which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title> To authorize the Secretary of the Interior, through the Coastal Program of the United States Fish and Wildlife Service, to work with willing partners and provide support to efforts to assess, protect, restore, and enhance important coastal areas that provide fish and wildlife habitat on which Federal trust species depend, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coastal Habitat Conservation Act of 2021</short-title></quote>.</text></section><section id="ID8fb2b8fc51db4fe08a96b9d497fa2cc8"><enum>2.</enum><header>Findings and purpose</header><subsection id="ID3e7dbf348c6a43cc8c98859479427759"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="ID5e5ab4d65e9c4b129f8f3368e1210014"><enum>(1)</enum><text>an effective means of conserving and recovering Federal trust species and promoting self-sustaining populations of those species is to protect, conserve, restore, and enhance the habitats of the species;</text></paragraph><paragraph id="ID1230477f159040f0a8bdd638cb72206a"><enum>(2)</enum><text>coastal ecosystems are highly dynamic areas that provide valuable breeding, nursery, staging, and resting areas for a rich diversity of fish, shellfish, migratory birds, and mammals;</text></paragraph><paragraph id="IDdc2f74f240014c23bb270d31c4f4edd1"><enum>(3)</enum><text>coastal areas support—</text><subparagraph id="idBE0E83850B824C70A0D056011978D457"><enum>(A)</enum><text>40 percent of the refuges within the National Wildlife Refuge System;</text></subparagraph><subparagraph id="id7004D25E0D42439D8EE8915F05809A97"><enum>(B)</enum><text>40 percent of the threatened species or endangered species, including 75 percent of the listed mammals and birds, under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and </text></subparagraph><subparagraph id="id1CB904C503424F91811999D879EC1ACE"><enum>(C)</enum><text>50 percent of the fisheries conservation activities of the Service;</text></subparagraph></paragraph><paragraph id="ID954c85f7f70743c8af3d399df5dfb1ee"><enum>(4)</enum><text>although coastal counties make up only 10 percent of total contiguous United States land area, coastal areas are home to more than 40 percent of the human population of the United States, which is placing enormous pressure on coastal ecosystems;</text></paragraph><paragraph id="ID1e68390cd352432f874a34c3f005bc23"><enum>(5)</enum><text>because coastal deterioration can cause fragmentation and landward migration of coastal ecosystems, as well as create new habitats along shorelines, it has become necessary to incorporate adaptation assistance into coastal ecosystem management strategies;</text></paragraph><paragraph id="ID2ba7153504fb4a5f925c9917ceba04a7"><enum>(6)</enum><text>in addition to serving as fish and wildlife habitat, coastal ecosystems—</text><subparagraph id="idF91FC957A1674127A521E49DD57F0034"><enum>(A)</enum><text>serve as an important source of food;</text></subparagraph><subparagraph id="id460B2AD9F14F4B538F23E7A26BDE9975"><enum>(B)</enum><text>protect coastal communities, including infrastructure in those communities, against floods;</text></subparagraph><subparagraph id="id5A234BA9C2214315A8FD21610C05E7F9"><enum>(C)</enum><text>filter polluted runoff; and</text></subparagraph><subparagraph id="idE815E18F3D26403CB5DA8129F3F5A8F1"><enum>(D)</enum><text>provide valuable commercial and recreational benefits to coastal communities and the United States;</text></subparagraph></paragraph><paragraph id="ID8e8f7311874e4e05a0a5003694f30730"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id6DE0BC669E544908991571393F4B807C"><enum>(A)</enum><text>fish and wildlife conservation is a responsibility shared by citizens and government; and</text></subparagraph><subparagraph id="idB03DF83E5AF447C99AF73B5BB7E85F38" indent="up1"><enum>(B)</enum><text>public-private partnerships should be supported through technical assistance and financial assistance to