which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Administrator of the Environmental Protection Agency to establish a grant program to award grants to eligible entities to purchase and install, as applicable, zero emissions port equipment and technology, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HB97C6EE78D704052A7D9EB8478D817A7"><section section-type="section-one" id="HF77521F07F584FB2B8A9BC9A95A90B48"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Climate Smart Ports Act of 2021</short-title></quote>.</text></section><section id="HE24B77D7F7114A3B8CFFB0C488582277"><enum>2.</enum><header>Climate smart ports grant program</header><subsection id="H4F026192F4584795BF87030367F4B5DD"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H092FA06DCA3344EBBCD2578253E2A458"><enum>(1)</enum><header>Active duty</header><text display-inline="yes-display-inline">The term <term>active duty</term> has the meaning given the term in section 101(d) of title 10, United States Code.</text></paragraph><paragraph id="H286424F7BF404CA9A726E422523D017D"><enum>(2)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph commented="no" id="H127A7A243FA74A41AB3220808DF4C3E9"><enum>(3)</enum><header>Alternative emissions control technology</header><text display-inline="yes-display-inline">The term <term>alternative emissions control technology</term> means a technology, technique, or measure that—</text><subparagraph commented="no" id="H3A1ACD62A5C94A90A465AEAA7364668A"><enum>(A)</enum><text>captures the emissions of nitrogen oxide, particulate matter, reactive organic compounds, and greenhouse gases from the auxiliary engine and auxiliary boiler of an ocean-going vessel at berth; </text></subparagraph><subparagraph commented="no" id="HCD72936799254142B14480D6D250E251"><enum>(B)</enum><text display-inline="yes-display-inline">is verified or approved by a State or Federal air quality regulatory agency;</text></subparagraph><subparagraph commented="no" id="H135E72F548A54D569290D31A77E58D08"><enum>(C)</enum><text>the use of which achieves at least the equivalent reduction of emissions as the use of shore power for an ocean-going vessel at berth;</text></subparagraph><subparagraph commented="no" id="HA84E32257D1B47998647CD6530733C76"><enum>(D)</enum><text display-inline="yes-display-inline">the use of which results in reducing emissions of the auxiliary engine of an ocean-going vessel at berth to a rate of less than—</text><clause commented="no" id="H3E5FBAA275BF4015A18612B2F274CA2F"><enum>(i)</enum><text display-inline="yes-display-inline">2.8 grams per kilowatt-hour for nitrogen oxide;</text></clause><clause commented="no" id="H7444844A2E3A4BEAAAAA4ED07B3CE706"><enum>(ii)</enum><text>0.03 grams per kilowatt-hour for fine particulate matter (PM<subscript>2.5</subscript>); and</text></clause><clause commented="no" id="HF76852A3DBC047C797C19332AC2CCCA7"><enum>(iii)</enum><text display-inline="yes-display-inline">0.1 grams per kilowatt-hour for reactive organic compounds; and </text></clause></subparagraph><subparagraph commented="no" id="HE9C612AFB19245C9B7AFC94E0E1D1679"><enum>(E)</enum><text display-inline="yes-display-inline">reduces the emissions of the auxiliary engine and boiler of an ocean-going vessel at berth by at least 80 percent of the default emissions rate, which is, as of the date of enactment of this Act, 13.8 grams per kilowatt-hour.</text></subparagraph></paragraph><paragraph commented="no" id="HC254B2AD6E54421D873CDB85330D6FCD"><enum>(4)</enum><header>Criteria pollutant</header><text display-inline="yes-display-inline">The term <term>criteria pollutant</term> means—</text><subparagraph id="H6FF12B599E424266A97110B8F11FE926"><enum>(A)</enum><text>ground-level ozone;</text></subparagraph><subparagraph id="H97B3A8CA9B124DA1968DB91A713FA47B"><enum>(B)</enum><text>particulate matter;</text></subparagraph><subparagraph id="H59F346443EDD44938724FA9634D1544E"><enum>(C)</enum><text>carbon monoxide;</text></subparagraph><subparagraph id="H0BC5946AE5A749FDAF5CE881F7D82687"><enum>(D)</enum><text>lead;</text></subparagraph><subparagraph id="H7336E3D23BAB4CFE858BF2277E8F294B"><enum>(E)</enum><text>sulfur dioxide; and</text></subparagraph><subparagraph id="H6AB528039BC844528B6F439A3A6E0389"><enum>(F)</enum><text>nitrogen dioxide.