which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize certain Bureau of Reclamation programs, and for other purposes.</official-title></form><legis-body><section id="id9BF28CAF52B34E31B084DD0281568435" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Western Water Infrastructure Act of 2021</short-title></quote>.</text></section><section id="id0AE0708C55334F718A91B1BEA053449E"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id9AFF35AFC61C42A28EF99B781A074257"><enum>(1)</enum><header>Grandfathered project</header><text display-inline="yes-display-inline">The term <term>grandfathered project</term> means a project that has been included in a feasibility level study by the Secretary that was commenced, including at the appraisal level, on or before January 1, 2021, in anticipation of Federal funding or recommended by the Secretary and approved by an Act of Congress prior to the date of enactment of this Act pursuant to— </text><subparagraph id="id26A827C8159D4F40939168B6405099DD"><enum>(A)</enum><text>section 4007 of the WIIN Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>); </text></subparagraph><subparagraph id="id68B29896A8CF4A2BAF9A0419DA48E455"><enum>(B)</enum><text>section 4(a)(2) of the Water Desalination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/10301">42 U.S.C. 10301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/298">Public Law 104–298</external-xref>); or</text></subparagraph><subparagraph id="id7B8E61D78CDE4E5682C4FC9020E0E5B5" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>section 1602(e) of the Reclamation Wastewater and Groundwater Study and Facilities Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390h">43 U.S.C. 390h(e)</external-xref>). </text></subparagraph></paragraph><paragraph id="id69DC2F19D78946BB8347CC08E8136F19"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the Secretary of the Interior, acting through the Commissioner of Reclamation. </text></paragraph></section><section id="idfb6e68ab0a2a46048501c6497379f7c9"><enum>3.</enum><header>Reauthorization of certain reclamation programs</header><subsection id="id97bdabe2f8ee4aecb9a94413b6de7c50"><enum>(a)</enum><header>Water storage program</header><text>Section 4007 of the WIIN Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>) is amended—</text><paragraph id="ide7b8a1e24d5c404c84c2f73856ef7862"><enum>(1)</enum><text>in subsection (h)—</text><subparagraph id="idA82D830CFE064A9BAEC6B1F4089E48FF"><enum>(A)</enum><text>in paragraph (1), by striking <quote>(1) $335,000,000</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id76BD607A3BAA4FDFB031F4235875FA9F"><paragraph id="idCAACC597F8774799BB9E0DF8C5B526A9"><enum>(1)</enum><header>In general</header><text>$1,600,000,000</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id7200e03d095b4006859930ec44ba0fb1"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6235F50079C14C9182FCC69640BF5BB9"><paragraph id="idAF478E6A422F45BFAD36F573FAE58AED"><enum>(2)</enum><header>Requirement</header><subparagraph id="id388D3E08E53C4518B85CF69040D1AAE7"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), a project may only receive funding under this section if the project has been included in an Act of Congress that specifically approves a project recommendation in an annual report issued in accordance with section 5 of the <short-title>Western Water Infrastructure Act of 2021</short-title>.</text></subparagraph><subparagraph id="id170EF34863B2418E9FAD94F8C87D493B"><enum>(B)</enum><header>Limitation</header><text>Subparagraph (A) shall not apply to a grandfathered project (as defined in section 2 of the <short-title>Western Water Infrastructure Act of 2021</short-title>).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id8ad0eb647e954caa809d228831e1a267"><enum>(2)</enum><text>by striking subsection (i); and</text></paragraph><paragraph id="idE22B7BCE2D9349DA96E04FA85CD0C012"><enum>(3)</enum><text>by redesignating subsections (j) and (k) as subsections (i) and (j), respectively.