such increase of less than 1 percent.</text></clause></subparagraph><subparagraph id="HE9B91F37DF8240D389E6A47644E53E53" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Consumer Price Index defined</header><text>For purposes of this paragraph, the term <term>Consumer Price Index</term> means the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id9B1CC3A199F94EB7A7958EB0BA38D551"><enum>(b)</enum><header>Pilot program for expanded eligibility</header><text>Section 246 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2318">19 U.S.C. 2318</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0282DD0DAEE54010A5A6D2B6E0A4D634"><subsection id="id8330B50F792A4756A01A81F9B4CA004F"><enum>(c)</enum><header>Pilot program for expanded eligibility</header><paragraph id="id87C49626A5C541E68C019206B295792E"><enum>(1)</enum><header>In general</header><text>The Secretary may establish a pilot program under which the Secretary may provide benefits under paragraph (2) of subsection (a) to workers younger than 50 years of age who otherwise meet the eligibility requirements set forth in paragraph (3) of that subsection.</text></paragraph><paragraph id="id2D6B344F124E45F8A3562033455B9D9B"><enum>(2)</enum><header>Requirement</header><text>The Secretary may not provide to workers under paragraph (1) benefits that are reduced relative to the benefits received by other workers under this section.</text></paragraph><paragraph id="idD4462DF563FE44FDB0097BA9DD86FB93"><enum>(3)</enum><header>Notification to Congress</header><text>Before implementing the pilot program under paragraph (1), the Secretary shall submit to Congress a report that includes a detailed plan for the program.</text></paragraph><paragraph id="id0BC47107E84E496A80FAA63ADBDF056E"><enum>(4)</enum><header>Termination</header><text>The pilot program under paragraph (1) shall terminate at such time as the Secretary considers appropriate.</text></paragraph><paragraph id="id5CAE23D0F96143828C756105989F8FDC"><enum>(5)</enum><header>Report required</header><text>Not later than 90 days after the termination under paragraph (4) of the pilot program under paragraph (1), the Secretary shall submit to Congress a report on the outcomes for the workers who participated in the program.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" id="idA2C9E4600CFE4595B775EC249365349B"><enum>123.</enum><header>Subpoena power</header><text display-inline="no-display-inline">Section 249 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2321">19 U.S.C. 2321</external-xref>) is amended—</text><paragraph commented="no" id="id1B40A21F5E614C35B14E7CD4C91B2830"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by adding at the end the following: <quote>That authority includes the authority of States to require, by subpoena, a firm to provide information on workers employed by, or totally or partially separated from, the firm that is necessary to make a determination under this chapter or to provide outreach to workers, including the names and address of workers.</quote>; and</text></paragraph><paragraph commented="no" id="id1A9BA2384D4246ABA9172A44D2C76D12"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2656CB01B90347F98EB231165F2041A5"><subsection commented="no" id="id3A519AC72DA04A07988D4A835D3337CD"><enum>(c)</enum><header>Enforcement of subpoenas by States</header><text>A State may enforce compliance with a subpoena issued under subsection (a)—</text><paragraph commented="no" id="idCAA6DADA9ACD4BE1882CA630737A1610"><enum>(1)</enum><text>as provided for under State law; and</text></paragraph><paragraph commented="no" id="id1C1EE96903AB4F398903F22B01E28CDC"><enum>(2)</enum><text>by petitioning an appropriate United States district court for an order requiring compliance with the subpoena.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H1121B11E2D9D49E0A575B3AACEE6C0EC" commented="no"><enum>124.</enum><header>Data collection with respect to training</header><text display-inline="no-display-inline">Section 249B of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2323">19 U.S.C. 2323</external-xref>) is amended—</text><paragraph id="H21BE28EE910748A9A2557ABED202E5C0"><enum>(1)</enum><text>in 1974 before the date of the enactment of this Act shall be eligible, on and after such date of enactment, to receive benefits only under the provisions of chapter 2 of title II of the Trade Act of 1974, as in effect on such date of enactment, or as such provisions may be amended after such date of enactment.