</text></subparagraph></paragraph><paragraph commented="no" id="H5580BAC028A84EDC918B77CC4D44DD02"><enum>(5)</enum><header>Distributed energy resource</header><subparagraph id="H9B0726021B674BB7A7EDA9F8FC7F77DE"><enum>(A)</enum><header>In general</header><text>The term <term>distributed energy resource</term> means an energy resource that—</text><clause id="H162A047474584DCA8D6CC040B5E69571"><enum>(i)</enum><text>is located on or near a customer site;</text></clause><clause id="H6FD36F0DE79247C9AF7ABC254584AEAD"><enum>(ii)</enum><text>is operated on the customer side of the electric meter; and</text></clause><clause id="HE7D9FF714580422BB9D3CB8F616EC137"><enum>(iii)</enum><text>is interconnected with the electric grid.</text></clause></subparagraph><subparagraph commented="no" id="H771CB066E9694D949248EB282ED87E99"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>distributed energy resource</term> includes—</text><clause commented="no" id="H4BBCF6A623A740B6A5C93AB9D9A5AFEB"><enum>(i)</enum><text>clean electric generation;</text></clause><clause id="H357F33566FD94D918E759272B9FAA459"><enum>(ii)</enum><text>customer electric efficiency measures;</text></clause><clause id="H559F6B7CB259440A9CCB49FF2CDED1CA"><enum>(iii)</enum><text>electric demand flexibility; and</text></clause><clause id="H6794B5432D2A4D84BC0F78CD3E177FDD"><enum>(iv)</enum><text>energy storage.</text></clause></subparagraph></paragraph><paragraph id="H5663469C83DF46608B23C37C1D86A9B6"><enum>(6)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph id="HFCF5BA8FE5304424AB84D55458BE57B5"><enum>(A)</enum><text>a port authority;</text></subparagraph><subparagraph id="H99E5D8CF4F2D4022830C73C17950C848"><enum>(B)</enum><text>a State, regional, local, or Tribal agency that has jurisdiction over a port authority or a port;</text></subparagraph><subparagraph id="HC013F723F17D466EA5A94F61BDA5EEEE"><enum>(C)</enum><text display-inline="yes-display-inline">an air pollution control district or air quality management district; and</text></subparagraph><subparagraph id="HB46E54B6790944B7A20892A9F571FD0D"><enum>(D)</enum><text>a private or nonprofit entity, applying for a grant awarded under this section in collaboration with another entity described in subparagraphs (A) through (C), that owns or uses cargo or transportation equipment at a port.</text></subparagraph></paragraph><paragraph id="HAA767A72A6C446F18DBBEE6156F37DFD"><enum>(7)</enum><header>Energy storage system</header><text>The term <term>energy storage system</term> means a system, piece of equipment, facility, or technology that—</text><subparagraph id="HF6E554A60A07488AA15EFBE09064E047"><enum>(A)</enum><text display-inline="yes-display-inline">is capable of absorbing energy, storing energy for a period of time, and dispatching that stored energy; and</text></subparagraph><subparagraph id="HE690C55E2266467485C19E37045B7670"><enum>(B)</enum><text display-inline="yes-display-inline">uses a mechanical, electrical, chemical, electrochemical, or thermal process to store energy that—</text><clause id="H9E00CCFD52B647E0BDB374014866FCB0"><enum>(i)</enum><text display-inline="yes-display-inline">was generated at an earlier time for use at a later time; or</text></clause><clause id="H52FC76BA3823424F8AA59BE20A71169D"><enum>(ii)</enum><text display-inline="yes-display-inline">was generated from a mechanical process, and would otherwise be wasted, for delivery at a later time.</text></clause></subparagraph></paragraph><paragraph id="H9549FD6141264FFC9D2881CA23E2AAD7"><enum>(8)</enum><header>Fully automated cargo handling equipment</header><text display-inline="yes-display-inline">The term <term>fully automated cargo handling equipment</term> means cargo handling equipment that—</text><subparagraph id="H7752E508D27846879AAF5954D192BA99"><enum>(A)</enum><text>is remotely operated or remotely monitored; and</text></subparagraph><subparagraph id="HD97A60A458194C3EB1C000BC9B395116"><enum>(B)</enum><text>with respect to the use of that equipment, does not require the exercise of human intervention or control.</text></subparagraph></paragraph><paragraph commented="no" id="HEA170F41E38241D0A79E7FB9F12338F8"><enum>(9)</enum><header>Major urban area</header><text display-inline="yes-display-inline">The term <term>major urban area</term> means a metropolitan statistical area within the United States with an estimated population of 1,500,000 or more.