<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2144</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210621">June 21, 2021</action-date><action-desc><sponsor name-id="S385">Ms. Cortez Masto</sponsor> (for herself and <cosponsor name-id="S373">Mr. Cassidy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify the eligibility for participation of peer support specialists in the furnishing of behavioral health integration services under the Medicare program.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H0688B0F243864E36B57C698030C0EE00"><section section-type="section-one" id="HA72B1903CB3D491291EDD034130EE996"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Effective and Empowering Recovery Services in Medicare Act of 2021</short-title></quote> or the <quote><short-title>PEERS Act of 2021</short-title></quote>.</text></section><section id="H57009CC9A12C4CF78560993FB88F393D"><enum>2.</enum><header>Clarifying the eligibility for participation of peer support specialists in the furnishing of behavioral health integration services under the Medicare program</header><subsection id="H7F2E78BBA0EF4BFDA3190A1402ED5C71"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>) shall be construed as prohibiting a peer support specialist (as defined in subsection (b)) from participating in the furnishing of behavioral health integration services under such title under the supervision of a physician or other entity billing for such services under such title.</text></subsection><subsection id="HA134DE0DDDB8475E81F5AF72AE86928D"><enum>(b)</enum><header>Peer support specialist defined</header><text>For purposes of subsection (a), the term <quote>peer support specialist</quote> means an individual who—</text><paragraph id="HBAD3A277CDAD496792F903D3F3096D2B"><enum>(1)</enum><text display-inline="yes-display-inline">is recovering from a mental health or substance use condition; and</text></paragraph><paragraph id="HB07C81F0EF6346F0BB915C03DE251EF5"><enum>(2)</enum><text display-inline="yes-display-inline">is certified as qualified to furnish peer support services under a certification process consistent with the National Practice Guidelines for Peer Supporters and inclusive of the Substance Abuse and Mental Health Services Administration Core Competencies for Peer Workers in Behavioral Health Settings (as established by the State in which such individual furnishes such services or under such national certification process determined appropriate by the Secretary of Health and Human Services).</text></paragraph></subsection></section></legis-body></bill>