</text></paragraph></subsection><subsection id="id7282b7a326d74d16875ef1dec607e067"><enum>(b)</enum><header>Eligible desalination projects</header><text>Section 4(a) of the Water Desalination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/10301">42 U.S.C. 10301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/298">Public Law 104–298</external-xref>) is amended—</text><paragraph id="id9e3594ddb67847c595153afe73928927"><enum>(1)</enum><text>by redesignating the second paragraph (1) (relating to eligible desalination projects) as paragraph (2); and</text></paragraph><paragraph id="id870ad37d9e0f451cb740fe41a447a1be"><enum>(2)</enum><text>in subparagraph (F) of paragraph (2) (as so redesignated)—</text><subparagraph id="id003353CBB025482491016C97B4A8A280"><enum>(A)</enum><text>in clause (i)—</text><clause id="idA6EFCCBC1BD84288A75F0A3EF25C23FC"><enum>(i)</enum><text>by striking <quote>(i) $30,000,000</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id21167C0F7A6746E38E573FA797A10329"><clause id="id4438F9B8684C4BC7B3F30D071F27B3F6"><enum>(i)</enum><header>In general</header><text>$125,000,000</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="idAAA431826B6B4F6FAC79CCBBCB64337E"><enum>(ii)</enum><text>by striking <quote>; and</quote> and at the end and inserting a period; and</text></clause></subparagraph><subparagraph id="id1089eaa41d7b46f5a99ebb37e7ffac07"><enum>(B)</enum><text>by striking clause (ii) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id025CE703A6784074A39D1A26B128A03F"><clause id="idFBA96164BE9C407A8837836BB1463E53"><enum>(ii)</enum><header>Requirement</header><subclause id="id82D352FDD5A1489FAF862F1A0A128FB0"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II), a project may only receive funding under this section if the project has been included in an Act of Congress that specifically approves a project recommendation in an annual report issued in accordance with section 5 of the <short-title>Western Water Infrastructure Act of 2021</short-title>.</text></subclause><subclause id="idD2BEB459802141DAB9A87B97C0BA96D3"><enum>(II)</enum><header>Limitation</header><text>Subclause (I) shall not apply to a grandfathered project (as defined in section 2 of the <short-title>Western Water Infrastructure Act of 2021</short-title>).</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id9c660535fe89422180ad8bba69086fd5"><enum>(c)</enum><header>Reclamation and reuse of wastewater and groundwater</header><text>Section 1602(g) of the Reclamation Wastewater and Groundwater Study and Facilities Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390h">43 U.S.C. 390h(g)</external-xref>) is amended—</text><paragraph id="ide1a19ef8c78545c7a512498ee9ff9707"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id1C97B91A4E584B809B7713CE9511326D"><enum>(A)</enum><text>by striking the paragraph designation and all that follows through <quote>There is</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2EFE0D2D753341159A2C2325B9CB3E52"><subparagraph id="id4DDBAB791B56466E8144590FA2DC888A"><enum>(A)</enum><header>In general</header><text>There is</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idB5A5C22EFCE04DF5BF87746B3A1964BF"><enum>(B)</enum><text>by striking <quote>$50,000,000</quote> and inserting <quote>$375,000,000</quote>; and</text></subparagraph></paragraph><paragraph id="idCEEBAC3AA3E94629BE0B183424263191"><enum>(2)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6754C1F4C5EA420C8662BF5F6D75ABFA"><paragraph id="id8C272E8FCD60408EAA09E4B7C2C7BB77"><enum>(2)</enum><header>Requirement</header><subparagraph id="id06A1BE994A844E3E84B5B35DEFBA2502"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), a project may only receive funding under this section if the project has been included in an Act of Congress that specifically approves a project recommendation in an annual report issued in accordance with section 5 of the <short-title>Western Water Infrastructure Act of 2021</short-title>.</text></subparagraph><subparagraph id="idAF3218C6E70E49CAB1F06C536E96932E"><enum>(B)</enum><header>Limitation</header><text>Subparagraph (A) shall not apply to a grandfathered project (as defined in section 2 of the <short-title>Western Water Infrastructure Act of 2021</short-title>).