</text></paragraph><paragraph id="H78289AFA52C2449AA964624FB6D9C47C"><enum>(10)</enum><header>Nonattainment area</header><text display-inline="yes-display-inline">The term <term>nonattainment area</term> has the meaning given the term in section 171 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7501">42 U.S.C. 7501</external-xref>).</text></paragraph><paragraph commented="no" id="HB40B7055EE0F4E6CB8A0F9FBB1CF2176"><enum>(11)</enum><header>Port</header><text>The term <term>port</term> includes a maritime port and an inland port.</text></paragraph><paragraph commented="no" id="H465F0B3AE86849C6B56B6A164303B5CA"><enum>(12)</enum><header>Port authority</header><text display-inline="yes-display-inline">The term <term>port authority</term> means a governmental or quasi-governmental authority formed by a legislative body to operate a port.</text></paragraph><paragraph id="HEC9A5AE858A0481ABE2CA07931FE7327"><enum>(13)</enum><header>Project labor agreement</header><text display-inline="yes-display-inline">The term <term>project labor agreement</term> means a pre-hire collective bargaining agreement with 1 or more labor organization that—</text><subparagraph id="id038303D3CCD144319D6E2B9ED8726157"><enum>(A)</enum><text display-inline="yes-display-inline">establishes the terms and conditions of employment for a specific construction project; and </text></subparagraph><subparagraph id="idFFAA7770474B46048DFFBFBC6836B9E8"><enum>(B)</enum><text display-inline="yes-display-inline">is described in section 8(f) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158(f)</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" id="H0DC3BFD79E7341C4BBE6D838AA3356F5"><enum>(14)</enum><header>Registered apprentice</header><text display-inline="yes-display-inline">The term <term>registered apprentice</term> means a person who is participating in a registered apprenticeship program.</text></paragraph><paragraph id="HBF5D12FDC3D44E64A81E05D99C022D2F"><enum>(15)</enum><header>Registered apprenticeship program</header><text display-inline="yes-display-inline">The term <term>registered apprenticeship program</term> means a program registered under the Act of August 16, 1937 (commonly known as the “National Apprenticeship Act”; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50</external-xref> et seq.).</text></paragraph><paragraph id="HE72FB7089C55425BAAB694E49E55E674"><enum>(16)</enum><header>Shore power</header><text display-inline="yes-display-inline">The term <term>shore power</term> means the provision of shoreside electrical power to a ship at berth that has shut down main and auxiliary engines.</text></paragraph><paragraph id="H063F556D46264193897C2F30DE1CA971"><enum>(17)</enum><header>State Apprenticeship Agency</header><text>The term <term>State Apprenticeship Agency</term> has the meaning given the term in section 29.2 of title 29, Code of Federal Regulations (as in effect on January 1, 2020).</text></paragraph><paragraph id="HAEFC888FB0724E4796A641A9C60D1352"><enum>(18)</enum><header>Zero emissions port equipment and technology</header><subparagraph id="H665065C0DCCA4ADAA8F226E5983AF557"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>zero emissions port equipment and technology</term> means equipment and technology that—</text><clause id="HB7D879D5631E468BA4F196568FDAFF68"><enum>(i)</enum><text>is used at a port; and</text></clause><clause display-inline="no-display-inline" id="HA9D6718BFC2D4FE9A3E8E64DD5E34715"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HBB451AD824BB4AD2AEDC53F2141FDCD3"><enum>(I)</enum><text>produces zero exhaust emissions of—</text><item id="H286AA463D04047FB8041162C7B426D35" indent="up1"><enum>(aa)</enum><text>any criteria pollutant and precursor of a criteria pollutant; and</text></item><item id="HCAF110664CC44754A6099F4B02CCF7F3" indent="up1"><enum>(bb)</enum><text>any greenhouse gas, other than water vapor; or</text></item></subclause><subclause display-inline="no-display-inline" id="H32421A10C3304A1BAC3C111617B2C497" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">captures 100 percent of the exhaust emissions produced by an ocean-going vessel at berth.