<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2207</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210624">June 24, 2021</action-date><action-desc><sponsor name-id="S303">Mr. Thune</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To temporarily increase the availability of temporary nonimmigrant nonagricultural workers for the purposes of restoring American forests, and for other purposes.</official-title></form><legis-body><section id="id3385A6A20BB24721B524CE30232751F4" section-type="section-one"><enum>1.</enum><header>Exemption from H–2B numerical limitation for certain forestry conservation workers</header><subsection id="idDF35D3FF0DFE45FB9B3F2BA501B14577"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 214(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA56A49DE0B9041AEA1F511D408C6EF79"><paragraph id="id4fa719554684433fa964187774a5753a" indent="up1"><enum>(12)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idCB4F1DC37A1A4E6A923867188C7A662E"><enum>(A)</enum><text>Except as provided in subparagraph (B), the numerical limitation under paragraph (1)(B) shall not apply to principal aliens described in section 101(a)(15)(H)(ii)(b) who are employed or have received an offer of employment for the work of—</text><clause indent="up1" id="id148FA484638A48F4B212A8E4AE52BA48"><enum>(i)</enum><text>orchard work and seed collection;</text></clause><clause indent="up1" id="id5CB98253A9FC43C9AB07F6DDD8842201"><enum>(ii)</enum><text>tree planting;</text></clause><clause indent="up1" id="id7AAE1E6677E24644A659F4B37297C81A"><enum>(iii)</enum><text>nursery care;</text></clause><clause indent="up1" id="id211D7D6EC5A749FB898952A795E4EAE3"><enum>(iv)</enum><text>forest management;</text></clause><clause indent="up1" id="idBCAA6CB4B1EB45128C22BC1F61220086"><enum>(v)</enum><text>harvesting pine straw or other minor forest products;</text></clause><clause indent="up1" id="id664340035BCE433C88C089A83D2F76BC"><enum>(vi)</enum><text>timber stand improvement;</text></clause><clause indent="up1" id="id148DD67D65054E5A9248B1FC56BB9089"><enum>(vii)</enum><text>herbicide application;</text></clause><clause indent="up1" id="idB16902ED1A194CA29A1899B6E5BAC97E"><enum>(viii)</enum><text>fire prevention and fire management activities;</text></clause><clause indent="up1" id="id7286ABA151FE4B678AEC5E38990F7B90"><enum>(ix)</enum><text>brush clearing and vegetation management;</text></clause><clause indent="up1" id="id39BF36848047485E9076E1CA5DC8F48E"><enum>(x)</enum><text>maintenance of right of ways;</text></clause><clause indent="up1" id="id4C4C91871487433994A04184AFB91D75"><enum>(xi)</enum><text>habitat protection and restoration;</text></clause><clause indent="up1" id="id681292FD56B64D1DA9D1DE5036C6FEEA"><enum>(xii)</enum><text>watershed protection and restoration;</text></clause><clause indent="up1" id="idBA74B1BC21384C1AA6C861749FB6F11E"><enum>(xiii)</enum><text>land reclamation; or</text></clause><clause indent="up1" id="idDFEA82CFCCA5428488F5053C79883420"><enum>(xiv)</enum><text>other activities with a direct forest health or conservation nexus.</text></clause></subparagraph><subparagraph indent="up1" id="id22F4509955BC4B80A196ABF5E6B6B3B7"><enum>(B)</enum><text>The exemptions described in subparagraph (A) shall not apply to landscaping or groundskeeping.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idD0D03F2D110B420CBC8AB05E77477064"><enum>(b)</enum><header>Sunset</header><text>The amendment made by subsection (a) shall remain in effect until the date that is 5 years after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
