which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Dingell-Johnson Sport Fish Restoration Act with respect to sport fish restoration and recreational boating safety, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H97F537884A5846A59335EBF07D3086E1"><section section-type="section-one" id="H3A1834E4F3B24E3A854A2804F5E5F9A3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sport Fish Restoration and Recreational Boating Safety Act of 2021</short-title></quote>.</text></section><section id="H7E6DE75AA97C4583AF26301FA03DC679"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="H72105D4D61F348DC90214E660A318B58"><enum>(1)</enum><text>the Sport Fish Restoration and Boating Trust Fund established by <external-xref legal-doc="usc" parsable-cite="usc/26/9504">section 9504(a)</external-xref> of the Internal Revenue Code of 1986 (referred to in this section as the <term>Trust Fund</term>) was established in 1950 to provide dedicated funding for aquatic conservation and boating safety;</text></paragraph><paragraph id="H5336C7BDCAFF4A778B7856BA8926EAE6"><enum>(2)</enum><text>the Trust Fund is a user fee-public benefit system funded through motorboat fuel tax receipts, import duties, and excise taxes on small engines, fishing equipment, and electric motors;</text></paragraph><paragraph id="H22822375EE344CFCBD69B79CA665AE4A"><enum>(3)</enum><text>the Trust Fund provides nearly $650,000,000 annually for recreational infrastructure projects, coastal wetlands restoration, and boating safety and conservation programs in all 50 States;</text></paragraph><paragraph id="HD3E7037FF45C44E699934BB05DEDD007"><enum>(4)</enum><text>since 2010, more than 28,000 acres of habitats have been restored and improved throughout coastal wetland ecosystems, which not only serve a critical role in conservation, but provide a significant economic benefit to coastal communities;</text></paragraph><paragraph id="HD75516B3B7BE42B9AC5839F457F59EE7"><enum>(5)</enum><text>the recreational boating and angling community, as well as State agencies, recognize the significant increase in the use of nonmotorized, human-propelled vessels in recent years; and</text></paragraph><paragraph id="id1EA12583D3364FA098A56E4116F29DBE"><enum>(6)</enum><text>growth of the human-propelled vessel community has required the Coast Guard and State agencies to use significant resources to address human-propelled vessel infrastructure, boating safety, law enforcement, and search and rescue needs, all of which are paid for by the Trust Fund.</text></paragraph></section><section id="HD81A3ADAC9FB400591526CC46D995A04"><enum>3.</enum><header>Division of annual appropriations</header><subsection id="HE6F12C6B7DF94400A1AAE8E226829B31"><enum>(a)</enum><header>In general</header><text>Section 4 of the Dingell-Johnson Sport Fish Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/777c">16 U.S.C. 777c</external-xref>) is amended—</text><paragraph id="HD5BF330382E1458DA19CA75F481827E7"><enum>(1)</enum><text>in subsection (a), by striking <quote>2021</quote> and inserting <quote>2026</quote>;</text></paragraph><paragraph id="HA3A3C0A53D2A47D583FC16833A92241E"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H894A2169007347A2B2DAFB595E9904DA"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="HD75DE4728EDF41769408C236BFF49E95"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>2021</quote> and inserting <quote>2026</quote>; and</text></clause><clause id="H37A30F648F724172AD2418E3ACBED6FD"><enum>(ii)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD5B6BD4C53EC4ECC8A62ABFE74126988"><subparagraph id="HE34A0D71DAFB4317B9961370D9DA191B"><enum>(B)</enum><header>Available amounts</header><text display-inline="yes-display-inline">The available amount referred to in subparagraph (A) is—</text><clause id="H4ADE18A4F84040CC80AE933330010F08"><enum>(i)</enum><text>for the fiscal year that includes the date of enactment of the <short-title>Sport Fish Restoration and Recreational Boating Safety Act of 2021</short-title>, the sum obtained by adding—</text><subclause id="idB7AA047CCED54CA3AEFD9208DD0CC131"><enum>(I)</enum><text>the available amount specified in this subparagraph for the preceding fiscal year; and</text></subclause><subclause id="id017A2CD907FF4768A1B1F09E6701438A"><enum>(II)</enum><text>$979,500; and</text></subclause></clause><clause id="HD494A392959846759C5D814B2C12FF38"><enum>(ii)</enum><text>for each fiscal year thereafter, the sum obtained by adding—</text><subclause id="HE8CB585E162A4620B5C7541D74C7EB68"><enum>(I)</enum><text>the available amount specified in this subparagraph for the preceding fiscal year; and</text></subclause><subclause id="HD6A0C335C5B84ED2BC1D501D77FD608F"><enum>(II)</enum><text>the product obtained by multiplying—</text><item id="HAC3A5E1C13AD43258C113764904A0A4A"><enum>(aa)</enum><text>the available amount specified in this subparagraph for the preceding fiscal year; and</text></item><item id="H756B5E4867004183A67BEB793CB3D1BA"><enum>(bb)</enum><text>the change, relative to the preceding fiscal year, in the Consumer Price Index for All Urban Consumers published by the Department of Labor.