</text></paragraph><paragraph id="HB051E8A209084D6BB33ADE222C16C791"><enum>(2)</enum><header>Computation of maximum benefits</header><text display-inline="yes-display-inline">Benefits received by a worker described in paragraph (1) under chapter 2 of title II of the Trade Act of 1974 before the date of the enactment of this Act shall be included in any determination of the maximum benefits for which the worker is eligible under the provisions of chapter 2 of title II of the Trade Act of 1974, as in effect on the date of the enactment of this Act, or as such provisions may be amended after such date of enactment.</text></paragraph><paragraph id="HDE8F6EAB2D234F7C8919E552C542D52F"><enum>(3)</enum><header>Authority to make adjustments to benefits</header><text display-inline="yes-display-inline">Notwithstanding any provision of chapter 2 of title II of the Trade Act of 1974, for the 90-day period beginning on the date of the enactment of this Act, the Secretary is authorized to make any adjustments to benefits to workers described in paragraph (1) that the Secretary determines to be necessary and appropriate in applying and administering the provisions of such chapter 2, as in effect on the date of the enactment of this Act, or as such provisions may be amended after such date of enactment, in a manner that ensures parity of treatment between the benefits of such workers and the benefits of workers certified after such date of enactment.</text></paragraph></subsection><subsection id="HD9A764E5A0A44B5AA99C8BC74E4D5973"><enum>(b)</enum><header>Workers not certified pursuant to certain petitions filed before date of enactment</header><paragraph id="H11A6A4A6DD114794BDA53A3C3E1B4493"><enum>(1)</enum><header>Certifications of workers not certified before date of enactment</header><subparagraph id="H8D85A642D48D4E9497BE8D9841F60F4C"><enum>(A)</enum><header>Criteria if a determination has not been made</header><text display-inline="yes-display-inline">If, as of the date of the enactment of this Act, the Secretary of Labor has not made a determination with respect to whether to certify a group of workers as eligible to apply for adjustment assistance under section 222 of the Trade Act of 1974 pursuant to a petition described in subparagraph (C), the Secretary shall make that determination based on the requirements of section 222 of the Trade Act of 1974, as in effect on such date of enactment. </text></subparagraph><subparagraph id="HC768F67228724AB38DD9EE6CAB9001DB"><enum>(B)</enum><header>Reconsideration of denials of certifications</header><text display-inline="yes-display-inline">If, before the date of the enactment of this Act, the Secretary made a determination not to certify a group of workers as eligible to apply for adjustment assistance under section 222 of the Trade Act of 1974 pursuant to a petition described in subparagraph (C), the Secretary shall—</text><clause id="H61819ABCDBED4F2AA16F95F2F45FB09E"><enum>(i)</enum><text>reconsider that determination; and</text></clause><clause id="HCC63D92771CC47CE91772046318221CD"><enum>(ii)</enum><text>if the group of workers meets the requirements of section 222 of the Trade Act of 1974, as in effect on such date of enactment, certify the group of workers as eligible to apply for adjustment assistance.</text></clause></subparagraph><subparagraph id="H5AF26DC7649047FDA71395F7ACDE4280"><enum>(C)</enum><header>Petition described</header><text display-inline="yes-display-inline">A petition described in this subparagraph is a petition for a certification of eligibility for a group of workers filed under section 221 of the Trade Act of 1974 on or after January 1, 2021, and before the date of the enactment of this Act.