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id112447b99d364200b5db879e99013c85"><enum>(d)</enum><header>Duration of certain reclamation projects</header><text>Section 4013 of the WIIN Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>) is amended—</text><paragraph id="id479987FC0C214BAFB5DFCF3E36298610"><enum>(1)</enum><text>in paragraph (1), by striking <quote>; and</quote> at the end;</text></paragraph><paragraph id="id894CC371F7844FADBD5BCA3ACAE0550B"><enum>(2)</enum><text> in paragraph (2), by striking the period at the end the following and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id17E7ACF9659D414493D02A6B59D0D829"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc855a6f2a8be4e11a30d536ccfe345d7"><paragraph id="idbd913fabe19f4477b91d7ea5df02ea49"><enum>(2)</enum><text>sections 4006, 4007 (other than a project under construction under that section that is covered by paragraph (2)), 4008, 4009 (other than a project under construction under the amendment made by subsection (a) or (c) of section 4009 that is covered by paragraph (2)), and 4011 (including any amendments made by those sections), which shall expire 5 years after the date of enactment of the <short-title>Western Water Infrastructure Act of 2021</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id8a12c8dc875b4b7d850111a5de378c0d" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header>Applicable law</header><text>A grandfathered project shall continue to be subject to the applicable requirements of the following:</text><paragraph id="idB7ECF71F3B3041AF8035028512543F79"><enum>(1)</enum><text>Section 4007 of the WIIN Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>).</text></paragraph><paragraph id="id1D1A17EFF47B4272A195BD4199DFB981"><enum>(2)</enum><text>Section 4(a)(2) of the Water Desalination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/10301">42 U.S.C. 10301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/298">Public Law 104–298</external-xref>).</text></paragraph><paragraph id="id446ACB782DF8436D96AC4E70BFAAA2B7" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>Section 1602(e) of the Reclamation Wastewater and Groundwater Study and Facilities Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390h">43 U.S.C. 390h(e)</external-xref>). </text></paragraph></subsection></section><section id="idA3FFECB72DC94937AFB604A649F80869"><enum>4.</enum><header>Increased funding for water management improvement</header><text display-inline="no-display-inline">Section 9504(e) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/42/10364">42 U.S.C. 10364(e)</external-xref>) is amended by striking <quote>$700,000,000</quote> and inserting <quote>$1,000,000,000</quote>. </text></section><section id="idad186fd818a14d4bba9da6239c36541a"><enum>5.</enum><header>Annual report to congress on future western water storage projects</header><subsection id="id1e200c05cd924a15b9a3a4448521c4ca"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idc75c196ac55840a48c7ad68632b7731a"><enum>(1)</enum><header>Annual report</header><text>The term <term>annual report</term> means a report required under subsection (b)(1).</text></paragraph><paragraph id="id23e9d8687a424fa9a247b899cbf23889"><enum>(2)</enum><header>Authorized reclamation project</header><subparagraph id="id9FE61B9652834EB9B1B6214FBD9FCE48"><enum>(A)</enum><header>In general</header><text>The term <term>authorized Reclamation project</term> means a project authorized under—</text><clause id="id4d20bcb39dff49b297a8ce93c8eb5e51"><enum>(i)</enum><text>section 4007 of the WIIN Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>);</text></clause><clause id="id585aaf95d08e478fa0f58b5e7b280df2"><enum>(ii)</enum><text>section 4(a)(2) of the Water Desalination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/10301">42 U.S.C. 10301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/298">Public Law 104–298</external-xref>); or</text></clause><clause id="id60b98fffb3a34f4292ec71142a7523db"><enum>(iii)</enum><text>section 1602(e) of the Reclamation Wastewater and Groundwater Study and Facilities Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390h">43 U.S.C. 390h(e)</external-xref>).</text></clause></subparagraph><subparagraph id="id3EE574D1F4D64A3DAF01F8D7204D5350"><enum>(B)</enum><header>Exclusion</header><text>The term <quote>authorized Reclamation project</quote> does not include a grandfathered project.