<section section-type="section-one" id="idA126FCD0A97443DBAD490676EE98FCAC"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reinvesting In Shoreline Economies and Ecosystems Act of 2021</short-title></quote> or the <quote><short-title>RISEE Act of 2021</short-title></quote>.</text></section> <section id="idB9EF446D0F5C4917B3D13DAB8AA1783C"><enum>2.</enum><header>National Oceans and Coastal Security Fund; parity in offshore wind revenue sharing</header> <subsection id="id6FB3F823316D445C915E3F7A2EEE5F18"><enum>(a)</enum><header>Definitions in the National Oceans and Coastal Security Act</header><text display-inline="yes-display-inline">Section 902 of the National Oceans and Coastal Security Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7501">16 U.S.C. 7501</external-xref>) is amended—</text>
<paragraph id="idCD67247852B846378DC87831B056542B"><enum>(1)</enum><text>by striking paragraph (5) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idDBCFDD1FEC8C4C87A352C74B74B04506"> <paragraph id="id4d99b3b1df984735a237e83cf4222657"><enum>(5)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="id6AEE1E243506455EBCEBA106E57FED61"><enum>(2)</enum><text>by striking paragraph (7) and inserting the following: </text> <quoted-block id="idE4D92BF03FAD48B6A1450199E24C5F91" style="OLC" act-name=""> <paragraph id="id2CEFF890F6A04CE89A5A07B76E31D83C"><enum>(7)</enum><header>Tidal shoreline</header><text>The term <term>tidal shoreline</term> means the length of tidal shoreline or Great Lake shoreline based on the most recently available data from or accepted by the Office of Coast Survey of the National Oceanic and Atmospheric Administration.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="idF735C156CB4E4A1D83C940CA037D2791"><enum>(b)</enum><header>National Oceans and Coastal Security Fund</header><text display-inline="yes-display-inline">Section 904 of the National Oceans and Coastal Security Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7503">16 U.S.C. 7503</external-xref>) is amended—</text> <paragraph id="idCFA6D020FC9949E5BFF40AACD7877903"><enum>(1)</enum><text>in subsection (a), by inserting <quote>and manage</quote> after <quote>establish</quote>;</text></paragraph>
<paragraph id="idD7D6FFA603DA4C5A99D555EC16C4EDCD"><enum>(2)</enum><text>in subsection (b), by striking paragraph (1) and inserting the following: </text> <quoted-block style="OLC" display-inline="no-display-inline" id="id7433D6FECF334873998D7F66ED33B4AE"> <paragraph id="id688BB5E90081406CBD9184AF51C064C1"><enum>(1)</enum><header>In general</header><text>The Fund shall consist of such amounts as— </text>
<subparagraph id="id34F8D0B26704481BA08191195BA3DB43"><enum>(A)</enum><text>are deposited in the Fund under section 105(a)(2)(B) of the Gulf of Mexico Energy Security Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/432">Public Law 109–432</external-xref>); </text></subparagraph> <subparagraph id="id964EACC7BE65406E93A116C5BA76FC7E"><enum>(B)</enum><text>are deposited in the Fund under subparagraph (C)(ii)(I)(bb) of section 8(p)(2) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)(2)</external-xref>); and</text></subparagraph>
<subparagraph id="id30FEFF21D1BA4B799940E8382129B7D9"><enum>(C)</enum><text>are appropriated or otherwise made available for the Fund.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph> <paragraph id="id0852612D066242BA97638268E91E66F1"><enum>(3)</enum><text>by striking subsection (d) and inserting the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="id5754DA8390214B4C8B94E093C3FD269A">
<subsection commented="no" display-inline="no-display-inline" id="P72FF9D244B7CCD4B3967B59A88E7D1F"><enum>(d)</enum><header display-inline="yes-display-inline">Expenditure</header>
<paragraph commented="no" display-inline="no-display-inline" id="id5F670ABD01CC4BFEBE8F21E4FB28D986"><enum>(1)</enum><header>$34,000,000 or less</header><text display-inline="yes-display-inline">If $34,000,000 or less is deposited in, or appropriated or otherwise made available for, the Fund for a fiscal year, in that fiscal year— </text> <subparagraph id="id225a6a7575bd48f0a4ffe5b8b562097b"><enum>(A)</enum><text>not more than 5 percent of such amounts may be used by the Administrator and the Foundation for administrative expenses to carry out this title; and</text></subparagraph>
