which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for a Community-Based Emergency and Non-Emergency Response Grant Program.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community-Based Response Act of 2021</short-title></quote>.</text></section><section id="idB0F2EF72886A426FB74351C6B165C52D"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline"> The purposes of this Act are— </text><paragraph id="id2b2676e233d140d08ad6a19c0274479f"><enum>(1)</enum><text>to provide an additional option beyond law enforcement for community-based emergency and non-emergency response for covered populations in need of help or support, in order to—</text><subparagraph id="id7bd5b42aa19841178eb3b9b8b4d48ea7"><enum>(A)</enum><text>target the best professional intervention to an individual in need of help or support; and</text></subparagraph><subparagraph id="idb4f7ac6fc6474123a92eb97ca2a95440"><enum>(B)</enum><text>avoid escalation of a crisis situation—</text><clause id="id0c09d613b2744554803e001d74a7269c"><enum>(i)</enum><text>that may not require a response from law enforcement; and</text></clause><clause id="idc0ee9b385f6841ae9fe1e8d7b80c2ec2"><enum>(ii)</enum><text>to which a law enforcement response can create increased risk of harm; and</text></clause></subparagraph></paragraph><paragraph id="id3138e1ede2ea486b9727f75d1670251a"><enum>(2)</enum><text>establishing a grant program to provide that additional response option by awarding funding to partnerships described in section 5(a).</text></paragraph></section><section id="id3e687687356b438b8a1731aa412327e3"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id6ac3f5e542e84f3fbe6609bf3fbe95d6"><enum>(1)</enum><header>Community mental health center</header><text>The term <term>community mental health center</term> has the meaning given the term in section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>).</text></paragraph><paragraph id="idd9ea63e87edf4a16b81d4f4a69f7e1e4"><enum>(2)</enum><header>Covered community-based organization</header><text>The term <term>covered community-based organization</term> means an organization that meets the requirements of section 5(b).</text></paragraph><paragraph id="id94fc20e0b51048449655bb1c291fbe0f"><enum>(3)</enum><header>Covered population</header><text>The term <term>covered population</term> means—</text><subparagraph id="id9c4eb89b233940a9bec850eb919b73ba"><enum>(A)</enum><text>individuals who are racial or ethnic minorities or members of an Indian tribe;</text></subparagraph><subparagraph id="id2f7f3f8e629d42b9b769e1b0fdc2ecd9"><enum>(B)</enum><text>immigrants, including undocumented immigrants, immigrants who have recently entered the United States, and refugees;</text></subparagraph><subparagraph id="idad09b4f0acdf4df8a654955c8b28dd84"><enum>(C)</enum><text>individuals with limited English proficiency, meaning their primary language for communication is not English and communication with emergency responders may be difficult;</text></subparagraph><subparagraph id="id66f6e859146346529dcaeb8d063a834b"><enum>(D)</enum><text>individuals who are age 60 or older and determined to be likely to be—</text><clause id="id6A9BD94427EA443CB4F59CBD9AC0E7EF"><enum>(i)</enum><text>vulnerable to abuse; or </text></clause><clause id="id354DA1B77EE445CD96F75842A5BD2DBE"><enum>(ii)</enum><text>experiencing health challenges;</text></clause></subparagraph><subparagraph id="idab0db573c10c4adeac1ac9387ae24da4"><enum>(E)</enum><text>people with disabilities, as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>);</text></subparagraph><subparagraph id="idaf97cd5d838745a4b7ae3328c7fb9ddd"><enum>(F)</enum><text>people in the LGBTQIA+ community;</text></subparagraph><subparagraph id="idd5f49caa9b364a51a48e60f8df58b2ce"><enum>(G)</enum><text>people who are likely to face disproportionate or discriminatory law enforcement contact;</text></subparagraph><subparagraph id="id1e0c1cab16464ff4bdb581dd28f7af62"><enum>(H)</enum><text>people who are or were involved in the criminal justice system;</text></subparagraph><subparagraph id="ida2e8030e88604838b2c8cd059aade581"><enum>(I)</enum><text>homeless persons, as defined in section 103 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11302">42 U.S.C. 11302</external-xref>);</text></subparagraph><subparagraph id="idd6d1528d955145119d21011bc62ec741"><enum>(J)</enum><text>people facing or with a history of mental or behavioral health crises or who need check-ins for health, safety, or substance use disorder reasons;</text></subparagraph><subparagraph id="id767b2c577be2466c8aa07aab4813b76b"><enum>(K)</enum><text>people