</text></subparagraph></paragraph><paragraph id="ided8b7ed3abe3455a88ce52fead6061cd"><enum>(3)</enum><header>Authorizing committees of congress</header><text>The term <term>authorizing committees of Congress</term> means—</text><subparagraph id="idb077945b2b3a4787ae076a988d61a599"><enum>(A)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text></subparagraph><subparagraph id="id2f61b67a1bf84440ad981ed76cbb6803"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></subparagraph></paragraph></subsection><subsection id="id2e8c9cdac2aa4815814f36f281c694c0"><enum>(b)</enum><header>Annual report</header><paragraph id="idEF6308190E35451D892571A56F294CEA"><enum>(1)</enum><header>In general</header><text>Not later than February 1 of each year, the Secretary shall develop and submit to the authorizing committees of Congress a report, to be entitled <quote>Report to Congress on Future Water Storage Projects </quote>, that identifies each authorized Reclamation project that the Secretary has determined meets the criteria and eligibility requirements under subsection (a) or (b) of section 4007 of the WIIN Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>), section 4(a)(2) of the Water Desalination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/10301">42 U.S.C. 10301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/298">Public Law 104–298</external-xref>), or section 1602(e) of the Reclamation Wastewater and Groundwater Study and Facilities Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390h">43 U.S.C. 390h(e)</external-xref>), as applicable. </text></paragraph><paragraph id="id191495f5c1024f83a937081a0c23d0ab"><enum>(2)</enum><header>Transparency</header><text>For each authorized Reclamation project included in the annual report under paragraph (1), the Secretary shall include—</text><subparagraph id="idd116f40acba449c4aa5fedef066ea1be"><enum>(A)</enum><text>the name of the associated non-Federal entity, including the name of any non-Federal entity that has contributed, or is expected to contribute, a non-Federal share of the cost of the authorized Reclamation project;</text></subparagraph><subparagraph id="idbd480f2674864380a1eb11fa76e55de3"><enum>(B)</enum><text>a letter or statement of support from each associated non-Federal entity; and</text></subparagraph><subparagraph id="id65a8b14381bd4b6d8fc894630492778d" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>a summary of the basis for the determination of the Secretary that the authorized Reclamation project meets the eligibility requirements referred to in paragraph (1), including an estimate, to the maximum extent practicable, of the monetary and nonmonetary benefits of the authorized Reclamation project. </text></subparagraph></paragraph></subsection></section><section id="id42cb116cd1e34729b1457085a25ce77f"><enum>6.</enum><header>Contracts for enhanced inspection</header><subsection id="ide7534e84f7414d6dbd249e87ccc69d45"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id2796dd7e16ec41919930be4c5e20f80b"><enum>(1)</enum><header>Aging infrastructure</header><text>The term <term>aging infrastructure</term> means any infrastructure subject to an enhanced inspection under this section that is associated with a facility that—</text><subparagraph id="id335787E153584853B05CBF5B00597895"><enum>(A)</enum><text>was constructed by the Bureau of Reclamation (or a precursor to the Bureau of Reclamation), in accordance with the reclamation laws; and</text></subparagraph><subparagraph id="id47CE3541F56344019BA60AA51EAB3D72"><enum>(B)</enum><text>is greater than 50 years old as of the date of the enhanced inspection.</text></subparagraph></paragraph><paragraph id="ida5ec861a2fc74396b73df9c8d49eb011"><enum>(2)</enum><header>Enhanced inspection</header><text>The term <term>enhanced inspection</term> means an inspection that uses current or innovative technology, including Light Detection and Ranging (commonly known as <quote>LiDAR</quote>), ground penetrating radar, subsurface imaging, or subsurface geophysical techniques, to detect whether the features of aging infrastructure—</text><subparagraph id="id549efdc89af74ef88ec6a26bff8592e9"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id4F4AA38ED25B4B02A39D44B64D393384"><enum>(i)</enum><text>are structurally sound; and</text></clause><clause id="id499F1DFB58F94C1E984BD7779787648B" indent="up1"><enum>(ii)</enum><text>can operate as intended; or</text></clause></subparagraph><subparagraph id="idb4c488148b864e7b859a317c718277ac"><enum>(B)</enum><text>are at risk of failure.</text></subparagraph></paragraph><paragraph id="idf4ddae5c570a420a98c3f643ea8b876e"><enum>(3)</enum><header>Reclamation laws</header><text>The term <term>reclamation laws</term> means Federal reclamation law (the Act of June 17, 1902 (32 Stat. 388, chapter 1093), and Acts supplemental to and amendatory of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/371">43 U.S.C. 371 et seq.