 STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend the Families First Coronavirus Response Act to extend child nutrition waiver authority, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section id="idff73772515c14afaa3cd0fb97beb92fb" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keep Kids Fed Act of 2022</short-title></quote>.</text></section><section section-type="subsequent-section" id="idA5FAD777C79C48A3A7C10493AFE844C8" commented="no" display-inline="no-display-inline"><enum>2.</enum><header display-inline="yes-display-inline">Support for child nutrition programs</header><subsection id="idD5BE5D2C1CA84F0BB18B5E9573E54330" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><paragraph id="id5ceeb41977c94ce4a48165929e441b7d" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Temporary lunch reimbursement</header><text display-inline="yes-display-inline">Each lunch served under the school lunch program authorized under the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) shall receive additional reimbursement in the amount of 40 cents.</text></paragraph><paragraph id="id2AFABEC2999246929944267924735038" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Temporary breakfast reimbursement</header><text display-inline="yes-display-inline">Each breakfast served under the school breakfast program established by section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) shall receive additional reimbursement in the amount of 15 cents.</text></paragraph><paragraph id="id11a5579e216a42e4994614b14fd4f9d3" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The additional reimbursement amounts authorized under this subsection shall only be available for the school year beginning July 2022.</text></paragraph><paragraph id="idB4FFC7AC7DEE4FD3A0D49F9D997FA485" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Appropriations</header><subparagraph id="idF598A33B52174E5EBD698A8B64DB2C31" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is appropriated, out of any funds in the Treasury not otherwise appropriated, such sums as are necessary to carry out this subsection.</text></subparagraph><subparagraph id="id869562f050e04f46b738ead6430cd442" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Disbursement</header><text display-inline="yes-display-inline">A State agency shall disburse funds made available under subparagraph (A) to school food authorities participating in the school meal programs described in paragraphs (1) and (2).</text></subparagraph></paragraph></subsection><subsection id="idBAF17D16970B421E8DC748F08EA91825" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Extension of waivers</header><text display-inline="yes-display-inline">Section 2202 of the Families First Coronavirus Response Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1760">42 U.S.C. 1760</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>) is amended—</text><paragraph id="idcca1c654b4674983b3636084f341e94d" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)—</text><subparagraph id="idE8AC17B305CD4459A3C1C060C3008363" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by inserting <quote>due to the COVID–19 pandemic</quote> after <quote>(<external-xref legal-doc="usc" parsable-cite="usc/42/1760">42 U.S.C. 1760(l)</external-xref>)</quote>; </text></subparagraph><subparagraph id="idB61B8C27EF734A0EB1518D3BA25BDCF1" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>and</quote> after the semicolon and inserting <quote>or</quote>; and</text></subparagraph><subparagraph id="idC9C7CA6D6B9B4A00AB1978D2E31EEBDF" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8C0AD0DB9D804842914E2522ED897A14"><subparagraph id="id9E99691856F6495D89D76F3972D90A12" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">ensuring continuity of program operation under a qualified program.</text></subparagraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id0136953552e1454d9615df17ad93a3bb" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text><subparagraph id="idEC985C58F8B3412B957D66A2969D9990" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraph (2); and</text></subparagraph><subparagraph id="id60F0B6B3FEBD45ACB7E261D25204BEFF" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>the following:</quote> in the matter preceding paragraph (1) and all that follows through <quote>A summary</quote> in paragraph (1) and inserting <quote>a summary</quote>; and</text></subparagraph></paragraph><paragraph id="id84777b461093403d8de1e4b8e21d1454" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by striking subsection (e) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id717b1dfa5e4d48229f402eba90aaeafb"><subsection id="id1538eea011c14414806541a91419f115" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Sunset</header><paragraph id="id42a99c5534904ef69c4d87d8c7059242" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Nationwide waivers</header><text display-inline="yes-display-inline">The authority of the Secretary to establish or grant a waiver under subsection (a) shall expire on September 30, 2022.