experiencing family violence or domestic violence under the laws of the jurisdiction involved, or dating violence;</text></subparagraph><subparagraph id="ide6b771ad743f416b8867f0a52bd3acc2"><enum>(L)</enum><text>victims of child abuse and children exposed to violence;</text></subparagraph><subparagraph id="id03ddd360dfc54697998cd41f86f420d0"><enum>(M)</enum><text>people who are likely to be engaged in or to experience violence in the community;</text></subparagraph><subparagraph id="id39f946fae84041969330f5f966cc3a25"><enum>(N)</enum><text>people with, or recovering from, a substance use disorder;</text></subparagraph><subparagraph id="id4e0fe1a325d64f8c93f204ef1096cdc6"><enum>(O)</enum><text>current and former foster youth;</text></subparagraph><subparagraph id="id3489585a1432464fbd43151358e380c6"><enum>(P)</enum><text>youth who are or were involved in the juvenile justice system;</text></subparagraph><subparagraph id="id3ee0888ffb6744d09a56e392ada471ca"><enum>(Q)</enum><text>victims of conduct described in section 1591 or 2251 of title 18, United States Code;</text></subparagraph><subparagraph id="id1cc3efe6443f483993b45585d7f038a6"><enum>(R)</enum><text>people who engage in acts defined in paragraph (4) of section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>);</text></subparagraph><subparagraph id="id748ad435315645d89feb2c80c2954e33"><enum>(S)</enum><text>adult survivors of sexual assault, as defined under the laws of the jurisdiction involved;</text></subparagraph><subparagraph id="idf077683f1f08406a81e273b874f5cef9"><enum>(T)</enum><text>victims of trafficking, as defined in section 103 of the Trafficking Victims Protection Act of 2000; </text></subparagraph><subparagraph id="id879ED7521E524BC196515AE1867A8999"><enum>(U)</enum><text>out-of-school youth; and</text></subparagraph><subparagraph id="id83e2caf7295042c4b7e09ee2e56c9f69"><enum>(V)</enum><text>people in an acute crisis not covered under subparagraphs (A) through (U).</text></subparagraph></paragraph><paragraph id="id768b07b988834cffa3622cdc6e28f657"><enum>(4)</enum><header>Dating violence</header><text>The term <term>dating violence</term> has the meaning given the term in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12291">34 U.S.C. 12291(a)</external-xref>).</text></paragraph><paragraph id="id8d01e59442b84ffdaf4d086c8401edf6"><enum>(5)</enum><header>Immigration terms</header><subparagraph id="id5a822b0d267944e88d56c41f65d678b4"><enum>(A)</enum><header>Immigrant</header><text>The term <term>immigrant</term> means an alien who has entered the United States.</text></subparagraph><subparagraph id="id083191824b33463eb0ed3cf8ce18c7be"><enum>(B)</enum><header>Undocumented immigrant</header><text>The term <term>undocumented immigrant</term> means an alien who is unlawfully present in the United States.</text></subparagraph></paragraph><paragraph id="ide0d1d1539f354b079c8f81ee0773dd9f"><enum>(6)</enum><header>Indian tribe; tribal organization</header><text>The terms <term>Indian tribe</term> and <term>tribal organization</term> have the meanings given the terms in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="ida0875282b3b4404a9649ed57e3e405e8"><enum>(7)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> means—</text><subparagraph id="id280a31aa443645f6a72bc32f825431e7"><enum>(A)</enum><text>such an institution as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>); and</text></subparagraph><subparagraph id="id325b37299047444f8535c2ac0eebaf52"><enum>(B)</enum><text>a tribally controlled college or university as defined in section 2 of the Tribally Controlled Colleges and Universities Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/1801">25 U.S.C. 1801</external-xref>).</text></subparagraph></paragraph><paragraph id="id8859B48BB233423D8F879FFC1C1DC3DD"><enum>(8)</enum><header>Out-of-school youth</header><text>The term <term>out-of-school youth</term> means an individual who is—</text><subparagraph id="ide93f9ab8ea404e45ba66a4a02675b4d4"><enum>(A)</enum><text>not attending any school (as defined under State law);</text></subparagraph><subparagraph id="idc617d1bd67b6452f9e1ee3c14bc70ada"><enum>(B)</enum><text>not younger than age 16 or older than age 24; and</text></subparagraph><subparagraph id="id7f0a704cc0b94395b13987a6ce93c519"><enum>(C)</enum><text>one or more of the following:</text><clause id="id8af3c17e47d7463d8165a47aec244fc8"><enum>(i)</enum><text>A young person who has dropped out of school.</text></clause><clause id="idb28f9c2642ca4a539dfc0b8a08317bf3"><enum>(ii)</enum><text>A youth who is within the age of compulsory school attendance, but has not attended school for at least the most recent complete school year calendar quarter.