which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the imposition of sanctions with respect to the deliberate concealment or distortion of information about public health emergencies of international concern, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Li Wenliang Global Public Health Accountability Act of 2021</short-title></quote>.</text></section><section id="iddf27257c5df44673a29baff1ab10ab87"><enum>2.</enum><header>Authorization of imposition of sanctions</header><subsection id="id6e9bd24cfa484c009be243bab024b756"><enum>(a)</enum><header>In general</header><text>The President may impose the sanctions described in subsection (b) with respect to any foreign person the President determines, based on credible evidence—</text><paragraph id="ide59eda38b5294e18a7431569903456e3"><enum>(1)</enum><text>is a government official, or a senior associate of such an official, that is responsible for, or complicit in, ordering, controlling, or otherwise directing, or financially benefits from, acts intended to deliberately conceal or distort information about a public health emergency of international concern, including coronavirus disease 2019 (commonly known as <quote>COVID–19</quote>); or</text></paragraph><paragraph id="id27f5be7bb8804c0bb4061b2ba4b64424"><enum>(2)</enum><text>has materially assisted, sponsored, or provided financial, material, or technological support for, or goods or services in support of, an act described in paragraph (1).</text></paragraph></subsection><subsection id="id0f6ba3a0d19049c384b99e92c12c36a9"><enum>(b)</enum><header>Sanctions described</header><text>The sanctions described in this subsection are the following:</text><paragraph id="id28248092051d4019b638647778b98861"><enum>(1)</enum><header>Inadmissibility to United States</header><text>In the case of a foreign person who is an individual—</text><subparagraph id="id0f39bd8719b44550b0f97fc433eebb22"><enum>(A)</enum><text>ineligibility to receive a visa to enter the United States or to be admitted to the United States; or</text></subparagraph><subparagraph id="iddb7e4292e8be4934a8371049de66be76"><enum>(B)</enum><text>if the individual has been issued a visa or other documentation, revocation, in accordance with section 221(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1201">8 U.S.C. 1201(i)</external-xref>), of the visa or other documentation.</text></subparagraph></paragraph><paragraph id="id8d6829533b824e8eb9e1d949cebe3501"><enum>(2)</enum><header>Blocking of property</header><subparagraph id="ide7151a3a2b544556a90229c80cfc0462"><enum>(A)</enum><header>In general</header><text>The blocking, in accordance with the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>), of all transactions in all property and interests in property of a foreign person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></subparagraph><subparagraph id="ideb6204f29ded402aae15e93f5ae36dbb"><enum>(B)</enum><header>Exception relating to importation of goods</header><clause id="idc7a36cd4583e40dcbe5c4020bf8232d6"><enum>(i)</enum><header>In general</header><text>The authority to block and prohibit all transactions in all property and interests in property under subparagraph (A) shall not include the authority to impose sanctions on the importation of goods.</text></clause><clause id="id872f181579fa4e9b93e190d20cbb7772"><enum>(ii)</enum><header>Good defined</header><text>In this subparagraph, the term <term>good</term> means any article, natural or manmade substance, material, supply, or manufactured product, including inspection and test equipment, and excluding technical data. </text></clause></subparagraph></paragraph></subsection><subsection id="id7d30ef952cd3441ea980e322886c1dd6"><enum>(c)</enum><header>Consideration of certain information in imposing sanctions</header><text>In determining whether to impose sanctions under subsection (a), the President shall consider—</text><paragraph id="id81ec7f0cba4b4fcd9719e219ce9041d1"><enum>(1)</enum><text>information provided jointly by the chairperson and ranking member of each of the appropriate congressional committees; and</text></paragraph><paragraph id="id20e99f735b254080ad1a24dfb1795f19"><enum>(2)</enum><text>credible information obtained by other countries and nongovernmental organizations that monitor violations of human rights and global health issues, including issues related to infectious disease.</text></paragraph></subsection><subsection id="id5443a90805234256878534b1df87d4de"><enum>(d)</enum><header>Requests by appropriate congressional committees</header><paragraph id="id894e7821720c451dba4bf79d42a4b336"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after receiving a request that meets the requirements of paragraph (2) with respect to whether a foreign person is described in subsection (a), the President shall—</text><subparagraph id="ida01db4bdf9e84089873ad5f2633b7354"><enum>(A)</enum><text>determine if that person is so described; and </text></subparagraph><subparagraph id="idEC4FBB8BCCC44CD990C777871A7106C1"><enum>(B)</enum><text>submit a classified or unclassified report to the chairperson and ranking member of the committee or committees that submitted the request with respect to that determination that includes—</text><clause id="id5169a88f295a41618914a5dd21495c98"><enum>(i)</enum><text>a statement of whether or not the President imposed or intends to impose sanctions with respect to the person; and</text></clause><clause id="idb279c0381812487aa8856c2e81ed3a6c"><enum>(ii)</enum><text>if the President imposed or intends to impose sanctions, a description of those sanctions.</text></clause></subparagraph></paragraph><paragraph id="id603f0de0f9754438b70fd69d0e89c84b"><enum>(2)</enum><header>Requirements</header><text>A request under paragraph (1) with respect to whether a foreign person is described in subsection (a) shall be submitted to the President in writing jointly by the chairperson and ranking member of one of the appropriate congressional committees.