<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2013</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210610">June 10, 2021</action-date><action-desc><sponsor name-id="S309">Mr. Casey</sponsor> (for himself, <cosponsor name-id="S376">Ms. Ernst</cosponsor>, <cosponsor name-id="S153">Mr. Grassley</cosponsor>, and <cosponsor name-id="S402">Ms. Rosen</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the coverage of medically necessary food and vitamins and individual amino acids for digestive and inherited metabolic disorders under Federal health programs and private health insurance, to ensure State and Federal protection for existing coverage, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H86D9F22DE05C49ED8D24A2D78B8A4CEA"><section section-type="section-one" id="HEF17885276DB4D3EAF9A0660EA6DFA44"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medical Nutrition Equity Act of 2021</short-title></quote>.</text></section><section id="HA23457A3D5D540C9AEB06FA023DC6F45"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HCAF831D95ED14F90B7366C6E603FF039"><enum>(1)</enum><text>Each year, thousands of children and adults in the United States are diagnosed with certain digestive or inherited metabolic disorders that prevent their bodies from digesting or metabolizing the food they need to survive. For them, medically necessary food, which can often be administered as an orally consumed formula, is their treatment.</text></paragraph><paragraph id="H57A4C7F3C5954E59A6F5203E1CDEB644"><enum>(2)</enum><text>Without medically necessary food, these patients risk malnutrition, surgery, and repeated hospitalizations. They may suffer intellectual disability or even death. Risks in pediatric populations are particularly profound and often severe and also include inadequate growth, abnormal development, cognitive impairment, and behavioral disorders. Specialized medically necessary food is standard-of-care therapy for these patients and is essential to preventing such outcomes.</text></paragraph><paragraph id="H82ED816499264E019EAC18B389959F69"><enum>(3)</enum><text>While not every person diagnosed with these conditions needs to be treated with medically necessary food for a prolonged period, it is critical that patients and their physicians be able to consider the full range of options and select the treatment that will be most effective for each patient.</text></paragraph><paragraph id="H051112427F424F518F3F4013C3EBB2D2"><enum>(4)</enum><text>Insurance companies will typically cover pharmaceuticals or biologics for treatment of many of these conditions, if there is a Food and Drug Administration-approved therapy. However, these types of treatments may not be the first-line therapy a physician would recommend, do not work for all patients, and can have undesirable risks, such as cancer or suppression of the immune system, which can increase a patient’s risk of infection.</text></paragraph><paragraph id="H82015E4DF37C4DEEA069E451690D2CDB"><enum>(5)</enum><text>Even when an insurance company does cover medically necessary food, it can come with the stipulation the formula be administered through a feeding tube, placed through the nose into the stomach or surgically placed directly into the stomach or jejunum, even if a patient is capable of taking the formula orally without these devices. Surgical placement of feeding tubes unnecessarily results in increased risk to the patient and increased cost to the healthcare system. </text></paragraph><paragraph id="id74223582226f48328a5f4921b9c6205f"><enum>(6)</enum><text>Testing for select inherited metabolic disorders is required in all States, and approximately 2,000 babies per year are diagnosed with one of these disorders that requires treatment through medically necessary food. Yet, policies on medically necessary food vary significantly and do not always make it possible for families to get sufficient nutrition for their affected children which can lead to delayed development, brain damage, and even death. </text></paragraph><paragraph id="id62d6f21e11da4ca8af60449279b004be"><enum>(7)</enum><text>The worsening of food insecurity during the COVID–19 pandemic has had a significant impact on patients who rely on medical nutrition, and the cost of meeting their dietary needs has been a major burden to individuals facing financial challenges as a result of the pandemic. </text></paragraph></section><section id="id20A37E727D394634A13EF106A00FF1A1"><enum>3.