</text></clause><clause id="ide284b279d569457083d713d980ec2163"><enum>(iii)</enum><text>A recipient of a secondary school diploma or its recognized equivalent who is a low-income individual and is either basic skills deficient or an English language learner (as such 3 terms are defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>)).</text></clause><clause id="ide5503d7abc14433aaf2c9ff67ef359c8"><enum>(iv)</enum><text>An individual who is subject to the criminal justice system.</text></clause><clause id="id2a4724c38b8047b19798c675ed7c5125"><enum>(v)</enum><text>An individual who experiences homelessness, a homeless child or youth, or a runaway.</text></clause><clause id="idf2fb5da0a5fa450aa9895a87f334519a"><enum>(vi)</enum><text>An individual—</text><subclause id="id63CB8B18A11140FBADCFC4A3F015F2CB"><enum>(I)</enum><text>who is in foster care, who has aged out of the foster care system, or who has attained 16 years of age and left foster care for kinship guardianship or adoption;</text></subclause><subclause id="id1437FC0C571C4518B5F99919CCAF7E5D"><enum>(II)</enum><text>who is a child eligible for assistance under section 477 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677</external-xref>); or </text></subclause><subclause id="id039F54320DC54A8790AA584A081BEF11"><enum>(III)</enum><text>who is a child in an out-of-home placement.</text></subclause></clause><clause id="id43ea807378b14dc4a85dfc541af30f34"><enum>(vii)</enum><text>An individual who is pregnant or parenting.</text></clause><clause id="id9f39edb6321d4c4fbd5a441e03772946"><enum>(viii)</enum><text>An individual with a disability (as defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>)).</text></clause><clause commented="no" display-inline="no-display-inline" id="id72cad654fe5b46399781fc887044c4d4"><enum>(ix)</enum><text>A low-income individual (as defined in that section 3) who requires additional assistance to enter or complete an educational program or to secure or hold employment. </text></clause></subparagraph></paragraph><paragraph id="id2931f8aeb5804940a3a5fb93057cbde4"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services, acting through the Administrator of the Administration for Community Living and in consultation with the Assistant Secretary for Mental Health and Substance Use, the Secretary of Housing and Urban Development, and the Attorney General.</text></paragraph><paragraph id="id235bfb62d49e420e8faaa20f31533075"><enum>(10)</enum><header>Substance use disorder</header><text>The term <term>substance use disorder</term> means such a disorder within the meaning of title V of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290aa">42 U.S.C. 290aa et seq.</external-xref>).</text></paragraph></section><section id="idd2695b321b8e44b7bb388a13edc54f1b"><enum>4.</enum><header>Establishment of grant program</header><text display-inline="no-display-inline">The Secretary shall establish a Community-Based Emergency and Non-Emergency Response Grant Program to improve community-based emergency and non-emergency response for public safety and problem solving, and to promote the safety and well-being of the populations and communities served under the program by—</text><paragraph id="ide310e7219c124be9bfeb2676da6dd94d"><enum>(1)</enum><text>identifying eligible organizations with demonstrated capacity for emergency and non-emergency response work, including violence interruption, community mediation, and crisis behavioral health response, who are capable of providing, and increasing the capacity of the localities to provide, emergency and non-emergency response for specified covered populations;</text></paragraph><paragraph id="idb939f3f31ef44658bdbfde1b5dbddf74"><enum>(2)</enum><text>developing a local infrastructure of systems and resources needed to develop, implement, and sustain effective interventions to protect the mental and physical well-being of members of the community, prevent violence, de-escalate volatile situations, ensure access to human services, protect property and the environment, reduce law enforcement use of force, and ensure the health and safety of communities, while decreasing the sole reliance on law enforcement for emergency and non-emergency situations; </text></paragraph><paragraph id="id35036662bf2847ab8b3e8509d5ad0819"><enum>(3)</enum><text>creating and strengthening formal and informal partnerships, for such purposes as providing solutions and committing resources to sustain and scale up successful models of community-based emergency and non-emergency response; and</text></paragraph><paragraph id="id62cd1fd7741d4e6bbb4a596a91d754e8"><enum>(4)</enum><text>providing timely evaluation to clarify the outcomes and costs of the program, and the new interventions and service models provided through the program, for service recipients and law enforcement.