</text></subparagraph></paragraph><paragraph id="H8FE7E6D40F02466FA1AD471F27C6E700"><enum>(2)</enum><header>Eligibility for benefits</header><subparagraph id="H00EAD448179840D6AA2FDD07CC527C77"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), a worker certified as eligible to apply for adjustment assistance under section 222 of the Trade Act of 1974 pursuant to a petition described in paragraph (1)(C) shall be eligible, on and after the date of the enactment of this Act, to receive benefits only under the provisions of chapter 2 of title II of the Trade Act of 1974, as in effect on such date of enactment, or as such provisions may be amended after such date of enactment.</text></subparagraph><subparagraph id="H43AE97979159492D9EB4BFD46A33AA67" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Computation of maximum benefits</header><text display-inline="yes-display-inline">Benefits received by a worker described in paragraph (1) under chapter 2 of title II of the Trade Act of 1974 before the date of the enactment of this Act shall be included in any determination of the maximum benefits for which the worker is eligible under the provisions of chapter 2 of title II of the Trade Act of 1974, as in effect on the date of the enactment of this Act, or as such provisions may be amended after such date of enactment. </text></subparagraph></paragraph></subsection></section><section id="id432E004EC6104D5B9F1261F403AAFC2B"><enum>133.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that, in administering the trade adjustment assistance program under chapter 2 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271 et seq.</external-xref>), a State should—</text><paragraph id="id01BCDB0023F54DB687FC5614C8F0624D"><enum>(1)</enum><text display-inline="yes-display-inline">prioritize providing training that leads to employment outcomes that replace 100 percent of an adversely affected worker’s wages; and</text></paragraph><paragraph id="id3BF7CFCBAF204E15BC9CC5546DBA70E7" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">steer workers toward training that leads to a livable wage and sustainable employment. </text></paragraph></section></subtitle></title><title id="id96717F1B554A4D89A04A88419A52CDC7" style="OLC"><enum>II</enum><header>Amendments to Worker Adjustment and Retraining Notification Act</header><section id="id0EBE4BF50051496EB1BA5D2CFC40305C"><enum>201.</enum><header>Worker Adjustment and Retraining Notification Act</header><subsection id="id53E706D166E44D33848E5B309CC7D170"><enum>(a)</enum><header>Availability of trade adjustment assistance</header><text>Section 3(a) of the Worker Adjustment and Retraining Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2102">29 U.S.C. 2102(a)</external-xref>) is amended—</text><paragraph id="id54900131BBAC4FED931F255BD60538C1"><enum>(1)</enum><text>in the first sentence—</text><subparagraph id="id6EFA49DBC8D14E5391C3AB14952EA849"><enum>(A)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively; and</text></subparagraph><subparagraph id="id6E97E82CDFBB463DB38A16FA5047A8B7"><enum>(B)</enum><text>by striking <quote>An employer</quote> and inserting <quote>(1) An employer</quote>;</text></subparagraph></paragraph><paragraph id="id89DD1C4389464D00B2EA75908720489E"><enum>(2)</enum><text>in the second sentence, by striking <quote>If there</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9134D31CB5374A86A98A75F20C144119"><paragraph id="idAC2DFB888EA54870ABE96FAA4963FC0E" indent="up1"><enum>(2)</enum><text>If there</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id2356EA86C301438280D920ABC17DFC10"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id965980A651814294BCF90013C8AA04F2"><paragraph id="id2D501F929869425BA2E964716CC6E59B" indent="up1"><enum>(3)</enum><text>If the plant closing or mass layoff involved is caused by conditions described in section 222(a)(2) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272(a)(2)</external-xref>), then, in serving notice under paragraph (1)(A), the employer shall include in the notice information on the availability of adjustment assistance under chapter 2 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271 et seq.</external-xref>) for eligible workers.