<subparagraph id="idee1a71a6486a4e6a934871ac16a0fdee"><enum>(B)</enum><text>any remaining amounts shall be used only for the award of grants under section 906(c). </text></subparagraph></paragraph> <paragraph id="idd908412789514b2990c1a09ffc0df687"><enum>(2)</enum><header>More than $34,000,000</header><text>If more than $34,000,000 is deposited in, or appropriated or otherwise made available for, the Fund for a fiscal year, in that fiscal year— </text>
<subparagraph id="idf0d0f87c76bc447abbcc6a84af1b0092"><enum>(A)</enum><text>not more than 5 percent of such amounts may be used by the Administrator and the Foundation for administrative expenses to carry out this title;</text></subparagraph> <subparagraph id="id9df9335d7d2140b8a42e2e8125940f48"><enum>(B)</enum><text>not less than $34,000,000 shall be used for the award of grants under section 906(c); and</text></subparagraph>
<subparagraph id="id5b65a918795a41e2baaa83a6dc435080"><enum>(C)</enum><text>of any amounts exceeding $34,000,000—</text> <clause id="id3fc350a2e0c545519b748d0497d6f349"><enum>(i)</enum><text>not more than 75 percent may be used for the award of grants under section 906(b); and</text></clause>
<clause id="id59892db1dbb64945b434570a5cdd263c"><enum>(ii)</enum><text>not more than 20 percent may be used for the award of grants under section 906(c). </text></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id20234f6251684d99905dc9248137123b"><enum>(3)</enum><header>Division of amounts for administrative expenses</header><text>The amounts referred to in paragraphs (1)(A) and (2)(A) shall be divided between the Administrator and the Foundation pursuant to an agreement reached and documented by both the Administrator and the Foundation.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="idC949BF02C8C74A89B7E0A2BF318B8C96"><enum>(4)</enum><text>in subsection (e)(2), by striking <quote>section 906(a)(1)</quote> and inserting <quote>section 906(a)</quote>.</text></paragraph></subsection> <subsection id="id9FE1666150AD45818FB946218E673E81"><enum>(c)</enum><header>Eligible uses of amounts in the National Oceans and Coastal Security Fund</header><text display-inline="yes-display-inline">Section 905 of the National Oceans and Coastal Security Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7504">16 U.S.C. 7504</external-xref>) is amended to read as follows: </text>
<quoted-block style="OLC" display-inline="no-display-inline" id="id886A693186874CECB1AF6B3EC60F9D94">
<section id="id79b3475efd954f5a93a8aa689bf082b6"><enum>905.</enum><header>Eligible uses</header>
<subsection id="id6fb1eaed15d54a16aad09a865fc40ffd"><enum>(a)</enum><header>In general</header><text>Amounts in the Fund may be allocated by the Administrator under section 906(b) and the Foundation, in consultation with the Administrator, under section 906(c) to support programs and activities intended to improve understanding and use of ocean and coastal resources and coastal infrastructure.</text></subsection> <subsection id="idCEB345F51E1B4B77BCD117955DD8B1CD"><enum>(b)</enum><header>Programs and activities</header><text>The programs and activities referred to in subsection (a) may include scientific research related to changing environmental conditions, ocean observing projects, efforts to enhance resiliency of infrastructure and communities (including project planning and design), habitat protection and restoration, monitoring and reducing damage to natural resources and marine life (including birds, marine mammals, and fish), and efforts to support sustainable seafood production carried out by States, local governments, Indian tribes, regional and interstate collaboratives (such as regional ocean partnerships), nongovernmental organizations, public-private partnerships, and academic institutions. </text></subsection>