</text></subclause></clause></subparagraph><subparagraph id="H12E38A5194684A45B3158F00AB9A455F"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>zero emissions port equipment and technology</term> includes—</text><clause id="H67E22452C1D1466080AC0F779376C981"><enum>(i)</enum><text>any equipment that handles cargo;</text></clause><clause id="HCC105730DD40418A98D0124B99A80A7D"><enum>(ii)</enum><text>a drayage truck that transports cargo;</text></clause><clause id="H8CE4F69548554229991385CA9FBB10BD"><enum>(iii)</enum><text>a train that transports cargo;</text></clause><clause id="HF2DCBA592EA44FDBA816C45801CC6C5F"><enum>(iv)</enum><text>port harbor craft;</text></clause><clause id="HE0FAA46ACE7749E188DCCB2545DF3DA4"><enum>(v)</enum><text>a distributed energy resource;</text></clause><clause id="H1149A3EF629A4327B161A8E8808B56A4"><enum>(vi)</enum><text>an energy storage system;</text></clause><clause id="H6C65CCD35F094A899D56BACC1DBF0D8B"><enum>(vii)</enum><text display-inline="yes-display-inline">electrical charging infrastructure;</text></clause><clause commented="no" id="H33FC132325C8433299A7AAACD191817D"><enum>(viii)</enum><text>shore power or an alternative emissions control technology; and</text></clause><clause id="H3A361E8FB3684F729328845ED7B93E62" commented="no" display-inline="no-display-inline"><enum>(ix)</enum><text display-inline="yes-display-inline">an electric transport refrigeration unit.</text></clause></subparagraph></paragraph></subsection><subsection id="idB9D4604BFED946AAAE7AE918D1CB21A5"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, not later than 180 days after the date of enactment of this section, the Administrator shall establish a grant program to award grants to eligible entities to purchase and install, as applicable, zero emissions port equipment and technology.</text></subsection><subsection id="H52D71705B18F41ACA26F280C122D2883"><enum>(c)</enum><header>Application</header><paragraph id="H876006B7ED4D40B69784E6C2352EC5B2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To be eligible to receive a grant under this section, an eligible entity shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require.</text></paragraph><paragraph id="H183188EAABCD48558E95F32E5666FED3"><enum>(2)</enum><header>Priority</header><text>The Administrator shall prioritize awarding grants under this section to eligible entities based on—</text><subparagraph id="H6FEDAA05DE2D4BB1905235E689374F0E"><enum>(A)</enum><text display-inline="yes-display-inline">the degree to which the proposed use of the grant will—</text><clause id="H160212ED063B4F1B8C0EBF567132B9A2"><enum>(i)</enum><text>reduce greenhouse gas emissions;</text></clause><clause id="H16B64DA5715F4ECCA6CD79082AB09BDF"><enum>(ii)</enum><text>reduce emissions of any criteria pollutant and precursor of a criteria pollutant;</text></clause><clause commented="no" id="H2C2CAC748C8F4040903B9227A36ACC6B"><enum>(iii)</enum><text>reduce hazardous air pollutant emissions; and</text></clause><clause id="HF46863BE9B3A47A69F3EBC35BE904543"><enum>(iv)</enum><text>reduce public health disparities in communities that receive a disproportionate quantity of air pollution from a port;</text></clause></subparagraph><subparagraph commented="no" id="H3679410742CD4FAEB399690C47F91B48"><enum>(B)</enum><text display-inline="yes-display-inline">the amount of matching, non-Federal funds expected to be used by an applicant to purchase and install, as applicable, zero emissions port equipment and technology;</text></subparagraph><subparagraph commented="no" id="H8A5B966DA8BF4E2EA4983B3DD52312D3"><enum>(C)</enum><text display-inline="yes-display-inline">whether the applicant will use the grant to purchase and install, as applicable, zero emissions port equipment and technology that is produced in the United States;</text></subparagraph><subparagraph id="H5A8F3A9BFAD1449D900B21FCE658F33B"><enum>(D)</enum><text display-inline="yes-display-inline">whether the applicant will meet the utilization requirements for registered apprentices established by the Secretary of Labor or a State Apprenticeship Agency, as applicable; and</text></subparagraph><subparagraph id="H7C3989CCB7F14A8C839A8EF72ED2F8CB" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">whether the applicant will recruit and retain skilled workers through a State-approved joint labor-management apprenticeship program, as applicable. </text></subparagraph></paragraph></subsection><subsection id="id2FADEF06610B4D5A8FE3570C79326242"><enum>(d)</enum><header>Use of funds</header><paragraph id="HDCB8CD2170B24A51AAF035DEF5B65725"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A grant awarded under this section shall be used to purchase and install, as applicable, zero emissions port equipment and technology.