Russell National School Lunch Act to require alternative options for summer food service program delivery.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id2069410550A24EC88CBC85EDB46D9E5D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hunger-Free Summer for Kids Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="idC37A562680F34815AF16F93C2194E4C6"><enum>2.</enum><header>Alternative options for summer food service program delivery</header><text display-inline="no-display-inline">Section 13 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1761">42 U.S.C. 1761</external-xref>) is amended—</text><paragraph id="id7AE66C78906248A5AD7BCDA22D5307E6"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB3C5BD30A4654A27886BFD7C9AEF11A1"><paragraph id="id380dc31f39a84f80af4886d88bd4dc65"><enum>(13)</enum><header>Alternative options for program delivery</header><subparagraph id="id42a48397e6f741f5979f3706c198713c"><enum>(A)</enum><header>Purpose</header><text>The purpose of this paragraph is to establish the alternative program delivery options described in subparagraph (B)—</text><clause id="id7299D924587B4982B871969FB3AB1BB7"><enum>(i)</enum><text>to provide meals to children that do not have readily available access to meals otherwise provided under this section; and</text></clause><clause id="id53f9afab6dd5462a8177d8a0abd25b38"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id18DCEDC880194F47A0D94F2BE9076731"><enum>(I)</enum><text>to increase program participation, effectiveness, and efficiency;</text></subclause><subclause id="id3441F77DEC634EC89C83786630CB3944" indent="up1"><enum>(II)</enum><text>to improve child nutrition; and</text></subclause><subclause id="idaf032958df21494792254140b4031f19" indent="up1"><enum>(III)</enum><text>to reduce food insecurity among children.</text></subclause></clause></subparagraph><subparagraph commented="no" id="id666dafeb7c5d4936a266abb7f8be9781"><enum>(B)</enum><header>Alternative options</header><text>The Secretary shall establish the following 2 alternative options for program delivery:</text><clause commented="no" id="idd660c73e4ece45fd809d2ecd09fecf07"><enum>(i)</enum><text>Provision of an electronic benefit transfer card (referred to in this paragraph as an <quote>EBT card</quote>) in accordance with subparagraph (C).</text></clause><clause commented="no" id="id1c0df55f07a2475c92971d48072b3872"><enum>(ii)</enum><text>Off-site consumption in accordance with subparagraph (D).</text></clause></subparagraph><subparagraph id="id6d1e0240c87141aeb31490e4adad01c4"><enum>(C)</enum><header>EBT card</header><clause commented="no" id="idde744c6beba64e8eb3616d90f9f6d516"><enum>(i)</enum><header>In general</header><text>Beginning not later than summer 2023, the Secretary shall make available an option to States to provide program meals under this section through the issuance of EBT cards to the households of eligible children, determined in accordance with clause (iv), for the benefit of those eligible children.</text></clause><clause id="id17e7ec76f2aa4e1bb1c3fe99c726600d"><enum>(ii)</enum><header>Amount</header><subclause id="id86859B1C68D94FCDA3591191EC908DAC"><enum>(I)</enum><header>In general</header><text>Subject to subclause (III), the value of an EBT card provided under this subparagraph shall be $30 per eligible child per month.</text></subclause><subclause id="idA750CC8D842C4C5CB0A18670318380BE"><enum>(II)</enum><header>Annual limitation</header><text>No household of an eligible child shall receive benefits under this subparagraph for more than 3 months in a summer period. </text></subclause><subclause id="id12576c10c4d24616b13225d28ace4f52"><enum>(III)</enum><header>Adjustment</header><text>On January 1 of each year, the Secretary shall adjust the values described in subclauses (I) and (II) by the same percentage as the adjustment made under subsection (b)(1)(B).</text></subclause></clause><clause id="idcbb378aa6a3149c5bf6f674be70a5118"><enum>(iii)</enum><header>Use of benefits</header><subclause id="id5C15D02D4B554FFF8B7D9D98BC210AEC"><enum>(I)</enum><header>In general</header><text>An EBT card issued under this subparagraph may be used only for the purchase of food from retail stores approved for participation in the supplemental nutrition assistance program established under the <act-name parsable-cite="FSA77">Food and Nutrition Act of 2008</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>).