</external-xref>)). </text></paragraph></subsection><subsection id="id2f1a6e48f03d43e0a3bb9ad5ee4a4b6b"><enum>(b)</enum><header>Enhanced inspection</header><paragraph id="idb45a6e3868854f278b5dee26ca0bcd73"><enum>(1)</enum><header>In general</header><text>The Secretary may carry out enhanced inspections of aging infrastructure, pursuant to a contract with the owner or operator of the aging infrastructure.</text></paragraph><paragraph id="idfdca0aabb0f24ec9bb696425db4047fe"><enum>(2)</enum><header>Certain circumstances</header><text>Subject to the availability of appropriations or funds otherwise available pursuant to subsection (d), the Secretary shall enter into a contract described in paragraph (1), if the owner or operator of the aging infrastructure requests that the Secretary carry out the enhanced inspections.</text></paragraph><paragraph id="id9F7987F8D4D04BC995EC852B7207CC1C"><enum>(3)</enum><header>Reimbursability</header><text>Any Federal funds used to carry out the enhanced inspections under this section are nonreimbursable.</text></paragraph></subsection><subsection id="idf39142bfab504681a928de626e972d4c"><enum>(c)</enum><header>Limitation</header><text>The Secretary shall not require an owner or operator of a project under the jurisdiction of another Federal agency to carry out corrective or remedial actions in response to an enhanced inspection carried out under this section.</text></subsection><subsection id="id9271813845fc40a8842d1b595a02b423"><enum>(d)</enum><header>Funding</header><paragraph id="id65630BB2DA6847B297601A7768580083"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $50,000,000, to remain available until expended.</text></paragraph><paragraph id="id3CDC6B4A846D40A498C526FD011EF460"><enum>(2)</enum><header>Acceptance of funds</header><text>The Secretary may—</text><subparagraph id="id4c6e8bf2aa384445b410a51c702854f5"><enum>(A)</enum><text>accept funds from an owner or operator of aging infrastructure to carry out an enhanced inspection of the aging infrastructure under this section; and</text></subparagraph><subparagraph id="id1431f809c85a4b258ddd0e49d77d6665"><enum>(B)</enum><text>use the funds accepted under subparagraph (A) to carry out an enhanced inspection of the aging infrastructure pursuant to a contract entered into with the owner or operator under this section. </text></subparagraph></paragraph></subsection></section><section id="id4ed6d594853e4c86b74daef32b6b9a1a"><enum>7.</enum><header>Reservoir sediment management</header><subsection id="id60c61ca175a541ceb1a1ab70ed9885f1"><enum>(a)</enum><header>Definition of sediment management plan</header><text>In this section, the term <term>sediment management plan</term> means a plan for—</text><paragraph id="idd8e6d335009b4854b59800fbab2d6656"><enum>(1)</enum><text>preventing sediment from reducing water storage capacity at a reservoir; and</text></paragraph><paragraph id="iddbd7fcd502c741a2b2f75598d5c2c04a"><enum>(2)</enum><text>increasing water storage capacity through sediment removal at a reservoir.</text></paragraph></subsection><subsection id="id3749c85712f346e28f151418555baf89"><enum>(b)</enum><header>Sediment management program</header><text>The Secretary shall carry out a program for the development and implementation of sediment management plans for reservoirs owned by the Secretary, on request by project beneficiaries.</text></subsection><subsection id="ida94de822b57648048b9fe6611af6f209"><enum>(c)</enum><header>Plan elements</header><text>A sediment management plan under subsection (b) shall—</text><paragraph id="id64007b0cbfae4ef5869eaef9c69c3aad"><enum>(1)</enum><text>provide opportunities for States, project beneficiaries, and other stakeholders to participate in sediment management decisions;</text></paragraph><paragraph id="id2252046385a84faa888aa559d5f50110"><enum>(2)</enum><text>evaluate the volume of sediment in a reservoir and impacts on project purposes, including storage capacity;</text></paragraph><paragraph id="idf059c226fa77451396eba5a0db266f4f"><enum>(3)</enum><text>identify sediment management options, including sediment dikes and dredging;</text></paragraph><paragraph id="ide077c1de25a9488aa2eb45dda22c4e25"><enum>(4)</enum><text>identify constraints;</text></paragraph><paragraph id="id2e417801ac314203aef06342c4ba15c9"><enum>(5)</enum><text>assess technical feasibility, economic justification, and environmental impacts;</text></paragraph><paragraph id="idbf967716d9094630b3b3ec9ef78f9ffa"><enum>(6)</enum><text>identify beneficial uses for sediment; and</text></paragraph><paragraph id="id49736eb3bd2b4332bb1fea037593b306"><enum>(7)</enum><text>to the maximum extent practicable, use, develop, and demonstrate innovative, cost-saving technologies, including structural and nonstructural technologies and designs, to manage sediment.