</text></paragraph></section><section id="idAF77C7CEE6504B0896BA6E170B5D7811"><enum>5.</enum><header>Eligible partnerships</header><subsection id="idD088632EE0DC43BD80EFB35EE82A341B"><enum>(a)</enum><header>In general</header><text>To be eligible to receive a grant under this title Act, an entity shall be a partnership of—</text><paragraph id="idE14DC622EAFE483B906535358B5FF0DA"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD677B85DB4554B47A54F0B39AB9F6F75"><enum>(A)</enum><text>a unit of local government (or its contractor), or Indian tribe or tribal organization, acting through an entity that is independent of any law enforcement agency; and</text></subparagraph><subparagraph id="idCF1411B2E0514FEB9CAADE61BAC39176" indent="up1"><enum>(B)</enum><text>a covered community-based organization; and</text></subparagraph></paragraph><paragraph id="id32073E7C231342EB8057F4103BA3AE10"><enum>(2)</enum><text>if applicable, a nonprofit or public institution of higher education, community mental health center, or behavioral health organization.</text></paragraph></subsection><subsection id="idA83DB55F08B74212AAE35137E8913EEE" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Community-Based organization</header><text>A community-based organization referred to in subsection (a)(1) shall be a nonprofit community-based organization, a consortium of nonprofit community-based organizations, a national nonprofit organization acting as an intermediary for a community-based organization, or a community-based organization that has a fiscal sponsor that allows the organization to function as an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="idB7498DEFD93240C797AAF84FA2A7775B"><enum>6.</enum><header>Planning grants</header><subsection id="id004e85a8897440d6b2232c2919428687"><enum>(a)</enum><header>In general</header><text>In carrying out the Program, the Secretary shall use not more than 10 percent of the amount appropriated under section 13(1) to make planning grants to eligible partnerships to engage, with meaningful participation from the covered populations and covered community-based organizations involved, in comprehensive design of a community response plan, in order to prepare a high-quality application for an initiation grant. </text></subsection><subsection id="idc06a7ba78b754ab98f601c29e2933baf"><enum>(b)</enum><header>Application</header><text>To be eligible to receive a planning grant under this section, an eligible partnership shall submit to the Secretary a planning application at such time, in such manner, and containing such information as the Secretary may require, including information on—</text><paragraph id="id4e754f9abdda446b82faaae5f7f682f3"><enum>(1)</enum><text>the covered populations that will be consulted through the planning process;</text></paragraph><paragraph id="ida0e1087592dd45fbb95672731e233133"><enum>(2)</enum><text>how the partnership will engage entities that are led by the covered populations; and</text></paragraph><paragraph id="id3490af574e71436989a9db74b0e7b4c9" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>how the partnership will solicit and confirm support from covered populations and community stakeholders in the plan. </text></paragraph></subsection></section><section id="id1511E379D13A48948E21ED20CADA83E0"><enum>7.</enum><header>Initiation and continuation grants</header><subsection id="id414438838d5547bb9a9bbe8bd9166aa4"><enum>(a)</enum><header>Initiation grants</header><text>In carrying out the Program, the Secretary shall make initiation grants to not fewer than 40 eligible partnerships, including not fewer than 4 eligible partnerships that include Indian tribes or tribal organizations, of which not fewer than 2 shall be eligible partnerships led by an Indian tribe or tribal organization, to carry out projects to meet the objectives described in subsection (a). The Secretary shall make the grants for periods of 5 years. The Secretary shall make the grants to partnerships in geographically diverse areas, including urban and rural communities, and in communities with varying population sizes.