</enum><header>Coverage of medically necessary food, vitamins, and individual amino acids for digestive and inherited metabolic disorders under Federal health programs and private health insurance</header><subsection id="idA4E870CE862E4DA0B738370F139512F4"><enum>(a)</enum><header>Coverage under the Medicare program</header><paragraph id="id3943AFC5FF634BC69585EA54B1EB6810"><enum>(1)</enum><header>Medically necessary food</header><subparagraph id="idEA73AD3A94B34936817DAA3598A5A878"><enum>(A)</enum><header>In general</header><text>Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text><clause id="id8BB07E25B0374C56A0BE212F745897A7"><enum>(i)</enum><text>in subparagraph (GG), by striking <quote>and</quote> at the end;</text></clause><clause id="id5584FAE7979048B4A43AEF5BB56A77F1"><enum>(ii)</enum><text>in subparagraph (HH), by striking the period and inserting <quote>and</quote>; and</text></clause><clause id="idB0F03EE77287456FA7D151432EBE6E78"><enum>(iii)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD18981944E9C48A882CF5B492FC4DB72"><subparagraph id="id0B4B6030D24E485781FEF0D7664F4DBF" indent="up1"><enum>(II)</enum><text>medically necessary food (as defined in subsection (lll)) and, if required, the medical equipment and supplies necessary to administer such food (other than medical equipment and supplies described in subsection (n));</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id60542A5A64C240C39C51F6EB84765DB1"><enum>(B)</enum><header>Definition</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="other" display-inline="no-display-inline" id="idCF488AE0491141A7A23026C3F66F0AB7" other-style="archaic"><subsection id="id9B0808B258CC46A9A25154905A078AB6"><enum>(lll)</enum><header>Medically Necessary Food</header><paragraph commented="no" display-inline="yes-display-inline" id="id034CAE21B879458C9EFDC29EB6655AB0"><enum>(1)</enum><text>Subject to paragraph (2), the term <term>medically necessary food</term> means food, including a low protein modified food product, an amino acid preparation product, a modified fat preparation product, or a nutritional formula (including such a formula that does not require a prescription), that is—</text><subparagraph id="id7FBD56C5F4A347EFB1603A5C0F088097" indent="up1"><enum>(A)</enum><text>furnished pursuant to the prescription, order, or recommendation (as applicable) of a physician or other health care professional qualified to make such prescription, order, or recommendation, for the dietary management of a covered disease or condition;</text></subparagraph><subparagraph id="idA0744DA595C3480CA7EAA7CBCD2FF3DB" indent="up1"><enum>(B)</enum><text>a specially formulated and processed product (as opposed to a naturally occurring foodstuff used in its natural state) for the partial or exclusive feeding of an individual by means of oral intake or enteral feeding by tube;</text></subparagraph><subparagraph id="id2ADF5E2C7E1E4EC0BF0D55EFBF789B93" indent="up1"><enum>(C)</enum><text>intended for the dietary management of an individual who, because of a specified disease or condition, has limited or impaired capacity to ingest, digest, absorb, or metabolize ordinary foodstuffs or certain nutrients, or who has other special medically determined nutrient requirements, the dietary management of which cannot be achieved by the modification of the normal diet alone;</text></subparagraph><subparagraph id="id20E519BA82CF4FD48678B14B7904FB14" indent="up1"><enum>(D)</enum><text>intended to be used under medical supervision, which may include in a home setting; and</text></subparagraph><subparagraph id="idC8C70A8607FD4CBEAFE487AAC70217F1" indent="up1"><enum>(E)</enum><text>intended only for an individual receiving active and ongoing medical supervision wherein the individual requires medical care on a recurring basis for, among other things, instructions on the use of the food.</text></subparagraph></paragraph><paragraph id="id07E126A05343482295284533ACCC4F79" indent="up1"><enum>(2)</enum><text>For purposes of paragraph (1), the term <term>medically necessary food</term> does not include the following:</text><subparagraph id="id29EF62BABBDA4D159C69AC865C0D2109"><enum>(A)</enum><text>Foods taken as part of an overall diet designed to reduce the risk of a disease or medical condition or as weight loss products, even if they are recommended by a physician or other health professional.</text></subparagraph><subparagraph id="idEAC3C6751D7F488FAC70D0620A20EC20"><enum>(B)</enum><text>Foods marketed as gluten-free for the management of celiac disease or non-celiac gluten sensitivity.</text></subparagraph><subparagraph id="id99E977C29B8E4F52980D9EC514C9624A"><enum>(C)</enum><text>Foods marketed for the management of diabetes.</text></subparagraph><subparagraph id="id82053551324E49E7975080F33B470E25"><enum>(D)</enum><text>Other products determined appropriate by the Secretary.