which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To permit Centers for Disease Control and Prevention-recognized virtual diabetes prevention program suppliers to be included in the Medicare Diabetes Prevention Program Expanded Model conducted by the Center for Medicare and Medicaid Innovation under section 1115A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315a">42 U.S.C. 1315a</external-xref>).</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Responsible and Effective Virtual Experiences through Novel Technology to Deliver Improved Access and Better Engagement with Tested and Evidence-based Strategies Act</short-title></quote> or the <quote><short-title>PREVENT DIABETES Act</short-title></quote>.</text></section><section id="id34F9BD3EEB864EA38B94582A705A247A"><enum>2.</enum><header>Inclusion of virtual diabetes prevention program suppliers in MDPP Expanded Model</header><subsection id="id347EA8F7757C457689AEAC3BC0EF6740"><enum>(a)</enum><header>In general</header><text>Not later than January 1, 2022, the Secretary shall revise the regulations under part 410 and section 424.200–.518 of title 42, Code of Federal Regulations (or any successor regulations), to permit any diabetes prevention lifestyle change program, including any online or virtual diabetes prevention program, that has met the standards for full recognition by the CDC—</text><paragraph id="id734844C6CD6A4672BAC9C049F97EDF74"><enum>(1)</enum><text>to apply to be a MDPP supplier; and</text></paragraph><paragraph id="id333002D886754088BC3BA3ABFF8F0581"><enum>(2)</enum><text>upon a successful application, to participate in the MDPP Expanded Model described in the final rule published in the Federal Register on November 15, 2017, entitled <quote>Medicare Program; Revisions to Payment Policies Under the Physician Fee Schedule and Other Revisions to Part B for CY 2018; Medicare Shared Savings Program Requirements; and Medicare Diabetes Prevention Program</quote>, in accordance with this section.</text></paragraph></subsection><subsection id="idD0B4E2891F824F029CE42913E50F8DE0"><enum>(b)</enum><header>Virtual diabetes prevention program suppliers</header><text>A virtual diabetes prevention program supplier participating in the MDPP Expanded Model shall be subject to the same standards as in-person MDPP suppliers participating in such program, except—</text><paragraph id="id11c5644c078b498ba9adee4dee244453"><enum>(1)</enum><text>the administrative location of a virtual diabetes prevention program supplier shall be the address of the supplier on file under the Diabetes Prevention Recognition Program of the CDC;</text></paragraph><paragraph id="id725056d0e8b54681a1476d30624e1d1c"><enum>(2)</enum><text>a virtual diabetes prevention program supplier shall not be required to report a change in its administrative location except when such supplier’s address on file under the Diabetes Prevention Recognition Program has changed; and</text></paragraph><paragraph id="id13949a9fb1c749dbbd863514d2a1505a"><enum>(3)</enum><text>a virtual diabetes prevention program supplier shall not be prohibited from submitting or receiving payment for a claim for virtual diabetes prevention program services because the beneficiary was not present in the same State or country as such supplier or service.</text></paragraph></subsection><subsection id="id2F50D3A30D574637BA1D6DFDC6E48D8E"><enum>(c)</enum><header>Diabetes prevention program supplier screening level</header><text>The supplier enrollment screening level applicable to a virtual diabetes prevention program supplier shall be at a <quote>high</quote> categorical risk in accordance with section 424.518(c)(2) of title 42, Code of Federal Regulations (or any successor regulations).</text></subsection><subsection id="id1293005AD8474D7CB1276EC407DC889F"><enum>(d)</enum><header>Clarification</header><text>Notwithstanding any provision of this law, the MDPP Expanded Model, upon the inclusion of virtual diabetes prevention program suppliers, shall continue to be an expanded model under section 1115A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315a">42 U.S.C. 1315a</external-xref>), unless the Secretary determines, based on performance data from the MDPP Expanded Model, that continued testing would be inconsistent with the requirements set forth in subsection (c) of such section 1115A.</text></subsection><subsection id="idBC08F973AA4A4F5DBE4BD7050A73EDA4"><enum>(e)</enum><header>Other testing</header><text>Nothing in this section shall limit the Secretary from developing and testing additional models that utilize virtual technology or deliver health care services through virtual means.</text></subsection><subsection id="id370D27E08990438AA46EF3A9E1557C34"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idDE163BC6297B4F91A9DCBDE488A8EA55"><enum>(1)</enum><header>CDC</header><text>The term <term>CDC</term> means the Centers for Disease Control and Prevention.</text></paragraph><paragraph id="id79188CEBA96840A1967760F9C9772BAD"><enum>(2)</enum><header>MDPP</header><text>The term <term>MDPP</term> means the Medicare Diabetes Prevention Program.</text></paragraph><paragraph id="id2C84CB01339E44ED8D8BA4A55D801974"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph><paragraph id="id8900591AE30141E49D3A9B8D48AE9C9B"><enum>(4)</enum><header>Virtual diabetes prevention program supplier</header><text>The term <term>virtual diabetes prevention program supplier</term> means a supplier, that meets the standards for full recognition by the CDC, of diabetes prevention program services that are delivered via a synchronous or asynchronous technology or telecommunications.</text></paragraph></subsection></section></legis-body></bill>