</text></subsection><subsection id="id5216733c704c4fe5867825dd7317ca60"><enum>(b)</enum><header>Continuation grants</header><paragraph id="ide9ab05e1fee547df841047854e7a3768"><enum>(1)</enum><header>In general</header><text>In carrying out the Program, the Secretary shall make continuation grants to eligible partnerships who are recipients of the initiation grants and who are determined by the Secretary to be in good standing on completion of the grant period for those grants, to pay for the Federal share of the cost of carrying out projects to meet the objectives described in subsection (a). The Secretary shall make the continuation grants for periods of 2 years.</text></paragraph><paragraph id="idace414835fef426789983853667df9b9"><enum>(2)</enum><header>Non-federal share</header><text>The non-Federal share of the costs described in this subsection shall be 25 percent. The eligible partnership receiving such a continuation grant shall provide the non-Federal share from State, tribal, local, or private sources.</text></paragraph></subsection></section><section id="id0dcb8b02c37f492c944566882645da98"><enum>8.</enum><header>Initiation and continuation grant applications</header><subsection id="id66FB1F250A24464D86566F4BB8BCB15A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">To be eligible to receive an initiation or continuation grant under section 7 for a project, a partnership shall submit an application (which, for a continuation grant, shall be an update of the partnership’s initiation grant application) to the Secretary, at such time, in such manner, and containing such information as the Secretary may require, including—</text><paragraph id="id6d9186a78e394749870265d7e50cf249"><enum>(1)</enum><text>information that specifies in detail—</text><subparagraph id="idb61953ef13394b828170c415faa96392"><enum>(A)</enum><text>the covered populations that the partnership will target for services under this Act;</text></subparagraph><subparagraph id="id79c62a3cd2cd494182f2ccb9f18080ff"><enum>(B)</enum><text>the experience of the members of the partnership in successfully working in the community to be served and partnering with the target populations, including—</text><clause id="idb48b5b60a7534d8395ac1e271254f61d"><enum>(i)</enum><text>for a partnership that includes an Indian tribe or tribal organization, an understanding of tribal sovereignty; and</text></clause><clause id="idb66b26d47fd54708aa4f43c6d4e6f7ee"><enum>(ii)</enum><text>for a partnership not described in clause (i), the partnership’s understanding of racial equity, systems of oppression, and the impact of structural racism on the community and population to be served, the partnership’s commitment to promoting anti-racism, anti-bias, and equity, dismantling such systems, and reducing such impact, and an established record of accomplishment in improving outcomes or preventing, reducing, or eliminating inequities in that community;</text></clause></subparagraph><subparagraph id="id2abb208d33084341a58cb0c7514547a6"><enum>(C)</enum><text>how the grant funds will be used;</text></subparagraph><subparagraph id="idb1087114e62a47ec9b9c8caf6f50e2d8"><enum>(D)</enum><text>the expertise of the partnership, including its staff, in implementing the project to provide the proposed services;</text></subparagraph><subparagraph id="id8aab0f87c3d34185837f8fe3cd7ecc85"><enum>(E)</enum><text>how the partnership will implement or develop practices with clear methods of evaluation, including development of culturally informed practices, in carrying out the project, including references to applicable research or demonstrated practices; and</text></subparagraph><subparagraph id="id262e0be8250b45c6ae9062b15a3272d5"><enum>(F)</enum><text>the partnership’s plan for gathering feedback from service recipients about the quality of the services, including contacts and resources, provided through the project; and</text></subparagraph></paragraph><paragraph id="idd4f7053c9ae943e0abf0b3ceefd417c7"><enum>(2)</enum><text>a memorandum of understanding that—</text><subparagraph id="idadd913ccaad1470b8eaa090a508e49b1"><enum>(A)</enum><text>identifies each partner (including each agency of the unit of local government or Indian tribe or tribal organization, as applicable, involved) and is signed by a representative of each partner in the partnership carrying out the project; and</text></subparagraph><subparagraph id="id91b687511a8a45d78a37e39f06e0d89c"><enum>(B)</enum><text>outlines—</text><clause id="id388b22c707ad4a4bb4dcb7f20e9e6350"><enum>(i)</enum><text>the partnership’s engagement with the community, including members of the covered population, and the role the engagement played in developing the project;</text></clause><clause id="id79fe17a6c384419d87d890525da4dfbb"><enum>(ii)</enum><text>the