</text></subparagraph></paragraph><paragraph id="idA41EFADFFA5E491F9953911138219AEC" indent="up1"><enum>(3)</enum><text>In this subsection, the term <term>covered disease or condition</term> means the following diseases or conditions:</text><subparagraph id="id0EE160151FA74964B55AC6DB781668E2"><enum>(A)</enum><text>Inherited metabolic disorders, including the following:</text><clause id="id9CB5341CF0504CD4ACB31658B64D89A5"><enum>(i)</enum><text>Disorders classified as metabolic disorders on the Recommended Uniform Screening Panel Conditions list of the Secretary of Health and Human Services’ Advisory Committee on Heritable Disorders in Newborns and Children.</text></clause><clause id="idB736AFFB8ABE4F048C4C6E3154D3758A"><enum>(ii)</enum><text>N-acetyl glutamate synthase deficiency.</text></clause><clause id="id0D0BB9B1DC9D41B49BA2B25F213988C1"><enum>(iii)</enum><text>Ornithine transcarbamlyase deficiency.</text></clause><clause id="idAE2DEEAD43A04B3193B266F2BAF4158E"><enum>(iv)</enum><text>Carbamoyl phosphate synthestase deficiency.</text></clause><clause id="id2B566745B9A04FD2A57BF76AB8D03F0E"><enum>(v)</enum><text>Inherited disorders of mitochondrial functioning.</text></clause></subparagraph><subparagraph id="idDB56A8E0B23D4624B27BB5E987E177D0"><enum>(B)</enum><text>Medical and surgical conditions of malabsorption, including the following:</text><clause id="id3911A51F80B14A8AA1A93F2A2AC4A251"><enum>(i)</enum><text>Impaired absorption of nutrients caused by disorders affecting the absorptive surface, functional length, and motility of the gastrointestinal tract, including short bowel syndrome and chronic intestinal pseudo-obstruction.</text></clause><clause id="idADAAA2E8377A4F74AD5FD4174CE1076F"><enum>(ii)</enum><text>Malabsorption due to liver or pancreatic disease.</text></clause></subparagraph><subparagraph id="id6813ED5EDDBC4B61A2296957F27EE621"><enum>(C)</enum><text>Immunoglobulin E and non-Immunoglobulin E-mediated allergies to food proteins, including the following:</text><clause id="id8BD27E34C49341108AAD05B2E6FE054B"><enum>(i)</enum><text>Immunoglobulin E and non-Immunoglobulin E-mediated allergies to food proteins.</text></clause><clause id="id5531E8CF50B74619BA537232C0A589E6"><enum>(ii)</enum><text>Food protein-induced enterocolitis syndrome.</text></clause><clause id="id6605ADAB800E4A6E907C5C136A4C6CA5"><enum>(iii)</enum><text>Eosinophilic disorders, including eosinophilic esophagitis, eosinophilic gastroenteritis, eosinophilic colitis, and post-transplant eosinophilic disorders.</text></clause></subparagraph><subparagraph id="idFA8132A853A442FCBCF3D3696B52F823"><enum>(D)</enum><text>Inflammatory or immune mediated conditions of the alimentary tract, including the following:</text><clause id="id854CBC64CF9C40FBB6C50505657CE884"><enum>(i)</enum><text>Inflammatory bowel disease, including Crohn’s disease, ulcerative colitis, and indeterminate colitis.</text></clause><clause id="idA39EA444A58545A5A103D16AEBF5D21E"><enum>(ii)</enum><text>Gastroesophageal reflux disease that is nonresponsive to standard medical therapies.</text></clause></subparagraph><subparagraph id="idD1492B2E399245E38CE029DA4EA49EFF"><enum>(E)</enum><text>Any other disease or condition determined appropriate by the Secretary in consultation with appropriate scientific entities, such as the Agency for Healthcare Research and Quality. </text></subparagraph></paragraph><paragraph commented="no" id="idF6A39CD1A86B4CC9A2C8F3CBA0065467" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id84A63B550B3B4FFC89689A13CCEA02DB"><enum>(A)</enum><text>In this subsection, the term <term>low protein modified food product</term> means a type of medical food that is modified to be low in protein and formulated for oral consumption for individuals with inborn errors of protein metabolism.</text></subparagraph><subparagraph commented="no" id="id1AA1BDF4405C4CB9B5115C6F0A20F918" indent="up1"><enum>(B)</enum><text>Such term does not include foods that are naturally low in protein, such as some fruits or vegetables.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="id27C0D6F521E546058A1D3DA16E498424"><enum>(C)</enum><header>Payment</header><text>Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text><clause id="id122297C15879478F85A12EA1EC6111C9"><enum>(i)</enum><text>by striking <quote>and</quote> before <quote>(DD)</quote>; and</text></clause><clause id="id4E786333CB334CA38EF4F7616784FFEB"><enum>(ii)</enum><text>by inserting before the semicolon at the end the following: <quote>and (EE) with respect to medically necessary food (as defined in section 1861(lll)), the amount paid shall be an amount equal to 80 percent of the lesser of the actual charge for the services or the amount determined under a fee schedule established by the Secretary for purposes of this subparagraph.</quote>.</text></clause></subparagraph><subparagraph id="id9921453F43334136B0E1EBB031E7CDB2"><enum>(D)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply to items and services furnished on or after the date that is 1 year after the date of the enactment of this Act.