</text></paragraph><paragraph id="id659239A78CBB4B2891995EC57F9D7E23" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Waiver restriction</header><text display-inline="yes-display-inline">After June 30, 2022, a waiver established or granted under subsection (a) shall only apply to schools or summer food service program food service sites—</text><subparagraph id="id1e3e2aa97f8f46d3aaa0c4e0e8c4f17e" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">operating—</text><clause id="id3569c36590f44087a74f901097670652" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the qualified program described in subsection (f)(1)(D); or</text></clause><clause id="id82a39f7fde4d43d58a2e5d3bfd560c61" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the option described in section 13(a)(8) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1761">42 U.S.C. 1761(a)(8)</external-xref>); and</text></clause></subparagraph><subparagraph id="idd818bdd690e7487a93442982e64ccaf4" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">not operating the qualified program described in subsection (f)(1)(A).</text></subparagraph></paragraph><paragraph id="id797935c511a0443cadf4385b597add0b" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Other waivers</header><subparagraph id="idC0C3D25A39794F049E038DD527994CF5" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Child and adult care food program waiver</header><text display-inline="yes-display-inline">The authority of the Secretary to establish or grant a waiver under subsection (b) shall expire on June 30, 2022.</text></subparagraph><subparagraph id="id864F0177F89A41C489AC61ACDDE7EF1D" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Meal pattern waiver</header><text display-inline="yes-display-inline">The authority of the Secretary to establish or grant a waiver under subsection (c) shall expire on June 30, 2023.</text></subparagraph></paragraph><paragraph id="idc31a38cbad0945c8a4a63009e01283d1" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Limitations</header><text display-inline="yes-display-inline">A waiver authorized by the Secretary under this section shall not be in effect after the date on which the authority of the Secretary to establish or grant that waiver under this subsection expires.</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id6CC934FDCBD94D47806238BBC3E7ED0F" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Appropriation</header><text display-inline="yes-display-inline">There are appropriated, out of any funds in the Treasury not otherwise appropriated, such sums as are necessary to provide waivers under section 2202(a) of the Families First Coronavirus Response Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1760">42 U.S.C. 1760</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>) that apply—</text><paragraph id="idB1C9DB2193D0483AA6536A2DDEF0BD0D" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">only during the months of May through September in 2022; and</text></paragraph><paragraph id="id98CCEAD737854EB1B636B175FE297744" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">to—</text><subparagraph id="idB7CF55F380D6453DA22960F57C76DE35" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the summer food service program for children under section 13 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1761">42 U.S.C. 1761</external-xref>); or </text></subparagraph><subparagraph id="idFA4A0A98B62C41298357315701B18347" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the option described in section 13(a)(8) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1761">42 U.S.C. 1761(a)(8)</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="id22816a4cb9c948c288f190644e83f1f6" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Nationwide waiver for school year 2022-2023</header><paragraph id="ida4be82a9adb44e0494defc75cc882b03" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For purposes of school year 2022-2023, the Secretary of Agriculture may establish waivers under section 12(l) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1760">42 U.S.C. 1760(l)</external-xref>)—</text><subparagraph id="id2d649515c14c4a66800a1765238d4092" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">on a nationwide basis; and</text></subparagraph><subparagraph id="ida2d12c128df7441ba7677aaa16f98a57" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">without regard to the requirements under paragraphs (1), (2), and (3) of such section that a State or eligible service provider shall submit an application for a waiver request.</text></subparagraph></paragraph><paragraph id="id5bc33e428552476a9004c64dde3ba885" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">A nationwide waiver established by the Secretary of Agriculture under section 12(l) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1760">42 U.S.C. 1760(l)</external-xref>) pursuant to paragraph (1) shall not be in effect after June 30, 2023. </text></paragraph></subsection></section><section id="id01E4EECD2ECB473B97E29AF2F5DE4FC7" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Child and adult care food program</header><subsection id="id124ADF583EC840AB8917AE5DFDD87182" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><paragraph id="idFC55A1F5608B4434B528AC7BC1309FB7" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Temporary additional reimbursement for 2022-2023 school year</header><text display-inline="yes-display-inline">Each meal and supplement served under the program authorized by section 17 of the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>) shall receive additional reimbursement in the amount of 10 cents.