conduct coastal habitat assessment, protection, planning, restoration, and enhancement projects in coastal ecosystems;</text></subparagraph></paragraph><paragraph id="ID2cde316223a8475db4e447de7e465f84"><enum>(8)</enum><text>successful fish and wildlife conservation increasingly relies on interdependent partnerships in which priority setting, planning, and conservation delivery are collaborative endeavors;</text></paragraph><paragraph id="IDe30a2d9d468f41b090c438862cd64e58"><enum>(9)</enum><text>since 1985, the Service has administered the Coastal Program through which the Service works with willing partners to assess, protect, plan, restore, and enhance coastal ecosystems, including coastal wetlands and watersheds, uplands, and riparian and in-stream habitats, that provide significant benefits to Federal trust species;</text></paragraph><paragraph id="IDb838c2ef33b3497098f5fd0cd6e3581b"><enum>(10)</enum><text>through the Coastal Program, the Service provides strategic conservation planning and design at the regional and landscape scales, and integrates the resources of the Service to address priorities identified by partners; and</text></paragraph><paragraph id="IDad4a7f7249e1432da05be1fdeed6db95"><enum>(11)</enum><text>the Coastal Program of the Service complements and enhances the National Coastal Wetlands Conservation Grant Program under section 305 of the Coastal Wetlands Planning, Protection and Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3954">16 U.S.C. 3954</external-xref>), which provides matching grants to coastal States to support long-term conservation of coastal wetlands and associated habitats.</text></paragraph></subsection><subsection id="IDe2d63fa98b124e3583b7bc3d2ac44b29"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to legislatively authorize the Coastal Program of the Service in effect as of the date of enactment of this Act to conduct collaborative landscape-level planning and on-the-ground coastal habitat protection, restoration, and enhancement projects in priority coastal areas to conserve and recover Federal trust species.</text></subsection></section><section id="IDeea372af2d314282880d7e7ffc48e2f8"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id2BB3B3CCFC8F4072A5E989A2ED3FE347"><enum>(1)</enum><header>Coastal area</header><text>The term <term>coastal area</term> means a marine or freshwater area within or adjacent to a coastal State, including—</text><subparagraph id="id01A0372DE73B4C2A99F64FC4792CC685"><enum>(A)</enum><text>a coastal wetland or watershed;</text></subparagraph><subparagraph id="id454D8C15BCED4B92B4317334E3A26C56"><enum>(B)</enum><text>coastal water;</text></subparagraph><subparagraph id="idA316822E9096421D87D62685EC2091DC"><enum>(C)</enum><text>a coastal bay;</text></subparagraph><subparagraph id="idE14575A811F044A29BF3993AFFA508BC"><enum>(D)</enum><text>a coastline; and</text></subparagraph><subparagraph id="idA2BE5B51B44E47E99D3267053489579D"><enum>(E)</enum><text>an estuary and associated upland.</text></subparagraph></paragraph><paragraph id="id28E00692A6A74F9AA15FE2E53FA257CF"><enum>(2)</enum><header>Coastal ecosystem</header><text>The term <term>coastal ecosystem</term> means an ecological community that provides fish and wildlife habitat in coastal areas.</text></paragraph><paragraph id="ID62d7ba34672f4a8580e408b912d11018"><enum>(3)</enum><header>Coastal habitat assessment</header><text>The term <term>coastal habitat assessment</term> means the process of evaluating the physical, chemical, and biological function of a coastal site to determine the value of the site to fish and wildlife.</text></paragraph><paragraph id="ID400f30204f1a410d9ddf8e6401fe031b"><enum>(4)</enum><header>Coastal habitat enhancement</header><text>The term <term>coastal habitat enhancement</term> means the manipulation of the physical, chemical, or biological characteristics of a coastal ecosystem to increase or decrease specific biological functions that make the ecosystem valuable to fish and wildlife.