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idD2280A2398FD4038B458648A51FD8CD7"><enum>(b)</enum><header>Notice requirements relating to shifts in production</header><text>Section 3 of the Worker Adjustment and Retraining Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2102">29 U.S.C. 2102</external-xref>) is amended—</text><paragraph id="id71FD9A1FFFEC4EE28D801A93266DEC06"><enum>(1)</enum><text>in subsection (d), by striking <quote>(2) or (3)</quote> and inserting <quote>(4)(A) or (5)</quote>; and</text></paragraph><paragraph id="idCFA36735E0EF46309137308A7C471752"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="id76475A63A14146ADA366A983BC761546" display-inline="no-display-inline" style="OLC"><subsection id="idF3B5146855E040F597E4E8549299E13A"><enum>(e)</enum><header>Statement relating to shifts in production of articles or supply of services</header><paragraph commented="no" display-inline="yes-display-inline" id="id2E5A40FFB0CB41FCBB7E256ACB16AA6E"><enum>(1)</enum><text>If the plant closing or mass layoff involved is caused by conditions described in section 222(a)(2)(B) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272(a)(2)(B)</external-xref>), then, in serving notice under subsection (a), the employer shall include in the notice a statement that the closing or layoff was so caused.</text></paragraph><paragraph id="id59cda0fbf2ca4a9590be16a8f2aadd85" indent="up1"><enum>(2)</enum><text>Each State that receives a notice under subsection (a) that includes a statement described in paragraph (1) shall notify the Secretary of that receipt, immediately file a petition under subsection (a)(1) of section 221 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271</external-xref>) on behalf of that group of workers, and act as the petitioner for that petition under this chapter. </text></paragraph><paragraph id="idefe879c99034437abd433cca5c5100dc" indent="up1"><enum>(3)</enum><text>If the Secretary receives a petition under paragraph (2) regarding a plant closing or mass layoff affecting a group of workers, the Secretary shall—</text><subparagraph id="id71425A3C6B3C483FBA0F66FF938A29E3"><enum>(A)</enum><text>immediately initiate an investigation under subsection (a)(3) of that section 221; </text></subparagraph><subparagraph id="id1B4ECDA5885D4F099CF484F09ACB8788"><enum>(B)</enum><text>immediately waive the requirements for a hearing under subsection (b) of that section 221; and</text></subparagraph><subparagraph id="id604F0EC94DEC40C39CA6E63937C79647"><enum>(C)</enum><text>unless the Secretary issues a determination that includes substantial evidence that the petition has not met the requirements of paragraph (1) or (2)(B) of section 222(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272(a)</external-xref>) within 20 days after receipt of the petition—</text><clause id="idCC798A55B97A4CE2A8A9ED8E9358D2C2"><enum>(i)</enum><text>certify the group of workers under section 222 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272</external-xref>); or</text></clause><clause id="idC6B89A468D844A32A222CB2077F60954"><enum>(ii)</enum><text>be considered to have issued such certification on the 21st day after receipt of the petition. </text></clause></subparagraph></paragraph><paragraph indent="up1" id="id8F1F16F9C93E4870A659AE0667506B57"><enum>(4)</enum><text>Even after the Secretary issues such a certification for a group of workers at a firm under paragraph (3)(C), the Secretary may conduct an investigation under subsection (a)(3) of that section 221 to identify additional groups of workers who may be eligible for benefits under this chapter.</text></paragraph></subsection><subsection id="id6DA9664C8DBA428AAC1742EACFC93FC2"><enum>(f)</enum><header>Notification of downstream producers and suppliers</header><text>On certification of a group of workers as described in subsection (e)(3)(C), the Secretary, in conjunction with the State in which the site of employment involved is located, shall—</text><paragraph id="id3DAE928928CA41EF83F9DC6006B710C2"><enum>(1)</enum><text>endeavor to identify downstream producers and suppliers as defined in section 222(c) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272(c)</external-xref>) that are potentially impacted by the plant closing or mass layoff involved; </text></paragraph><paragraph id="idE4E50C2A9BC1473CB2FF77C3348F0431"><enum>(2)</enum><text>provide to such producers and suppliers—</text><subparagraph id="idAF4C2E848602419299CBD60564951CF9"><enum>(A)</enum><text>concerning benefits available under chapter 2 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271 et seq.