which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reform pattern or practice investigations conducted by the Department of Justice, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="HB1ED6F7B46A749D68594AADBE4ED1263"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhancing Oversight to End Discrimination in Policing Act</short-title></quote>.</text></section><section id="id2ED914D5DF264BD1A342FA0FBB71B276"><enum>2.</enum><header>Consent decree procedures</header><subsection id="idD1A70FAB4376414A8675B7E2527B05B1"><enum>(a)</enum><header>In general</header><text>The Attorney General, acting through the Assistant Attorney General of the Civil Rights Division of the Department of Justice, shall—</text><paragraph id="idECD05F5492C6467C965973501721D791"><enum>(1)</enum><text>modify the procedures for civil consent decrees and consent agreements in civil litigation with State and local governmental entities arising from pattern or practice investigations under section 210401 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12601">34 U.S.C. 12601</external-xref>) to ensure that—</text><subparagraph id="idD60A0276E5A04AEA8B9941016C26F62E"><enum>(A)</enum><text>the use of consent decrees and consent agreements foster the creation and use of remedies that are not limited to law enforcement reforms, such as mental health support or community-based restorative justice mechanisms; and</text></subparagraph><subparagraph id="idE78ECA9AB38D4950B5BFF67B2CE3315A"><enum>(B)</enum><text>community oversight requirements, such as a community oversight body described in subsection (b), are incorporated, when possible, into the terms of consent decrees and consent agreements; and </text></subparagraph></paragraph><paragraph id="idCE25864B4DE5497FBDBF0C87347D8E1A"><enum>(2)</enum><text>in carrying out paragraph (1)(A), request guidance from the heads of other relevant agencies, such as the Secretary of Housing and Urban Development and the Secretary of Health and Human Services, on the efficacy of the alternative remedies described in paragraph (1)(A). </text></paragraph></subsection><subsection id="id0E2479383EFC4D848F42AA51BA9971E9"><enum>(b)</enum><header>Community oversight body described</header><text>A community oversight body described in this subsection is an oversight entity that—</text><paragraph id="id69E48D3171814124BEFCC1B47440A4FB"><enum>(1)</enum><text>is comprised of individuals who—</text><subparagraph id="id06DEEA89F4D94863A97D019AA009D477"><enum>(A)</enum><text>represent the communities and organizations within the State or unit of local government to which the consent decree or consent agreement applies; and</text></subparagraph><subparagraph id="idDF6744F85F5948228CD0D4B2627A712B"><enum>(B)</enum><text>do not work, or have not previously worked, in a law enforcement capacity; and</text></subparagraph></paragraph><paragraph id="id93058A79830244FC9987A72275CADB7E"><enum>(2)</enum><text>has a role of—</text><subparagraph id="id16C68CF4146D4553929BEB545E9BE3BB"><enum>(A)</enum><text>ensuring compliance with the provisions of the consent decree or consent agreement; and</text></subparagraph><subparagraph id="idAB3AB2786FA4465CBE76256F2520499E"><enum>(B)</enum><text>fostering transparency in the administration and personnel of the law enforcement agency; and</text></subparagraph></paragraph><paragraph id="id563DDFF2DD6542DC9DC60CDA0BCEA494"><enum>(3)</enum><text>has the authority to—</text><subparagraph id="id76D42B0E55224DD9A38D37A71A6E234F"><enum>(A)</enum><text>ask questions of the law enforcement agency; </text></subparagraph><subparagraph id="id90287C43465A4582AA163B630D8C1BE5"><enum>(B)</enum><text>obtain documents, data, and information from the law enforcement agency; and</text></subparagraph><subparagraph id="id9E154823E3974F3485349BC4DE9AB24E"><enum>(C)</enum><text>make recommendations—</text><clause id="id9803EA6A4FAD4B64A5F0DED29DEB41CE"><enum>(i)</enum><text>for modifications to the provisions of the consent decree or consent agreement, as necessary; and</text></clause><clause id="idF47052D2A26A49F0A5567C43CBDF5EB8"><enum>(ii)</enum><text>to the law enforcement agency or governmental officials overseeing the agency about changes in policing services. </text></clause></subparagraph></paragraph></subsection></section><section id="id26CED3CD9C524770AA0A2A7A46AFF5FD"><enum>3.