</text></paragraph><paragraph commented="no" id="H7D73B852B3E64405B23DA858CDB90CA9"><enum>(2)</enum><header>Prohibited use</header><subparagraph id="H6183FE04A36D4FAE8C5F8941B2C729CC"><enum>(A)</enum><header>In general</header><text>An eligible entity may not use a grant awarded under this section to purchase or install fully automated cargo handling equipment or terminal infrastructure that is designed for fully automated cargo handling equipment.</text></subparagraph><subparagraph commented="no" id="H487B1FC3DC30478C8A103549F9F8157E"><enum>(B)</enum><header>Human-operated zero emissions port equipment and technology</header><text display-inline="yes-display-inline">Nothing in subparagraph (A) prohibits an eligible entity from using a grant awarded under this section to purchase human-operated zero emissions port equipment and technology or infrastructure that supports the human-operated zero emissions port equipment and technology.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1456965D254E41CCAC108924646F921B"><enum>(3)</enum><header>Cost-sharing</header><subparagraph commented="no" id="HDAD370699ED4479793DF00E68C6CE771"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), an eligible entity may not use a grant awarded under this section to cover more than 70 percent of the cost of purchasing and installing, as applicable, zero emissions port equipment and technology.</text></subparagraph><subparagraph commented="no" id="HB66E655D118B44ACA5B7EE6C856C8855"><enum>(B)</enum><header>Certain grants</header><text display-inline="yes-display-inline">With respect to a grant of $3,000,000 or more, an eligible entity may use the grant to cover not more than 85 percent of the cost of purchasing and installing zero emissions port equipment and technology if that eligible entity certifies to the Administrator that—</text><clause commented="no" id="H2332A2AA90284FCA80D413F7F950895D"><enum>(i)</enum><text display-inline="yes-display-inline">the grant will be used, at least in part, to employ laborers or mechanics to install zero emissions port equipment and technology; and</text></clause><clause commented="no" id="H05A5134933BB4F88B60B028E2C4B301F"><enum>(ii)</enum><text display-inline="yes-display-inline">the eligible entity is a party to a project labor agreement or requires that each subgrantee of the eligible entity, and any subgrantee of that subgrantee at any tier, that performs the installation participate in a project labor agreement.</text></clause></subparagraph></paragraph><paragraph id="H3811F2D38A074E2680A1D83D45A46516"><enum>(4)</enum><header>Project labor</header><text display-inline="yes-display-inline">An eligible entity that uses a grant awarded under this section to install zero emissions port equipment and technology shall ensure, to the greatest extent practicable, that any subgrantee of the eligible entity, and any subgrantee of that subgrantee, at any tier, that carries out the installation employs at least 40 percent of the laborers or mechanics for the installation from among individuals who—</text><subparagraph id="H26A4D1DB8CAD44549F6195DBE326FF15"><enum>(A)</enum><text display-inline="yes-display-inline">are domiciled—</text><clause id="H8DFB8F5EFE8D4DC08EB8DDD434916ED6"><enum>(i)</enum><text display-inline="yes-display-inline">if the applicable installation area is a major urban area, not further than 15 miles from the installation area; and</text></clause><clause id="H7ACDA2E744874A068B09ADE07F76C6A1"><enum>(ii)</enum><text display-inline="yes-display-inline">if the applicable installation area is not a major urban area, not further than 50 miles from the installation area;</text></clause></subparagraph><subparagraph id="HF6B30A0018A34ACAB92122806DE7462D"><enum>(B)</enum><text display-inline="yes-display-inline">are displaced and unemployed energy workers;</text></subparagraph><subparagraph id="H646E2E5D75F44306B79DB8FDAC6A6A88"><enum>(C)</enum><text display-inline="yes-display-inline">are members of the Armed Forces serving on active duty, separated from active duty, or retired from active duty;</text></subparagraph><subparagraph id="H30098DC079394CB48AD1209CE8EB9672"><enum>(D)</enum><text display-inline="yes-display-inline">have been incarcerated