</external-xref>), a description of the benefits, of the means for filing a petition and applying for such benefits, and of the availability of assistance in filing the petition; and</text></subparagraph><subparagraph id="idFEF4C7001601430B851E340FA3133006"><enum>(B)</enum><text>concerning benefits available under chapter 3 of that title (<external-xref legal-doc="usc" parsable-cite="usc/19/2341">19 U.S.C. 2341 et seq.</external-xref>), the description specified in subparagraph (A); and </text></subparagraph></paragraph><paragraph id="idF4BBDF6A7E9B4F6B832980D46A4DAC53"><enum>(3)</enum><text>direct the producers and suppliers to provide to their workers the description specified in paragraph (2)(A), concerning benefits described in paragraph (2)(A).</text></paragraph></subsection><subsection id="idC92C6D42206445E1BD52C45F44AEEF36" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header>State transmittal of notices</header><text>Each State that receives 1 or more notices described in subsection (a)(2) during a calendar quarter shall, not later than 10 days after the end of the quarter, transmit the notices to the Secretary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id645CE03FF435429682C7915A4877D6D7"><enum>(c)</enum><header>Administrative enforcement and database</header><text>Section 5 of the Worker Adjustment and Retraining Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2104">29 U.S.C. 2104</external-xref>) is amended—</text><paragraph id="id9F49B08F180944A28AECC2EB8D5D223F"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (d); and</text></paragraph><paragraph id="idA28092CCE46D47DC9CEA9135DEECEFAE"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idADB1D68C092343F78FC4140BEF6EDD70"><subsection commented="no" display-inline="no-display-inline" id="id7D584590EDD2467EB7D00225B54700D5"><enum>(b)</enum><header>Administrative enforcement</header><paragraph commented="no" display-inline="yes-display-inline" id="idFC314948150349969EF24FF353A26160"><enum>(1)</enum><text>The Secretary may impose a fine on any employer who orders a plant closing or mass layoff in violation of section 3.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD1A70C8A0E544E0B9DC8F333BCF7297A" indent="up1"><enum>(2)</enum><text>The Secretary shall deposit the fines in an account. Funds in the account shall be available to States, without appropriation, for an activity authorized under subchapter B of chapter 2 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2291">19 U.S.C. 2291 et seq.</external-xref>).</text></paragraph></subsection><subsection id="idFF31917310FB480F9D2722ABEB65A5C3"><enum>(c)</enum><header>Database</header><paragraph id="idE08980146A2346F1B0456BB0A1DC30FE"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish and maintain a database, available to the public, of notices served under section 3(a).</text></paragraph><paragraph id="idD1362D64293F4D469B9C92B226FD6508"><enum>(2)</enum><header>Features</header><text>In carrying out paragraph (1), the Secretary shall ensure that all such notices are accessible and searchable by including in the database—</text><subparagraph id="id7C8121B0CD374BD0BD65FCB489ECBE5F"><enum>(A)</enum><text>a link to the notices, or files containing the notices in portable document format; and</text></subparagraph><subparagraph id="id69CE1BDCF3AD4421931D6F530B15F927"><enum>(B)</enum><text>an interactive map and search tool that is capable of—</text><clause id="idEB2EBB47D45A4E7F98A3C52662694705"><enum>(i)</enum><text>sorting the notices, by date and region of the plant closings and mass layoffs described in the notices; and</text></clause><clause id="id2B845AD867394779ABEFFE83F3DBCD42"><enum>(ii)</enum><text>enabling the user to locate plant closings and mass layoffs of various sizes, in terms of numbers of employees affected.</text></clause></subparagraph></paragraph><paragraph id="id05810F60D8254352A2AF85C7D2A62BC6"><enum>(3)</enum><header>Other information</header><subparagraph id="id1090B6AB1EA44AF29A26404CEBCE6E97"><enum>(A)</enum><header>In general</header><text>The Secretary shall ensure that the database includes, for each such notice, information on the political subdivision, county, and local area where the plant closing or mass layoff takes place, the number of affected workers, the date of the notice, the date of the beginning of the plant closing or mass layoff, and the North American Industry Classification System code for the affected industry.