financial and programmatic commitment of each partner, and the specific role of a law enforcement agency if involved in a backup role;</text></clause><clause id="idd9d77fbf6ef24881a6c25e003487404f"><enum>(iii)</enum><text>the responsibilities of emergency dispatch operators, dispatchers, and partners in the national 911 system, in properly identifying calls in the community to be served necessitating a community-based emergency and non-emergency response and directing those calls to appropriate responders;</text></clause><clause id="idf76b6fc4d8c1466ea492e02f61974a21"><enum>(iv)</enum><text>the responsibilities of information and referral systems for essential community services (accessed in most localities by dialing 211) and the National Suicide Prevention Hotline (to be accessed by dialing 988) for participating in efficiently routing direct callers to services;</text></clause><clause id="id8a72feb012694149ae172b479b84763a"><enum>(v)</enum><text>the responsibilities of each partner with respect to data collection and evaluation;</text></clause><clause id="id724039de8a7f4442896b25106f1cb430"><enum>(vi)</enum><text>how each partner’s existing (as of the date of submission of the application) vision, theory of change, theory of action, anti-racist and anti-bias practice, and activities align with those of the grant program set forth in this Act;</text></clause><clause id="id8dd1229838fd47f1983cecc0aa4a7cf5"><enum>(vii)</enum><text>the governance structure proposed for the project, including a system for holding partners accountable;</text></clause><clause id="id749857e5e9754546a6b710e9ccc3872e"><enum>(viii)</enum><text>how the eligible partners’ governing boards or advisory boards, and emergency responders, are representative of the community to be served;</text></clause><clause id="id5b5cb95f91204011963ae8826b6e9d31"><enum>(ix)</enum><text>how a structure through which residents of the community and grassroots organizations will have an active role in the eligible partnership’s decision making;</text></clause><clause id="id069e8568cbf34f99b9f2f645e2c04aef"><enum>(x)</enum><text>how the partnership anticipates that the project involved will decrease the responsibilities of local law enforcement, including responsibilities related to policing, arrests, and incarceration, and of other public safety entities; </text></clause><clause id="id33ee88bd772a4403a13aa2614126a3b1"><enum>(xi)</enum><text>any voluntary, community-based mental health services and other support services that the partnership is committing to provide; </text></clause><clause id="id70d775c73be64af99b3b400ba868b372"><enum>(xii)</enum><text>any State or local laws that may be an impediment to implementation of the project; and</text></clause><clause id="ide74e022539dd427292f15caebf1b6834"><enum>(xiii)</enum><text>any other information the Secretary reasonably determines to be necessary.</text></clause></subparagraph></paragraph></subsection><subsection id="id26d68d9a59594e1eb1cca232be0a3d21"><enum>(b)</enum><header>Priority</header><text>In making initiation and continuation grants under section 7, the Secretary shall give priority to—</text><paragraph id="id358C3C1FA86A4CDF98C0FA340902455C"><enum>(1)</enum><text>eligible partnerships that include covered community-based organizations with a documented record of effectively serving 1 or more covered populations;</text></paragraph><paragraph id="id7C4A68A4F42E4368ACB25E858AF5B3C9"><enum>(2)</enum><text>eligible partnerships that include covered community-based organizations that are led by individuals who are members of the covered populations to be served; </text></paragraph><paragraph id="idc245045bbf504a6297a8997289cded94"><enum>(3)</enum><text>eligible partnerships that include a unit of local government that commits to increasing resources for community-based mental health services and housing, with the goals of—</text><subparagraph id="id2745d5dd0e3943edac36ebac01461d28"><enum>(A)</enum><text>reducing the incarceration and death of persons with a mental illness or an intellectual or developmental disability; and</text></subparagraph><subparagraph id="idedc502e4b7884c448d3d74ea35cda984"><enum>(B)</enum><text>increasing referrals of persons with a mental illness or an intellectual or developmental disability to voluntary, community-based mental health services and other support services (rather than institutionalization); and</text></subparagraph></paragraph><paragraph id="id229A75FCD4FD4A589C06FEE079F6E359"><enum>(4)</enum><text>eligible partnerships that have successfully executed planning under a planning grant.