which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure that an employment relationship is not established between a franchisor and a franchisee if the franchisor engages in certain activities, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H17EA53CEE6B444A4A8B0A651715744F4"><section section-type="section-one" id="H5AA712CA34B34B65914499985F7D03F6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protections for Socially Good Activities Act</short-title></quote>.</text></section><section id="HF66C1D14A1094429B0EDDF35D8ABEFC9"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HF547900251BA40C2BFEDD94412FC6F98"><enum>(1)</enum><header>Employment relationship</header><text>The term <term>employment relationship</term> means any type of joint employer relationship, single employer relationship, or other employment-related status or relationship under any of the laws described in section 3(b).</text></paragraph><paragraph id="H13ACFBE78D984961B7FB3D428FB09E59"><enum>(2)</enum><header>Franchisee</header><text>The term <term>franchisee</term> means a franchisee, as defined—</text><subparagraph id="H0DF1947DE7674B83949F833076583489"><enum>(A)</enum><text>in section 436.1(i) of title 16, Code of Federal Regulations, as in effect on the day before the date of enactment of this Act; or</text></subparagraph><subparagraph id="H86FA34D64A7B4BDAAD0D16EFB7968CDE"><enum>(B)</enum><text>under an applicable State franchise law.</text></subparagraph></paragraph><paragraph id="H56D6DEEDF7B34B65970035CC8BAE1AC5"><enum>(3)</enum><header>Franchisor</header><text>The term <term>franchisor</term> means a franchisor, as defined—</text><subparagraph id="H30A7F39FAD374D8DB916A8B25ED0B8AF"><enum>(A)</enum><text>in section 436.1(k) of title 16, Code of Federal Regulations, as in effect on the day before the date of enactment of this Act; or</text></subparagraph><subparagraph id="HD7FBF8A4A1F844558582CE4C2B86F6D4"><enum>(B)</enum><text>under an applicable State franchise law.</text></subparagraph></paragraph></section><section id="HE8480C5C05A2498B898314663CD53C7A"><enum>3.</enum><header>Safe harbor</header><subsection id="H93CC365BD66C4897872727588BAF1473"><enum>(a)</enum><header>In general</header><text>For the purposes of each law described in subsection (b), none of the following may be construed, alone or in combination with any other factor, as establishing an employment relationship between a franchisor (or any employee of the franchisor) and a franchisee (or any employee of the franchisee):</text><paragraph id="H73710EDD29A34608A30D8D0C87AA9F17"><enum>(1)</enum><text display-inline="yes-display-inline">The franchisor (or any employee of the franchisor) provides the franchisee (or any employee of the franchisee) with, or requires the franchisee (or any employee of the franchisee) to use, a handbook, or other training, on sexual harassment, human trafficking, workplace violence, discrimination, or opportunities for apprenticeships or scholarships.</text></paragraph><paragraph id="H27D50A444E274DA5851AB7CB24F08B85"><enum>(2)</enum><text display-inline="yes-display-inline">The franchisor (or any employee of the franchisor) requires the franchisee (or any employee of the franchisee) to adopt a policy on sexual harassment, human trafficking, workplace violence, discrimination, opportunities for apprenticeships or scholarships, childcare, or paid leave, including a requirement for the franchisee (or any employee of the franchisee) to report to the franchisor (or any employee of the franchisor) any violations or suspected violations of such policy.</text></paragraph><paragraph id="H6E608E3064904C55ADD3A61B88C063A1"><enum>(3)</enum><text>The franchisor (or any employee of the franchisor) requires the franchisee (or any employee of the franchisee) to adopt a policy based on the novel coronavirus (referred to in this paragraph as <quote>COVID–19</quote>) pandemic such as the use of personal protective equipment or other policies, or the franchisor (or any employee of the franchisor) provides the franchisee (or any employee of the franchisee) with personal protective equipment or other material goods or compensation to help the franchisee (or any employee of the franchisee) during or due to the COVID–19 pandemic. </text></paragraph></subsection><subsection id="HE5E0D838C2E84D309683E2FF284ECD24"><enum>(b)</enum><header>Laws</header><text>The laws described in this subsection are each of the following:</text><paragraph id="H381D68849FD44FC1B37EE95614701F12"><enum>(1)</enum><text>The National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151 et seq.</external-xref>).</text></paragraph><paragraph id="H6E2E9BA95A9242BDB52ECCADB1BD3298"><enum>(2)</enum><text>The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>).</text></paragraph><paragraph id="HCF1FCF9EFE1F4D6C9BA00E076039F217"><enum>(3)</enum><text>The Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/651">29 U.S.C. 651 et seq.</external-xref>). </text></paragraph></subsection></section><section id="HA02136FF1FC64FF3BFA32258F17381E3"><enum>4.</enum><header>Preemption</header><text display-inline="no-display-inline">Except with respect to the definitions of the terms <term>franchisee</term> and <term>franchisor</term> under section 2, this Act shall preempt any State law to the extent that such State law is inconsistent with the provisions of this Act.</text></section></legis-body></bill>
