which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prevent a person who has been convicted of a misdemeanor hate crime, or received an enhanced sentence for a misdemeanor because of hate or bias in its commission, from obtaining a firearm.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7247F42B05AA490D991C7F5AE8052A27"><section section-type="section-one" id="HC6FC5BCDBD5044AD96CEF17A364D9684"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disarm Hate Act</short-title></quote>.</text></section><section id="HD32A4DDC1AE34062AB4CE69DD1DD21E2"><enum>2.</enum><header>Prevention of person who has been convicted of a misdemeanor hate crime, or received an enhanced sentence for a misdemeanor because of hate or bias in its commission, from obtaining a firearm</header><subsection id="H434FD84E8CEF4EB9AA6F8E9385B18053"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 921(a) of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0ADF6494686C4B9A9EDB716BA6925A5F"><paragraph id="H428E9D20973A47DBBDDE7B853FA6691B" indent="up1"><enum>(36)</enum><text display-inline="yes-display-inline">The term <term>convicted in any court of a misdemeanor hate crime</term>—</text><subparagraph id="id8AA85E5F988943178303776F37680C09"><enum>(A)</enum><text display-inline="yes-display-inline">means being convicted by a court of an offense that—</text><clause id="HDDA91FD85DE64D39957EBA322121E446"><enum>(i)</enum><text>is a misdemeanor under Federal, State, or tribal law;</text></clause><clause id="HF6771BE20EDC495B97939484C62C156D"><enum>(ii)</enum><text display-inline="yes-display-inline">has, as an element, that the conduct of the offender was motivated by hate or bias because of the actual or perceived race, color, religion, national origin, gender, sexual orientation, gender identity (as defined in section 249), or disability of any person; and</text></clause><clause id="id664c9bdb0b2741eb854437aa9bec6db2"><enum>(iii)</enum><text>involves the use or attempted use of physical force, the threatened use of a deadly weapon, or other credible threat to the physical safety of any person; and</text></clause></subparagraph><subparagraph id="id20B5A81FC8E34E80BC961276B0630C89"><enum>(B)</enum><text>does not include—</text><clause id="id00476A099F7C456BB4C3EA0B97573D5D"><enum>(i)</enum><text>a conviction of an offense described in subparagraph (A), unless—</text><subclause id="idB7A4921B38BE480684729EC37862A642"><enum>(I)</enum><text>the person—</text><item id="idEC5E2BB0676845C491821AF07F227BCB"><enum>(aa)</enum><text>was represented by counsel in the case; or</text></item><item id="id6ABCDBDC64064563B5C1D67F649F7472"><enum>(bb)</enum><text>knowingly and intelligently waived the right to counsel in the case; and</text></item></subclause><subclause id="idB983FC8827484C6489318555C5CDD1DA"><enum>(II)</enum><text>in the case of a prosecution for an offense described in subparagraph (A) for which a person was entitled to a jury trial in the jurisdiction in which the case was tried—</text><item id="id9C0AF1241C84433ABFB330C899B609B0"><enum>(aa)</enum><text>the case was tried by a jury; or</text></item><item id="id7a3b14934a8146a496fc906128d227ba"><enum>(bb)</enum><text>the person knowingly and intelligently waived the right to have the case tried by a jury, by guilty plea or otherwise; or</text></item></subclause></clause><clause id="ida7144aee846446bc8d10e47f31462182"><enum>(ii)</enum><text>a conviction of an offense described in subparagraph (A) if—</text><subclause id="id9BDBA9F6A3364DE0AEB192B5F887D2E0"><enum>(I)</enum><text>the conviction—</text><item id="idACAA223A02444F09B603AC762564A5BF"><enum>(aa)</enum><text>has been expunged or set aside; or</text></item><item id="idE8F346A9732E4C339B570F36AE3A8054"><enum>(bb)</enum><text>is an offense for which the person has been pardoned or has had civil rights restored (if the law of the applicable jurisdiction provides for the loss of civil rights under such an offense); and</text></item></subclause><subclause id="id49020CBF6DCA40C6A032CFFEEC2D6EE9"><enum>(II)</enum><text>the pardon, expungement, or restoration of civil rights does not expressly provide that the person may not ship, transport, possess, or receive firearms.