</text></subclause><subclause id="idA2003458A5DA4F00B8F12C7BCCCFA91F"><enum>(II)</enum><header>Benefit redemption</header><text>A retail store shall redeem EBT card benefits under this subparagraph in the same manner that benefits are redeemed under the supplemental nutrition assistance program described in subclause (I).</text></subclause><subclause id="id1278d5cb5e7048969193b3083a96ef98"><enum>(III)</enum><header>Timing</header><text>An EBT card issued under this subparagraph may be used by a household for the benefit of an eligible child only when school is out of session for the summer period, as defined by the Secretary.</text></subclause></clause><clause id="id741da2cd29e64838b8d855512c650259"><enum>(iv)</enum><header>Eligible children</header><text>In administering this subparagraph, the Secretary shall ensure that an EBT card—</text><subclause id="id81a362cb7a80405da4512cc5111b6f29"><enum>(I)</enum><text>is only issued to a household for the benefit of a child in that household—</text><item id="idA79535C33A4B49AFB40ED5C6D85753FE"><enum>(aa)</enum><text>who lives or attends school—</text><subitem id="ida15eefcae8724e6da8440b2a01fbbc46"><enum>(AA)</enum><text>in a rural area, as determined by the Secretary; or</text></subitem><subitem id="ida5f1d950d5344fdb967286c72c89203e"><enum>(BB)</enum><text>outside an area in which poor economic conditions exist; </text></subitem></item><item id="idf8b72b561b654d3891cf8c0953b00977"><enum>(bb)</enum><text>who has been determined to be eligible for a free or reduced price lunch under this Act and a free or reduced price breakfast under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>); and </text></item><item id="id54e13ea8255c49868983e3d403c24225"><enum>(cc)</enum><text>in accordance with, with respect to the State in which the child resides—</text><subitem id="id710CFAE4554F4FB0BC127D67D76D01E1"><enum>(AA)</enum><text>a State agency plan approved by the Secretary pursuant to section 1101(b) of the Families First Coronavirus Response Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>); or</text></subitem><subitem id="idE36CF94099DE47E096583D8DD1F760DC"><enum>(BB)</enum><text>an application process developed by the State; and</text></subitem></item></subclause><subclause id="id27def27c2ef845ecb69d81339cbc3605"><enum>(II)</enum><text>is not issued to a household for the benefit of a child living in an area in which a congregate open feeding site is operating, to prevent duplication in benefits.</text></subclause></clause></subparagraph><subparagraph id="id6957526a01c54406b24b798e70394992"><enum>(D)</enum><header>Off-site consumption</header><clause id="id0631d26efb5c48c5a19bbd37a71b6ad8"><enum>(i)</enum><header>In general</header><text>Beginning not later than summer 2023, the Secretary shall make available an option to States to provide program meals under this section for off-site consumption.</text></clause><clause id="id503cd5adbb674246ae5394f3d465bd76"><enum>(ii)</enum><header>Availability</header><text>In administering this subparagraph, the Secretary shall ensure that off-site consumption is only available to a child if—</text><subclause id="idF7A910092C2D4510B7AD8E4CE971DE94"><enum>(I)</enum><text>the child is determined to be eligible for a free or reduced price lunch under this Act and a free or reduced price breakfast under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>); and </text></subclause><subclause id="id4ACB84CEC0144A7F9C26613C6596AD84"><enum>(II)</enum><text>not fewer than 1 of the conditions described in clause (iii) is present.</text></subclause></clause><clause id="id929878896CFE461188AACF3135B41F2D"><enum>(iii)</enum><header>Conditions</header><text>The conditions referred to in clause (ii)(II) are the following:</text><subclause id="id4edd356d284749dc8733d1eb103e76ec"><enum>(I)</enum><text>The child lives or attends school in a rural area, as determined by the Secretary.