<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2061</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210615">June 15, 2021</action-date><action-desc><sponsor name-id="S373">Mr. Cassidy</sponsor> (for himself, <cosponsor name-id="S394">Ms. Smith</cosponsor>, <cosponsor name-id="S308">Mr. Cardin</cosponsor>, and <cosponsor name-id="S303">Mr. Thune</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to ensure coverage of mental health services furnished through telehealth.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Telemental Health Care Access Act of 2021</short-title></quote>.</text></section><section id="id9CA6A7DD063B44D3B02157D8950D3911"><enum>2.</enum><header>Ensuring coverage for mental health services furnished through telehealth</header><subsection id="id0F1A7DC43FD34C2CAA1EBB60D2CA02A5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1834(m)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(7)</external-xref>) is amended—</text><paragraph id="id98020D9F521D4B9DAC721B7B86838D52"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>subject to subparagraph (B),</quote>;</text></paragraph><paragraph id="id6735E390419141C29129F5BFAFE4C9F1"><enum>(2)</enum><text>by striking <quote>(A) <header-in-text style="OLC" level="subparagraph">In general</header-in-text>.—The geographic</quote> and inserting <quote>The geographic</quote>; and</text></paragraph><paragraph id="idF82DF70C83074DBF8E0866001A3ABDF2"><enum>(3)</enum><text>by striking subparagraph (B).</text></paragraph></subsection><subsection id="id36DBEB220B5946B1B31D05B1709BB23C"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect as if included in the enactment of section 123 of division CC of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>).</text></subsection></section><section id="id8E515A2CAEB04B14AA60617C746DAEB1"><enum>3.</enum><header>Study and report on utilization of mental health services furnished through telehealth</header><text display-inline="no-display-inline">Not later than 1 year after the first day after the end of the emergency period described in section 1135(g)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)(B)</external-xref>), the Secretary of Health and Human Services shall submit to Congress a report on the utilization of mental health services furnished through telehealth under section 1834(m)(7) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(7)</external-xref>), that includes any recommendations of the Secretary regarding—</text><paragraph id="idDD4CD33E190444109E63BD470EBC8A92"><enum>(1)</enum><text display-inline="yes-display-inline">fraud or abuse prevention with respect to such services; and</text></paragraph><paragraph id="idCFBAA5FBDCFA499BB659DC94FAFFDA13"><enum>(2)</enum><text display-inline="yes-display-inline">additional funding that the Office of Inspector General of the Department of Health and Human Services may require for purposes of conducting audits, investigations, and other oversight and enforcement activities with respect to the furnishing of such services.</text></paragraph></section></legis-body></bill>
