which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To develop best practice guidelines for the use of dogs in Federal courts, and for other purposes. </official-title></form><legis-body><section section-type="section-one" id="id3C61555B1F7C4F1D95E24A9604C599F9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Courtroom Dogs Act</short-title></quote>.</text></section><section id="id35771d32a25640dab080ec9ce816fe7a"><enum>2.</enum><header>Best practice guidelines for the use of dogs in Federal courts</header><subsection id="id83d506e457c64a29af4b539b670383c2"><enum>(a)</enum><header>Definition of qualified training organization</header><text>In this section, the term <term>qualified training organization</term> means an organization that—</text><paragraph id="id18032d310eee4c178ca5a7fda7b146c0"><enum>(1)</enum><text>meets the requirements of <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986;</text></paragraph><paragraph id="id24511c0d950c49b297bf1112b2e204b1"><enum>(2)</enum><text>is exempt from taxation under section 501(a) of such Code; and</text></paragraph><paragraph id="id99cefd57e769412a886b8dad8c3d6012"><enum>(3)</enum><text>includes staff members with knowledge about—</text><subparagraph id="id1A59ED17A2E24DB39B6F3771B55EC21D"><enum>(A)</enum><text>the criminal justice system; and</text></subparagraph><subparagraph id="id8B6A278A9CAF464280DAEA78EAE9A475"><enum>(B)</enum><text>the breeding, training, and placement of facility dog teams that have graduated from a qualified assistance dog organization.</text></subparagraph></paragraph></subsection><subsection id="id5090a805e3ee4a9892af3f9db270019a"><enum>(b)</enum><header>Best practice guidelines</header><text>Not later than 18 months after the date of enactment of this Act, the Attorney General shall develop and publish best practices for the use of dogs to provide support for defendants, complainants, and witnesses in Federal courtrooms and grand jury rooms, which shall include guidelines for—</text><paragraph id="id96a3e7bf636540e6b4d5dd465233386c"><enum>(1)</enum><text>avoiding prejudice;</text></paragraph><paragraph id="id3055e46887e94b06818198fab2880638"><enum>(2)</enum><text>addressing whether and when dog handlers should be required, and what training, credentials, or experience should be required;</text></paragraph><paragraph id="id1945d24c27d9420b985c5e50ef00baf8"><enum>(3)</enum><text>stating what experience, training, or certification should be required for the dogs;</text></paragraph><paragraph id="id6cd03734f7544065b2648c9b94fb0a34"><enum>(4)</enum><text>addressing liability concerns; and</text></paragraph><paragraph id="id197859c71b48483ebe35af4c8301e593"><enum>(5)</enum><text>ensuring the dog or handler will not unduly interfere with the management of the case or any other court operations.</text></paragraph></subsection><subsection id="id438a740d99cd4264ad0f381bb4fe085b"><enum>(c)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out subsection (b), the Attorney General may consult with the judiciary branch, Federal, State, and local law enforcement agencies and prosecutors, defense-side professionals, and experts in the field, including a qualified training organization.</text></subsection><subsection id="id8b6d590969054cd69fdd94215abd825e"><enum>(d)</enum><header>Guidelines</header><text display-inline="yes-display-inline">Not later than 60 days after the date on which the best practice guidelines required under subsection (b) are published, the Attorney General shall issue guidance informing all United States attorneys of the best practice guidelines and recommending the implementation of the guidelines.</text></subsection><subsection id="id7a1c9bcd57e0403ab9d3436f935ad58c"><enum>(e)</enum><header>Rules of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to prevent a court of the United States from—</text><paragraph id="id43fcaf6980e942d188643487d257326d"><enum>(1)</enum><text>providing any other accommodation to a witness or other person in accordance with applicable law; or</text></paragraph><paragraph id="id48a75b9b52624955b96295eb0e07c637"><enum>(2)</enum><text>retaining control of the courtroom.</text></paragraph></subsection></section></legis-body></bill>