</text></paragraph></subsection><subsection id="id5447b9594828417cbfbbc01e2ccf3c06"><enum>(c)</enum><header>Consideration</header><text>In reviewing applications for grants described in section 7, the Secretary shall consider applications with innovative proposals and clear methods of evaluation. </text></subsection></section><section id="idcdcc900868af474db753813fbd086c5a"><enum>9.</enum><header>Use of funds</header><subsection id="idc4b9a9ee4ddb4a969e7874df18334349"><enum>(a)</enum><header>In general</header><text>An eligible partnership that receives a grant under section 7 for a project may use the grant funds for—</text><paragraph id="idc81bbbc3ff75403684d8bddd0105b9e2"><enum>(1)</enum><text>project planning and community engagement;</text></paragraph><paragraph id="id98a0f561bb38411293fdbc344d82b92a"><enum>(2)</enum><text>project implementation;</text></paragraph><paragraph id="idbcd7110c2461446495fcffed90a2a47f"><enum>(3)</enum><text>staffing and recruitment;</text></paragraph><paragraph id="id9dff9e2ba4bd48538615c3696ae9e8ce"><enum>(4)</enum><text>facilities;</text></paragraph><paragraph id="idad86605483d94e8cbb56775077103510"><enum>(5)</enum><text>operational costs, including costs of startup or expansion activities, marketing, language translation, and transportation;</text></paragraph><paragraph id="id76b53d86e3834c4398405b712318b2eb"><enum>(6)</enum><text>engagement with technical assistance providers;</text></paragraph><paragraph id="id083ee3ea445f41efb0a1de058f4ab81a"><enum>(7)</enum><text>consulting services;</text></paragraph><paragraph id="id85006a006e7649e4a7b6e803bce2561c"><enum>(8)</enum><text>training;</text></paragraph><paragraph id="idbc4589cae2d44f7b9f322d4ea2d596dd"><enum>(9)</enum><text>program and project evaluation, including evaluation of program and project efficacy, staff performance, and service delivery;</text></paragraph><paragraph id="idc481be94eef94b39acfc94e33e87a425"><enum>(10)</enum><text>programming and service interventions that include—</text><subparagraph id="idc802f495a71d4505b553e51be969e00c"><enum>(A)</enum><text>activities that prioritize human service interventions, by entities other than law enforcement, over interventions by law enforcement; or</text></subparagraph><subparagraph id="idbdd08439ce7947c7b63c3fcf7eba27ce"><enum>(B)</enum><text>activities that include triaging emergencies, through emergency dispatch operators, in a manner that results in referral to a wholly nonpolice entity; and</text></subparagraph></paragraph><paragraph id="id292beb7b0e7a46ce85373dae1da6da1d"><enum>(11)</enum><text>programming and service interventions that may include—</text><subparagraph id="idf9bb89a2f29f4ce2ba444333f1b2944d"><enum>(A)</enum><text>activities that include co-occurring law enforcement and human services activities, such as responses to calls about dating violence;</text></subparagraph><subparagraph id="iddc5c55223b394e2babaa8a32c109caed"><enum>(B)</enum><text>activities that include followup by human services organizations after contact by law enforcement, such as community mediation, social services, or behavioral health services;</text></subparagraph><subparagraph id="id200e78a76ee94f0bba96a7f1af599cbe"><enum>(C)</enum><text>training for emergency dispatch operators; and</text></subparagraph><subparagraph id="id9fded04bc2cb45c99b8133807c814857"><enum>(D)</enum><text>training for community members, or family members of people requiring emergency or non-emergency response, to facilitate comprehensive and clear communication with emergency dispatch operators to ensure that necessary information is conveyed about when an intervention by a nonpolice human services organization is the most appropriate response.</text></subparagraph></paragraph></subsection><subsection id="ida20fa020d5af429fa753c5afd9d83520"><enum>(b)</enum><header>Funding limitation</header><text>None of the grant funds provided under section 7 shall be provided to State, tribal, or local law enforcement agencies.</text></subsection></section><section id="idf16e02bf0aa749da89da221658f44b2d"><enum>10.</enum><header>Technical assistance</header><text display-inline="no-display-inline">The Secretary shall arrange for a national technical assistance provider for organizations described in section 5, to provide technical assistance support and develop and disseminate best practices for projects carried out under this Act.</text></section><section id="id34226b705c3b48a3a0c75c17577d6bc2"><enum>11.