<subsection id="id4cbc59ba858b47ff800a8ae414fa5817"><enum>(c)</enum><header>Prohibition on use of funds for litigation or other purposes</header><text>No funds made available under this title may be used—</text> <paragraph id="id67221cb2412245d5a3791ce0a8923e6b"><enum>(1)</enum><text>to fund litigation against the Federal Government; or</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id0dd112f9e66e4db88ab3c67496cb58eb"><enum>(2)</enum><text>to fund the creation of national marine monuments, marine protected areas, or marine spatial plans.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="id39769284151742BEA529F9C31E9532C9"><enum>(d)</enum><header>Grants under the National Oceans and Coastal Security Act</header><text display-inline="yes-display-inline">Section 906 of the National Oceans and Coastal Security Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7505">16 U.S.C. 7505</external-xref>) is amended—</text>
<paragraph id="id0F1BA733F71E455EBEFF1E496C38FE86"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="idDAA634F602FB4DFE85BC3F5247D6FE7B"><enum>(A)</enum><text>by striking paragraph (2); </text></subparagraph>
<subparagraph id="idD756681463B043138282082F3F11C462"><enum>(B)</enum><text>by striking <quote>(a) <header-in-text level="subsection" style="OLC">Administration of grants</header-in-text>.—</quote> and all that follows through <quote>the following:</quote> and inserting the following: </text> <quoted-block style="OLC" id="idB7679C9826D54D8B963065A79B6A1AC5" act-name=""> <subsection id="idA5DCD80AD1B34F67B96F6DB41F760193"><enum>(a)</enum><header>Administration of grants</header><text>Not later than 90 days after funds are deposited in the Fund and made available to the Administrator and the Foundation for administrative purposes, the Administrator and the Foundation shall establish the following:</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="id9ED42D7515484CAEAE13335B36CEE0C6"><enum>(C)</enum><text>in subparagraph (A), by striking <quote>such subsections</quote> and inserting <quote>this section</quote>; </text></subparagraph> <subparagraph id="id13DC9389877C43D99E478F74D93956B1"><enum>(D)</enum><text>by striking subparagraph (B) and inserting the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="idACA3050EC47C41D5878894EC057F46EF">
<subparagraph commented="no" display-inline="no-display-inline" id="P0505CA574D4A22A6A4C515B4B7185A2"><enum>(B)</enum><text display-inline="yes-display-inline">Selection procedures and criteria for the awarding of grants under this section that require consultation with the Administrator and the Secretary of the Interior.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="id05AB7751672A4401ABF4DFB0D966818D"><enum>(E)</enum><text>in subparagraph (C), by striking clause (ii) and inserting the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="idD3DB80BC4C624B909B6B6963661DA6BD">
<clause commented="no" display-inline="no-display-inline" id="PC7866ADB49D6FD863F3F48B4E773F3B"><enum>(ii)</enum><text display-inline="yes-display-inline">under subsection (c) to entities including States, local governments, Indian tribes, regional and interstate col­lab­or­a­tives (such as regional ocean partnerships), nongovernmental organizations, public-private partnerships, and academic institutions.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="idD0560FE780624553BDB0F57A81ECBBE3"><enum>(F)</enum><text>in subparagraph (D), by striking <quote>Performance accountability and monitoring</quote> and inserting <quote>Performance, accountability, and monitoring</quote>; </text></subparagraph>
<subparagraph id="idF95F115540DD4E8DAE238F85392BF9DC"><enum>(G)</enum><text>by redesignating subparagraphs (A) through (H) as paragraphs (1) through (8), respectively, and moving such paragraphs, as so redesignated, 2 ems to the left; and</text></subparagraph> <subparagraph id="id4F85EADBB0E5458A826C7B7DCA6DC0A1"><enum>(H)</enum><text>in paragraph (3), as so redesignated, by redesignating clauses (i) and (ii) as subparagraphs (A) and (B), respectively, and moving such subparagraphs, as so redesignated, 2 ems to the left; </text></subparagraph></paragraph>