</text></subclause></clause></subparagraph></paragraph><paragraph id="H7BEBD96DAC254C2F8C79DD29AF4EF3B0" indent="up1"><enum>(37)</enum><text display-inline="yes-display-inline">The term <term>received from any court an enhanced hate crime misdemeanor sentence</term>—</text><subparagraph id="idB68237DC09C04708BEF85917E2594FF8"><enum>(A)</enum><text display-inline="yes-display-inline">means a court has imposed a sentence for a misdemeanor under Federal, State, or tribal law—</text><clause id="id8BF09EF50C9F40ECB0BF05237D699B69"><enum>(i)</enum><text display-inline="yes-display-inline">that involves the use or attempted use of physical force, the threatened use of a deadly weapon, or other credible threat to the physical safety of any person; and</text></clause><clause id="idABDDADAD43434B3197689BDA3C8222F3"><enum>(ii)</enum><text display-inline="yes-display-inline">based, in whole or in part, on a judicial finding that the conduct of the offender was motivated, in whole or in part, by hate or bias for any reason referred to in paragraph (36)(A)(ii); and</text></clause></subparagraph><subparagraph id="id457A0D57A0CD457EBFB86E060C8C1F61"><enum>(B)</enum><text display-inline="yes-display-inline">does not include—</text><clause id="id1D3EFC928987445DB1BFEB57E46661A6"><enum>(i)</enum><text>the imposition of a sentence described in subparagraph (A), unless—</text><subclause id="id1D2B78593FDF4FDCA36CE3B9CC0914A3"><enum>(I)</enum><text>the person—</text><item id="id47B107F60F9D47AEADDE064F1ECB0683"><enum>(aa)</enum><text>was represented by counsel in the case; or</text></item><item id="id76EDBF509E5F4ED7A088160832D3E215"><enum>(bb)</enum><text>knowingly and intelligently waived the right to counsel in the case; and</text></item></subclause><subclause id="id2340271863264E86B17E03F901223149"><enum>(II)</enum><text>if the sentence described in subparagraph (A) was imposed in a prosecution for an offense for which a person was entitled to a jury trial in the jurisdiction in which the case was tried—</text><item id="id091CE2DFAD244108BFA3C60CA50CDABE"><enum>(aa)</enum><text>the case was tried by a jury; or</text></item><item id="idF1FFFE1B27C9481D8E3FEFFDA2C61C96"><enum>(bb)</enum><text>the person knowingly and intelligently waived the right to have the case tried by a jury, by guilty plea or otherwise; or</text></item></subclause></clause><clause id="id477E8427EA984EC2AEAF5CB2D36A344A"><enum>(ii)</enum><text>the imposition of a sentence described in subparagraph (A) if—</text><subclause id="idBACFB01156E741EE928FF13C748F0EBA"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="id6024FB0B58EF4530941A780C8B98CFD2"><enum>(aa)</enum><text>the conviction of the offense for which the sentence was imposed has been expunged or set aside; or</text></item><item id="id2ED7A214B16F4CB7B6F1D3318DA38B0A" indent="up1"><enum>(bb)</enum><text>the offense for which the sentence was imposed is an offense for which the person has been pardoned or has had civil rights restored (if the law of the applicable jurisdiction provides for the loss of civil rights under such an offense); and</text></item></subclause><subclause id="id606FD32250154908957B667E395E332E"><enum>(II)</enum><text>the pardon, expungement, or restoration of civil rights does not expressly provide that the person may not ship, transport, possess, or receive firearms.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2A27AF0E831A4E6C9109AC2E5DECA93A"><enum>(b)</enum><header>Prohibition on sale or other disposition of firearm</header><text>Section 922(d) of title 18, United States Code, is amended—</text><paragraph id="HDD7604FD2ACC4E92B169C9F9AA8303FB"><enum>(1)</enum><text>in paragraph (8), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="HC987622783E14F9992E4E948036C4B71"><enum>(2)</enum><text>in paragraph (9), by striking the period and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HE2DCB9562918472EA4E844944E481C99"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (9) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD84AC76959574B61A7A4E4BDB9810330"><paragraph id="HC374A6F56C2C440291DE7C17B180398E"><enum>(10)</enum><text display-inline="yes-display-inline">has been convicted in any court of a misdemeanor hate crime, or has received from any court an enhanced hate crime misdemeanor sentence.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection display-inline="no-display-inline" id="H70A9012C309D49878289DB36E3288DD9"><enum>(c)</enum><header>Prohibition on possession, shipment, or transport of firearm</header><text>Section 922(g) of title 18, United States Code, is amended—</text><paragraph id="H6C0E7D913D1048B2B6DE1DF6C1EAE2DD"><enum>(1)</enum><text>in paragraph (8), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H135812808EE64508B91DF4DB59AE4AD6"><enum>(2)</enum><text>in paragraph (9), by striking the comma and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HCB38B245847F4B3FB189CC53619E8A6E"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (9) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3F3B7B3AF1084C2F82F56DBEF1B71AFE"><paragraph id="H2D5AECA8A8F444448443DEFFCF997862"><enum>(10)</enum><text display-inline="yes-display-inline">who has been convicted in any court of a misdemeanor hate crime, or has received from any court an enhanced hate crime misdemeanor sentence,</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