</text></item></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H217BB1792CB84296B6223091E0DAB577"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="H05ADB7A95E344C70A24328F32BE1B7EB"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>2016 through 2021</quote> and inserting <quote>2022 through 2026</quote>; and</text></clause><clause id="HB98D9F7A00834F009FA8979633487E32"><enum>(ii)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H468C9B0479EF421EB6821896BCFACF7E"><subparagraph id="H1C7B0297B2FC4EE9B67B298CA0A2ACF7"><enum>(B)</enum><header>Available amounts</header><text display-inline="yes-display-inline">The available amount referred to in subparagraph (A) is—</text><clause id="H18F3D7BD57E3498EBA87C589A88E8597"><enum>(i)</enum><text>for fiscal year 2022, $12,786,434; and</text></clause><clause id="H54F120A994DF4AA78A8651BF62B04E76"><enum>(ii)</enum><text>for fiscal year 2023 and each fiscal year thereafter, the sum obtained by adding—</text><subclause id="H0436772123684B8E8641E68B077793B0"><enum>(I)</enum><text>the available amount specified in this subparagraph for the preceding fiscal year; and</text></subclause><subclause id="H5001EB773AEC46098225AE518F507044"><enum>(II)</enum><text>the product obtained by multiplying—</text><item id="H7983B661A5E34AD6942441A19164FE7B"><enum>(aa)</enum><text>the available amount specified in this subparagraph for the preceding fiscal year; and</text></item><item id="HDA9E67F6484441C580A1118514A5A6E7"><enum>(bb)</enum><text>the change, relative to the preceding fiscal year, in the Consumer Price Index for All Urban Consumers published by the Department of Labor.</text></item></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H70EEC7672B564868884F150520F842C1"><enum>(3)</enum><text>in subsection (e)(2), by striking <quote>$900,000</quote> and inserting <quote>$1,300,000</quote>.</text></paragraph></subsection><subsection id="H380C380C88D34B43A05B3AC172C88503"><enum>(b)</enum><header>Administration</header><text>Section 9(a) of the Dingell-Johnson Sport Fish Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/777h">16 U.S.C. 777h(a)</external-xref>) is amended—</text><paragraph id="H211421A8B13B42558ACFC80FDFE0343C"><enum>(1)</enum><text>by striking paragraphs (1) and (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id89055A5A2D174B57811A35BEF6309BE6"><paragraph id="id24FCFF41C8564B9C8D6DCBC14C910F30"><enum>(1)</enum><text>personnel costs of employees for the work hours of each employee spent directly administering this Act, as those hours are certified by the supervisor of the employee;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id779378AB15D843538596653550CD30FF"><enum>(2)</enum><text>by redesignating paragraphs (3) through (12) as paragraphs (2) through (11), respectively;</text></paragraph><paragraph id="idCCC379FA539D4D7187B06B7DE23F27F4"><enum>(3)</enum><text>in paragraph (2) (as so redesignated), by striking <quote>paragraphs (1) and (2)</quote> and inserting <quote>paragraph (1)</quote>;</text></paragraph><paragraph id="HA6131E051CF04A0E991C233C44CF469A"><enum>(4)</enum><text>in paragraph (4)(B) (as so redesignated), by striking <quote>full-time equivalent employee authorized under paragraphs (1) and (2)</quote> and inserting <quote>employee authorized under paragraph (1)</quote>; </text></paragraph><paragraph id="HFD1337B061FD4AE38CDBA9E37E323CFC"><enum>(5)</enum><text>in paragraph (8)(A) (as so redesignated), by striking <quote>on a full-time basis</quote>; and</text></paragraph><paragraph id="idA33CC6B140F24FC28EE66BFB35AFC406"><enum>(6)</enum><text>in paragraph (10) (as so redesignated)—</text><subparagraph id="id47763166D1D743569682E89F130EF437"><enum>(A)</enum><text>by inserting <quote>or part-time</quote> after <quote>full-time</quote>; and</text></subparagraph><subparagraph id="id0791CED8007640C5B05281C747886D92"><enum>(B)</enum><text>by inserting <quote>, subject to the condition that the percentage of the relocation expenses paid with funds made available pursuant to this Act may not exceed the percentage of the work hours of the employee that are spent administering this Act</quote> after <quote>incurred</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HD743365CE2384FAA9E6FA1E1F37A83B8"><enum>(c)</enum><header>Other activities</header><text>Section 14(e) of the Dingell-Johnson Sport Fish Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/777m">16 U.S.C. 777m(e)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF103C0C082A445E995E8BD5C1D809D40"><paragraph commented="no" id="H52DA4B86D189410F9FF950A6894E0583"><enum>(3)</enum><text display-inline="yes-display-inline">A portion, as determined by the Sport Fishing and Boating Partnership Council, of funds disbursed for the purposes described in paragraph (2) but remaining unobligated as of October 1, 2021, shall be used to study the impact of derelict vessels and identify recyclable solutions for recreational vessels.