which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide loan forgiveness for certain borrowers of Department of Agriculture direct farm loans, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Relief for America's Small Farmers Act</short-title></quote>.</text></section><section id="idB2324479D1214AF7AB40CB0C97923319"><enum>2.</enum><header>Direct farm loan forgiveness</header><subsection id="id8517F4B3CC4F4EA284D987F1787E0D96"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id2ED4A651AB1A409C9696E680E6FB9497"><enum>(1)</enum><header>Eligible borrower</header><text>The term <term>eligible borrower</term> means a borrower of an eligible loan that is actively engaged in farming (within the meaning of section 1001A of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/7/1308-1">7 U.S.C. 1308–1</external-xref>)) with respect to a farming operation—</text><subparagraph id="id75460E03F2DD4F3DA7ADCAB72CDB73D4"><enum>(A)</enum><text>for which the eligible loan was made; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7F607DC91E4645E786B1B03ADA3C1557"><enum>(B)</enum><text>the average annual adjusted gross income for the previous 5-year period of which is not more than $300,000. </text></subparagraph></paragraph><paragraph id="id54CB207CEA1D414BA09B9AC72B4E4993"><enum>(2)</enum><header>Eligible loan</header><text>The term <term>eligible loan</term> means a loan made before March 19, 2020, that is—</text><subparagraph id="idA625ACE77B794906814C74197161E23F"><enum>(A)</enum><text>a direct farm ownership loan under subtitle A of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1922">7 U.S.C. 1922 et seq.</external-xref>);</text></subparagraph><subparagraph id="id8A8385F591F64F7F9A25B2EB1DC115EF"><enum>(B)</enum><text>a direct operating loan under subtitle B of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1941">7 U.S.C. 1941 et seq.</external-xref>); or</text></subparagraph><subparagraph id="id41D51D68E80544938A63B423E8731903"><enum>(C)</enum><text>an emergency loan under subtitle C of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1961">7 U.S.C. 1961 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="idF9B4A23A973D4658B2EE05476BDC303F"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="id2B7D9569943247D9AEF3E3768458569E"><enum>(b)</enum><header>Loan forgiveness</header><paragraph id="idAC1B1955A3AD4FC7BA5531E1ADF9FA39"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date on which the Secretary receives an application under paragraph (2), subject to paragraphs (3) and (4), the Secretary shall cancel the obligation to repay the balance of principal and interest due as of the date of enactment of this Act on an eligible loan for the eligible borrower.</text></paragraph><paragraph id="id60DF52473792414BA4279E6F5F51299D"><enum>(2)</enum><header>Applications</header><text>To be eligible for cancellation under paragraph (1), not later than 1 year after the date of enactment of this Act, an eligible borrower shall submit to the Secretary an application, which shall cover all eligible loans for which the eligible borrower is seeking cancellation.</text></paragraph><paragraph id="id9506F23B7B704220910F2BA7A6A45057"><enum>(3)</enum><header>Limitations</header><text>The total amount cancelled under paragraph (1) with respect to a farming operation shall be not more than $250,000. </text></paragraph><paragraph id="id7863A8CD4F2141979AC5BFBBB16B106D"><enum>(4)</enum><header>Condition</header><text>The cancellation of an obligation under paragraph (1) shall be subject to the condition that the applicable eligible borrower shall continue to be actively engaged in farming (within the meaning of section 1001A of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/7/1308-1">7 U.S.C. 1308–1</external-xref>)) for the 2-year period beginning on the date on which the Secretary cancels the obligation under that paragraph.</text></paragraph></subsection><subsection id="id763614FC85F04600824D486BFE4DE986"><enum>(c)</enum><header>Effect</header><text>An eligible borrower that receives cancellation of an obligation with respect to an eligible loan under subsection (b)(1) shall not be determined to be ineligible for any loan under subtitle A, B, or C of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1922">7 U.S.C. 1922 et seq.</external-xref>) because of that cancellation.</text></subsection><subsection id="idFCC8FDFCDEC84B36ADC6D4C9124B483E"><enum>(d)</enum><header>Taxability</header><text>For purposes of the Internal Revenue Code of 1986, any amount which (but for this subsection) would be includible in gross income of the eligible borrower by reason of forgiveness described in subsection (b) shall be excluded from gross income. </text></subsection><subsection id="idd91655a450f244759f8f715b2a72a2d9"><enum>(e)</enum><header>Emergency funding</header><paragraph id="id58fdce520d8f4aa3bdbebdc45a00878c"><enum>(1)</enum><header>In general</header><text>Out of amounts in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary $10,000,000,000 to provide loan forgiveness under subsection (b), to remain available until expended.</text></paragraph><paragraph id="id1e8503ca664946509fa8e0d53c5f3be8"><enum>(2)</enum><header>Receipt and acceptance</header><text>The Secretary shall be entitled to receive, shall accept, and shall use to provide loan forgiveness under subsection (b) the amount transferred under paragraph (1), without further appropriation.</text></paragraph><paragraph id="id8f3e9bb6bac043ff9a024d0c3c1a2b4e"><enum>(3)</enum><header>Emergency designation</header><subparagraph id="id4b3471387956405aae770937bef9861b"><enum>(A)</enum><header>In general</header><text>The amounts provided by this subsection are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)</external-xref>).</text></subparagraph><subparagraph id="idbb5e500409f54289b1b27e2ea4852c05"><enum>(B)</enum><header>Designation in Senate</header><text>In the Senate, this subsection is designated as an emergency requirement pursuant to section 4112(a) of H. Con. Res. 71 (115th Congress), the concurrent resolution on the budget for fiscal year 2018.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
