<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2127</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210617">June 17, 2021</action-date><action-desc><sponsor name-id="S306">Mr. Menendez</sponsor> (for himself, <cosponsor name-id="S390">Mr. Van Hollen</cosponsor>, and <cosponsor name-id="S309">Mr. Casey</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBU00">Committee on the Budget</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 31, United States Code, to require that Federal children’s programs be separately displayed and analyzed in the President’s budget, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC9673717B99040EE9EDF624D1BCD4060"><section section-type="section-one" id="H35DD806D96E3421BA71C33EBF5BA90D0"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Children's Budget Act</short-title></quote>.</text></section><section id="H862FF9974BF74636995CB1098025F66C"><enum>2.</enum><header>Amendment to
 title 31</header><text display-inline="no-display-inline">Section 1105(a) of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H45B19AFA6C4C49B1A169F984B2E7BCF6"><paragraph id="H5731934FC30047C2BBE3443DBE629C1F"><enum>(40)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H5FE5584EF5DE40CAA0CE785B12CC1B34"><enum>(A)</enum><text>A detailed, separate analysis for the prior fiscal year, the current fiscal year, the fiscal year for which the budget is submitted, and the ensuing fiscal year identifying—</text><clause id="idF047C05C2E7C4ABFB2A396BA22334A3C" indent="up1"><enum>(i)</enum><text>the amounts of gross and net appropriations or obligational authority and outlays that are directed to children within the United States and territories including—</text><subclause id="H3DF53D6661A847899E1A6C85427BA367"><enum>(I)</enum><text>summaries of the total amount of such appropriations or new obligational authority and outlays requested for children and children’s programs;</text></subclause><subclause id="H53ECED743C434493A2AB9542ED91131E"><enum>(II)</enum><text>an estimate of levels of spending on children and children’s programs; and</text></subclause><subclause id="H12F5475A59AA4459BF8ECBA65D879550"><enum>(III)</enum><text>a detailed breakdown of spending on children and children’s programs by agency and initiative; and</text></subclause></clause><clause indent="up1" id="id196700867481427B8976338C85E1110B"><enum>(ii)</enum><text>the amount of tax expenditures relating to children.</text></clause></subparagraph><subparagraph id="H62A2EB045E3A4CA3998438A409B122E4" indent="up1"><enum>(B)</enum><text>In this paragraph—</text><clause id="idE183E8F5123F4240AEF9E9FCB01D1758"><enum>(i)</enum><text>the term <quote>children</quote> means individuals under 19 years of age;</text></clause><clause id="idBB58E62484AA460EA47F659535C7B3EA"><enum>(ii)</enum><text>the term <quote>spending on children</quote> includes—</text><subclause id="H7C6EFD87ABF44540A90DA83A5556B7AB"><enum>(I)</enum><text>Federal entitlement spending that goes directly to children;</text></subclause><subclause id="HEDB86E31E1214155AD4478F80F494976"><enum>(II)</enum><text>outlays for programs and initiatives that, consistent with their mission, deliver services exclusively to children;</text></subclause><subclause id="H7AF01068F13647AB933B8901EDA3713D"><enum>(III)</enum><text>outlays for programs and initiatives that, while not serving children directly, have as a core mission goal the improvement of children’s health, education, welfare, or general well-being; and</text></subclause><subclause id="H13B68DBAC49D41BDBB9D53BB6CE6CEA3"><enum>(IV)</enum><text>the share of funding for Federal programs and initiatives that deliver services to both children and adults that is consistent with the share of program benefits for children based on the best available data; and</text></subclause></clause><clause id="id2EE6519802D24AA9B71966CECA3BF415"><enum>(iii)</enum><text>the term <term>tax expenditures</term> has the meaning given that term in section 3 of the Congressional Budget and Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/622">2 U.S.C. 622</external-xref>).</text></clause></subparagraph><subparagraph id="H1E040FC5806F4BFC913BA66BD3A1D63C" indent="up1"><enum>(C)</enum><text>In implementing this paragraph, including determining what Federal activities or accounts constitutes spending on children or children’s programs and tax expenditures relating to children, the Office of Management and Budget shall consult periodically with the Committee on the Budget and the Committee on Appropriations of the Senate, the Committee on the Budget and the Committee on Appropriations of the House of Representatives, and the Congressional Budget Office.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