</text></paragraph></subsection><subsection id="id204feec8801c4e5a98cb0366c9f41e35"><enum>(d)</enum><header>Justification</header><text>In determining the economic justification of a sediment management plan under subsection (b), the Secretary shall—</text><paragraph id="id91ecf72585204c2791fe923f5b786184"><enum>(1)</enum><text>measure and include flooding, erosion, and accretion damages upstream and downstream of the reservoir that are likely to occur as a result of sediment management within the reservoir compared to the damages that are likely to occur if the sediment management plan is not implemented; and</text></paragraph><paragraph id="id947e4dfc5a6147169598af72800280d3"><enum>(2)</enum><text>include—</text><subparagraph id="id1f7f9af172a84a4f993d2997179854db"><enum>(A)</enum><text>lifecycle costs; and</text></subparagraph><subparagraph id="id4438b05601494d4fa3bfd009717d9127"><enum>(B)</enum><text>a 100-year period of analysis.</text></subparagraph></paragraph></subsection><subsection id="id2712fad81d9a40c981643841ebe97df6"><enum>(e)</enum><header>Prioritization of sediment management plans</header><text>In carrying out the program under this section, the Secretary shall give priority to developing and implementing sediment management plans that affect reservoirs that cross State lines.</text></subsection><subsection id="id34f48c1b829d454db19ae6c119d482c3"><enum>(f)</enum><header>Cost share</header><paragraph id="id6153c64db2eb444198145d3d9528036f"><enum>(1)</enum><header>In general</header><text>The beneficiaries requesting a sediment management plan shall share in the cost of development and implementation of the sediment management plan.</text></paragraph><paragraph id="idaa189d3df0504767a61e2da44754094a"><enum>(2)</enum><header>Allocation</header><text>There shall be allocated—</text><subparagraph id="id6D0DBA2A37584552BBB644C3CA058C0F"><enum>(A)</enum><text>among the beneficiaries described in paragraph (1) the reimbursable costs of developing and implementing the sediment management plan; and</text></subparagraph><subparagraph id="id93A1CE728635460D89398AE3EEE7A8E8"><enum>(B)</enum><text>to the Secretary the nonreimbursable costs of any other public benefits identified in the sediment management plan.</text></subparagraph></paragraph></subsection><subsection id="id2d4180a9aad6460894e53b56f6a21cb6"><enum>(g)</enum><header>Contributed funds</header><text>The Secretary may accept funds from non-Federal entities and other Federal agencies to develop and implement a sediment management plan under this section.</text></subsection><subsection id="id2d3e3cd64bdb43c4ace6623fd9bdd3fb"><enum>(h)</enum><header>Guidance</header><text>The Secretary shall use the knowledge gained through the development and implementation of sediment management plans under subsection (b) to develop guidance for sediment management at other reservoirs.</text></subsection><subsection id="idb037b319f2344f92ae5a98b977480f6a"><enum>(i)</enum><header>Partnership with the chief of engineers</header><paragraph id="id3770fcc7f4da493893d54171a96531a0"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out the program established under this section in partnership with the Secretary of the Army, acting through the Chief of Engineers, which shall apply to reservoirs managed or owned by the Corps of Engineers.</text></paragraph><paragraph id="id1e227bd68e39409a85e2eb0b25c1ee34"><enum>(2)</enum><header>Memorandum of agreement</header><text>For sediment management plans that apply to a reservoir managed or owned by the Corps of Engineers under paragraph (1), the Secretary and the Secretary of the Army shall execute a memorandum of agreement establishing—</text><subparagraph id="idd99e348a51f34c109b58fe1be342665b"><enum>(A)</enum><text>the framework for a partnership; and</text></subparagraph><subparagraph id="idbd62a27335fc427c8592dc2ec23e948d"><enum>(B)</enum><text>the terms and conditions for sharing expertise and resources.</text></subparagraph></paragraph><paragraph id="id8bac71acb6fb4782b96152ae00bf494d"><enum>(3)</enum><header>Payments</header><text>The Secretary may accept and expend funds from the Secretary of the Army any work under this subsection at a reservoir managed or owned by Corps of Engineers.