which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Water Pollution Control Act to modify the definition of navigable waters, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id5332582671144B80A1BD8B51609722C8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Define WOTUS Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="HE8569B7827ED488F81B6A1F224045190"><enum>2.</enum><header>Navigable waters</header><subsection id="H8B6691079CDE484C8F2C1C880DE06A28"><enum>(a)</enum><header>Navigable waters definition</header><text>Section 502 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>) is amended by striking paragraph (7) and inserting the following:</text><quoted-block style="OLC" id="HEB4AD4F3F65D43F992A78017A89ED172"><paragraph id="H605A2DDAE7414E169084803BF4BDECB6"><enum>(7)</enum><header>Navigable waters</header><subparagraph id="HF854AF52587442F9A414739AC218DD05"><enum>(A)</enum><header>In general</header><text>The term <quote>navigable waters</quote> means—</text><clause id="HE12CE022A11243758A29AA2CE7F69E63"><enum>(i)</enum><text>the territorial seas;</text></clause><clause id="H1CFF6A18E3CD4DF6AD911CA522CC7D1D"><enum>(ii)</enum><text>interstate waters that are used, or are susceptible to use in the natural and ordinary condition of those waters, as a means in transport of interstate or foreign commerce;</text></clause><clause id="HFAB615D5D98B4788B8DA4793607F7FD1"><enum>(iii)</enum><text>relatively permanent, standing, or continuously flowing bodies of water that form geographical features commonly known as streams, rivers, or lakes, that flow directly into waters described in clause (ii); and</text></clause><clause id="HB7AE43026CD74D899EFAC39AA1BDFCD4"><enum>(iv)</enum><text>wetlands that are adjacent to and have a continuous surface water connection to waters described in clause (ii) or (iii).</text></clause></subparagraph><subparagraph id="H4A414A5F4A874BB7BB82FDFE3291A378"><enum>(B)</enum><header>Exclusions</header><text>The term <quote>navigable waters</quote> does not include—</text><clause id="HAA5C5BA0D58A452A92602B5592B1A6BB"><enum>(i)</enum><text>intermittent or ephemeral waters, including features that flow only in response to precipitation or melt from snowpack;</text></clause><clause id="HCD7B20CDD12E484D935F845BE269C18C"><enum>(ii)</enum><text>subsurface waters, such as groundwater or underground streams, including subsurface waters drained through subsurface drainage systems, such as drain tiling;</text></clause><clause id="H5B6513376669420ABE3E82C03A631855"><enum>(iii)</enum><text>intrastate waters, unless the waters meet the requirements described in subparagraph (A);</text></clause><clause id="HC1D827F5AC854E258AF3440AE94E4D0E"><enum>(iv)</enum><text>a man-made channel or ditch, including irrigation, distribution, and drainage systems;</text></clause><clause id="idF043DFD76E8A47B389DEBE8E605F8E9D"><enum>(v)</enum><text>prior converted cropland;</text></clause><clause id="id1968FC186E2047B7BC7A02F64A00691F"><enum>(vi)</enum><text>artificially irrigated areas;</text></clause><clause id="id73F87110A87B484E84E467547355490F"><enum>(vii)</enum><text>artificial lakes and ponds constructed in upland;</text></clause><clause id="id9EA268B67A074442AECBD27AE42C18C0"><enum>(viii)</enum><text>water-filled depressions created in upland, including water-filled depressions incidental to mining or construction activity;</text></clause><clause id="id7075C81D078446AFA01E09CAB0C26867"><enum>(ix)</enum><text>stormwater control features excavated or constructed in upland to convey, treat, infiltrate, or store stormwater runoff;</text></clause><clause id="id87BD54571AFB4008A26343F41E8015A4"><enum>(x)</enum><text>wastewater recycling structures constructed in upland;</text></clause><clause id="idC7A16137ED52475EB5C8A196B374EB8A"><enum>(xi)</enum><text>waste treatment systems;</text></clause><clause id="H68183A0CF56D4011BD6444BFF2B12598"><enum>(xii)</enum><text>waters that require the use of means beyond visual inspection by the naked eye, including aerial photographs, satellite imaging, or hydrological testing, to determine if the waters meets the requirements described in subparagraph (A); or</text></clause><clause id="idE7EAC1F7193D4C459859ED1E22062E75"><enum>(xiii)</enum><text>any other waters that do not meet the requirements under subparagraph (A), without regard to whether the water—</text><subclause id="id6B7406B993E84CC697A04B1FC1BCD0A4"><enum>(I)</enum><text>previously met or would have met those requirements; or</text></subclause><subclause id="id99973629BD104E7597F9B9549DD630A0"><enum>(II)</enum><text>may in the future meet those requirements.</text></subclause></clause></subparagraph><subparagraph id="id5F95BF5E8DC740CF9FCAF7F4C2D3B12A"><enum>(C)</enum><header>Associated definitions</header><text>For the purposes of this paragraph:</text><clause id="HBA14C47D1F484D77B5BFC059EDBF6051"><enum>(i)</enum><header>Continuous surface water connection</header><text>The term <quote>continuous surface water connection</quote> means a connection with respect to which an ordinary person would not be able to visually determine by the naked eye, by looking at the water surface, where 1 body of water ends and the other begins.