which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Comptroller General of the United States to conduct a study and submit a report on the use of crash test dummies by the National Highway Traffic Safety Administration, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Furthering Advanced and Inclusive Research for Crash Tests Act</short-title></quote> or the <quote><short-title>FAIR Crash Tests Act</short-title></quote>.</text></section><section id="id116E61FAA333463F8DA7AABC3BDC1924"><enum>2.</enum><header>GAO report on anthropomorphic crash test dummies</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study and submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that—</text><paragraph id="id9E29476C40944F5BB16B36923511B609"><enum>(1)</enum><text>examines—</text><subparagraph id="idD81AE68C809A47258C079EEE0A6F530C"><enum>(A)</enum><text>the processes used by the National Highway Traffic Safety Administration (referred to in this Act as the <term>Administration</term>) for studying and deploying crash test dummies;</text></subparagraph><subparagraph id="idadd852e0a25d4d6c9d463faa25c5336a"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idC3C3192DFC2D4CC6BC32EAF72DB6F385"><enum>(i)</enum><text>the types of crash test dummies used by the Administration as of the date of enactment of this Act; </text></clause><clause id="id51B363F34DA34184A85D09E14145698E" indent="up1"><enum>(ii)</enum><text>the seating positions in which those crash test dummies are tested; and</text></clause><clause indent="up1" id="id49066A7F1CB1420E8A1D54A510758BD2"><enum>(iii)</enum><text>whether the seating position affects disparities in motor vehicle safety outcomes based on demographic characteristics, including sex, and, if so, how the seating position affects those disparities;</text></clause></subparagraph><subparagraph id="ide6d7d7011f2f4759aa5a270b1c22b5f2"><enum>(C)</enum><text>the biofidelic crash test dummies that are available in the global and domestic marketplace that reflect the physical and demographic characteristics of the driving public in the United States, including—</text><clause id="id5D69B9E375BA4D1584E891DD85BC9B14"><enum>(i)</enum><text>females;</text></clause><clause id="idDE4443689D5A4FC2A6BCDA3DB679E5A1"><enum>(ii)</enum><text>the elderly;</text></clause><clause id="idD3E1000E13C94752B2505C8A37E8F346"><enum>(iii)</enum><text>young adults;</text></clause><clause id="id9EE47FEE47D7425890544B0651AFBF34"><enum>(iv)</enum><text>children; and</text></clause><clause id="idFDE1D64DCE88485EA897F5B1CB8F2125"><enum>(v)</enum><text>individuals of differing body weights;</text></clause></subparagraph><subparagraph id="id3d9926295e1b4f14b6c42037d9418088"><enum>(D)</enum><text>how the Administration determines whether to study and deploy new biofidelic crash test dummies, including the biofidelic crash test dummies examined under subparagraph (C), and the timelines by which the Administration conducts the work of making those determinations and studying and deploying new biofidelic crash test dummies;</text></subparagraph><subparagraph id="id5e1be9f8dffc47d68d2dfd25531e3f53"><enum>(E)</enum><text>challenges the Administration faces in studying and deploying new crash test dummies; and</text></subparagraph><subparagraph id="id4e2a8f6bdcbe4dac93d255b978297090"><enum>(F)</enum><text>how the practices of the Administration with respect to crash test dummies compare to other programs that test vehicles and report results to the public, including the European New Car Assessment Programme;</text></subparagraph></paragraph><paragraph id="id230A19DB4C5241E0ACB9477F242C704A"><enum>(2)</enum><text>evaluates potential improvements to the processes described in paragraph (1) that could reduce disparities in motor vehicle safety outcomes based on demographic characteristics, including sex;</text></paragraph><paragraph id="id235C19BF9472435BBC966C60A3536A01"><enum>(3)</enum><text>analyzes the potential use of computer simulation techniques, as a supplement to physical crash tests, to conduct virtual simulations of vehicle crash tests in order to evaluate predicted motor vehicle safety outcomes based on the different physical and demographic characteristics of motor vehicle occupants; and</text></paragraph><paragraph id="id78b5cd9c1930455c87668433767761bd"><enum>(4)</enum><text>includes, as applicable, any assessments or recommendations relating to crash test dummies that are relevant to reducing disparities in motor vehicle safety outcomes based on demographic characteristics, including sex.</text></paragraph></section><section id="idCDDB60F50B2D4ECDA3FD00E0499B8EF4"><enum>3.</enum><header>Interim report from the Administration</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator of the Administration shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that—</text><paragraph id="id4d902f5b1e6441a489a45c101585f753"><enum>(1)</enum><text>identifies—</text><subparagraph id="idE1C853B87E5F4D4394F6447CD5C8CC37"><enum>(A)</enum><text>the types of crash test dummies used by the Administration as of the date of enactment of this Act with respect to—</text><clause id="id67702a29510040c382e2436ef3e4f120"><enum>(i)</enum><text>the New Car Assessment Program of the Administration; and</text></clause><clause id="idd90f59432a874eb8a09abd5c9eec6501"><enum>(ii)</enum><text>testing relating to Federal Motor Vehicle Safety Standards;</text></clause></subparagraph><subparagraph id="id1fafbc7149af42f199c9ca4eb265963b"><enum>(B)</enum><text> how each type of crash test dummy identified under subparagraph (A) is tested with respect to seating position; and</text></subparagraph><subparagraph id="id40c2922a2cb94f83951a4292dff8446a"><enum>(C)</enum><text>any crash test dummies that the Administration is actively evaluating for future use—</text><clause id="id4D5F051A9CE140188B19C1C630BF33E8"><enum>(i)</enum><text>in the New Car Assessment Program of the Administration; or </text></clause><clause id="id3ED64095B5A14E6C999018028AB72327"><enum>(ii)</enum><text>for testing relating to Federal Motor Vehicle Safety Standards;</text></clause></subparagraph></paragraph><paragraph id="id7944bd15e22c4ea8a44a5a4dcb2ded0a"><enum>(2)</enum><text>explains—</text><subparagraph id="idf363f45a71e7484f9a737ace3ef43c42"><enum>(A)</enum><text>the plans of the Administration, including the expected timelines, for putting any crash test dummies identified under paragraph (1)(C) to use as described in that paragraph;</text></subparagraph><subparagraph id="iddba5cbcea70d45f88ebcb49fdaa0dee6"><enum>(B)</enum><text>any challenges to putting those crash test dummies to use; and</text></subparagraph><subparagraph id="idABAA72C0366C4221A82B3403903407F0"><enum>(C)</enum><text>the potential use of computer simulation techniques, as a supplement to physical crash tests, to conduct virtual simulations of vehicle crash tests in order to evaluate predicted motor vehicle safety outcomes based on the different physical and demographic characteristics of motor vehicle occupants; and</text></subparagraph></paragraph><paragraph id="idb02d650e2b4942bc82bf6379b14680b7"><enum>(3)</enum><text>provides policy recommendations for reducing disparities in motor vehicle safety testing and outcomes based on demographic characteristics, including sex.</text></paragraph></section></legis-body></bill>
