bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to direct the Secretary of Veterans Affairs to enforce the licensure requirement for medical providers of the Department of Veterans Affairs.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Veterans Affairs Provider Accountability Act</short-title></quote>.</text></section><section id="idf8ba0d6fb72b45629d110f38ac233cf1"><enum>2.</enum><header>Compliance with requirements for examining qualifications and clinical abilities of health care professionals of Department of Veterans Affairs</header><subsection id="id574d88f2a54c43039ce054bb945f54ae"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/74">chapter 74</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block id="ide98d33a9e28d4e12890157e64d60ee8a" display-inline="no-display-inline" style="USC"><section id="id723293b4175545f1b8e8dd57c104bcd8"><enum>7414.</enum><header>Compliance with requirements for examining qualifications and clinical abilities of health care professionals</header><subsection id="id58b5503ad14f4256908bf5ce22215a05"><enum>(a)</enum><header>Compliance with credentialing requirements</header><text>The Secretary shall ensure that each medical center of the Department, in a consistent manner—</text><paragraph id="id1bcd0719cf2a4dd38dbc0791571b13a6"><enum>(1)</enum><text>compiles, verifies, and reviews documentation for each health care professional of the Department at such medical center regarding, at a minimum—</text><subparagraph id="idf0f5cddb99ac44efa49c5ac4d2e0e631"><enum>(A)</enum><text>the professional licensure, certification, or registration of the health care professional;</text></subparagraph><subparagraph id="idd53032e0e0dc4f63ad6dc34facaf4155"><enum>(B)</enum><text>whether the health care professional holds a Drug Enforcement Administration registration; and</text></subparagraph><subparagraph id="idb061c107ce484f0b8845030d643b349d"><enum>(C)</enum><text>the education, training, experience, malpractice history, and clinical competence of the health care professional; and</text></subparagraph></paragraph><paragraph id="id1b48eada785d4d07b76f37085158b74e"><enum>(2)</enum><text>continuously monitors any changes to the matters under paragraph (1), including with respect to suspensions, restrictions, limitations, probations, denials, revocations, and other changes, relating to the failure of a health care professional to meet generally accepted standards of clinical practice in a manner that presents reasonable concern for the safety of patients.</text></paragraph></subsection><subsection id="idb82645fe86454b5794ca3021c70d340d"><enum>(b)</enum><header>Registration regarding controlled substances</header><paragraph commented="no" display-inline="yes-display-inline" id="id08e1229da2e34aa18b659dfb7893b241"><enum>(1)</enum><text>Except as provided in paragraph (2), the Secretary shall ensure that each covered health care professional holds an active Drug Enforcement Administration registration.</text></paragraph><paragraph id="id1dfb0e1567d449519bed853f4c76eda6" indent="up1"><enum>(2)</enum><text>The Secretary shall—</text><subparagraph id="id2cb262d5fda14e8790afd00f957273ca"><enum>(A)</enum><text>determine the circumstances in which a medical center of the Department must obtain a waiver under section 303 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823</external-xref>) with respect to covered health care professionals; and</text></subparagraph><subparagraph id="id7fd3b02a1fca4d8787b31aa63fda7f97"><enum>(B)</enum><text>establish a process for medical centers to request such waivers.</text></subparagraph></paragraph><paragraph id="id5c99bbbd9e1b48e68439fc308a8039dc" indent="up1"><enum>(3)</enum><text>In carrying out paragraph (1), the Secretary shall ensure that each medical center of the Department monitors the Drug Enforcement Administration registrations of covered health care professionals at such medical center in a manner that ensures the medical center is made aware of any change in status in the registration by not later than seven days after such change in status.</text></paragraph><paragraph id="ida9294057272240fc990661679fbbc41f" indent="up1"><enum>(4)</enum><text>If a covered health care professional does not hold an active Drug Enforcement Administration registration, the Secretary shall carry out any of the following actions, as the Secretary determines appropriate:</text><subparagraph id="id8d423d4dea7d4555bf261e8822feb9cc"><enum>(A)</enum><text>Obtain a waiver pursuant to paragraph (2).