<paragraph id="id1BDD469F729B40279C58FBC47BD7CDFD"><enum>(2)</enum><text>by striking subsection (b) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id6A08642834034099A0EA10BBE077A18E"> <subsection commented="no" display-inline="no-display-inline" id="P0F67B80E4A0A9D0C0EC63CB66B2DC9F"><enum>(b)</enum><header display-inline="yes-display-inline">Grants to coastal States</header> <paragraph commented="no" display-inline="no-display-inline" id="P6BE388F94EE1A46B0AFB7B92D5C3F88"><enum>(1)</enum><header>In general</header><text>The Administrator shall award grants to coastal States as follows:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id8DB3B4973A304AD39DDD114DB6DA7090"><enum>(A)</enum><text>Seventy percent of available amounts shall be allocated equally among coastal States.</text></subparagraph> <subparagraph id="idf74f64c9e0ab478198069885e6b1a799"><enum>(B)</enum><text>Fifteen percent of available amounts shall be allocated on the basis of the ratio of tidal shoreline in a coastal State to the tidal shoreline of all coastal States. </text></subparagraph>
<subparagraph id="id3c63a724f6c2417fb2863adaf8e485b3"><enum>(C)</enum><text>Fifteen percent of available amounts shall be allocated on the basis of the ratio of population density of the coastal counties of a coastal State to the average population density of all coastal counties based on the most recent data available from the Bureau of the Census. </text></subparagraph></paragraph> <paragraph id="idc14ae46fd8f9477d93181cdf8ebcf714"><enum>(2)</enum><header>Maximum allocation to States</header><text>Notwithstanding paragraph (1), not more than 5 percent of the total funds distributed under this subsection may be allocated to any single coastal State. Any amount exceeding that limitation shall be redistributed equally among the remaining coastal States.</text></paragraph>
<paragraph id="idFD5F0AC7476647C2901DCA083867921F"><enum>(3)</enum><header>Optional matching funds</header><text>Each entity seeking to receive a grant under this subsection is encouraged, but not required, to demonstrate that funds of any amount are available from non-Federal sources to supplement the amount of the grant.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="idD6DF26CA8BE145148705E4C41C08A709"><enum>(3)</enum><text>in subsection (c)—</text>
<subparagraph id="id76BC847184D7498F9A5EC81D45A0B1A6"><enum>(A)</enum><text>in paragraph (1), by striking <quote>The Administrator and the Foundation</quote> and inserting <quote>The Foundation, in consultation with the Administrator,</quote>; and</text></subparagraph> <subparagraph id="idB3C922723DBA49F9A4714AE31926F7D5"><enum>(B)</enum><text>by adding at the end the following: </text>
<quoted-block style="OLC" id="idE667BF432A5243FEA61B06595956DEA6" act-name="">
<paragraph id="id08354D00AC5844ADAB5C54A48F0C5492"><enum>(3)</enum><header>Exclusion of funds from limitation</header><text>The amount of a grant awarded under this subsection shall not count toward the limitation under subsection (b)(2) on funding to coastal States through grants awarded under subsection (b). </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="id0FE310AAB8FC4936B503222EA49BAA4A"><enum>(e)</enum><header>Annual report on operation of the National Oceans and Coastal Security Fund</header><text display-inline="yes-display-inline">Section 907(a) of the National Oceans and Coastal Security Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7506">16 U.S.C. 7506(a)</external-xref>) is amended by striking <quote>Subject to</quote> and all that follows through <quote>the Foundation</quote> and inserting the following: <quote>Not later than 60 days after the end of each fiscal year, the Administrator and the Foundation</quote>.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="idD5B178D01DDE445A9DD90B9BFA241D9D"><enum>(f)</enum><header>Repeal of authorization of appropriations for fiscal years 2017, 2018, and 2019</header><text display-inline="yes-display-inline">Section 908 of the National Oceans and Coastal Security Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7507">16 U.S.C. 7507</external-xref>) is repealed. </text></subsection> <subsection id="idb4debec2466544babc57e6445d70301a"><enum>(g)</enum><header>Parity in offshore wind revenue sharing</header><text display-inline="yes-display-inline">Section 8(p)(2) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)(2)</external-xref>) is amended—</text>
