<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2002</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210610">June 10, 2021</action-date><action-desc><sponsor name-id="S369">Mr. Markey</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide that any termination of a director of a national research institute or national center of the National Institutes of Health be on the basis of malfeasance, neglect of office, or incapacity only.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H4F363187B5874A108483FE0AAAA856F2"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Institutes of Health Director Protection Act</short-title></quote>.</text></section><section id="idBC8D3BC31D7A47BB9D5F02189AD694F4"><enum>2.</enum><header>Removal of directors of the national research institute or national center of the NIH</header><text display-inline="no-display-inline">Section 405(a)(2)(E) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/284">42 U.S.C. 284(a)(2)(E)</external-xref>) is amended—</text><paragraph id="id8DC71E0B6041460C9F745CD17B9E6766"><enum>(1)</enum><text>in the subparagraph heading, by striking <quote><header-in-text level="subparagraph" style="OLC">Rule of construction</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">Termination for cause</header-in-text></quote>; and</text></paragraph><paragraph id="id8FE881FD915D46C2B5329C98EB492656"><enum>(2)</enum><text>by inserting <quote>, except that any such termination may be made only on the basis of malfeasance by, neglect of office by, or incapacity of the director</quote> before the period.</text></paragraph></section></legis-body></bill>
