which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit consumer reporting agencies from furnishing a consumer report containing any adverse item of information about a consumer if the consumer is a victim of trafficking, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H665DD7B59DFA4E0FAE60C8325613620B"><section section-type="section-one" id="H6F5DA12C692F40F0BC5C726B90A10D5F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Debt Bondage Repair Act</short-title></quote>. </text></section><section id="H66AF46CB5F264FDBBA7E3718D6CF004D"><enum>2.</enum><header>Adverse information in cases of trafficking</header><subsection id="H7C4DCECD47204B3899AF9F2CC1973E33"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681 et seq.</external-xref>) is amended by inserting after section 605B the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H09CFF7F5C1764F878D31A47532F0166D"><section id="HD6452F4118C5436DAF617C3EAC3D5E96"><enum>605C.</enum><header>Adverse information in cases of trafficking</header><subsection id="H8FF3591164EB402B80E82A459D735CFB"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HB77EBF9800DB4594B22449D9A87222F6"><enum>(1)</enum><header>Trafficking documentation</header><text display-inline="yes-display-inline">The term <term>trafficking documentation</term> means—</text><subparagraph id="HF5FA5B73D10A4ACAA842BB9ABE37E0C9"><enum>(A)</enum><text>documentation of—</text><clause id="H0462DCBB86B240B7B8D93C34A3D2A655"><enum>(i)</enum><text display-inline="yes-display-inline">a determination by a Federal or State governmental entity that a consumer is a victim of trafficking; or</text></clause><clause id="HB1F549607AC745AAA3EA5C4F10205A9E"><enum>(ii)</enum><text>a determination by a court of competent jurisdiction that a consumer is a victim of trafficking; and</text></clause></subparagraph><subparagraph id="HDA256BD6613D4A9C841DD6EE2E980B09"><enum>(B)</enum><text display-inline="yes-display-inline">documentation that identifies items of adverse information that should not be furnished by a consumer reporting agency because the items resulted from the severe form of trafficking in persons or sex trafficking of which the consumer is a victim. </text></subparagraph></paragraph><paragraph id="HBCBE87B68B9F4732986DE19FFC191F97"><enum>(2)</enum><header>Victim of trafficking</header><text display-inline="yes-display-inline">The term <term>victim of trafficking</term> means a person who is a victim of a severe form of trafficking in persons or sex trafficking, as those terms are defined in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text></paragraph></subsection><subsection id="H2B0AB2C4E8F14EB88A14340B62762669"><enum>(b)</enum><header>Adverse information</header><text display-inline="yes-display-inline">A consumer reporting agency may not furnish a consumer report containing any adverse item of information about a consumer that resulted from a severe form of trafficking in persons or sex trafficking if the consumer has provided trafficking documentation to the consumer reporting agency.</text></subsection><subsection id="HC1B62515189342CF85FD32458B354E9A"><enum>(c)</enum><header>Rulemaking</header><paragraph id="HEB6724510CFF461D8F3271F62B50E960"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this section, the Director shall promulgate regulations to implement subsection (a).</text></paragraph><paragraph id="H2021651EE1464B61A0C8B958C4B8185A"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The regulations issued pursuant to paragraph (1) shall establish a method by which consumers shall submit trafficking documentation to consumer reporting agencies.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6BAC63AFA8D840E1BB711EEAF5D64A42"><enum>(b)</enum><header>Table of contents amendment</header><text display-inline="yes-display-inline">The table of contents of the Fair Credit Reporting Act is amended by inserting after the item relating to section 605B the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3A4D75EA3E3D44679A22FD6A6B57D9D2"><toc regeneration="no-regeneration"><toc-entry level="section">605C. Adverse information in cases of trafficking.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4C73544D0FF646EA9EC7948EEA1F30A3"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to any trafficking documentation, as defined in section 605C(a) of the Fair Credit Reporting Act, as added by subsection (a) of this section, provided on or after the date that is 30 days after the date on which the Director of the Bureau of Consumer Financial Protection promulgates regulations pursuant to subsection (c) of section 605C.</text></subsection></section></legis-body></bill>
