<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2111</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210617">June 17, 2021</action-date><action-desc><sponsor name-id="S389">Mr. Kennedy</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to provide for the waiver of certain telehealth requirements to permit reimbursement for audio-only telehealth services under the Medicare program during emergency declarations.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Audio-Only Telehealth for Emergencies Act</short-title></quote>.</text></section><section id="id51347f2e29d140929ab841875ddd0f2d"><enum>2.</enum><header>Waiver of certain telehealth requirements to permit reimbursement for audio-only telehealth services under the Medicare program during emergency declarations</header><text display-inline="no-display-inline">Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) is amended—</text><paragraph id="id733906C7B8A44DC989A956CE832BC259"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>paragraph (8)</quote> and inserting <quote>paragraphs (8) and (9)</quote>; and</text></paragraph><paragraph id="id052F621E2AA347B18F454521CF5C52FC"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFDB96C6E95154B729B380E32B31D8847"><paragraph id="id8A28456C9E174861B0197176B02BD577"><enum>(9)</enum><header>Reimbursement for audio-only telehealth services during emergency declarations</header><subparagraph id="idC89741A92C9C4E4085A865D203300707"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to telehealth services furnished on or after the date of enactment of this paragraph, the Secretary shall waive the requirements of paragraph (1) and section 410.78(a)(3) of title 42, Code of Federal Regulations (or any successor regulation), relating to the use of interactive telecommunications systems to furnish telehealth services, to the extent such provisions require the use of video technology, to allow for the furnishing of telehealth services using audio-only technology, as determined appropriate by the Secretary, with respect to such services furnished in any geographical area in which, and any period during which, there exists—</text><clause id="idE889CF96B6F6499AB9D05819369A173A"><enum>(i)</enum><text display-inline="yes-display-inline">an emergency or disaster declared by the President pursuant to the National Emergencies Act or the Robert T. Stafford Disaster Relief and Emergency Assistance Act; or</text></clause><clause id="idECF02F846A454E4D86F1E25B6911BC52"><enum>(ii)</enum><text>a public health emergency declared by the Secretary pursuant to section 319 of the Public Health Service Act.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCBF676092C2548158F0AA0827CD1D04A"><enum>(B)</enum><header>Payment parity</header><text display-inline="yes-display-inline">The Secretary shall provide that any telehealth service furnished using audio-only technology pursuant to a waiver under subparagraph (A) is reimbursed at the same rate at which the service would be reimbursed if furnished in person.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