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id315e25eba1544023a8a2652b5aaf5ecc"><enum>(d)</enum><header>Recreational boating safety</header><text>Section 13107(c)(2) of title 46, United States Code, is amended by striking <quote>No funds available</quote> and inserting <quote>On or after October 1, 2024, no funds available</quote>.</text></subsection></section><section id="idb1243fb6a9d04e9da149887a1146d5ec"><enum>4.</enum><header>Wildlife restoration fund administration</header><subsection id="idf229d1151bd04c47935515ce66d1c9d4"><enum>(a)</enum><header>Allocation and apportionment of available amounts</header><text>Section 4(a) of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669c">16 U.S.C. 669c(a)</external-xref>) is amended—</text><paragraph id="id5fb38d820213438a9f8a696f1fb28df3"><enum>(1)</enum><text>in paragraph (1), by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE8228BED42764A1E972320F240249731"><subparagraph id="idC90213A5274E4EC888628FF0147C994E"><enum>(B)</enum><header>Available amounts</header><text display-inline="yes-display-inline">The available amount referred to in subparagraph (A) is—</text><clause id="idB0A575C13EB4402991D845B9CBA59AAD"><enum>(i)</enum><text>for the fiscal year that includes the date of enactment of the <short-title>Sport Fish Restoration and Recreational Boating Safety Act of 2021</short-title>, the sum obtained by adding—</text><subclause id="idBE11656191A34566953136CF7E2ED7F7"><enum>(I)</enum><text>the available amount specified in this subparagraph for the preceding fiscal year; and</text></subclause><subclause id="idF58CB2B24B0B4094AC4D67CA8F582739"><enum>(II)</enum><text>$979,500; and</text></subclause></clause><clause id="id321BC8954AC5424EA081E8DC66F59451"><enum>(ii)</enum><text>for each fiscal year thereafter, the sum obtained by adding—</text><subclause id="id974CAD8B201840CB8CC1BE76756C1922"><enum>(I)</enum><text>the available amount specified in this subparagraph for the preceding fiscal year; and</text></subclause><subclause id="id5652E9214FE14BDAB0AC0F22507C8A2E"><enum>(II)</enum><text>the product obtained by multiplying—</text><item id="id3598E54E30EB4571B30980989BAEC02F"><enum>(aa)</enum><text>the available amount specified in this subparagraph for the preceding fiscal year; and</text></item><item commented="no" display-inline="no-display-inline" id="idCFF035C3A3A54E8AB261DF2EA568B7A0"><enum>(bb)</enum><text>the change, relative to the preceding fiscal year, in the Consumer Price Index for All Urban Consumers published by the Department of Labor.</text></item></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id26c0d6d4c2e04343bb30a2609ce8f221"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="id2FCF4104A21D41AB88DD3A724E263886"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>subsequent</quote> before <quote>fiscal year.</quote>; and</text></subparagraph><subparagraph id="idED12580D2CD649EEBFA3D36809776963"><enum>(B)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5198FF4BE4D648E28F6C5CF1D9BB8B7F"><subparagraph id="id1E44327264404A339954FC1F5224A1F6"><enum>(B)</enum><header>Apportionment of unobligated amounts</header><clause id="idD1C8F483F1574B1C99A2DB06C71F4C27"><enum>(i)</enum><header>In general</header><text>Not later than 60 days after the end of a fiscal year, the Secretary of the Interior shall apportion among the States any of the available amount under paragraph (1) that remained available for obligation pursuant to subparagraph (A) during that fiscal year and remains unobligated at the end of that fiscal year.</text></clause><clause id="id4B976BE17A064CE79E875B78DA74A156"><enum>(ii)</enum><header>Requirement</header><text>The available amount apportioned under clause (i) shall be apportioned on the same basis and in the same manner as other amounts made available under this Act were apportioned among the States for the fiscal year in which the amount was originally made available.