</enum><header>Annual reporting requirements</header><text display-inline="no-display-inline">Each recipient of a grant under section 7 for a project is required to submit an annual report to the Secretary that details—</text><paragraph id="id29479bdd3d6a44cb92fe09b9e41f32ae"><enum>(1)</enum><text>the specific uses of the grant funds;</text></paragraph><paragraph id="id543e836603e64158bef8b1566ec9746b"><enum>(2)</enum><text>the number of individuals contacted through the project;</text></paragraph><paragraph id="id3bc5d044f6f6400da2198091303ad7f3"><enum>(3)</enum><text>the number of individuals connected with ongoing services or resources through the project, disaggregated by race, ethnicity, gender, sexual orientation and gender identity, disability status, and other characteristics;</text></paragraph><paragraph id="id98a21cc9b1a547d7911516463d1c4732"><enum>(4)</enum><text>the quality of the contacts, services, and resources, as reported by the individuals contacted;</text></paragraph><paragraph id="id0f800b721f30432c9dc69dcc8c4436ff"><enum>(5)</enum><text>any evidence of positive outcomes following the contacts or connections;</text></paragraph><paragraph id="id07257138ef734b1280b155c548b2290d"><enum>(6)</enum><text>any evidence of negative outcomes that may have occurred following the contacts or connections;</text></paragraph><paragraph id="id33560f0c42ba4a7389142fb2b4870fe8"><enum>(7)</enum><text>the percentage of total emergency calls diverted from law enforcement to the grant recipient;</text></paragraph><paragraph id="id4388838b73a14648a27ccecc76054165"><enum>(8)</enum><text>the percentage of emergency calls diverted to the grant recipient that have been addressed;</text></paragraph><paragraph id="id831839657800481aa86e143f2d61717f"><enum>(9)</enum><text>the extent to which the grant recipient is hiring or training individuals from within the covered population, and the recruitment, hiring, training, and retention practices for such individuals;</text></paragraph><paragraph id="idef66d57f12ea483fa09d56128eec81ff"><enum>(10)</enum><text>any related reduction in the number of calls to law enforcement over the period of the project;</text></paragraph><paragraph id="idb544787827e94ee5a76680aef291243d"><enum>(11)</enum><text>any changes in the types of calls made to the 911 system, to the extent that it is practicable to report information on such changes;</text></paragraph><paragraph id="id1593efb1bf534639add4eb65f4485336"><enum>(12)</enum><text>any increases in the number of calls to the 211 (or equivalent) systems for essential non-emergency community services or calls to the 988 National Suicide Prevention Hotline over the period of the project;</text></paragraph><paragraph id="idee525933242b4d899129411f0524e9bd"><enum>(13)</enum><text>any related reduction in the budget of the law enforcement agency that has jurisdiction over the community served by the eligible partnership over that period;</text></paragraph><paragraph id="idce2ea293290d465299088ab6139fa860"><enum>(14)</enum><text>any State or local laws that were an impediment to implementation of the project; and</text></paragraph><paragraph id="id1da39313077f401da575156c1832d530"><enum>(15)</enum><text>any evidence of completed in-home, teletherapy, or in-community responses that included counseling, crisis response, family treatment, mediation, or other evidence-based interventions that addressed complex needs not able to be resolved by non-emergency calls alone.</text></paragraph></section><section id="id83364505880744fe85859aa07f960d11"><enum>12.</enum><header>Evaluation and report</header><text display-inline="no-display-inline">Not later than October 1, 2027, the Secretary shall—</text><paragraph id="id8557cd20de61408280d7ecd4d87c6990"><enum>(1)</enum><text>complete an evaluation detailing the implementation of, outcomes of, and best practices from the grant program carried out under this Act, including program-wide information on the factors described in paragraphs (2) through (15) of section 11; and</text></paragraph><paragraph id="id72567e75b2af45108654ebbcb01d66d5"><enum>(2)</enum><text>submit to Congress a report containing the evaluation.</text></paragraph></section><section id="id22fbb07a7af149a8add88ce80d4f9b1b"><enum>13.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated—</text><paragraph id="id68381fe764144216ba1f5835ce15c69c"><enum>(1)</enum><text>to carry out planning and initiation grants under this Act, $100,000,000 for each of fiscal years 2022 through 2026; and</text></paragraph><paragraph id="id1e7b12094f404619b71a2d3e8b611464"><enum>(2)</enum><text>to carry out continuation grants under this Act, $75,000,000 for each of fiscal years 2027 and 2028.</text></paragraph></section></legis-body></bill>