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id76A8EA71BEEE40C487C12337E949D13A"><enum>(2)</enum><header>Inclusion of medically necessary vitamins and individual amino acids as a covered part D drug</header><subparagraph commented="no" display-inline="no-display-inline" id="id2A6811BF62334F898B9F8A7A54505760"><enum>(A)</enum><header>In general</header><text>Section 1860D–2(e)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(e)(1)</external-xref>) is amended—</text><clause commented="no" display-inline="no-display-inline" id="id4485E910F9C44C379D636E0C2CDD4EEE"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>or</quote> at the end;</text></clause><clause commented="no" display-inline="no-display-inline" id="id132B73834576473CAA115535DF666438"><enum>(ii)</enum><text>in subparagraph (B), by striking the comma at the end and inserting <quote>; or</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idD02DB305012E48D48540FB5408D2ED00"><enum>(iii)</enum><text>by inserting after subparagraph (B) the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id638A410960334DEB85CF5A7D932D796A"><subparagraph commented="no" display-inline="no-display-inline" id="idF5E25232C25D48748B720C2B2703F9A6"><enum>(C)</enum><text>medically necessary vitamins and individual amino acids used for the management of a covered disease or condition (as defined in section 1861(lll)(3)) pursuant to the prescription, order, or recommendation (as applicable) of a physician or other health care professional qualified to make such prescription, order, or recommendation,</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id06F86B8EAD024B1A98D916E65E14148F" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Effective date</header><text>The amendments made by subparagraph (A) shall apply to plan years beginning on or after the date that is 1 year after the date of the enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="HA8C4B377641A4033AD2D60CD02A5AE6B"><enum>(b)</enum><header>Coverage under the Medicaid program</header><paragraph id="HC9BD58FF7409492CB70B3AE4730B5B9F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended—</text><subparagraph id="HEA089D8ECD274D719F65FCC80F3E3F2C"><enum>(A)</enum><text>in paragraph (30), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H8C9E4898A54844ACBAF4D08E2E3D857F"><enum>(B)</enum><text>by redesignating paragraph (31) as paragraph (33); and</text></subparagraph><subparagraph id="HD097C861D54F48E885C0C5614FD9AB04"><enum>(C)</enum><text>by inserting after paragraph (30) the following new paragraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5423CB524B554E9D9D27F81C67AF3918"><paragraph id="H83D28074FE2648D09579C39D75C68B42"><enum>(31)</enum><text display-inline="yes-display-inline">medically necessary food (as defined in section 1861(lll)) and the medical equipment and supplies necessary to administer such food;</text></paragraph><paragraph id="H8487E03C0C734E849450040501CB4965"><enum>(32)</enum><text display-inline="yes-display-inline">medically necessary vitamins and individual amino acids used for the management of a covered disease or condition (as defined in section 1861(lll)(3)) pursuant to the prescription, order, or recommendation (as applicable) of a physician or other health care professional qualified to make such prescription, order, or recommendation; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HCC528D976E6F4DA0923EBABE847444D7"><enum>(2)</enum><header>Conforming amendments</header><subparagraph id="H25E213104C3045E7AC8F6A90610B80C6"><enum>(A)</enum><header>Mandatory benefits</header><text>Section 1902(a)(10)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)</external-xref>) is amended, in the matter preceding clause (i), by striking <quote>and (30)</quote> and inserting <quote>(30), (31), and (32)</quote>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H87D92E442EC043388C46B73CD0348F29"><enum>(B)</enum><header>Exception to coverage restriction</header><text>Section 1927(d)(2)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-8">42 U.S.C. 1396r–8(d)(2)(E)</external-xref>) is amended by inserting <quote>and except for medically necessary vitamins and individual amino acids described in section 1905(a)(32)</quote> before the period at the end.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7FB03D64AB894518AFCBD48C9D72B099"><enum>(3)</enum><header>Effective date</header><subparagraph commented="no" display-inline="no-display-inline" id="HE1206E3BB26146509176F7753643F531"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the amendments made by this subsection shall take effect on the date that is 1 year after the date of the enactment of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA933AADD9B33434888A471F549B9C3ED"><enum>(B)</enum><header>Exception to effective date if State legislation required</header><text>In the case of a State plan for medical assistance under title XIX of the Social Security Act which the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirements imposed by the amendments made by this subsection, the State plan shall not be regarded as failing to comply with the requirements of such title solely on the basis of its failure to meet this additional requirement before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of the enactment of this Act. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of such session shall be deemed to be a separate regular session of the State legislature.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6680A71460E04577B2D4303ACA231C9C"><enum>(c)</enum><header>Coverage under CHIP</header><paragraph commented="no" display-inline="no-display-inline" id="H3CAF759AB278444DAD17C614AF5907E2"><enum>(1)</enum><header>In general</header><text>Section 2103(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397cc">42 U.S.C. 1397cc(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD8C0E976A4E940AD8ADF30345849D937"><paragraph commented="no" display-inline="no-display-inline" id="H935F300FE8434DC88AA61B292D505F77"><enum>(12)</enum><header>Medically necessary food</header><text>The child health assistance provided to a targeted low-income child under the plan shall include coverage of medically necessary food (as defined in section 1861(lll)) and the medical equipment and supplies necessary to administer such food.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB12F418038DB473A84B299D50EE3B03C"><enum>(13)</enum><header>Certain vitamins and individual amino acids</header><text>The child health assistance provided to a targeted low-income child under the plan shall include coverage of medically necessary vitamins and individual amino acids used for the management of a covered disease or condition (as defined in section 1861(lll)(3)) pursuant to the prescription, order, or recommendation (as applicable) of a physician or other health care professional qualified to make such prescription, order, or recommendation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5EDAC558340745F99A872C1029793626"><enum>(2)</enum><header>Conforming amendment</header><text>Section 2103(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397cc">42 U.S.C. 1397cc(a)</external-xref>) is amended, in the matter preceding paragraph (1), by striking <quote>and (8)</quote> and inserting <quote>(8), (12), and (13)</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA4426A993D3B419591957EE51D54A6A4"><enum>(3)</enum><header>Effective date</header><subparagraph commented="no" display-inline="no-display-inline" id="HE3F27A9DC2884900BC6B3A86470CE9F8"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the amendments made by this subsection shall take effect on the date that is 1 year after the date of the enactment of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H64B120D987FE4118A702EA7ADA326666"><enum>(B)</enum><header>Exception to effective date if State legislation required</header><text>In the case of a State child health plan for child health assistance under title XXI of the Social Security Act which the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirements imposed by the amendments made by this subsection, the State child health plan shall not be regarded as failing to comply with the requirements of such title solely on the basis of its failure to meet this additional requirement before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of the enactment of this Act. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of such session shall be deemed to be a separate regular session of the State legislature.</text></subparagraph></paragraph></subsection><subsection id="HEE147F1C2B5744B8AAB8252C3B720C1A"><enum>(d)</enum><header>Modification of definition of medically necessary food and covered disease or condition under the
 TRICARE program</header><paragraph id="HAD6007EEC8544F1F8DBC761AA1066211"><enum>(1)</enum><header>In general</header><text>Section 1077(h) of title 10, United States Code, is amended—</text><subparagraph id="H556DC6D54C404F4A86F1EF09E7E9C3F7"><enum>(A)</enum><text>in paragraph (2)(A), in the matter preceding clause (i), by striking <quote>or an amino acid preparation product</quote> and inserting <quote>, an amino acid preparation product, a modified fat preparation product, or a nutritional formula (including such a formula that does not require a prescription)</quote>; and</text></subparagraph><subparagraph id="HDA1DF0DDA8E848159174C023F8217D80"><enum>(B)</enum><text>in paragraph (3)—</text><clause id="HFFBD6C62D7D74D17A075AECD6EB608EF"><enum>(i)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></clause><clause id="H2DB095D00B934FB5B5D44CA80BD0E9A5"><enum>(ii)</enum><text>by