</text></subclause><subclause id="id40e7150a1ad34ec696597a364ed731f2"><enum>(II)</enum><text>The child lives or attends school outside an area in which poor economic conditions exist.</text></subclause><subclause id="id5345c99360054fa69c7fb35c1901d0aa"><enum>(III)</enum><text>The program is available to the child at a congregate feeding site but—</text><item id="id77951621defc4394a61f4e41d70d4519"><enum>(aa)</enum><text>the site is closed due to extreme weather conditions;</text></item><item id="ida82cf82812064fda907b58da58ef543b"><enum>(bb)</enum><text>violence or other public safety concerns in the area prevent the child from traveling safely to the site;</text></item><item id="id1f30498776944181a7836d664ff503ec"><enum>(cc)</enum><text>the site is open not more than 4 days a week; or</text></item><item id="id0a5bfaa817a344929e5bfd956ee92e53"><enum>(dd)</enum><text>the site provides only 1 meal per day.</text></item></subclause></clause><clause id="idb82424334d6c43259c9aa102de71a0ca"><enum>(iv)</enum><header>Administration</header><text>In administering this subparagraph, the Secretary shall ensure that—</text><subclause id="id2d64078716a1460c9d90ea45873c63d1"><enum>(I)</enum><text>any meal served through off-site consumption—</text><item id="idA3A2743E19644905BC7642CDE94E3B1D"><enum>(aa)</enum><text>meets all applicable State and local health, safety, and sanitation standards; and</text></item><item id="idD097A185F12649C8B64EC4C483F81C1D"><enum>(bb)</enum><text>meets the requirements under subsection (f)(1);</text></item></subclause><subclause id="id0E9277DCD6BB46DE9FCFDABB65577704"><enum>(II)</enum><text>each State gives priority to a child living in an area in which a congregate open feeding site is not reasonably accessible, as determined by the Secretary;</text></subclause><subclause id="id3586522cf00c4d64ae6063525b8414d3"><enum>(III)</enum><text>the number of reimbursable meals served to each child in a single meal service does not exceed the total number of meals allowed for reimbursement under the program during a 10-day period; and</text></subclause><subclause id="id3faebbe3f0fe4a44921cc7079ca78a29"><enum>(IV)</enum><text>meals may be provided by entities that participated in a summer meals demonstration project carried out under section 749(g) of the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/80">Public Law 111–80</external-xref>; 123 Stat. 2132), on the same terms and conditions as provided under the demonstration project. </text></subclause></clause></subparagraph><subparagraph id="idf6437581ffc54dd09e6da8244357147f"><enum>(E)</enum><header>Scope</header><text>Under this paragraph, a State—</text><clause id="id37b93491a4704501acd18b9f12373d7a"><enum>(i)</enum><text>may implement an alternative option described in subparagraph (B) in any area described in subitem (AA) or (BB) of subparagraph (C)(iv)(I)(aa) in the State; but</text></clause><clause id="id350B4A89AAD24E679042108037E692ED"><enum>(ii)</enum><text>shall not simultaneously implement both alternative options described in subparagraph (B) in the same area in the State.</text></clause></subparagraph><subparagraph id="id1a1c7b8ba7e54b2b9793fffbba5fa6a9"><enum>(F)</enum><header>Regulations</header><text>Not later than October 1, 2022, the Secretary shall promulgate regulations, with an opportunity for notice and comment—</text><clause id="idD3DCF9CA31BC4366BBD31CBD426CD020"><enum>(i)</enum><text>to ensure the integrity of the alternative options for program delivery described in subparagraph (B); and</text></clause><clause id="idB11CB0EEB4E841DBA70A7AE7132EF6D6"><enum>(ii)</enum><text>to prevent duplication in benefits received under this paragraph.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id05A57B1D0C3F4EE0953A507D67209E7C"><enum>(2)</enum><text>in subsection (n)—</text><subparagraph id="id56A651C63169403089E05489D35FA597"><enum>(A)</enum><text>by striking <quote>and (6)</quote> and inserting <quote>(6)</quote>; and</text></subparagraph><subparagraph id="id502C02B8E73E4FE781CFB541ADF1FE1E"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and (7) the plans of the State for using the alternative options for program delivery described in subsection (a)(13), if applicable.</quote>.</text></subparagraph></paragraph></section></legis-body></bill>
