<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2010</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210610">June 10, 2021</action-date><action-desc><sponsor name-id="S341">Mr. Blumenthal</sponsor> (for himself, <cosponsor name-id="S350">Mr. Rubio</cosponsor>, and <cosponsor name-id="S308">Mr. Cardin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require an accounting of certain property forfeited to the United States, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H64872F901FA64B49BAE6575BBE392582"><section section-type="section-one" id="H3DB64CEB311342D89944634FCED673D7"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice for Victims of Kleptocracy Act of 2021</short-title></quote>.</text></section><section id="H08348FD4C54B48428A3229C5C7E3E493"><enum>2.</enum><header>Forfeited property</header><subsection id="H61483DF9EB314AB79967813E9CA41930"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/46">Chapter 46</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HBB1E2A2596154D188A3A615AE7BFCFD1"><section id="HBB36C9E0FBA645459143062D9204F5D5"><enum>988.</enum><header>Accounting of certain forfeited property</header><subsection id="HA5265F56FD194875BA1D33DDBB1305DD"><enum>(a)</enum><header>Accounting</header><text>The Attorney General shall make available to the public an accounting of any property relating to foreign government corruption that is forfeited to the United States under section 981 or 982.</text></subsection><subsection id="HBAADF95171264E8394199A6ED982747C"><enum>(b)</enum><header>Format</header><text>The accounting described under subsection (a) shall be published on the website of the Department of Justice in a format that includes the following:</text><paragraph id="H7F8B274B53D64FF8958C50E0BC3743DB"><enum>(1)</enum><text>A heading as follows: <quote>Assets stolen from the people of ______ and recovered by the United States</quote>, the blank space being filled with the name of the foreign government that is the target of corruption.</text></paragraph><paragraph id="H83D798572DB4489BBC56E78C47FE614E"><enum>(2)</enum><text>The total amount recovered by the United States on behalf of the foreign people that is the target of corruption at the time when such recovered funds are deposited into the Department of Justice Asset Forfeiture Fund or the Department of the Treasury Forfeiture Fund.</text></paragraph></subsection><subsection id="H29A3F2D57DBE4952B08D2BA41C01F956"><enum>(c)</enum><header>Updated website</header><text>The Attorney General shall update the website of the Department of Justice to include an accounting of any new property relating to foreign government corruption that has been forfeited to the United States under section 981 or 982 not later than 14 days after such forfeiture, unless such update would compromise an ongoing law enforcement investigation.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H91198D60A7154A7992D01E0073DBF0E0"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/46">chapter 46</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H95589FE9E0E74E6C9D3915EBF1CAFD45"><toc regeneration="no-regeneration"><toc-entry level="section">988. Accounting of certain forfeited property.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HA1AFC35C18AA4AEFA9AF542385B8DE60"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that recovered assets be returned for the benefit of the people harmed by the corruption under conditions that reasonably ensure the transparent and effective use, administration, and monitoring of returned proceeds.</text></section></legis-body></bill>