</text></subparagraph><subparagraph id="idd322d4fbf64d40198c37e3549ddba1a8"><enum>(B)</enum><text>Transfer the health care professional to a position that does not require prescribing, dispensing, administering, or conducting research with controlled substances.</text></subparagraph><subparagraph id="idb90201f1285540d4b03bbfe1ebe2e741"><enum>(C)</enum><text>Take appropriate actions under subchapter V of this chapter, with respect to an employee of the Department, or take appropriate contract administration actions, with respect to a contractor of the Department.</text></subparagraph></paragraph></subsection><subsection id="idfff001fce944488ab81db0cb1f46a425"><enum>(c)</enum><header>Reviews of concerns relating to quality of clinical care</header><paragraph commented="no" display-inline="yes-display-inline" id="ide033b199492c4cf495511080c37b4a72"><enum>(1)</enum><text>The Secretary shall ensure that each medical center of the Department, in a consistent manner, carries out—</text><subparagraph id="id8e4cc3939edb4412843445e0443bfd3f" indent="up1"><enum>(A)</enum><text>ongoing, retrospective, and comprehensive monitoring of the performance and quality of the health care delivered by each health care professional of the Department located at the medical center, including with respect to the safety of such care; and</text></subparagraph><subparagraph id="id90fc88a9d1804435b5ef637d5dd84c38" indent="up1"><enum>(B)</enum><text>timely and documented reviews of such care if an individual notifies the Secretary of any potential concerns relating to a failure of a health care professional of the Department to meet generally accepted standards of clinical practice in a manner that presents reasonable concern for the safety of patients.</text></subparagraph></paragraph><paragraph id="id10c1a4f5d68748e791f496c2767b8489" indent="up1"><enum>(2)</enum><text>The Secretary shall establish a policy to carry out paragraph (1), including with respect to—</text><subparagraph id="id341df2fe012b4cfa81ae4cf19f65b4e6"><enum>(A)</enum><text>determining the period by which a medical center of the Department must initiate the review of a concern described in subparagraph (B) of such paragraph following the date on which the concern is received; and</text></subparagraph><subparagraph id="idcc0aceafe07d442088479d19dba7c206"><enum>(B)</enum><text>ensuring the compliance of each medical center with such policy.</text></subparagraph></paragraph></subsection><subsection id="idabbca91da4e94712b311d0c9e35c2009"><enum>(d)</enum><header>Compliance with requirements for reporting quality of care concerns</header><text>If the Secretary substantiates a concern relating to the clinical competency of, or quality of care delivered by, a health care professional of the Department (including a former health care professional of the Department), the Secretary shall ensure that the appropriate medical center of the Department timely notifies the following entities of such concern, as appropriate:</text><paragraph id="id1741c45c8acf40a3bd7b7051008f4b7f"><enum>(1)</enum><text>The appropriate licensing, registration, or certification body in each State in which the health care professional is licensed, registered, or certified.</text></paragraph><paragraph id="id799a6f50f1eb43b093e5efa46e14571b"><enum>(2)</enum><text>The Drug Enforcement Administration.</text></paragraph><paragraph id="id20dacea83bbc44f8a1b70f8cafa79234"><enum>(3)</enum><text>The National Practitioner Data Bank established pursuant to the Health Care Quality Improvement Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11101">42 U.S.C. 11101 et seq.</external-xref>).</text></paragraph><paragraph id="id04e08754523d400a835779a7ba7b855d"><enum>(4)</enum><text>Any other relevant entity.</text></paragraph></subsection><subsection id="idbbf2af0115e4482ea61d402ff0322bb4"><enum>(e)</enum><header>Prohibition on certain settlement agreement terms</header><paragraph commented="no" display-inline="yes-display-inline" id="id819bd4db587d42c3b03474a250c02062"><enum>(1)</enum><text>Except as provided in paragraph (2), the Secretary may not enter into a settlement agreement relating to an adverse action against a health care professional of the Department if such agreement includes terms that require the Secretary to conceal from the personnel file of the employee a serious medical error or lapse in clinical practice that constitutes a substantial failure to meet generally accepted standards of clinical practice as to raise reasonable concern for the safety of patients.