which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Elder Abuse Prevention and Prosecution Act to authorize the Elder Justice Initiative, to require that online resources of such initiative are made available in Spanish, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" changed="not-changed" id="H55D888A5A4A24F549944DE6438F7405C"><section section-type="section-one" id="HFF53019E47F94FF5BB86668EC584A4A5" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Elder Abuse Protection Act of 2021</short-title></quote>.</text></section><section id="HF4315585F41743B78ECA6508D02E9271" changed="not-changed"><enum>2.</enum><header>Elder justice initiative</header><text display-inline="no-display-inline">Section 101(b) of the Elder Abuse Prevention and Prosecution Act (<external-xref legal-doc="usc" parsable-cite="usc/34/21711">34 U.S.C. 21711(b)</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H405E611FD4C04BF4B65DF2220912D35E" changed="not-changed"><subsection id="H6A740385E6604FC88648650F3E81880D" changed="not-changed"><enum>(b)</enum><header>Elder justice initiative</header><paragraph id="HAB294DC09F764DF6BE61D93C304A213B" changed="not-changed"><enum>(1)</enum><header>Permanent initiative</header><text display-inline="yes-display-inline">The Attorney General shall establish an Elder Justice Initiative to coordinate criminal enforcement and public engagement efforts to combat elder abuse, neglect, and financial fraud and scams that target elders, and to support and coordinate the efforts of the Elder Justice Coordinator designated under subsection (a).</text></paragraph><paragraph id="H4A3BADB08AF94462929D7A1EB72E8137" changed="not-changed"><enum>(2)</enum><header>Department of Justice Elder Justice Coordinator</header><text display-inline="yes-display-inline">The Attorney General shall designate an Elder Justice Coordinator within the Department of Justice who, in addition to any other responsibilities, shall be responsible for—</text><subparagraph id="HA37E7EC0E44A42768F13A22DA9A70305" changed="not-changed"><enum>(A)</enum><text>coordinating and supporting the law enforcement efforts and policy activities as the head of the Elder Justice Initiative for the Department of Justice on elder justice issues; </text></subparagraph><subparagraph id="H90E68D3FA7954A3CB645ACC1F5B423D4" changed="not-changed"><enum>(B)</enum><text>evaluating training models to determine best practices and creating or compiling and making publicly available replication guides and training materials for law enforcement officers, prosecutors, judges, emergency responders, individuals working in victim services, adult protective services, social services, and public safety, medical personnel, mental health personnel, financial services personnel, and any other individuals whose work may bring them in contact with elder abuse regarding how to—</text><clause id="H81D6A2002E5947D2B9ABFF0BA79387A6" changed="not-changed"><enum>(i)</enum><text>conduct investigations in elder abuse cases; </text></clause><clause id="H279380D887A3449BA13FBE3195913EEA" changed="not-changed"><enum>(ii)</enum><text>address evidentiary issues and other legal issues; and </text></clause><clause id="HA8A91E6EF1BC4437A11B3C714EEAADAF" changed="not-changed"><enum>(iii)</enum><text>appropriately assess, respond to, and interact with victims and witnesses in elder abuse cases, including in administrative, civil, and criminal judicial proceedings; and </text></clause></subparagraph><subparagraph id="HD11DA77E37A84639B670FE450137DBB7" changed="not-changed"><enum>(C)</enum><text>carrying out such other duties as the Attorney General determines necessary in connection with enhancing the understanding, prevention, and detection of, and response to, elder abuse.</text></subparagraph></paragraph><paragraph id="HE1C454F0559849BB8D2932A89B459D24" changed="not-changed"><enum>(3)</enum><header>Online public resources</header><text>The Elder Justice Initiative shall maintain and publish on the internet, information aimed at protecting elders from fraudulent schemes and contain resources aimed at preventing elder abuse.</text></paragraph><paragraph id="HA546755CC6C04692A3970952FB4DDB81" changed="not-changed"><enum>(4)</enum><header>Telephone hotline</header><text display-inline="yes-display-inline">The Attorney General, in consultation with the Elder Justice Coordinator and the Office of Victims of Crime, shall establish a national elder fraud telephone hotline to provide support to victims and resources to help victims, including referrals to federal, local and state law enforcement where appropriate.</text></paragraph><paragraph id="HD6BB22F39BDC418784B09C5F925B66B5" changed="not-changed"><enum>(5)</enum><header>Tribal consultation</header><text>The Elder Justice Coordinator shall provide recommendations to the Office of Tribal Justice on a yearly basis on how to address elder abuse and elder fraud that takes place on federally recognized tribal reservations.</text></paragraph><paragraph id="HCBE4C31C3974464BA347370366EC3C9B" changed="not-changed"><enum>(6)</enum><header>Legal aid</header><text>The Elder Justice Coordinator shall consult with components of the Department of Justice to promote the provision of civil legal aid to victims of elder abuse and elder fraud.</text></paragraph><paragraph id="H6CC6FB8904A34BB2AD71FCC25BE1434A" changed="not-changed"><enum>(7)</enum><header>Spanish language resources</header><text>The Attorney General shall ensure that Elder Justice Initiative online resources are available in Spanish and link linguistically appropriate resources to inform Spanish-speaking elders of Federal and State resources to combat fraud and abuse that targets the elderly, to include—</text><subparagraph id="HBD5942433E884D7A99AC93D2F0D26866" changed="not-changed"><enum>(A)</enum><text>Spanish-language resources and links that help report instances of elder fraud and abuse to State and local law enforcement; and</text></subparagraph><subparagraph id="H9E4AFEBB9169412CAE4BDFE03F767D91" changed="not-changed"><enum>(B)</enum><text>resources that help prevent financial exploitation of elders.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