or served time in a juvenile or adult detention or correctional facility, or been placed on probation, community supervision, or in a diversion scheme;</text></subparagraph><subparagraph id="H38F7CBFC8E0D4A459F6616F057703891"><enum>(E)</enum><text display-inline="yes-display-inline">have a disability;</text></subparagraph><subparagraph id="H06AFA6106C99461287CD7BC53CD36365"><enum>(F)</enum><text display-inline="yes-display-inline">are homeless;</text></subparagraph><subparagraph id="H4B3A0C16F43E4C689C27B99C536F5B53"><enum>(G)</enum><text display-inline="yes-display-inline">are receiving public assistance;</text></subparagraph><subparagraph id="H43D06002FE95457188BF17C45B4A37D6"><enum>(H)</enum><text display-inline="yes-display-inline">lack a general education diploma or high school diploma;</text></subparagraph><subparagraph id="HD8747E1D211C481C87F7E9AEE8638979"><enum>(I)</enum><text display-inline="yes-display-inline">are emancipated from the foster care system; or</text></subparagraph><subparagraph id="H1D941AC4EE664D8EBDCFEBD275583B43"><enum>(J)</enum><text display-inline="yes-display-inline">are registered apprentices with fewer than 15 percent of the required graduating apprentice hours in a program.</text></subparagraph></paragraph></subsection><subsection id="HB15D721D419348EF9BAAF4E5CB5A6224"><enum>(e)</enum><header>Wages</header><paragraph commented="no" id="HE041549285F6481D8FAA70DC04F716CE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">All laborers and mechanics employed by a subgrantee of an eligible entity, and any subgrantee of a subgrantee at any tier, to perform construction, alteration, installation, or repair work that is assisted, in whole or in part, by a grant awarded under this section, shall be paid wages at rates not less than those prevailing on similar construction, alteration, installation, or repair work in the locality as determined by the Secretary of Labor in accordance with subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code.</text></paragraph><paragraph id="H72E8147CEC3048778601F516BE361F81"><enum>(2)</enum><header>Labor standards</header><text>With respect to the labor standards in this subsection, the Secretary of Labor shall have the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (64 Stat. 1267; 5 U.S.C. App.) and section 3145 of title 40, United States Code.</text></paragraph></subsection><subsection commented="no" id="HC98E030C833D4D2090BDD1E66308B586"><enum>(f)</enum><header>Outreach</header><paragraph commented="no" id="H1581E4E5B7BE443A81CA64F32E672354"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><italic></italic>Not later than 90 days after funds are made available to carry out this section, the Administrator shall develop and carry out an educational outreach program to promote and explain the grant program established under subsection (b) to prospective grant recipients.</text></paragraph><paragraph commented="no" id="HA4F40EA5993F444FB7623A060D57B481"><enum>(2)</enum><header>Program components</header><text>In carrying out the outreach program developed under paragraph (1), the Administrator shall—</text><subparagraph commented="no" id="H21FD8B6FB1C046569BBF1C0EAD2A974D"><enum>(A)</enum><text display-inline="yes-display-inline">inform prospective grant recipients how to apply for a grant awarded under this section;</text></subparagraph><subparagraph commented="no" id="HB59E3993F90D40F69C26EDF8D7397414"><enum>(B)</enum><text display-inline="yes-display-inline">describe to prospective grant recipients the benefits of available zero emissions port equipment and technology;</text></subparagraph><subparagraph commented="no" id="H08C2A6FE4AAA4E4ABEBA9C4A0DCE7B17"><enum>(C)</enum><text display-inline="yes-display-inline">explain to prospective grant recipients the benefits of participating in the grant program established under this section; and</text></subparagraph><subparagraph commented="no" id="H0545723A6C6B440AA442CB7B3EA3FE76"><enum>(D)</enum><text display-inline="yes-display-inline">facilitate the sharing of best practices and lessons learned between grant recipients and prospective grant recipients with respect to how to apply for and use grants awarded under this section.