Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>), is further amended—</text><paragraph id="HABCF70FABB534A80B6DC729B047AA2AB"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d)(2), by striking <quote>The Secretary may</quote> and inserting <quote>Except as provided in subsection (i), the Secretary may</quote>; and </text></paragraph><paragraph id="H91029597605B4D5589335DE20F8890FA"><enum>(2)</enum><text>by adding at the end the following new subsections: </text><quoted-block style="USC" id="H793CA49D3AD6412A85EB5F0B3CEE1612" act-name="" changed="deleted" reported-display-style="strikethrough" committee-id="SSVA00"><subsection id="H1BC4357F4E20447C891787CCC28BEFD7"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HB7C5780411794504A09908D78693496D"><enum>(1)</enum><text>The Secretary may not establish a condition for a grant under this section that restricts the ability of a State receiving such a grant to inter in a veterans' cemetery owned by that State any individual described in paragraph (2) solely by reason of the ineligibility of such individual for burial in an open national cemetery under the control of the National Cemetery Administration under section 2402(a) of this title. </text></paragraph><paragraph indent="up1" id="HCCB122820C214F48AB2D5619A76EB751"><enum>(2)</enum><text>An individual described in this paragraph is the following: </text><subparagraph id="HBEDFE6049B894152910D305E17EB8F60"><enum>(A)</enum><text>Any member of a reserve component of the Armed Forces whose service was terminated under honorable conditions. </text></subparagraph><subparagraph id="H321470DA274E4E79BF66C8A372647B67"><enum>(B)</enum><text>Any member of the Army National Guard or the Air National Guard whose service was terminated under honorable conditions.</text></subparagraph><subparagraph id="H2AE81A71A7E24167B94E23650B278049"><enum>(C)</enum><text>Any member of the Reserve Officers' Training Corps of the Army, Navy, or Air Force whose death occurs under honorable conditions while a member of the Reserve Officers’ Training Corps of the Army, Navy, or Air Force.</text></subparagraph><subparagraph id="HA1884A5FBF32486C835D43A8A0AFDAD7"><enum>(D)</enum><text>Any spouse of any member described in subparagraphs (A) through (C).</text></subparagraph><subparagraph id="HDACE0A714A344213AE79673AF2DF2CBC"><enum>(E)</enum><text display-inline="yes-display-inline">Any minor child or unmarried adult child (as such terms are defined in section 2402(a) of this title) of any member described in subparagraphs (A) through (C).</text></subparagraph></paragraph></subsection><subsection id="H4E2C0D61035C4203B6BA468A2AA602F5"><enum>(j)</enum><text>The Secretary may not deny an application for a grant under this section solely on the basis that the State receiving such grant may use funds from such grant to expand, improve, operate, or maintain a veterans’ cemetery to allow for the interment of individuals described in subsection (i)(2).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H961BEFCA02444624A5A87DA7EE7C2BCE"><enum>(b)</enum><header>Prohibition on enforcing certain conditions on grants for State veterans' cemeteries</header><text>The Secretary of Veterans Affairs may not enforce a condition on a grant described in subsection (i)(1) of section 2408 of title 38, United States Code, as added by subsection (a), that was established before the date of the enactment of this Act.</text></subsection><subsection id="H7FE7ECCF35E748AA844AFA5B49C7687C"><enum>(c)</enum><header>Plot allowances</header><text display-inline="yes-display-inline">Section 2303(b)(1) of title 38, United States Code, is amended—</text><paragraph id="HF97D193113CC4B88BBC310370DC32354"><enum>(1)</enum><text>by striking <quote>and (ii) members</quote> and inserting <quote>(ii) members</quote>; and</text></paragraph><paragraph id="H8CB20A0DCD9B459BA42402B8E85A94E3"><enum>(2)</enum><text>by striking <quote>other than dishonorable, and</quote> and inserting <quote>other than dishonorable, or (iii) described in section 2408(i)(2) of this title</quote>.</text></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="HA0899E8097A6416EBEA4A49AA07B4ED3" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSVA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Burial Equity for Guards and Reserves Act of 2021</short-title></quote>.</text></section><section id="HB73E01D6FA4B43AB890AE5CF430D2623" changed="added" reported-display-style="italic" committee-id="SSVA00"><enum>2.</enum><header>Prohibitions on restricting interment of certain individuals in certain State veterans' cemeteries</header><subsection id="HFBF4F569E2794045A29C503D6CA974E9"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">Section 2408 of title 38, United States Code, is amended—</text><paragraph id="HE239DAA03FBD4EBBA42284B9C1099F03"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d)(2), by striking <quote>The Secretary may</quote> and inserting <quote>Except as provided in subsection (i), the Secretary may</quote>;</text></paragraph><paragraph id="H3B7EA1D7478C45BCB7E961BFB2E7264B"><enum>(2)</enum><text>by redesignating subsection (i) as subsection (k); and</text></paragraph><paragraph id="HEA7CB7432CBA4F64B47E4B4C0A25F300"><enum>(3)</enum><text>by inserting after subsection (h) the following new subsections: </text><quoted-block id="HA124AB4D880E443C804B142E072FCA27" style="USC" act-name="" changed="added" reported-display-style="italic" committee-id="SSVA00"><subsection id="HFE4336F0F4684871AD9E04700A4E01FC"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H1081A46325F940F08ADDD556C7517FC0"><enum>(1)</enum><text>The Secretary may not establish a condition for a grant under this section that restricts the ability of a State receiving such a grant to inter in a veterans' cemetery owned by that State any individual described in paragraph (2) solely by reason of the ineligibility of such individual for burial in an open national cemetery under the control of the National Cemetery Administration under section 2402(a) of this title. </text></paragraph><paragraph indent="up1" id="H135BC8CF436F4FA1A9751D84743E5576"><enum>(2)</enum><text>An individual described in this paragraph is the following: </text><subparagraph id="H93C62AFC45454549B0530797BF419279"><enum>(A)</enum><text display-inline="yes-display-inline">Any member of a reserve component of the Armed Forces who was discharged or released from service under conditions other than dishonorable or whose death occurs under conditions other than dishonorable while a member of such a reserve component. </text></subparagraph><subparagraph id="H8C365C32EC81421BAA94D733DD629B03"><enum>(B)</enum><text display-inline="yes-display-inline">Any member of the Army National Guard or the Air National Guard who was discharged or released from service under conditions other than dishonorable or whose death occurs under conditions other than dishonorable while a member of the Army National Guard or the Air National Guard.</text></subparagraph><subparagraph id="H659328B131BC4FB186D8C0D32D296CCB"><enum>(C)</enum><text>Any member of the Reserve Officers' Training Corps of the Army, Navy, or Air Force whose death occurs under conditions other than dishonorable while a member of the Reserve Officers’ Training Corps of the Army, Navy, or Air Force.</text></subparagraph><subparagraph id="H414D79E466504BBCBCF9BBFFC0C1D8CE"><enum>(D)</enum><text>Any spouse of any member described in subparagraphs (A) through (C).</text></subparagraph><subparagraph id="H5A2810E328AE4EC0A12F54F46BC13049"><enum>(E)</enum><text display-inline="yes-display-inline">Any minor child or unmarried adult child (as such terms are defined in section 2402(a) of this title) of any member described in subparagraphs (A) through (C).</text></subparagraph></paragraph></subsection><subsection id="H3BCDFF44C3CB449EA359E2CA2E41F757"><enum>(j)</enum><text display-inline="yes-display-inline">The Secretary may not deny an application for a grant under this section solely on the basis that the State receiving such grant may use funds from such grant to expand, improve, operate, or maintain a veterans’ cemetery in which interment of individuals described in subsection (i)(2) is allowed.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA120D36C0FD9458291006D5F1ECAADFE"><enum>(b)</enum><header>Prohibition on enforcing certain conditions on grants for State veterans' cemeteries</header><text>The Secretary of Veterans Affairs may not enforce a condition on a grant described in subsection (i)(1) of section 2408 of title 38, United States Code, as added by subsection (a), that was established before the date of the enactment of this Act.</text></subsection><subsection id="id719EF92820A44B3CA136D514037DCAC9"><enum>(c)</enum><header>Plot allowances</header><text>Section 2303 of title 38, United States Code, is amended—</text><paragraph id="idC3EFCE91F57D43F59B5A0F9B7E6D17E4"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id800081EFDC8B48E7871197014C765024"><enum>(A)</enum><text>by amending paragraph (1) to read as follows: </text><quoted-block id="id5619CBA147F04C4DA0EE62BD7B681FDE" style="USC" act-name="" changed="added" reported-display-style="italic" committee-id="SSVA00"><paragraph id="id2E37171D7B834191AB3451789A0EFFB0"><enum>(1)</enum><text>the Secretary shall pay to the relevant State, agency, political subdivision, or tribal organization, as the case may be, the sum of $700 (as increased from time to time under subsection (c)) as a plot or interment allowance for such veteran if the veteran is buried (without charge for the cost of a plot or interment) in a cemetery, or a section of a cemetery, that—</text><subparagraph id="id185D8C835DF547A796929721987F45D3"><enum>(A)</enum><text>is used solely for the interment of persons who are—</text><clause id="idFE41A43F1FAC4450BA2E18826A220C1B"><enum>(i)</enum><text>eligible for burial in a national cemetery;</text></clause><clause id="id0FA6B8AE688F4199A5A122EE07D4CE4F"><enum>(ii)</enum><text>members of a reserve component of the Armed Forces not otherwise eligible for such burial or former members of such a reserve component not otherwise eligible for such burial who are discharged or released from service under conditions other than dishonorable; or </text></clause><clause id="idF697DB364198437AB676F2D4F7E9EA05"><enum>(iii)</enum><text>described in section 2408(i)(2) of this title; and</text></clause></subparagraph><subparagraph id="id647B115F045C495A9900AB6E442FAC6C"><enum>(B)</enum><text>is— </text><clause id="idFB44530569C54BEFA5A2880ADA0D8DB7"><enum>(i)</enum><text>owned by a State or by an agency or political subdivision of a State; or </text></clause><clause id="idB171A278E10B48CB859CAFD2DE170732"><enum>(ii)</enum><text>on trust land owned by, or held in trust for, a tribal organization.</text></clause></subparagraph></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph><subparagraph id="idFA6EA11D075440CEB2C512142F16BCED"><enum>(B)</enum><text>in paragraph (2), by inserting <quote>tribal organization,</quote> after <quote>of a State,</quote>; and</text></subparagraph></paragraph><paragraph id="id6FFD45A9E57B4D829BF328DB6510C84C"><enum>(2)</enum><text>by adding at the end the following new subsection: </text><quoted-block id="id01DFC2313CC244ED9C739133FA2AE5E1" style="USC" act-name="" changed="added" reported-display-style="italic" committee-id="SSVA00"><subsection id="idE18CE21529234C7B9A1FFF95F74A9441"><enum>(e)</enum><text>In this section, the terms <term>tribal organization</term> and <term>trust land</term> have the meanings given those terms in section 3765 of this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body><endorsement><action-date>March 1,