</text></subparagraph><subparagraph id="id74AA1413A32846C5B08CB5312B066AE5"><enum>(B)</enum><header>Definition</header><text>In this paragraph, the term <term>local area</term> has the meaning given the term in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></subparagraph></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="idA9F515EF394640EFA451F343233D2738"><enum>(d)</enum><header>Report on plant closings and mass layoffs</header><text>The Worker Adjustment and Retraining Notification Act is amended by inserting after section 10 (<external-xref legal-doc="usc" parsable-cite="usc/29/2109">29 U.S.C. 2109</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id85AB16BF6B154E468F2D50EB6A0EA627"><section id="idB6BA8245E3434F89A396FBB0CC7BC09C"><enum>10A.</enum><header>Report on plant closings and mass layoffs</header><text display-inline="no-display-inline">The Secretary shall annually prepare, submit to Congress, and make available to the public, a report that specifies, for the year involved—</text><paragraph id="idD9390E6CE80C4487B299E7282AEDD511"><enum>(1)</enum><text>the number of plant closings and mass layoffs that occurred, for which employers were subject to the notification requirements of section 3; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5290CEA066A64497956E2B83EF00B4E5"><enum>(2)</enum><text>the number of such plant closings and mass layoffs for which employers met the requirements.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id2E1E282A998640B3BC1F01F9C5EF72BB" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header>Conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="idCA35B1C6D6F1411597738C52441E2C9D"><enum>(1)</enum><header>Worker adjustment and retraining notification act</header><text>Sections 8(a) and 11 of the Worker Adjustment and Retraining Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2107">29 U.S.C. 2107(a)</external-xref>, 2101 note) are amended by striking <quote>of Labor</quote>. </text></paragraph><paragraph id="id8B695D9F4AF44D3B98B287E49FCED41F" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Trade act of 1974</header><text>Section 223(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2273">19 U.S.C. 2273(a)</external-xref>) is amended by inserting <quote>(except as provided in section 3(e)(3)(C) of the Worker Adjustment and Retraining Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2102">29 U.S.C. 2102(e)(3)(C)</external-xref>))</quote> after <quote>40 days</quote>. </text></paragraph></subsection></section></title><title id="id6005049D200B40BC8E2E64DAD12221BF" style="OLC"><enum>III</enum><header>Health care tax credit</header><section id="ided0243cb09864cfda0e9d5eea790eb42"><enum>301.</enum><header>Permanent credit for health insurance costs</header><subsection id="ideede2bc05ee04adfbe9e085388c8e52e"><enum>(a)</enum><header>In general</header><text>Subparagraph (B) of <external-xref legal-doc="usc" parsable-cite="usc/26/35">section 35(b)(1)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>, and before January 1, 2022</quote>.</text></subsection><subsection id="id226415e75e194a65bd169048b6d02fd5"><enum>(b)</enum><header>Increase in credit percentage</header><text>Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/26/35">section 35</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>72.5 percent</quote> and inserting <quote>80 percent</quote>.</text></subsection><subsection id="id08ef103e80ce45b5a1e66b96538bb4ae"><enum>(c)</enum><header>Conforming amendments</header><text>Subsections (b) and (e)(1) of <external-xref legal-doc="usc" parsable-cite="usc/26/7527">section 7527</external-xref> of the Internal Revenue Code of 1986 are each amended by striking <quote>72.5 percent</quote> and inserting <quote>80 percent</quote>.</text></subsection><subsection id="idb8e7283fd79544e5b8eeb7096114d060"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to coverage months beginning after December 31, 2021.</text></subsection></section></title></legis-body></bill>