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id5639c83bfd874541a848917415533be8"><enum>(b)</enum><header>Authorized expenses for administration</header><text>Section 9(a) of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669h">16 U.S.C. 669h(a)</external-xref>) is amended—</text><paragraph id="id2EAC34E40B6A488DBEA838A75FE69254"><enum>(1)</enum><text>by striking paragraphs (1) and (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id989D85A56F3D45BE8C31AA30A5D86D64"><paragraph id="id8521F34A37AE4E2991AE12B3946153E2"><enum>(1)</enum><text>personnel costs of employees for the work hours of each employee spent directly administering this Act, as those hours are certified by the supervisor of the employee;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idFDFED7CD22714E1EA0D22D5653419F42"><enum>(2)</enum><text>by redesignating paragraphs (3) through (12) as paragraphs (2) through (11), respectively;</text></paragraph><paragraph id="id758A364E016C4EC290BE3EE4801D57AB"><enum>(3)</enum><text>in paragraph (2) (as so redesignated), by striking <quote>paragraphs (1) and (2)</quote> and inserting <quote>paragraph (1)</quote>;</text></paragraph><paragraph id="idFBA5AFA41FEB45BA82016FFD79899BC0"><enum>(4)</enum><text>in paragraph (4)(B) (as so redesignated), by striking <quote>full-time equivalent employee authorized under paragraphs (1) and (2)</quote> and inserting <quote>employee authorized under paragraph (1)</quote>; </text></paragraph><paragraph id="id202502E6732F41B391E96D426F7BB5D9"><enum>(5)</enum><text>in paragraph (8)(A) (as so redesignated), by striking <quote>on a full-time basis</quote>; and</text></paragraph><paragraph id="id6AB3A6039FD54B94ABBDE2A0466DACE2"><enum>(6)</enum><text>in paragraph (10) (as so redesignated)—</text><subparagraph id="id098D5DF6522D4C41932083940DDF08EF"><enum>(A)</enum><text>by inserting <quote>or part-time</quote> after <quote>full-time</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC1D8E8B8DDE24CA196065512F67506EC"><enum>(B)</enum><text>by inserting <quote>, subject to the condition that the percentage of the relocation expenses paid with funds made available pursuant to this Act may not exceed the percentage of the work hours of the employee that are spent administering this Act</quote> after <quote>incurred</quote>.</text></subparagraph></paragraph></subsection></section><section id="H14E1ED08750B41558A6B4015B443948B"><enum>5.</enum><header>Recreational boating access</header><subsection id="id3BCA792430D84BF483B132CF55812B0F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Sport Fishing and Boating Partnership Council, the Committee on Natural Resources and the Committee on Transportation and Infrastructure of the House of Representatives, and the Committee on Commerce, Science, and Transportation and the Committee on Environment and Public Works of the Senate a report that, to the extent practicable, given available data, shall document—</text><paragraph id="HF41290ED80964DC6AB899E3EFA53C824"><enum>(1)</enum><text>the use of nonmotorized vessels in each State and how the increased use of nonmotorized vessels is impacting motorized and nonmotorized vessel access;</text></paragraph><paragraph id="HD5EA3017166742F69ADB03CBA97C8862"><enum>(2)</enum><text>user conflicts at waterway access points; and</text></paragraph><paragraph id="HFADD15A192FF496C9F3745786EFC3D08"><enum>(3)</enum><text display-inline="yes-display-inline">the use of—</text><subparagraph id="id896324659A9B414FAA6F5201A6BA6273"><enum>(A)</enum><text display-inline="yes-display-inline">Sport Fish Restoration Program funds to improve nonmotorized access at waterway entry points and the reasons for providing that access; and </text></subparagraph><subparagraph id="idCCCB10469E9B4740BB6A5A75BE9D8968"><enum>(B)</enum><text display-inline="yes-display-inline">Recreational Boating Safety Program funds for nonmotorized boating safety programs.</text></subparagraph></paragraph></subsection><subsection id="id51C82E8050B64856A23226239EC1BDFE"><enum>(b)</enum><header>Consultation</header><text>The Comptroller General of the United States shall consult with the Sport Fishing and Boating Partnership Council and the National Boating Safety Advisory Council on study design, scope, and priorities for the report under subsection (a).</text></subsection></section><section id="id0781766C3B514DA9B3F4C6A5F15C8EF9"><enum>6.</enum><header>Sport Fishing and Boating Partnership Council</header><subsection id="idEC49D462197E4A6491480C7344DC8D2C"><enum>(a)</enum><header>In general</header><text>The Sport Fishing and Boating Partnership Council established by the Secretary of the Interior shall be an advisory committee of the Department of the Interior and the Department of Commerce subject to the Federal Advisory Committee Act (5 U.S.C. App.).</text></subsection><subsection id="id1E839097958A4240892AFA2FDB9B24CB"><enum>(b)</enum><header>FACA</header><text> The Secretary of the Interior and the Secretary of Commerce shall jointly carry out the requirements of the Federal Advisory Committee Act (5 U.S.C. App.) with respect to the Sport Fishing and Boating Partnership Council described in subsection (a).</text></subsection><subsection id="idB0FD160639EB4B7B9AFD8D127ED8E3F0"><enum>(c)</enum><header>Effective date</header><text>This section shall take effect on January 1, 2023.</text></subsection></section></legis-body></bill>