</text></paragraph><paragraph id="id4c52cb2e4a8b4d3491d3f32850839cc3" indent="up1"><enum>(2)</enum><text>Paragraph (1) does not apply to adverse actions that the Special Counsel under section 1211 of title 5 determines constitutes a prohibited personnel practice.</text></paragraph></subsection><subsection id="ide12ad56a677c498fbbaf04bd74fd9650"><enum>(f)</enum><header>Training</header><text>Not less frequently than annually, the Secretary shall provide mandatory training on the following duties to employees of the Department who are responsible for performing such duties:</text><paragraph id="id51a7d6de77574918b411a455b5fdcd9e"><enum>(1)</enum><text>Compiling, validating, or reviewing the credentials of health care professionals of the Department.</text></paragraph><paragraph id="id37d99e30df2747a5961216d5eeea1bd6"><enum>(2)</enum><text>Reviewing the quality of clinical care delivered by health care professionals of the Department.</text></paragraph><paragraph id="id6bd0cd9c9fb24faa828cc689efc18872"><enum>(3)</enum><text>Taking adverse privileging actions or making determinations relating to other disciplinary actions or employment actions against health care professionals of the Department for reasons relating to the failure of a health care professional to meet generally accepted standards of clinical practice in a manner that presents reasonable concern for the safety of patients.</text></paragraph><paragraph id="idf08e53c716f141c29400b60e10111d6c"><enum>(4)</enum><text>Making notifications under subsection (d).</text></paragraph></subsection><subsection id="id346b6ed4fbbc43879222469c053853fd"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idf80ad42d6bdd4b4fbb88ad332272e40d"><enum>(1)</enum><text>The term <term>controlled substance</term> has the meaning given that term in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph><paragraph id="id5fdb657abd464ba8a8a71431c6dc865e"><enum>(2)</enum><text>The term <term>covered health care professional</term> means an individual employed in a position as a health care professional of the Department, or a contractor of the Department, that requires the individual to be authorized to prescribe, dispense, administer, or conduct research with, controlled substances.</text></paragraph><paragraph id="id9f8432c7230349529a48c1816138c246"><enum>(3)</enum><text>The term <term>Drug Enforcement Administration registration</term> means registration with the Drug Enforcement Administration under section 303 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823</external-xref>) by health care practitioners authorized to dispense, prescribe, administer, or conduct research with, controlled substances.</text></paragraph><paragraph id="id3fe755cb33b940fabbd22de874a29b9f" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>The term <term>health care professional of the Department</term> means an individual working for the Department in a position described in section 7401 of this title, including a contractor of the Department serving in such a position.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id2aca851311794b72b5480976dfc1d809"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 7413 the following new item:</text><quoted-block style="USC" id="ida0c30530-1f97-4adf-8c8d-25cba44dc40f"><toc><toc-entry level="section">7414. Compliance with requirements for examining qualifications and clinical abilities of health care professionals.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id15151f9972af4aa58ba088b64b6c6a4e"><enum>(c)</enum><header>Deadline for implementation</header><text>The Secretary of Veterans Affairs shall commence the implementation of section 7414 of title 38, United States Code, as added by subsection (a), by the following dates:</text><paragraph id="id3b6fb396e8cd4c1e855700778bcf227a"><enum>(1)</enum><text>With respect to subsections (a), (c)(2), (d), and (f) of such section, not later than 180 days after the date of the enactment of this Act.</text></paragraph><paragraph id="ide6650e38d8a74054b464f40622465f95"><enum>(2)</enum><text>With respect to subsection (c)(1) of such section, not later than one year after the date of the enactment of this Act.</text></paragraph><paragraph id="id1ceabc248eea4288a32b382f6466b72e" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>With respect to subsection (b)(2) of such section, not later than 18 months after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="id5e341e7e6fa74f08a1f301ae9e56cd7a"><enum>(d)</enum><header>Audits and reports</header><paragraph id="idb6a97df3e3f1420ea56490385b073c4e"><enum>(1)</enum><header>Audits</header><subparagraph id="id8835DA9A74F9410FBA9235630EAE40E5"><enum>(A)</enum><header>In general</header><text>The Secretary of Veterans Affairs shall carry out annual audits of the compliance of medical centers of the Department of Veterans Affairs with the matters required by section 7414 of title 38, United States Code, as added by subsection (a).