</text></clause><clause commented="no" display-inline="no-display-inline" id="id5006FC62A0DD43CEA3B35BBE50E5E452"><enum>(ii)</enum><header display-inline="yes-display-inline">Relatively permanent, standing, or continuously flowing bodies of water</header><text display-inline="yes-display-inline">The term <quote>relatively permanent, standing, or continuously flowing bodies of water</quote> means waters that, except in cases of extreme events (such as a drought)—</text><subclause commented="no" display-inline="no-display-inline" id="idE24EB033B9FF420D9D16BF15843A6C44"><enum>(I)</enum><text display-inline="yes-display-inline">stand or have continuous flow for not less than 185 days each year; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id76632A12B66F4A0A9030A17937016901"><enum>(II)</enum><text display-inline="yes-display-inline">exhibit a bed and banks.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idBE4D1F08CCBC4DB6833D0EDB667F02D2"><enum>(b)</enum><header>Jurisdictional determination</header><text>Title V of the Federal Water Pollution Control Act is amended—</text><paragraph id="idD2635517C0FE42E3A3E0B2D491824B7C"><enum>(1)</enum><text>by redesignating section 520 (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251</external-xref> note) as section 521; and</text></paragraph><paragraph id="idAF1CC7914FDB488685886ED1188F220C"><enum>(2)</enum><text>by inserting after section 519 (<external-xref legal-doc="usc" parsable-cite="usc/33/1377a">33 U.S.C. 1377a</external-xref>) the following:</text><quoted-block style="OLC" act-name="" id="id103C9CA47D5E4B39B1029FF443DB6800"><section id="id55859BABB8CB40098DDD8ECC1AD75757"><enum>520.</enum><header>Jurisdictional determinations</header><subsection id="idF3B2BBE8BF8441DFBE2BF3A84085330B"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idD65590B0A8F240F8ACB685B6BBF5B963"><enum>(1)</enum><header>Affected person</header><text>The term <quote>affected person</quote> means an applicant for a permit under section 404, landowner, or other affected person with an identifiable and substantial legal interest in a property.</text></paragraph><paragraph id="id60C1E8C6E53147CFA0F2A212FB3F5B9E"><enum>(2)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Army.</text></paragraph></subsection><subsection id="id83A179DBF2DC4C6E904E21CBBB8A3965"><enum>(b)</enum><header>Binding determination</header><text>On written request of an affected person, the Secretary shall provide a binding determination of whether the waters on the property of the affected person are navigable waters that meet the requirements described in section 502(7)(A)(iv).</text></subsection><subsection id="id7F2AD97172FC49C2822B21CA931ECF7E"><enum>(c)</enum><header>Costs</header><text>A determination of the Secretary under subsection (b) shall be made at the cost of the Secretary.</text></subsection><subsection id="id7C23BB4D814E4BC7B8944AE6F8FA4B23"><enum>(d)</enum><header>Timing</header><paragraph id="id409CA1E3B8F14D528DEF217359A797DE"><enum>(1)</enum><header>In general</header><text>The Secretary shall make a determination under subsection (b) not later than 60 days after the date on which the Secretary receives a written request from an affected person.</text></paragraph><paragraph id="idE2D9BD1C959D445FA57D5509A135DFE3"><enum>(2)</enum><header>Effect of nonresponse</header><text>If the Secretary does not make a determination by the end of the period described in paragraph (1), the waters on the property of the affected person shall not be considered to be navigable waters.</text></paragraph></subsection><subsection id="idC188B43D17BF4257BB3F379CDA7D0DDA"><enum>(e)</enum><header>Term of determination</header><paragraph id="id9A9CC76EBA7C41F2A295890C37AD7814"><enum>(1)</enum><header>Finding of navigable waters</header><text>If the Secretary determines under subsection (b) that the waters on the property of the affected person are navigable waters, the determination shall be binding on the Secretary and the Administrator for a period to be determined by the Secretary, but in any case not longer than 5 years after the date of the determination.</text></paragraph><paragraph id="idEB5B2C4FB3904C2AAFD8AEC4FCA78EEC"><enum>(2)</enum><header>Finding of nonnavigable waters</header><text>If the Secretary determines under subsection (b) that the waters on the property of the affected person are not navigable waters, the determination shall be binding on the Secretary and the Administrator for as long as the affected person has an identifiable and substantial legal interest in the property.</text></paragraph></subsection><subsection id="idB7F1A92E7F1D472C9B76C4D285154580"><enum>(f)</enum><header>Judicial review</header><paragraph id="idD6EC93A0332848C087D43D86720CFE26"><enum>(1)</enum><header>In general</header><text>An affected person may obtain expedited judicial review of a determination of the Secretary under subsection (b).</text></paragraph><paragraph id="idD10ED2B439AC4959ADA38D70AD598BC1"><enum>(2)</enum><header>Timing</header><text>To obtain expedited judicial review under paragraph (1), the affected person shall submit a claim under that paragraph not later than 30 days after the date on which the Secretary makes the determination under subsection (b).</text></paragraph><paragraph id="id70ABAEA8EBC44EADB5FF6D22944BB490"><enum>(3)</enum><header>Jurisdiction</header><text>A district court of the United States with appropriate venue for the State in which the affected person resides or in which a substantial part of the property of the affected person is located shall have jurisdiction over an action under this subsection.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