</text></paragraph><paragraph id="idA24A07F47D8F48F7835513F652637E12" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The additional reimbursement amount authorized under paragraph (1) shall only be available for the school year beginning July 2022.</text></paragraph></subsection><subsection id="id1C3C9D43AD894B0889EBB56F682D4CD4" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Tier determinations for 2022-2023 school year</header><text display-inline="yes-display-inline">For the school year beginning July 2022, a tier II family or group day care home described in subsection (f)(3)(A)(iii) of section 17 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>) shall be considered a tier I family or group day care home for purposes of the program authorized under that section. </text></subsection><subsection id="idb6bf3f66fcbd43dfb7fcbdc7137ab464" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Appropriations</header><text display-inline="yes-display-inline">There are appropriated, out of any funds in the Treasury not otherwise appropriated, such sums as are necessary to carry out this section.</text></subsection></section><section id="id5c90bf858e334674aa3e0ab3cb458273" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Rescissions and sunset</header><subsection id="id9e3be6d7845b4d3da927a31e9480832e" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Rescissions</header><paragraph id="ida557716f2e5a470ebb7b25fe06638e4d" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">USDA</header><subparagraph id="id70AF8064003746F8A4530253C2DB2103" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Of the unobligated balances from amounts made available to the Department of Agriculture in section 1001(a) of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/7/7501">7 U.S.C. 7501</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>), $1,000,000,000 are hereby permanently rescinded.</text></subparagraph><subparagraph id="idb2e4e73ac3964b238b084e6f2d3862e6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">Of the unobligated balances from amounts made available to the Department of Agriculture in section 751 of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; 134 Stat. 2105), $400,000,000 are hereby permanently rescinded. </text></subparagraph></paragraph><paragraph id="idfb91e0fba7144d29808d1a1189dfb111" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Department of Education</header><text display-inline="yes-display-inline">Of the unobligated balances from amounts made available to the Department of Education in section 2003 of title II of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>; 135 Stat. 23) and allocated to institutions of higher education as defined in section 102(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(b)</external-xref>), $400,000,000 are hereby permanently rescinded.</text></paragraph><paragraph id="id8ca60cf6300140fcaaff6764769507ea" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">SBA</header><text display-inline="yes-display-inline">Of the unobligated balances from amounts made available to the Small Business Administration in section 5005 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>; 135 Stat. 91) and in section 323(d)(1)(H) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; 134 Stat. 2021) to carry out section 324 of such division of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>), $1,200,000,000 are hereby permanently rescinded. </text></paragraph></subsection><subsection id="id62d5941a20e843e8810110b24fd4554f" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Additional rescission</header><text display-inline="yes-display-inline">Of the unobligated balances from amounts made available to the Department of Agriculture under the heading <quote>Agricultural Programs—Office of the Secretary</quote> in title I of division B of the Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; 134 Stat. 505), $600,000,000 are hereby permanently rescinded.</text></subsection><subsection id="id1cd7e6ffb00949a38ada416b9396a010" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">Section 756 of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/7/2254c">7 U.S.C. 2254c</external-xref>), is amended by striking <quote>for fiscal year</quote> and all that follows through <quote>thereafter</quote> and inserting <quote>for each of fiscal years 2021 and 2022</quote>. </text></subsection></section><section id="id26faeaea23a44c5aa142b5fc8c198150" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Operationally ready</header><text display-inline="no-display-inline">The Secretary of Agriculture shall ensure that technical assistance is made available to States and school food authorities for purposes of assisting parents and school leaders with respect to the transition of operating school meal programs not pursuant to a waiver under section 2(d) or section 2202 of the Families First Coronavirus Response Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1760">42 U.S.C. 1760</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>).</text></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
