<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 207</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210203">February 3, 2021</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> (for himself, <cosponsor name-id="S384">Mr. Tillis</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, and <cosponsor name-id="S378">Mr. Lankford</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend titles XIX and XXI of the Social Security Act to require hospitals and certain other participating providers under Medicaid or the Children's Health Insurance Program to disclose the provider's policy on parental access to the medical records of minors, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parental Right to Know Act</short-title></quote>.</text></section><section id="id09CE3A7ADDC44403B9E9DE6F8D179F1F"><enum>2.</enum><header>Parental access to medical records disclosure
 requirements under Medicaid and CHIP</header><subsection id="id5AF5FB38296741ED826A2C0E051EF8DF"><enum>(a)</enum><header>Medicaid</header><text>Section 1902(w) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(w)</external-xref>) is amended—</text><paragraph id="id7B919B36231346E08E90FC6D9CB31879"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id615A0847511E4B2E8068CFCFC76C9286"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>adult individuals receiving medical care by or through the provider or organization</quote> and inserting <quote>individuals receiving medical care by or through the provider or organization, and in the case of any such individual who is a minor individual (as defined in paragraph (4)(B)), written policies and procedures with respect to the parents and legal guardians of such an individual</quote>; and</text></subparagraph><subparagraph id="id2190D9BE18E542E7B5258FCF9C552069"><enum>(B)</enum><text>in subparagraph (A)—</text><clause id="idAAB85C738E5441BF82751FA02009D918"><enum>(i)</enum><text>in clause (i), by striking <quote>, and</quote> and inserting a semicolon;</text></clause><clause id="id2C5A695792E145C5B2B77623D95EADEA"><enum>(ii)</enum><text>in clause (ii), by adding <quote>and</quote> after the semicolon; and</text></clause><clause id="id453CA51607E445B790DCC1FC5678CEA9"><enum>(iii)</enum><text>by inserting after clause (ii), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE9573935A1CA4B12AD8CFE9B0A4B3F6F"><clause id="id3DC36DED616740BBA73C79AC697921A9"><enum>(iii)</enum><text>the provider's or organization's written policies respecting parental access to the medical records of a minor individual;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id74EF6A01F8EE4ABE95574AD372B7006A"><enum>(2)</enum><text>in paragraph (2), by striking <quote>adult individual</quote> and inserting <quote>individual, and in the case of a minor individual, to at least 1 parent or legal guardian of the minor individual</quote>;</text></paragraph><paragraph id="id6D9E259010A04AF8847579844E18B9B9"><enum>(3)</enum><text>in paragraph (3), by striking <quote>section</quote> and inserting <quote>subsection</quote>; and</text></paragraph><paragraph id="idAEA2381F7CAC49319C6E9CEB8941838E"><enum>(4)</enum><text>in paragraph (4)—</text><subparagraph id="id66677BC96F2844DE9DE61CF224CD0933"><enum>(A)</enum><text>by striking <quote>subsection, the term</quote> and inserting “subsection—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA2A2561188D8493493A6BCBA8C671D00"><subparagraph id="idA24A7E90969A4F3F8195F2784F444089" indent="up1"><enum>(A)</enum><text>the term</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id43B733EE95AE48DFAD6707DF46849AB0"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6F1C1B8A1CAF4654B01CB71F4278F7BD"><subparagraph commented="no" display-inline="no-display-inline" id="id144EDD105C7E4D39820C325FA2F61A1A" indent="up1"><enum>(B)</enum><text>the term <term>minor individual</term> means an individual who is an unemancipated individual who has not attained 18 years of age.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="idE07E0A69A9DF426686E3692612F6C1B2"><enum>(b)</enum><header>Application to CHIP</header><text>Section 2107(e)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)</external-xref>) is amended—</text><paragraph id="id98142D04356643B8A51F15FF723148A6"><enum>(1)</enum><text>by redesignating subparagraphs (D) through (S) as subparagraphs (E) through (T), respectively; and</text></paragraph><paragraph id="idE6BD9008935741DDA383EEBE14EFE0FB"><enum>(2)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id918CDCF40D7C4AB2A9B9F7374EABCA68"><subparagraph id="idC9517F50C91C45CCB9F355DE631BFD20"><enum>(D)</enum><text>Subsections (a)(57) and (w) of section 1902 (relating to maintenance of written policies and procedures respecting advance directives and parental access to the medical records of minor individuals).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idBB355469525A40578D0CD4F356DA08F8"><enum>(c)</enum><header>Effective date</header><paragraph id="idDBB98F3CE5054CF09C065C092A457EA3"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the amendments made by this section shall apply to provider agreements entered into or renewed on or after January 1, 2021.</text></paragraph><paragraph id="id19b5d5918aa5493eb115d885b659253a"><enum>(2)</enum><header>Exception for State legislation</header><text>In the case of a State plan under title XIX or XXI of the Social Security Act which the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirements imposed by the amendments made by this section, the State plan shall not be regarded as failing to comply with the requirements of such title solely on the basis of its failure to meet these additional requirements before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of the enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