</text></paragraph><paragraph id="ID7727fe0489bb48e29aa098e0aa787ccd"><enum>(5)</enum><header>Coastal habitat planning</header><text>The term <term>coastal habitat planning</term> means the process of developing a comprehensive plan that—</text><subparagraph id="idAE91212941B446C2A1CEDB0081152E2B"><enum>(A)</enum><text>characterizes a coastal ecosystem;</text></subparagraph><subparagraph id="id3E6B24208C774264AC28440CAE9943BF"><enum>(B)</enum><text>sets protection, restoration, or enhancement goals, and identifies the priorities of those goals;</text></subparagraph><subparagraph id="id0DD459D69E41469BAA1D30F528BE9996"><enum>(C)</enum><text>describes conservation strategies and methodologies;</text></subparagraph><subparagraph id="id2CCFB769DE33431C9CBF0E8CC94688D8"><enum>(D)</enum><text>establishes a timetable for implementation of the plan; and</text></subparagraph><subparagraph id="id7BF98B79C13C4A6CA413C19B10369715"><enum>(E)</enum><text>identifies roles of participants and stakeholders.</text></subparagraph></paragraph><paragraph id="IDc096103df9fe4319a1085456f68e69c1"><enum>(6)</enum><header>Coastal habitat protection</header><subparagraph id="ID2430b595f405483fa659211062f87eca"><enum>(A)</enum><header>In general</header><text>The term <term>coastal habitat protection</term> means a long-term action to safeguard habitats of importance to fish and wildlife species in a coastal ecosystem.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8929fa9f62344e2f8dd6f557a75478e6"><enum>(B)</enum><header>Inclusion</header><text>The term <term>coastal habitat protection</term> includes activities to support establishment of conservation easements or fee-title acquisition by Federal and non-Federal partners.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc59b5afdb17549daa185dcb9813de628"><enum>(7)</enum><header>Coastal habitat restoration</header><text>The term <term>coastal habitat restoration</term> means the manipulation of the physical, chemical, or biological characteristics of a coastal ecosystem with the goal of returning, to the maximum extent practicable, the full natural biological functions to lost or degraded native habitat.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id775A1FB2FD664E5D815430655547EC86"><enum>(8)</enum><header>Coastal State</header><text>The term <term>coastal State</term> means—</text><subparagraph id="id26756404588643d69c4f293b4bc4dcc7"><enum>(A)</enum><text>a State in, or bordering on, the Atlantic, Pacific, or Arctic Ocean, the Gulf of Mexico, the Long Island Sound, or 1 or more of the Great Lakes;</text></subparagraph><subparagraph id="idf593ca2601f84262b560510a1b5ddc54"><enum>(B)</enum><text>the Commonwealth of Puerto Rico;</text></subparagraph><subparagraph id="id1bec2d2fd6a84c5db1e3f23b2939688c"><enum>(C)</enum><text>Guam;</text></subparagraph><subparagraph id="idade9ca2a88964ddeb5c404ccb787be8a"><enum>(D)</enum><text>American Samoa;</text></subparagraph><subparagraph id="iddcc5ffebb1af4fe88f40319ac14e1225"><enum>(E)</enum><text>the Commonwealth of the Northern Mariana Islands;</text></subparagraph><subparagraph id="idfa02209391914837b97f480d2a795f17" commented="no"><enum>(F)</enum><text>the Federated States of Micronesia;</text></subparagraph><subparagraph id="id18701d505e954d92bd4a806fe2096952" commented="no"><enum>(G)</enum><text>the Republic of the Marshall Islands;</text></subparagraph><subparagraph id="idd6a191948ac84395a20af75f65b62e33" commented="no"><enum>(H)</enum><text>the Republic of Palau; and</text></subparagraph><subparagraph id="id98f302ac6e1a4332a09cfe004b578a8e"><enum>(I)</enum><text>the United States Virgin Islands.