<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 19</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210122">January 22, 2021</action-date><action-desc><sponsor name-id="S365">Mr. Scott of South Carolina</sponsor> (for himself, <cosponsor name-id="S364">Mr. Murphy</cosponsor>, <cosponsor name-id="S343">Mr. Boozman</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S287">Mr. Cornyn</cosponsor>, <cosponsor name-id="S327">Mr. Warner</cosponsor>, <cosponsor name-id="S293">Mr. Graham</cosponsor>, <cosponsor name-id="S403">Ms. Sinema</cosponsor>, and <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Administrator of the Federal Emergency Management Agency to approve State and local plans to partner with small and mid-size restaurants and nonprofit organizations to provide nutritious meals to individuals in need, to waive certain matching fund requirements, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H425A9A9433BD48FE9E6CB9834E228652"><section section-type="section-one" id="H6679DADD96AD487B86F4300C93E7A068"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>FEMA Empowering Essential Deliveries Act</short-title></quote> or the <quote><short-title>FEED Act</short-title></quote>. </text></section><section id="H395BE48ADBA74463A18830D0A6D6692C"><enum>2.</enum><header>State and local plans for meal delivery</header><subsection id="HC708FDD7D02342C5831CD2E4DA53AE68"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">During the period following the emergency declaration issued by the President on March 13, 2020, pursuant to section 501(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191(b)</external-xref>), and under any subsequent major disaster declaration under section 401 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) that supersedes such emergency declaration, the Administrator of the Federal Emergency Management Agency may approve plans from State, local, and Indian tribal governments that meet the requirements of subsection (b). </text></subsection><subsection id="H7FDE9BC5EEA343F0ADB52FE19C9C043F"><enum>(b)</enum><header>Requirements</header><text>To be eligible to provide food services set forth in this subsection, a State, local, or Indian tribal government shall establish a network to coordinate food distribution and delivery that includes a detailed plan to—</text><paragraph id="HFD43D9B6CCFB4DC7AF89496FFD5C1AEC"><enum>(1)</enum><text display-inline="yes-display-inline">establish contracts with small and mid-sized restaurants and non-profits, including faith-based organizations and soup kitchens to prepare healthy meals for people in need; and</text></paragraph><paragraph id="HB359E45867A14C22B45BB833509413F4"><enum>(2)</enum><text>partner with non-profit organizations, including faith-based organizations and soup kitchens to purchase directly from food producers and farmers.</text></paragraph></subsection><subsection id="H612CA99DEAA449FEA4770CF3EA9D5F5A"><enum>(c)</enum><header>Waiver of matching requirements</header><text display-inline="yes-display-inline">During the period referred to in subsection (a), the Administrator of the Federal Emergency Management Agency shall waive the matching requirements in sections 403(b) and 503(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170b">42 U.S.C. 5170b(b)</external-xref>, 5193(a)).</text></subsection></section></legis-body></bill>