</text></paragraph></subsection><subsection id="iddabc533bb2d04110819bd5b6f26819d9"><enum>(e)</enum><header>Exception To comply with United Nations headquarters agreement and law enforcement objectives</header><text>Sanctions under subsection (b)(1) shall not apply to an individual if admitting the individual into the United States—</text><paragraph id="id391E76953BBF4522AB93EEFE5FDD340A"><enum>(1)</enum><text>would further important law enforcement objectives; or </text></paragraph><paragraph id="idCEAC4246197346018FCE3C9972C5ED0F"><enum>(2)</enum><text>is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations of the United States.</text></paragraph></subsection><subsection id="id5e9297a42af64495a336f9b413ec628b"><enum>(f)</enum><header>Enforcement of blocking of property</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of subsection (b)(2) or any regulation, license, or order issued to carry out that subsection shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></subsection><subsection id="id3AE09779FEFC47F7BD2128449AC0A167"><enum>(g)</enum><header>Reports required</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, and annually thereafter, the President shall submit to the appropriate congressional committees a report that includes—</text><paragraph id="idea96c8a6fd614d86aa5b4bbd6e404254"><enum>(1)</enum><text>a list of each foreign person with respect to which the President imposed sanctions under subsection (b) during the year preceding the submission of the report;</text></paragraph><paragraph id="id16bb904ea2cd404580dd8138bd197363"><enum>(2)</enum><text>a description of the type of sanctions imposed with respect to each such person;</text></paragraph><paragraph id="idf5b1e2c03a7f48098aafa40e810b7537"><enum>(3)</enum><text>the number of foreign persons with respect to which the President—</text><subparagraph id="id83f4d8d1294d4a7c830e73cb84d4a0a5"><enum>(A)</enum><text>imposed sanctions under subsection (b) during that year; or</text></subparagraph><subparagraph id="idf0648e44f86b4dddbae991b5ab92842e"><enum>(B)</enum><text>terminated sanctions under subsection (h) during that year;</text></subparagraph></paragraph><paragraph id="idb0c6b55516794248b84c155f258a6c7f"><enum>(4)</enum><text>the dates on which such sanctions were imposed or terminated, as the case may be;</text></paragraph><paragraph id="id49c6b0f0094b427d8353cb57cccb011e"><enum>(5)</enum><text>the reasons for imposing or terminating such sanctions; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida7dbf4d307174592bf84145b07057889"><enum>(6)</enum><text>a description of the efforts of the President to encourage the governments of other countries to impose sanctions that are similar to the sanctions authorized by this section. </text></paragraph></subsection><subsection id="ide28a52359ce44a0aa019766b2c6249c7"><enum>(h)</enum><header>Termination of sanctions</header><text>The President may terminate the application of sanctions under this section with respect to a person if the President determines and reports to the appropriate congressional committees not later than 15 days before the termination of the sanctions that—</text><paragraph id="idcf96c2c6614f4407aeb1e19092ac271b"><enum>(1)</enum><text>credible information exists that the person did not engage in the activity for which sanctions were imposed;</text></paragraph><paragraph id="iddc21d465ba6d4d478958d1a3374ea8f3"><enum>(2)</enum><text>the person has been prosecuted appropriately for the activity for which sanctions were imposed; or</text></paragraph><paragraph id="idd01249a9bce84884bafa58f31121f8dc"><enum>(3)</enum><text>the termination of the sanctions is in the national security interests of the United States.</text></paragraph></subsection><subsection id="ida5228034216248148b442b631775e831"><enum>(i)</enum><header>Regulatory authority</header><text>The President shall issue such regulations, licenses, and orders as are necessary to carry out this section.</text></subsection><subsection id="id8322C1F28784470DB2616DD4B757AC6D"><enum>(j)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="idc33bc772cb7a4038a2dff049586ae49d"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id296F4D339BAD4A1B88A011C603E8EFEC"><enum>(A)</enum><text>the Committee on Banking, Housing, and Urban Affairs and the Committee on Foreign Relations of the Senate; and </text></subparagraph><subparagraph id="id4B6BF3F178934D18B7F2343BACDF7C20"><enum>(B)</enum><text>the Committee on Financial Services and the Committee on Foreign Affairs of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id534F0013338240F3AAC5210642DB9968"><enum>(2)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means a person that is not a United States person.</text></paragraph><paragraph id="id7f28c515e4d74d5fbc934f942370d167"><enum>(3)</enum><header>Person</header><text>The term <term>person</term> means an individual or entity.</text></paragraph><paragraph id="idB648F355B08D4AC5858EA38595B27C14"><enum>(4)</enum><header>Public health emergency of international concern</header><text>The term <term>public health emergency of international concern</term> means a public health emergency determined to be a public health emergency of international concern by the World Health Organization.</text></paragraph><paragraph id="idad611c086d524923ad3c5df2b9159e1c"><enum>(5)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text><subparagraph id="idde1c8507160d4d87ab6d3678f0cfbf09"><enum>(A)</enum><text>an individual who is a United States citizen or an alien lawfully admitted for permanent residence to the United States;</text></subparagraph><subparagraph id="idd6b72c93d4ad4a39b99eb255eec65502"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfc0ec64c0c644559bb68f6cf48eaabdc"><enum>(C)</enum><text>any person in the United States. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
