<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2043</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210614">June 14, 2021</action-date><action-desc><sponsor name-id="S253">Mr. Durbin</sponsor> (for himself, <cosponsor name-id="S252">Ms. Collins</cosponsor>, <cosponsor name-id="S277">Mr. Carper</cosponsor>, <cosponsor name-id="S307">Mr. Brown</cosponsor>, <cosponsor name-id="S361">Ms. Hirono</cosponsor>, <cosponsor name-id="S247">Mr. Wyden</cosponsor>, <cosponsor name-id="S229">Mrs. Murray</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S259">Mr. Reed</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, and <cosponsor name-id="S362">Mr. Kaine</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to prohibit smoking on the premises of any facility of the Veterans Health Administration, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H50B2EEECFB7D416D965ED6ECDFC34707"><section id="idAC3E643B6D9C44D2B3E2A7CDFB9DAAFE" section-type="section-one"><enum>1.</enum><header>Prohibition on smoking in facilities of the Veterans Health Administration</header><subsection id="id6CA390D649C94A7FA1097692D22D2CA1"><enum>(a)</enum><header>Prohibition</header><paragraph id="idC284B2BFE8A94E8C8CA39094778E0EE4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1715 of title 38, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="idCCD18A212F7F4DEA96FB6F858A6ABB39" style="USC"><section id="idB55BA880C6644F81A5551F48276A9F0E"><enum>1715.</enum><header>Prohibition on smoking in facilities of the Veterans Health Administration</header><subsection id="idBA854AD3C21A4804BBB00364DAD5C64B"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No person (including any veteran, patient, resident, employee of the Department, contractor, or visitor) may smoke on the premises of any facility of the Veterans Health Administration.</text></subsection><subsection id="idF15496922E6849CBB1A5B6E4E78CEB9C"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id4DF47A3D52E24F709C1CB7549D68F889"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>facility of the Veterans Health Administration</term> means any land or building (including any medical center, nursing home, domiciliary facility, outpatient clinic, or center that provides readjustment counseling) that is—</text><subparagraph id="id2CF5FB10BBD842C7960BAC6F82CD9D03"><enum>(A)</enum><text>under the jurisdiction of the Department of Veterans Affairs;</text></subparagraph><subparagraph id="id799A99AA2EE3439D9946A646A06E5783"><enum>(B)</enum><text>under the control of the Veterans Health Administration; and</text></subparagraph><subparagraph id="id56B17994B7D942ABB043AD748FEC94C7"><enum>(C)</enum><text>not under the control of the General Services Administration.</text></subparagraph></paragraph><paragraph id="id38D46313FAD34E4CAF4EEAE5C51AB61B"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>smoke</term> includes—</text><subparagraph id="id69EEAA28518B4893910BD2B013062EF3"><enum>(A)</enum><text>the use of cigarettes, cigars, pipes, and any other combustion or heating of tobacco; and</text></subparagraph><subparagraph id="idD522FE91AE5F4189B7AD7F3C57D3ABA2"><enum>(B)</enum><text display-inline="yes-display-inline">the use of any electronic nicotine delivery system, including electronic or e-cigarettes, vape pens, and e-cigars.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idC1D48316CABA43808E884CA417A9A862"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of subchapter II of chapter 17 of such title is amended by striking the item relating to section 1715 and inserting the following new item:</text><quoted-block display-inline="no-display-inline" id="id4314BC613E96473B890D1A9AA5D36B4E" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">1715. Prohibition on smoking in facilities of the Veterans Health Administration.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id8BC100C1FF9C4D08893A7A5B5BE100AA" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 526 of the Veterans Health Care Act of 1992 (<external-xref legal-doc="public-law" parsable-cite="pl/102/585">Public Law 102–585</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1715">38 U.S.C. 1715</external-xref> note) is repealed.</text></subsection></section></legis-body></bill>