</enum><header>Funding for pattern or practice investigations</header><subsection id="id81A2ADCF13ED4058A5935C9756072325"><enum>(a)</enum><header>Additional funding</header><text>There are authorized to be appropriated, in addition to any other amounts authorized, $445,000,000 to the Civil Rights Division of the Department of Justice for each of fiscal years 2021 through 2030, of which not less than $100,000,000 shall be made available each fiscal year for enforcement and technical assistance under section 210401 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12601">34 U.S.C. 12601</external-xref>).</text></subsection><subsection id="idCC8BAC3FDFB942758C2A1C8BFC5C897E"><enum>(b)</enum><header>Unlawful conduct</header><text>Section 210401(a) of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12601">34 U.S.C. 12601(a)</external-xref>) is amended by inserting <quote>including a prosecutor, court, or other agency involved in the administration of justice,</quote> before <quote>to engage</quote>. </text></subsection><subsection id="idAC8E061551B24E17A8C8364D666C9B0A"><enum>(c)</enum><header>Authority for State investigations</header><text>Section 210401(b) of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12601">34 U.S.C. 12601(b)</external-xref>) is amended—</text><paragraph id="idCDCCE645BD5C4E559BAA24978C1C113B"><enum>(1)</enum><text>by inserting <quote>(1) <header-in-text level="paragraph" style="OLC">Federal enforcement</header-in-text>.—</quote> before <quote>Whenever</quote>; </text></paragraph><paragraph id="id4F7853BE78FA4A46A1CFF0DE70454D28"><enum>(2)</enum><text>in paragraph (1), as so designated, by striking <quote>paragraph (1)</quote> and inserting <quote>subsection (a)</quote>; and</text></paragraph><paragraph id="idD7AF7108876F42E4819F48E06836AB7D"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC2CD4EDABE664DC6A94F3B01480BE6BF"><paragraph id="id60DD6E9ECAF140FCA40002CD10E68719"><enum>(2)</enum><header>State enforcement</header><subparagraph id="id4C3487F6534840E3B64A2D730E08CD33"><enum>(A)</enum><header>In general</header><text>Whenever an attorney general of a State has reasonable cause to believe that a violation of subsection (a) has occurred by a governmental authority, or agent thereof, of the State, including a prosecutor or other agency involved in the administration of justice, the attorney general, or another official or agency designated by a State, may in a civil action brought in any appropriate district court of the United States obtain appropriate equitable and declaratory relief to eliminate the pattern or practice.</text></subparagraph><subparagraph id="id317dd76964624557924cb565f828e8e0"><enum>(B)</enum><header>Prevention of conflicts of interest</header><clause id="idABFD18515DD64EE287170C8584539610"><enum>(i)</enum><header>In general</header><text>No official or agency may be designated under subparagraph (A) if—</text><subclause id="id1910FE8B489141A8A4F786844813E53F"><enum>(I)</enum><text>upon such designation, the Attorney General determines there is reason to believe—</text><item id="id167DA88483C74BB5B218FE844830CEC8"><enum>(aa)</enum><text>the official or agency would be unable to conduct an independent investigation; or</text></item><item id="idC06720A13E514744B3A122ADAB430605"><enum>(bb)</enum><text>a conflict of interest between the official or agency and the jurisdiction under investigation exists; or</text></item></subclause><subclause id="id03A5531CF33043939338348F39A465A9"><enum>(II)</enum><text>the official is employed by or the agency is within, as the case may be, the jurisdiction under investigation. </text></subclause></clause><clause id="idB34CCC811C084566AD9A8FB25AF75DD9"><enum>(ii)</enum><header>Independent organization required</header><text>In the case of a jurisdiction under investigation that is a State-wide office, an independent organization that is unaffiliated with State or local government shall be designated under subparagraph (A). </text></clause></subparagraph><subparagraph id="idFD23AD6A25B84C21952D326BD4B5D3AE"><enum>(C)</enum><header>Technical assistance</header><text>The Attorney General shall provide technical assistance and training to States and units of local government to assist States and units of local governments in carrying out pattern or practice investigations and cases.</text></subparagraph><subparagraph id="idDBECB8AB7A714279B79DDE9C349725FB"><enum>(D)</enum><header>Rule of construction</header><text>Nothing in this paragraph shall be construed to preclude a Federal investigation or other enforcement under this section during the course of a State-led investigation or claim.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id1D45CF6E983D4B25BA167431DA928F6B"><enum>(d)</enum><header>Grant program</header><paragraph id="id2791BF909840476CB6A73B126ECB801D"><enum>(1)</enum><header>State defined</header><text>In this subsection, the term <term>State</term> means each of the several States, the District of Columbia, and each commonwealth, territory, or possession of the United States.