which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act and the Bipartisan Budget Act of 2018 to expand and expedite access to cardiac rehabilitation programs and pulmonary rehabilitation programs under the Medicare program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H9125FF6E70A34C2DA8D2A1DAEC439E91"><section section-type="section-one" id="H01CD8E9B795E4AD885D0B03314529D73"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Increasing Access to Quality Cardiac Rehabilitation Care Act of 2021</short-title></quote>.</text></section><section id="H3F1ADC8FA17D4593B6E88FF84B810512"><enum>2.</enum><header>Expanding access to cardiac rehabilitation programs and pulmonary rehabilitation programs under Medicare program</header><subsection id="H15B22DD590E34191B70ECB91360CB137"><enum>(a)</enum><header>Cardiac rehabilitation programs</header><text display-inline="yes-display-inline">Section 1861(eee) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(eee)</external-xref>) is amended—</text><paragraph id="H3CC48A6E60164B4CBE37C42641BBCCA2"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="H38718FE9F9AA4C46AF6AB56413428337"><enum>(A)</enum><text>in subparagraph (A)(i), by striking <quote>a physician’s office</quote> and inserting <quote>the office of a physician (as defined in subsection (r)(1)) or the office of a physician assistant, nurse practitioner, or clinical nurse specialist (as those terms are defined in subsection (aa)(5))</quote>; and</text></subparagraph><subparagraph id="HBE3931B82E98449CAE4E7B3EB9C1686E"><enum>(B)</enum><text>in subparagraph (C), by inserting after <quote>physician</quote> the following: <quote>(as defined in subsection (r)(1)) or a physician assistant, nurse practitioner, or clinical nurse specialist (as those terms are defined in subsection (aa)(5))</quote>;</text></subparagraph></paragraph><paragraph id="H48332C4784D0426788BEC1089B0EA3CF"><enum>(2)</enum><text>in paragraph (3)(A), by striking <quote>physician-prescribed exercise</quote> and inserting <quote>exercise prescribed by a physician (as defined in subsection (r)(1)) or a physician assistant, nurse practitioner, or clinical nurse specialist (as those terms are defined in subsection (aa)(5))</quote>; and</text></paragraph><paragraph id="HE047FBEFD4E443F88D3A44F182A21F81"><enum>(3)</enum><text>in paragraph (5), by inserting after <quote>physician</quote> the following: <quote>(as defined in subsection (r)(1)) or a physician assistant, nurse practitioner, or clinical nurse specialist (as those terms are defined in subsection (aa)(5))</quote>.</text></paragraph></subsection><subsection id="H390DD6F7E0CD420CA0764208F887A4C5"><enum>(b)</enum><header>Pulmonary rehabilitation programs</header><text display-inline="yes-display-inline">Section 1861(fff) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(fff)</external-xref>) is amended—</text><paragraph id="HE551B999C4B6438AB3C99C910E839EAF"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)(A), by striking <quote>physician-prescribed exercise</quote> and inserting <quote>exercise prescribed by a physician (as defined in subsection (r)(1)) or a physician assistant, nurse practitioner, or clinical nurse specialist (as those terms are defined in subsection (aa)(5))</quote>; and</text></paragraph><paragraph id="H1C214E2E0B0B4B1F966CEB9A9662AB6C"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3), by inserting after <quote>physician</quote> the following: <quote>(as defined in subsection (r)(1)) or a physician assistant, nurse practitioner, or clinical nurse specialist (as those terms are defined in subsection (aa)(5))</quote>.</text></paragraph></subsection><subsection id="H6D3231C915634A8AA5EDB0F9016FF685"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to items and services furnished on or after January 1, 2022.</text></subsection></section><section section-type="subsequent-section" id="H691EFE04284B423BADE2F2FA95BF8161"><enum>3.</enum><header>Expediting access to cardiac rehabilitation programs and pulmonary rehabilitation programs under
 Medicare program</header><text display-inline="no-display-inline">Section 51008(c) of the Bipartisan Budget Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/123">Public Law 115–123</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref> note) is amended by striking <quote>January 1, 2024</quote> and inserting <quote>January 1, 2022</quote>.</text></section></legis-body></bill>
