<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 2201</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To manage supply chain risk through counterintelligence training, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supply Chain Security Training Act of 2021</short-title></quote>.</text></section><section id="id84a9c920c23d4c10a17bf455313ab330" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Training program to manage supply chain risk</header><subsection id="idb325dc94be004d4fa26a427110caa60b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Administrator of General Services, through the Federal Acquisition Institute, shall develop a training program for officials with supply chain risk management responsibilities at Federal agencies.</text></subsection><subsection id="id4d991e483f214cf2872bf4aaeeda4ea9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Content</header><text display-inline="yes-display-inline">The training program shall be designed to prepare such personnel to perform supply chain risk management activities and identify and mitigate supply chain security risks that arise throughout the acquisition lifecycle, including for the acquisition of information and communications technology. The training program shall—</text><paragraph id="idf625c5a692cc4a7db1ff875638e74c68" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">include, considering the protection of classified and other sensitive information, information on current, specific supply chain security threats and vulnerabilities; and</text></paragraph><paragraph id="id48b4d276fd6b4cbd9030978c2ad05cb4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">be updated as determined to be necessary by the Administrator.</text></paragraph></subsection><subsection id="id50c125f8819d4bf591e2e4f4922a027b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Coordination and consultation</header><text display-inline="yes-display-inline">In developing and determining updates to the training program, the Administrator shall—</text><paragraph id="id50c4ea76959141838fce0bbb9e0fdd47" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">coordinate with the Federal Acquisition Security Council, the Secretary of Homeland Security, and the Director of the Office of Personnel Management; and</text></paragraph><paragraph id="id2a57dcfdd1ab4ddebd5b9264589c269b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">consult with the Director of the Department of Defense’s Defense Acquisition University, the Director of National Intelligence, and the Director of the National Institute of Standards and Technology.</text></paragraph></subsection><subsection id="id9cc44973f4c8489cbb0c6f488a9f80ba" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Guidance</header><paragraph id="id0E6AED26E8D64A78B6B8CE1F32068F53" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the training program is developed under subsection (a), the Director of the Office of Management and Budget shall promulgate guidance to Federal agencies requiring executive agency adoption and use of the training program. Such guidance shall—</text><subparagraph changed="not-changed" id="id718AC173DFA04EB29BD450331176F5CA" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">allow executive agencies to incorporate the training program into existing agency training programs; and</text></subparagraph><subparagraph changed="not-changed" id="id8AC5ABCDEBC94A3DBFA8997B63711758" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">provide guidance on how to identify executive agency officials with supply chain risk management responsibilities.</text></subparagraph></paragraph><paragraph id="id167E834424074DC998F4A620EB1CBDC0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall make the guidance promulgated under paragraph (1) available to Federal agencies of the legislative and judicial branches.</text></paragraph></subsection></section><section id="id850b8660341a453d85af065e3769b3c1" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Reports on implementation of program</header><text display-inline="no-display-inline">Not later than 180 days after the completion of the first course, and annually thereafter for the next three years, the Administrator of General Services shall submit to the appropriate congressional committees and leadership a report on implementation of the training program required under section 2.</text></section><section id="id4432c3618cc9467f84e2d28e6e9df837" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idff6025a043a84f2aa0a3d65004ac88ff" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate congressional committees and leadership</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id1AD09C7EC55647C89DC87348A4514C2C" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs and the Committee on Armed Services of the Senate; and</text></subparagraph><subparagraph id="id572BFF46E4F14F10997A5546334F0526" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Oversight and Reform and the Committee on Armed Services of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id1BF58ABB5D874CA49E30613A1114CE75" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Information and communications technology</header><text display-inline="yes-display-inline">The term <term>information and communications technology</term> has the meaning given the term in section 4713(k) of title 41, United States Code.</text></paragraph><paragraph id="id838721632b664bfabfc02eef1084e127" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Executive agency</header><text display-inline="yes-display-inline">The term <term>executive agency</term> has the meaning given the term in section 133 of title 41, United States Code.</text></paragraph><paragraph id="id2E66B41FB5564F3E9A2E1A117EB1C95B" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Federal agency</header><text display-inline="yes-display-inline">The term <term>Federal agency</term> means any agency, committee, commission, office, or other establishment in the executive, legislative, or judicial branch of the Federal Government.</text></paragraph><paragraph id="idc6b37352649344d2b4c9575202cc20ee" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(5)</enum><header display-inline="yes-display-inline">Training program</header><text display-inline="yes-display-inline">The term <term>training program</term> means the training program developed pursuant to section 2(a). </text></paragraph></section></legis-body><attestation><attestation-group><attestation-date date="20220111" legis-day="20220110" chamber="Senate">Passed the Senate January 11 (legislative day, January 10), 2022.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