</text></subparagraph></paragraph><paragraph id="ID66ade89855f04831bb79765d8b224755"><enum>(9)</enum><header>Federal trust species</header><text>The term <term>Federal trust species</term> means—</text><subparagraph id="idC414A378DD7545E3B9121C56CDA34D47"><enum>(A)</enum><text>a species listed as a threatened species or an endangered species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></subparagraph><subparagraph id="idD8824C954D574C8CA3EE933B71086F04"><enum>(B)</enum><text>a species of migratory bird;</text></subparagraph><subparagraph id="idDE9B8ACAD8D844F0914F8C99192E27EA"><enum>(C)</enum><text>a species of interjurisdictional fish;</text></subparagraph><subparagraph id="id2F5484BED98647F3BF694EEFC34CADC6"><enum>(D)</enum><text>any species of marine mammal, as identified by the Secretary; and</text></subparagraph><subparagraph id="idB47857A97D69484C969CE8216FE37E82"><enum>(E)</enum><text>any other species of concern, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="ID55a67c29da1148d0b92bda0cb181ad34"><enum>(10)</enum><header>Financial assistance</header><text>The term <term>financial assistance</term> means Federal funding support provided to eligible recipients through a grant or cooperative agreement.</text></paragraph><paragraph id="ID0cbc766a0b1348d3a1d33bfd7839154c"><enum>(11)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="ID8a0fadd479f542ed972f40f89420adb2"><enum>(12)</enum><header>Service</header><text>The term <term>Service</term> means the United States Fish and Wildlife Service.</text></paragraph><paragraph id="id7F6ED1DD163643D5837C7BDC32EC329D"><enum>(13)</enum><header>Technical assistance</header><text>The term <term>technical assistance</term> means a collaboration, facilitation, or consulting action relating to a habitat protection, planning, restoration, or enhancement project or initiative in which the Service contributes scientific knowledge, skills, and expertise to a project or program.</text></paragraph></section><section id="IDd2d97721e6c44ec1a4db82000b454ff0"><enum>4.</enum><header>Coastal program</header><text display-inline="no-display-inline">The Secretary shall carry out the Coastal Program within the Service—</text><paragraph id="ID79dc18afe81d4bba879809a259fc7279"><enum>(1)</enum><text>to identify the most important natural resource problems and solutions in priority coastal ecosystems in partnership with—</text><subparagraph id="id01F951CA0D8F4F97B8823F53712DC422"><enum>(A)</enum><text>Federal, State, local, and Tribal governments;</text></subparagraph><subparagraph id="idC489587735614FA6B0C210E7E643FB62"><enum>(B)</enum><text>nongovernmental institutions;</text></subparagraph><subparagraph id="id53C01B99B90A4011922C48B074FA8C68"><enum>(C)</enum><text>nonprofit organizations;</text></subparagraph><subparagraph id="id00881C1CF4FB495FA487AD7160A7F5CA"><enum>(D)</enum><text>private individuals; and</text></subparagraph><subparagraph id="id330021B894AF43F6B8F7A5D4DEC4B111"><enum>(E)</enum><text>corporations;</text></subparagraph></paragraph><paragraph id="ID9e7077540a324d6caab301c1f4d9c52d"><enum>(2)</enum><text>to provide technical assistance and financial assistance through partnerships with Federal, State, local, and Tribal governments, nongovernmental institutions, nonprofit organizations, private individuals, and corporations to conduct voluntary coastal habitat assessment, protection, planning, restoration, and enhancement projects on public land or private land;</text></paragraph><paragraph id="idD4DE85FE0E12461CA3DB245B12C483C8"><enum>(3)</enum><text>to ensure the health and resilience of coastal ecosystems through adaptive management procedures based on the best available science;</text></paragraph><paragraph id="idDF83C19C520C4A6E8A3F016E5CDE2FC6"><enum>(4)</enum><text>to build the capacity of Federal, State, local, and Tribal governments, nongovernmental institutions, nonprofit organizations, private individuals, and corporations to carry out environmental conservation and stewardship measures;</text></paragraph><paragraph id="ID36a1e08549a74060a5097650b48090d9"><enum>(5)</enum><text>to assist in the development and implementation of monitoring protocols to ensure the success of coastal ecosystem restoration and enhancement measures; and</text></paragraph><paragraph id="IDe21660b532144c558d63e917831b125b"><enum>(6)</enum><text>to collaborate and share information with partners and the public relating to best management practices for the conservation, restoration, and enhancement of coastal ecosystems.