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HD85D1923C5F44310B881D44D6B31218D"><enum>(g)</enum><header>Reports</header><paragraph commented="no" id="H08ED6A055DBB4A88BC1D1881B84B727F"><enum>(1)</enum><header>Report to Administrator</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which an eligible entity is awarded a grant under this section, that eligible entity shall submit to the Administrator a report containing such information as the Administrator shall require.</text></paragraph><paragraph commented="no" id="H20E792A3131C4C9F8D29B2B6FAF8E371"><enum>(2)</enum><header>Annual report to Congress</header><text display-inline="yes-display-inline">Not later than January 31, 2022, and annually thereafter for each calendar year subsequent to a calendar year during which a grant was awarded under this section, the Administrator shall submit to Congress, and make available on the website of the Environmental Protection Agency, a report that includes, with respect to each grant awarded under this section during the preceding calendar year—</text><subparagraph commented="no" id="HEEC1E3D209EC4DBC89EFB17607F55308"><enum>(A)</enum><text display-inline="yes-display-inline">the name and location of the eligible entity that was awarded a grant;</text></subparagraph><subparagraph commented="no" id="H17D83483457A4CEF9282A3755CBB9C31"><enum>(B)</enum><text display-inline="yes-display-inline">the amount of the grant that the eligible entity was awarded;</text></subparagraph><subparagraph commented="no" id="HFDA9C6A202284EA28C29A61722D162BF"><enum>(C)</enum><text display-inline="yes-display-inline">the name and location of the port where the zero emissions port equipment and technology that was purchased and installed, as applicable, with the grant was used;</text></subparagraph><subparagraph commented="no" id="HD047993D97A7427D89B48EC8F69E7026"><enum>(D)</enum><text display-inline="yes-display-inline">an estimate of the impact of the zero emissions port equipment and technology on reducing—</text><clause commented="no" id="H000095EF60214BA5B2E9D873F3618D77"><enum>(i)</enum><text>greenhouse gas emissions;</text></clause><clause commented="no" id="H24C52E5BE247410783E0F817B0D64ADB"><enum>(ii)</enum><text>emissions of criteria pollutants and precursors of criteria pollutants;</text></clause><clause commented="no" id="HA9F16E732745420D97067437AC180EC0"><enum>(iii)</enum><text>hazardous air pollutant emissions; and</text></clause><clause commented="no" id="HA5267D45A5574AD1B9328B79F4C02BB5"><enum>(iv)</enum><text>public health disparities; and</text></clause></subparagraph><subparagraph commented="no" id="H8384AFFD911C40E5B63784BFA2B70F6F"><enum>(E)</enum><text>any other information the Administrator determines is necessary to understand the impact of grants awarded under this section. </text></subparagraph></paragraph></subsection><subsection id="H24C41EA4B23543ED96A79DA8C40C571A"><enum>(h)</enum><header>Authorization of appropriations</header><paragraph id="H31BF41AD15A84C6EA7F8323097C713F7"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Administrator to carry out this section $1,000,000,000 for each of fiscal years 2022 through 2031.</text></paragraph><paragraph id="HCD5315ADFC184063BB3AEE51C934321F"><enum>(2)</enum><header>Nonattainment areas</header><text display-inline="yes-display-inline">To the maximum extent practicable, 25 percent of amounts made available to carry out this section in each fiscal year shall be used to award grants to eligible entities to provide zero emissions port equipment and technology to ports that are in nonattainment areas.</text></paragraph></subsection></section><section commented="no" id="HEEA2A61AFEE647F4909BC3BCAB6F2B28"><enum>3.</enum><header>Energy Policy Act of 2005 authorization of appropriations for port authorities</header><text display-inline="no-display-inline">Section 797 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16137">42 U.S.C. 16137</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3FDE39474438458BB10D12E855E2DC0E"><subsection commented="no" id="H7D4CC10789FF4159A75ACE6F2D8AD469"><enum>(c)</enum><header>Port authorities</header><text display-inline="yes-display-inline">In addition to amounts made available under subsection (a), there is authorized to be appropriated $50,000,000 for each of fiscal years 2022 through 2026 to award grants, rebates, or loans under section 792 to eligible entities to carry out projects that reduce emissions at ports.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
