			 penalties due to
 student default</header><subsection id="id5E990809ECF94706938F8C596AB15AF4"><enum>(a)</enum><header>Higher Education Act of 1965 loans</header><text display-inline="yes-display-inline">Part B of title I of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011">20 U.S.C. 1011</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8356DF084A8444CC8A5D17D57E58275F"><section id="id57934F6C1F884471B914A85247EFF7B7"><enum>124.</enum><header>Prohibition against suspension, revocation, or denial of State-issued professional licenses or
			 penalties due to
 student default</header><subsection id="id094756EF83454F94876FB8DD84150F45"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Beginning 2 years after the date of enactment of the Protecting Job Opportunities for Borrowers Act, a State that receives assistance under this Act may not suspend, revoke, or deny the approval or renewal of a State-issued license described in subsection (b) or issue a fine or other penalty with respect to an individual based solely on such individual's default or delinquency on a loan made, insured, or guaranteed under title IV.</text></subsection><subsection id="idEDB0E3C682EA4E28B3BE3AD5AA54A17F"><enum>(b)</enum><header>Types of licenses</header><text>A State-issued license described in this subsection means any of the following:</text><paragraph id="idF88680CA12AC46B384925054E640379E"><enum>(1)</enum><text>A State-issued driver's license (including any State-issued document permitting a specific individual to operate one or more types of motorized vehicles, such as a motorcycle, car, truck, or bus on a public road).</text></paragraph><paragraph id="idC4747996313547FEB9CE04F795696E95"><enum>(2)</enum><text>A State-issued teaching license.</text></paragraph><paragraph id="id811BB3239A3E4443A69F57644667F270"><enum>(3)</enum><text>A State-issued professional license involved in or affecting interstate commerce (including any license, permit, certificate, registration, charter, authority or similar form of permission required for lawful employment in a particular career field).</text></paragraph></subsection><subsection id="idE3A5A5B99A1647619DB9C47AD2D3816C"><enum>(c)</enum><header>Injunctive relief</header><text>Any individual aggrieved as a result of a violation of subsection (a) may bring a civil action in an appropriate district court of the United States to obtain prospective injunctive relief against an individual State officer in the officer's official capacity.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idA117C6CC480C41E3932730D8818CAF2C"><enum>(b)</enum><header>Health education loans</header><paragraph id="id7DCCABD094564D4CA0E72320984083D1"><enum>(1)</enum><header>In general</header><text>A State may not suspend, revoke, or deny the approval or renewal of a State-issued license described in section 124(b) of the Higher Education Act of 1965 or issue a fine or other penalty with respect to an individual based solely on such individual's default or delinquency on a Health Education Assistance Loan or Primary Care Loan made under part A of title VII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/292">42 U.S.C. 292</external-xref> et seq.).</text></paragraph><paragraph id="id4D395D8E8BDB4C6CB0C57D87D811459C"><enum>(2)</enum><header>Injunctive relief</header><text>Any individual aggrieved as a result of a violation of paragraph (1) may bring a civil action in an appropriate district court of the United States to obtain prospective injunctive relief against an individual State officer in the officer's official capacity.</text></paragraph></subsection></section></legis-body></bill>