</text></paragraph></section><section id="ID674dc9e8b1d4416bad48fabacd3a3d62"><enum>5.</enum><header>Reports</header><subsection id="ID13a6d50789cc48c59bbe37ed4d5bb2e8"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary, acting through the Director of the Service, shall submit to the Committees on Appropriations and Environment and Public Works of the Senate and the Committees on Appropriations and Natural Resources of the House of Representatives, and make available to the public on the website of the Service, a report on the Coastal Program carried out under this Act.</text></subsection><subsection id="IDe6a81797e0da464199091b9c617a2c17" commented="no"><enum>(b)</enum><header>Requirements</header><text>Each report submitted under subsection (a) shall assess on regional and nationwide bases—</text><paragraph id="id085D3D4763644D6AAB1B33A367862A72" commented="no"><enum>(1)</enum><text>Coastal Program work on coastal ecosystems;</text></paragraph><paragraph id="id9E3F779CC1D34B2F8BC1A5D5F1D87D2B" commented="no"><enum>(2)</enum><text>progress made by the Coastal Program toward identifying the most important natural resource problems and solutions in priority ecosystems; and</text></paragraph><paragraph id="id4E53517CA4974A44BAE549CC1D85256A" commented="no"><enum>(3)</enum><text>prospects for, and success of, protecting, restoring, and enhancing coastal ecosystems.</text></paragraph></subsection><subsection id="ID2b9b2f1650ca464a92c0aacd81f70f6a" commented="no"><enum>(c)</enum><header>Inclusions</header><text>Each report submitted under subsection (a) shall include—</text><paragraph id="ID1a6e8bed4a3e482fad82d95ffa3e6f08" commented="no"><enum>(1)</enum><text>quantitative information on coastal areas protected, restored, or enhanced;</text></paragraph><paragraph id="ID16417a50d4c34e1d93966f7f67d999d4" commented="no"><enum>(2)</enum><text>funds appropriated to the Coastal Program that have been expended or leveraged;</text></paragraph><paragraph id="IDb3b58506251e48d4bdd8b4a725ea8109" commented="no"><enum>(3)</enum><text>a description of adaptive management practices implemented; and</text></paragraph><paragraph id="IDcbe6d89278b94893b741acc8c9acc57d" commented="no"><enum>(4)</enum><text>recommendations, if any, for additional research, management, or legislation needed to fully—</text><subparagraph id="id0EFFEFB55F01461E8C8CE8D7E2B3709A" commented="no"><enum>(A)</enum><text>address problems and implement solutions in coastal ecosystems; and</text></subparagraph><subparagraph id="idD9BCEF7CB8EC4E69A97172F69764AFCB" commented="no"><enum>(B)</enum><text>achieve the objectives of this Act.</text></subparagraph></paragraph></subsection></section><section id="ID15b6626e77394f409432a8089ba7faac" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this Act—</text><paragraph commented="no" display-inline="no-display-inline" id="id3C2D8FA954924B298FEB11D66C233D58"><enum>(1)</enum><text display-inline="yes-display-inline">$20,000,000 for fiscal year 2022;</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idD9096B15B74441B0831AB81768EABBA5"><enum>(2)</enum><text>$21,250,000 for fiscal year 2023;</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id39EF28F7E64A45EF887A18B76725B44E"><enum>(3)</enum><text>$22,500,000 for fiscal year 2024;</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id0278ED0A93DF4EADBC77B304A1DDDCD7"><enum>(4)</enum><text>$23,750,000 for fiscal year 2025; and</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idBC90F775D5834E86A413AE551CE22E3B"><enum>(5)</enum><text>$25,000,000 for fiscal year 2026.</text></paragraph></section></legis-body></bill>