</text></subparagraph><subparagraph id="id211BD705AB574595AA4AB988AC0E856B"><enum>(B)</enum><header>Conduct of audits</header><text>In carrying out audits under subparagraph (A), the Secretary—</text><clause id="id69871466d1fc425ebc47624bebf3b400"><enum>(i)</enum><text>may not authorize the medical center being audited to conduct the audit; and</text></clause><clause id="id53986af4e1c74e37b4d69e85bfb15081"><enum>(ii)</enum><text>may enter into an agreement with another department or agency of the Federal Government or a nongovernmental entity to conduct such audits.</text></clause></subparagraph></paragraph><paragraph id="id3eb523d79771425ea9d6f3b90b8c9895"><enum>(2)</enum><header>Reports</header><subparagraph id="id4D48B42658344444994BB77BA8F6AA20"><enum>(A)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, and annually thereafter for five years, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the audits conducted under paragraph (1).</text></subparagraph><subparagraph id="idDFDE53A604E6464C8C55DEFD0AAB0BC7"><enum>(B)</enum><header>Elements</header><text>Each report submitted under subparagraph (A) shall include a summary of the compliance by each medical center of the Department of Veterans Affairs with the matters required by section 7414 of title 38, United States Code, as added by subsection (a).</text></subparagraph><subparagraph id="id2b0805041b8547dbbf31766d380ca58e"><enum>(C)</enum><header>Initial report</header><text>The Secretary shall include in the first report submitted under subparagraph (A) the following:</text><clause id="idc9c7be53c2984758beca5b82bea52fc8"><enum>(i)</enum><text>A description of the progress made by the Secretary in implementing section 7414 of title 38, United States Code, as added by subsection (a), including any matters under such section that the Secretary has not fully implemented.</text></clause><clause id="id0424022f37e54c44b469888c49c8987e"><enum>(ii)</enum><text>An analysis of the feasibility, advisability, and cost of requiring cre­den­tial­ing employees of the Department to be trained by an outside entity and to maintain a credentialing certification.</text></clause></subparagraph></paragraph></subsection><subsection id="id0ed80390481644d5b539dbac69ace66f"><enum>(e)</enum><header>Report on updates to policy of the Department of Veterans Affairs for reporting patient safety concerns to appropriate State and other entities</header><paragraph id="idb5f59fe3f2604d3d9dd1aa6840d2f1e2"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the efforts of the Department of Veterans Affairs to update policies and practices for employees of medical centers of the Department, Veterans Integrated Service Networks, and the Veterans Health Administration to report to State licensing boards, the National Practitioner Data Bank established pursuant to the Health Care Quality Improvement Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11101">42 U.S.C. 11101 et seq.</external-xref>), and any other relevant entity health care professionals who are employed by or separated from employment with the Department and whose behavior and clinical practice so substantially failed to meet generally accepted standards of clinical practice as to raise reasonable concern for the safety of patients.</text></paragraph><paragraph id="idc7b60a600a214f08b790c64a19f898f3"><enum>(2)</enum><header>Consultation</header><text>The report required by paragraph (1) shall include a description of the efforts of the Department to consult with—</text><subparagraph id="id9995687c649a43c0b3d20a09469d307f"><enum>(A)</enum><text>State licensing boards;</text></subparagraph><subparagraph id="ida2e5da3c76eb4b82b8151dfdd68de0e5"><enum>(B)</enum><text>the Centers for Medicare &amp; Medicaid Services;</text></subparagraph><subparagraph id="id258a4ea1e3a0478c9057cabb34a53395"><enum>(C)</enum><text>the National Practitioner Data Bank; and</text></subparagraph><subparagraph id="id557c243e474a4380a4ee6bcfb0d047ef"><enum>(D)</enum><text>the exclusive representative of employees of the Department appointed under section 7401(1) of title 38, United States Code. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
