which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit Federal funds from being made available to teach the 1619 Project curriculum in elementary schools and secondary schools, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Saving American History Act of 2021</short-title></quote>.</text></section><section id="idA0571FA778CF4B5794F47C3C2CF77A0D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id856083f3454a4f6398d66fbbb47d3bd6"><enum>(1)</enum><text>The true date of America’s founding is July 4, 1776, the day the Declaration of Independence was adopted by the Second Continental Congress.</text></paragraph><paragraph id="idcb2f22cc577e40678251b5eece8344e2"><enum>(2)</enum><text>The self-evident truths set forth by that Declaration are the fundamental principles upon which America was founded.</text></paragraph><paragraph id="idc54df6cc93724352b76d97fffad49b5a"><enum>(3)</enum><text>An activist movement is now gaining momentum to deny or obfuscate this history by claiming that America was not founded on the ideals of the Declaration but rather on slavery and oppression.</text></paragraph><paragraph id="id5a58559143a74078b1e2e21516b1874e"><enum>(4)</enum><text>This distortion of American history is being taught to children in public school classrooms via the New York Times’ <quote>1619 Project</quote>, which claims that <quote>nearly everything that has truly made America exceptional</quote> grew <quote>out of slavery</quote>.</text></paragraph><paragraph id="id22833bf29cfc4eb28e9bef08c924ee1f"><enum>(5)</enum><text>The 1619 Project is a racially divisive and revisionist account of history that threatens the integrity of the Union by denying the true principles on which it was founded.</text></paragraph><paragraph id="id5231150afa3344a5ac3e90362ee849f2"><enum>(6)</enum><text>The Federal Government has a strong interest in promoting an accurate account of the Nation’s history through public schools and forming young people into knowledgeable and patriotic citizens. </text></paragraph></section><section id="id8AE01FD3741A40F3BB82D3479CE245FB"><enum>3.</enum><header>Prohibition of Federal funding for schools to teach the 1619 Project curriculum</header><subsection id="idEA5A481CF2964761A0BD0E84DA5C2289"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id47A5021E0D9642658B690D0510D9BB14"><enum>(1)</enum><header>ESEA</header><text>The terms <term>elementary school</term>, <term>local educational agency</term>, and <term>secondary school</term> have the meanings given the terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>). </text></paragraph><paragraph id="idF58B4B569ACD4661818550862B83CC73"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretaries</term> means the Secretary of Education, the Secretary of Agriculture, the Secretary of Health and Human Services, the Secretary of Defense, and the Secretary of the Interior.</text></paragraph></subsection><subsection id="idD51C1E43ED32493F9A1E4D092BBF2280"><enum>(b)</enum><header>Prohibition of use of federal funding for 1619 Project</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no Federal funds shall be used by any—</text><paragraph id="id6A4C7C2E62BC4F11B2754EFEE9A059EF"><enum>(1)</enum><text display-inline="yes-display-inline">elementary school or secondary school to teach the 1619 Project initiative of the New York Times in such school; or</text></paragraph><paragraph id="id95D77F5F20F74DA7BEA9CA51F2457675"><enum>(2)</enum><text>local educational agency to support the teaching of the 1619 Project initiative of the New York Times in the public schools served by such agency.</text></paragraph></subsection><subsection id="id44690292BE8B4196BFF33117A650F743"><enum>(c)</enum><header>Determination of cost and reduction in federal funds</header><paragraph id="idDEEB1C2B05FE43A0A8FBA833E1318621"><enum>(1)</enum><header>In general</header><text>In the case of an elementary school or secondary school that receives Federal funds and teaches the 1619 Project initiative of the New York Times in such school or a local educational agency that supports the teaching of the 1619 Project initiative of the New York Times in the public schools served by such agency, the Secretaries shall determine the cost associated with teaching the 1619 Project, including in planning time and teaching time. </text></paragraph><paragraph id="idF2D3B76A73854D438A2949D0D7699F24"><enum>(2)</enum><header>Reductions</header><text>The Secretaries, based on coordinated prorated formulas established by the Secretaries, shall reduce Federal funds provided to an elementary school, secondary school, or local educational agency described in paragraph (1) in an amount equal to the cost amount determined under paragraph (1).</text></paragraph><paragraph id="id7D2A74C992E84289AEADCE890C4D9982"><enum>(3)</enum><header>No reduction for certain funds</header><text>In reducing Federal funds to an elementary school, secondary school, or local educational agency under paragraph (2), the Secretaries shall not reduce Federal funds for—</text><subparagraph id="idB7FE8B0D8D924E7C9FF2E65F8D701E08"><enum>(A)</enum><text>the free and reduced price school lunch program established under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>), or any other program for low-income students; or </text></subparagraph><subparagraph id="id54076CCB4C6849469FC45118193EE9FF"><enum>(B)</enum><text>students with disabilities.</text></subparagraph></paragraph></subsection><subsection id="id9B25DF25FD8E41EE8CE513CA33936B63"><enum>(d)</enum><header>Future funding</header><text>The Secretaries shall promulgate regulations to ensure that Federal funds provided after the date of enactment of this Act to an elementary school, secondary school, or local educational agency comply with the requirements and restrictions provided under this Act.</text></subsection></section></legis-body></bill>