<paragraph id="idb6efc4a3a7814333aff63dea2c954ad3"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>(A) The Secretary</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id639c2efe2068413aa9250b62577cb158"> <subparagraph id="iddeeb8b00d6ba4f37b2cd0c3aaac590c6"><enum>(A)</enum><header>In general</header><text>Subject to subparagraphs (B) and (C), the Secretary</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph id="id60ffb548239b42089207b80460619e41"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>(B) The Secretary</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id977ee463ceca4bc3a2cbf2ca94ddc8c9"> <subparagraph id="id8f5fa119ab4c482e93a6b12b02036fd5"><enum>(B)</enum><header>Disposition of revenues for projects located within 3 nautical miles seaward of State submerged land</header><text>The Secretary</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="id7e4a8659855646b6a169439fcec4d999"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="ide48f7b7bbaff40efaa48a33d39ecbadd"> <subparagraph id="ide817e41c4f7849a49666777a096e3ac7"><enum>(C)</enum><header>Disposition of revenues for offshore wind projects in certain areas</header> <clause id="id9d663379957c4cfabc568bb3e6508a6b"><enum>(i)</enum><header>Definitions</header><text>In this subparagraph:</text>
<subclause id="idc150f9447b4e4e8eb73426b2e932eb64"><enum>(I)</enum><header>Covered offshore wind project</header><text>The term <term>covered offshore wind project</term> means a wind-powered electric generation project in a wind energy area on the outer Continental Shelf that is not wholly or partially located within an area subject to subparagraph (B).</text></subclause> <subclause id="idcf373f47641b4291aac883bfcb7617cb"><enum>(II)</enum><header>Eligible state</header><text>The term <term>eligible State</term> means a State a point on the coastline of which is located within 75 miles of the geographic center of the covered offshore wind project.</text></subclause></clause>
<clause id="id6d7a00a60a144e8b937bddb4eed78abe"><enum>(ii)</enum><header>Requirement</header>
<subclause id="id940e2c622733406896a467087d2db99a"><enum>(I)</enum><header>In general</header><text>Of the operating fees, rentals, bonuses, royalties, and other payments that are paid to the Secretary under subparagraph (A) from covered offshore wind projects—</text> <item id="idf820ef7a4f6e4dac943c72be941d7e0c"><enum>(aa)</enum><text>12.5 percent shall be deposited in the Treasury and credited to miscellaneous receipts;</text></item>
<item id="id176cc41b3c8a49659fe9f07fe8f181e1"><enum>(bb)</enum><text>37.5 percent shall be deposited in the National Oceans and Coastal Security Fund established under section 904(a) of the National Oceans and Coastal Security Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7503">16 U.S.C. 7503(a)</external-xref>); and</text></item> <item id="idead55b8c1e0b4089b9599336b54a9642"><enum>(cc)</enum><text>50 percent shall be deposited in a special account in the Treasury, from which the Secretary, subject to subclause (II), shall disburse to each eligible State an amount (based on a formula established by the Secretary of the Interior by rulemaking not later than 180 days after the date of enactment of the <short-title>Reinvesting In Shoreline Economies and Ecosystems Act of 2021</short-title>) that is inversely proportional to the respective distances between—</text>
<subitem id="idfa4c5ac8b57545b6bc58b50b1ad2d349"><enum>(AA)</enum><text>the point on the coastline of each eligible State that is closest to the geographic center of the applicable leased tract; and</text></subitem> <subitem id="id52b607c42129460083fcd0b1ed76fc95"><enum>(BB)</enum><text>the geographic center of the leased tract.</text></subitem></item></subclause>