</text></paragraph><paragraph id="idf5bb98f516f646d0a8b2bccf98b932fa"><enum>(4)</enum><header>Lead agency</header><text>The Secretary or the Secretary of the Army, as applicable, based on who has primary jurisdiction over a reservoir, shall take the lead in developing and implementing a sediment management plan for the reservoir.</text></paragraph></subsection><subsection id="idee11b66176fb4be4b237b1beceba4db9"><enum>(j)</enum><header>Other authorities not affected</header><text>Nothing in this section affects—</text><paragraph id="id497698fbea2e425abd13d34be3812639"><enum>(1)</enum><text>sediment management; or</text></paragraph><paragraph id="id591bd17e82864ce5afc7ca9673c7156a"><enum>(2)</enum><text>the share of costs paid by Federal and non-Federal entities relating to sediment management under any other provision of law (including regulations).</text></paragraph></subsection><subsection id="id4FCCC9768D53498884E1FA55552662CF"><enum>(k)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $100,000,000, to remain available until expended.</text></subsection></section><section id="idb56b448e4f114e82aa09d95770cc82fd"><enum>8.</enum><header>Elimination of Bureau of Reclamation maintenance backlog</header><subsection id="id5f08d92e4cec4ae6ae8cb8c93a955d03"><enum>(a)</enum><header>In general</header><text>The Secretary shall use amounts made available under subsection (b)—</text><paragraph id="idfe535b262d32455095756dcdf387dff1"><enum>(1)</enum><text>to carry out activities to reduce or eliminate all major rehabilitation and replacement needs of the Bureau of Reclamation, as identified in an Asset Management Report (as defined in section 8601 of the John D. Dingell, Jr. Conservation, Management, and Recreation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/505a">43 U.S.C. 505a</external-xref>)); or </text></paragraph><paragraph id="idbf05debd1c554526b42cf035e7d5eb89"><enum>(2)</enum><text>to support the rehabilitation, reconstruction, or replacement of any dam—</text><subparagraph id="id21D7052EBDF4440D83CBA408ABB0A096"><enum>(A)</enum><text>the construction of which began on or after January 1, 1905;</text></subparagraph><subparagraph id="id8234A7D385E541D9910D5C5F2FDF011D"><enum>(B)</enum><text>that was developed pursuant to section 4 of the Act of August 18, 1894 (commonly known as the <quote>Carey Act</quote>) (28 Stat. 422, chapter 301; <external-xref legal-doc="usc" parsable-cite="usc/43/641">43 U.S.C. 641</external-xref>);</text></subparagraph><subparagraph id="id81ac6b5134344a1eb16484ac84a74d1f"><enum>(C)</enum><text>that the Governor of the State in which the dam is located has—</text><clause id="id94935C714ED64DE1A9E74117B77FC138"><enum>(i)</enum><text>determined reached the useful life of the dam; </text></clause><clause id="id7F3BC6B706A44129B8565BDEB8792C32"><enum>(ii)</enum><text>determined poses significant health and safety concerns; and</text></clause><clause id="id0598c5908ca5488887f035c6f709960e"><enum>(iii)</enum><text> requested Federal support; and</text></clause></subparagraph><subparagraph id="id7e64bb51b39a4ba184ea915f755ae43d"><enum>(D)</enum><text>for which the estimated rehabilitation, reconstruction, or replacement, engineering, and permitting costs would exceed $50,000,000.</text></subparagraph></paragraph></subsection><subsection id="id7c5b32f024c94327aeaa45882290c316" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Authorization of appropriations</header><paragraph commented="no" display-inline="no-display-inline" id="idDFA2510175194F14966ED07C069E7CAB"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary to carry out this section $5,000,000,000 for the period of fiscal years 2022 through 2026.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idAC70BD7DE1284EC99715104BD641F13B"><enum>(2)</enum><header>Reimbursement of costs</header><text>Amounts made available to the Secretary under paragraph (1) for maintenance activities at reserved works and transferred works identified in the report described in subsection (a)(1) that are considered to be reimbursable costs under existing contracts shall be afforded the repayment terms provided under section 9603 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/510b">43 U.S.C. 510b</external-xref>). </text></paragraph></subsection></section></legis-body></bill>