redesignating subparagraph (E) as subparagraph (F); and</text></clause><clause id="H23588706C48941BC873EF082B6A959BA"><enum>(iii)</enum><text>by inserting after subparagraph (D) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H834E08A3327344F18BEE4B5478C25058"><subparagraph id="HF0EED9F08F5E49E2A521A85CCAA9BFD5" indent="up1"><enum>(E)</enum><text>Immunoglobulin E or non-Immunoglobulin E mediated allergies to food proteins; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H5EB8C947CD094F7696453FAE1C9E490E"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall apply to health care provided under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">chapter 55</external-xref> of title 10, United States Code, on or after the date that is one year after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H94C180C43E4B410385442376F477BCEA"><enum>(e)</enum><header>Coverage under FEHBP</header><paragraph id="HD5A85D17C5564D0BAFC0F47B67678188"><enum>(1)</enum><header>In general</header><text>Section 8902 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD64854FC46A14E778A95810677C55780"><subsection id="HD80C30005E6947B6ADE0A1D55C2BC252"><enum>(q)</enum><text display-inline="yes-display-inline">A contract for a plan under this chapter shall require the carrier to provide coverage for—</text><paragraph id="HAED1D2FA0EF24472AB4B2DF450D466F6"><enum>(1)</enum><text display-inline="yes-display-inline">medically necessary food (as defined in section 1861(lll) of the Social Security Act) and the medical equipment and supplies necessary to administer such food; and</text></paragraph><paragraph id="H560A51A287BA4323A1FC89526C02273D"><enum>(2)</enum><text>medically necessary vitamins and individual amino acids in the same manner provided for under section 1860D–2(e)(1)(C) of the Social Security Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC88420B762D8430BBC10D1068A6C990E"><enum>(2)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply with respect to contract years beginning on or after the date that is 1 year after the date of enactment of this Act.</text></paragraph></subsection><subsection id="H31843AD1BF724FF0A9A54F5DE19A5320"><enum>(f)</enum><header>Coverage under private health insurance</header><paragraph id="H0DD9521667D748B4A6F10D953560F8B6"><enum>(1)</enum><header>In general</header><text>Subpart II of part A of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-11">42 U.S.C. 300gg–11 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5D01CB4C52F34CACA81C9EC251216EC9"><section id="HFE2C3682038C4DA6966B612F8F24C6B7"><enum>2729A.</enum><header>Coverage of medically necessary food, vitamins, and individual amino acids</header><text display-inline="no-display-inline">A health insurance issuer offering group or individual health insurance coverage shall provide coverage for—</text><paragraph id="H51BDA89C54F5463D9176246040BEBCBB"><enum>(1)</enum><text display-inline="yes-display-inline">medically necessary food (as defined in section 1861(lll) of the Social Security Act) and the medical equipment and supplies necessary to administer such food; and</text></paragraph><paragraph id="H2DA3FEA959A944F9B14389412C3530E8"><enum>(2)</enum><text>medically necessary vitamins and individual amino acids in the same manner provided for under section 1860D–2(e)(1)(C) of the Social Security Act.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDC00100DE0704C48926F459664BB8351"><enum>(2)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply to plan years beginning on or after the date that is 1 year after the date of the enactment of this Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H92114143941D4A80808916DB286A8DF2"><enum>(g)</enum><header>Nonpreemption of State laws that provide greater coverage</header><text display-inline="yes-display-inline">Nothing in the provisions of, or the amendments made by, this section shall preempt a State law that requires coverage of medically necessary food and vitamins and individual amino acids for digestive and inherited metabolic disorders that exceeds the requirements for coverage under such provisions and amendments.</text></subsection><subsection id="H52F377BBCC0F4B6A913F9B6D11B71522"><enum>(h)</enum><header>Medically necessary nutrition coverage includes combinations and supplies</header><text>Nothing in the provisions of, or the amendments made by, this section shall limit coverage of a medically necessary food (as defined in subsection (lll) of section 1861 of the Social Security Act, as added by subsection (a)) or the medical equipment and supplies necessary to administer such food when prescribed, ordered, or recommended in combination with another medically necessary food (as so defined) or other necessary medical equipment and supplies.</text></subsection></section></legis-body></bill>