</text></paragraph><paragraph id="id5D7DE789A3D64B58B3AE1B7DDFFB1417"><enum>(2)</enum><header>Authorization</header><text>The Attorney General may award grants to States to assist such States in pursuing pattern or practice investigations and cases under section 210401 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12601">34 U.S.C. 12601</external-xref>).</text></paragraph><paragraph id="idc34c73389eb64a33abe62bc1e8f308b3"><enum>(3)</enum><header>Use of funds</header><text>A grant awarded under this subsection may be used by a State to—</text><subparagraph id="id5D0CE81ADFC44402BA2D771F8295D02A"><enum>(A)</enum><text>conduct pattern or practice investigations and cases under section 210401 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12601">34 U.S.C. 12601</external-xref>); </text></subparagraph><subparagraph id="idE3050F44770A4CD2B6B12EF2F5B225AC"><enum>(B)</enum><text>implement and enforce law enforcement reforms to address patterns and practices identified under such section 210401; and </text></subparagraph><subparagraph id="id9AF5518005D04DFE975691A7454E84E9"><enum>(C)</enum><text>develop non-law enforcement programs that reduce dependence on law enforcement agencies, such as funding social workers or behavioral health crisis experts. </text></subparagraph></paragraph><paragraph id="id4E813B24C1E248BE8F092FB6A3F753D9"><enum>(4)</enum><header>Application</header><text>To be eligible to receive a grant under this subsection, a State shall submit an application to the Attorney General that—</text><subparagraph id="ida74c8c4a1ca640688da40949dfa8348d"><enum>(A)</enum><text>contains clearly defined and measurable objectives for the grant funds; </text></subparagraph><subparagraph id="id81C40D3DE1EE425A896C071EB238648E"><enum>(B)</enum><text>describes how the State intends to use the grant funds to pursue, implement, and enforce pattern or practice investigations and cases under section 210401 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12601">34 U.S.C. 12601</external-xref>); </text></subparagraph><subparagraph id="id8C3E713B5C0641758A3274752E84A93F"><enum>(C)</enum><text>outlines the qualifications and training of the attorneys, staff, and other personnel who are, or who may be, assigned to lead or assist pattern or practice investigations and cases; and</text></subparagraph><subparagraph id="id0161E8E9B5E44C73BE86B720E730368F"><enum>(D)</enum><text>demonstrates how the State will remedy patterns or practices of unlawful law enforcement conduct through the creation of community-based programs designed to address underlying challenges leading to law enforcement interaction. </text></subparagraph></paragraph><paragraph id="id31BD9C864D0E4250B599A062D22F0D05"><enum>(5)</enum><header>Required reporting</header><subparagraph id="idA2D50FA21D444D5DB71F53C08B9F7204"><enum>(A)</enum><header>Grantee reporting</header><text>In each fiscal year a State receives a grant under this subsection, the State shall submit to the Attorney General a report detailing—</text><clause id="id25CF2611A70B42C5B458B447F2E5F304"><enum>(i)</enum><text>how the grant funds were used; and</text></clause><clause id="idE3C9C64BA49F40C8B956EAC9A68D9794"><enum>(ii)</enum><text>the progress made towards addressing patterns and practices identified under section 210401 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12601">34 U.S.C. 12601</external-xref>).</text></clause></subparagraph><subparagraph id="id31C213B8E83D4811B5CEA14452592A51"><enum>(B)</enum><header>Reports to Congress</header><text>Not later than 1 year after the date of enactment of this Act, and once each year thereafter, the Attorney General shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report on the grant program established under this subsection, which shall include—</text><clause id="id7462AE4C8CFB417BBFB4577D07675854"><enum>(i)</enum><text>a detailed summary of how grant funds awarded under the grant program were used; and</text></clause><clause id="idE72239020DAC41B9976500873C6D5B6D"><enum>(ii)</enum><text>recommendations, if any, for improvements needed for the grant program.</text></clause></subparagraph></paragraph><paragraph id="idCBB6FE0201E649C3923C88F755F8F258"><enum>(6)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Attorney General $150,000,000 for each of fiscal years 2021 through 2030 to carry out this subsection.</text></paragraph></subsection></section></legis-body></bill>