<subclause id="id06257b92674d472d8f8e7ab58334300c"><enum>(II)</enum><header>Minimum allocation</header><text>The amount allocated to an eligible State each fiscal year under item (cc) of subclause (I) shall be at least 10 percent of the amounts available under that item.</text></subclause></clause> <clause id="id18840ecfa42b4abc9f8cb2beb80ca054"><enum>(iii)</enum><header>Timing</header><text>The amounts required to be deposited under item (cc) of clause (ii)(I) for the applicable fiscal year shall be made available in accordance with that item during the fiscal year immediately following the applicable fiscal year.</text></clause>
<clause id="iddecf378736934b0e986d5f058b072212"><enum>(iv)</enum><header>Authorized uses</header>
<subclause id="id9ae28c32f9ed4859b12e566361ef1d9a"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II), each State shall use all amounts received under clause (ii)(I)(cc) in accordance with all applicable Federal and State laws, only for 1 or more of the following purposes:</text> <item id="idd1f3de93e078410ba302451dd6165290"><enum>(aa)</enum><text>Projects and activities for the purposes of coastal protection, including conservation, coastal restoration, hurricane protection, and infrastructure directly affected by coastal wetland losses.</text></item>
<item id="id3809a7c5bcbb412e98847798e7f029b3"><enum>(bb)</enum><text>Mitigation of damage to fish, wildlife, or natural resources, including through fisheries science and research.</text></item> <item id="id5c5ff066637e4a9e8a6bb4f21297a4b6"><enum>(cc)</enum><text>Implementation of a federally approved marine, coastal, or comprehensive conservation management plan.</text></item>
<item id="id2dc7e608e7a249a895d0e146fef3323d"><enum>(dd)</enum><text>Mitigation of the impact of outer Continental Shelf activities through the funding of onshore infrastructure projects.</text></item> <item id="id4ed21c500d6947209400d7cfbc088f93"><enum>(ee)</enum><text>Planning assistance and the administrative costs of complying with this section.</text></item></subclause>
<subclause id="idff29a062b3fa4f1a8560f0d759db0f72"><enum>(II)</enum><header>Limitation</header><text>Of the amounts received by a State under clause (ii)(I)(cc), not more than 3 percent shall be used for the purposes described in subclause (I)(ee).</text></subclause></clause> <clause id="id2bdf432ab0b847ea9b25252eade4f8ae"><enum>(v)</enum><header>Administration</header><text>Subject to clause (vi)(III), amounts made available under clause (ii)(I) shall—</text>
<subclause id="id89f5d12aa537426b93fee5af16df69d1"><enum>(I)</enum><text>be made available, without further appropriation, in accordance with this paragraph;</text></subclause> <subclause id="id54b0516380514f80a5ade75778b34f7a"><enum>(II)</enum><text>remain available until expended; and</text></subclause>
<subclause id="id645c050ae2d648cd8258ec7dc73eef1a"><enum>(III)</enum><text>be in addition to any amount appropriated under any other Act.</text></subclause></clause> <clause id="id5e870b4bd1c3455589439b1d7c9fd3ea"><enum>(vi)</enum><header>Reporting requirement</header> <subclause id="ide709cefdd8b3425bb66e7ba515c3c152"><enum>(I)</enum><header>In general</header><text>Not later than 180 days after the end of each fiscal year, the Governor of each eligible State that receives amounts under clause (ii)(I)(cc) for the applicable fiscal year shall submit to the Secretary a report that describes the use of the amounts by the eligible State during the period covered by the report.</text></subclause>
<subclause id="id8e0dff1819bd4dc582b73c7229197c99"><enum>(II)</enum><header>Public availability</header><text>On receipt of a report under subclause (I), the Secretary shall make the report available to the public on the website of the Department of the Interior.</text></subclause> <subclause id="idf095c66985d2448780bb8ce08e37c196"><enum>(III)</enum><header>Limitation</header><text>If the Governor of an eligible State that receives amounts under clause (ii)(I)(cc) for the applicable fiscal year fails to submit the report required under subclause (I) by the deadline specified in that subclause, any amounts that would otherwise be provided to the eligible State under clause (ii)(I)(cc) for the succeeding fiscal year shall be deposited in the National Oceans and Coastal Security Fund established under section 904(a) of the National Oceans and Coastal Security Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7503">16 U.S.C. 7503(a)</external-xref>).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="idd770e1517965410c8523635c1b39867a"><enum>(h)</enum><header>Exemption of certain payments from sequestration</header>
