which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title II of the Social Security Act to eliminate work disincentives for childhood disability beneficiaries.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H84DEEDAADE4543E9850BFAD367CF2D69"><section section-type="section-one" id="H67981AD823C246B5A1D8C9F7ADD380A6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Work Without Worry Act</short-title></quote>.</text></section><section id="H069254B6BB494473ACCF47147864E83C"><enum>2.</enum><header>Elimination of work disincentive for childhood disability beneficiaries</header><subsection id="id8EB27EB3681243D3A74DAD076013169D"><enum>(a)</enum><header>In general</header><text>Section 202(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(d)</external-xref>) is amended—</text><paragraph id="HA4D743909D1F435C8AEF4C83C08D2F87"><enum>(1)</enum><text>in paragraph (1)(B)(ii), by striking <quote>is under a disability (as defined in section 223(d)) which began before he attained the age of 22, and</quote> and inserting the following: “is under a disability (as defined in section 223(d)), and—</text><quoted-block style="other" other-style="archaic" act-name="" id="HB8900850A9AD40E6BAD166DEDE413C84"><subclause id="H04859AFA5C0F47418F86346780A3AF56"><enum>(I)</enum><text display-inline="yes-display-inline">the physical or mental impairment (or combination of impairments) that is the basis for the finding of disability began before the child attained the age of 22 (or is of such a type that can reasonably be presumed to have begun before the child attained the age of 22, as determined by the Commissioner), and</text></subclause><subclause id="H7AADA7CE887749DD9AC47D4C7BA01406"><enum>(II)</enum><text>the impairment or combination of impairments could have been the basis for a finding of disability (without regard to whether the child was actually engaged in substantial gainful activity) before the child attained age 22, and</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H1AD68FB4B9C74C2091A6A8C3CE6DC8FE"><enum>(2)</enum><text>by adding at the end the following new paragraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD6CA859264D245E3AB8E9B490DBBEFFD"><paragraph id="H92136201C1F84796BDF5C8CF4B6A9FD6"><enum>(11)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HC738D435E2B1488985F0BFBBC8DC7296"><enum>(A)</enum><text display-inline="yes-display-inline">In the case of a child described in subparagraph (B)(ii) of paragraph (1) who—</text><clause id="HE291D5EEC8AE4AFE9CABEE74A3D003A2" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">has not attained early retirement age (as defined in section 216(l)(2));</text></clause><clause id="HE06F274D6DFC45E29F41AA05DF5CA387" indent="up1"><enum>(ii)</enum><text>has filed an application for child's insurance benefits; and</text></clause><clause id="HF96044C2543F49868BFE7B0E728DEFA4" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">is insured for disability benefits (as determined under section 223(c)(1)) at the time of such filing;</text></clause><continuation-text continuation-text-level="subparagraph" indent="paragraph">such application shall be deemed to be an application for both child's insurance benefits under this subsection and disability insurance benefits under section 223.</continuation-text></subparagraph><subparagraph id="H6266379559B44114A2BBA0C1AEA095CC" indent="up1"><enum>(B)</enum><text>In the case of a child described in subparagraph (B)(ii) of paragraph (1) who—</text><clause id="H1BCE960AD2AD406890DEB48C0A487FF2"><enum>(i)</enum><text>has attained early retirement age (as defined in section 216(l)(2));</text></clause><clause id="H6843276A827F451B98DA30EC4AE38FAD"><enum>(ii)</enum><text display-inline="yes-display-inline">has filed an application for child's insurance benefits; and</text></clause><clause id="H1DF3CCA358974965B6BD82F80E62C21A"><enum>(iii)</enum><text display-inline="yes-display-inline">is a fully insured individual (as defined in section 214(a)) at the time of such filing;</text></clause><continuation-text continuation-text-level="subparagraph" indent="paragraph">such application shall be deemed to be an application for both child's insurance benefits under this subsection and old-age insurance benefits under section 202(a).</continuation-text></subparagraph><subparagraph id="HCED43C51E65E4CEE8C525B7807FB6D4D" indent="up1"><enum>(C)</enum><text>Notwithstanding paragraph (1), in the case of a child described in subparagraph (A) or (B), if, at the time of filing an application for child's insurance benefits, the amount of the monthly old-age or disability insurance benefit to which the child would be entitled is greater than the amount of the monthly child's insurance benefit to which the child would be entitled, the child shall not be entitled to a child's insurance benefit based on such application.</text></subparagraph><subparagraph indent="up1" id="id8F4C8B1E321B4CE18060DDCB3945077D"><enum>(D)</enum><text>For purposes of subparagraph (C), the amount of the monthly old-age or disability benefit to which the child would be entitled shall be determined—</text><clause id="idA6F00D4AA25D45E78656A3DACDC75426"><enum>(i)</enum><text>without regard to the primary insurance amount calculation described section 215(a)(7); and</text></clause><clause id="idDC1E333339774F8FBA8D4CE94D898B0C"><enum>(ii)</enum><text>before application of section 224.</text></clause></subparagraph></paragraph><paragraph id="H2EB7BB13873D45C3821B9F09921D7ECF"><enum>(12)</enum><text>For purposes of paragraph (1)(B)(ii), a child shall not be required to be continuously under a disability during the period between the date that the disability began and the date that the application for child’s insurance benefits is filed.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="id7DFEDD0268434C3EB60E7CEB0A0BD1EB"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to applications filed on or after the date that is 24 months after the date of the enactment of this section. </text></subsection></section></legis-body></bill>