<paragraph id="idc0572f225aae463a83b17bd2c8d2acc7"><enum>(1)</enum><header>In general</header><text>Section 255(g)(1)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/905">2 U.S.C. 905(g)(1)(A)</external-xref>) is amended by inserting after <quote>Payments to Social Security Trust Funds (28–0404–0–1–651).</quote> the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idAEFE12A76CC04D0FBD519D5FC711BADF"><list level="subparagraph"><list-item>Payments to States pursuant to subparagraph (C)(ii)(I)(cc) of section 8(p)(2) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)(2)</external-xref>).</list-item></list><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="id39204e27d01941028e598fa2de7bb182" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Applicability</header><text>The amendment made by this subsection shall apply to any sequestration order issued under the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900 et seq.</external-xref>) on or after the date of enactment of this Act. </text></paragraph></subsection></section>
<section section-type="subsequent-section" id="id2EF965A2AFB44D95A27D3D61E05B1A32"><enum>3.</enum><header>Gulf of Mexico outer Continental Shelf revenues</header>
<subsection id="idDA5394FEB1064EA48FB23F6F7B69699E"><enum>(a)</enum><header>Definition of qualified outer Continental Shelf revenues</header><text display-inline="yes-display-inline">Section 102(9)(A) of the Gulf of Mexico Energy Security Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/432">Public Law 109–432</external-xref>) is amended—</text> <paragraph id="id406120AB8FDC45DE87E631F86C698AC4"><enum>(1)</enum><text>in clause (i)(II), by striking <quote>and</quote> after the semicolon; and</text></paragraph>
<paragraph id="id752BAC20F1E94D72A514811707223D02"><enum>(2)</enum><text>by striking clause (ii) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id78E45B564356445C95BC132644DBB104"> <clause id="idD8699BB26DEE4F3495D4D8EE4DE0CE4D"><enum>(ii)</enum><text>with respect to amounts disbursed under subparagraphs (A) and (B) of section 105(a)(2)—</text>

<item id="id19d0204918994f0e8bfbfa40bef1e17b"><enum>(bb)</enum><text>the 181 South Area; and</text></item> <item id="id9606be618b4c4b08aba178b48cc761a3"><enum>(cc)</enum><text>the 2002–2007 planning area; and</text></item></subclause>
<subclause id="id7c0f5ecfbbc64285b57cd814b95b234d"><enum>(II)</enum><text>in the case of fiscal year 2022 and each fiscal year thereafter, all rentals, royalties, bonus bids, and other sums due and payable to the United States received on or after October 1, 2021, from leases entered into on or after October 1, 2000, for—</text> <item id="idd5bc70844af441a6861bfb1ae7d039d9"><enum>(aa)</enum><text>the 181 Area;</text></item>
<item id="idaddfa2a220f84f03994d58c26eac5065"><enum>(bb)</enum><text>the 181 South Area; and</text></item> <item id="id8f93e42d5a304ffd86ab9d80825d87dd" commented="no" display-inline="no-display-inline"><enum>(cc)</enum><text>the 2002–2007 planning area; and</text></item></subclause></clause>
<clause display-inline="no-display-inline" commented="no" id="id3B53C60AFF5A43409BB5EF7C314C7236"><enum>(iii)</enum><text>with respect to amounts disbursed under section 105(a)(2)(C), in the case of fiscal year 2017 and each fiscal year thereafter, all rentals, royalties, bonus bids, and other sums due and payable to the United States received on or after October 1, 2016, from leases entered into on or after December 20, 2006, for—</text> <subclause id="id36219c2ba64c4c9fb127c77b90edc2db"><enum>(I)</enum><text>the 181 Area;</text></subclause>

<subsection id="id8F4C0A2BF7F24BD2A57329EB27F69B2F"><enum>(b)</enum><header>Disposition of qualified outer Continental Shelf revenues</header>
