which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XIX of the Social Security Act to provide Medicaid coverage for all pregnant and postpartum women, to provide coverage under the Medicaid program for services provided by doulas, midwives, and lactation consultants, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="HEC0BFAE0686648B99A5D771B3F97B32B"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Coverage and Care for Mothers Act</short-title></quote>.</text></section><section id="HE35C1079C3F64E2984E7DC0A2D775200"><enum>2.</enum><header>Extending Medicaid eligibility to all pregnant women</header><subsection id="id3BC67DF1446649A594326DFBE629937A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1905(n)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(n)(1)</external-xref>) is amended to read as follows:</text><quoted-block style="traditional" id="idAA7BE1EFC5DB4BA697772E122193FA63" act-name=""><paragraph id="id0E095715650B4E0BB76CF419AC1AC240"><enum>(1)</enum><text display-inline="yes-display-inline">a woman who is pregnant and through the end of the month in which the 365-day period (beginning on the last day of her pregnancy) ends; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idF7A5787CD94F42B9AAECB97932F6C898"><enum>(b)</enum><header>Conforming amendments</header><text>Title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) is amended—</text><paragraph id="id314D1FEF9524467F9857E0FE2CBFC578"><enum>(1)</enum><text>in section 1902—</text><subparagraph id="id055B4810821F499DB8AD34B7BDDC1E0B"><enum>(A)</enum><text>in subsection (a)(10)(C)—</text><clause id="id2F7A149E084D491D96C3BECBB42B32C8"><enum>(i)</enum><text>in clause (ii), by striking <quote>must make available medical assistance—</quote> and all that follows through <quote>individual described in subparagraph (A);</quote> and inserting <quote>must make available medical assistance to individuals under the age of 18 who (but for income and resources) would be eligible for medical assistance as an individual described in subparagraph (A)(i);</quote>; and</text></clause><clause id="idAC2EF75EB72649CB8043C0879159B208"><enum>(ii)</enum><text>in clause (iii)—</text><subclause id="id09DFA68112724CB0B352A461D20710AB"><enum>(I)</enum><text>by striking <quote>must include (I) with respect to</quote> and inserting <quote>must include, with respect to</quote>; and</text></subclause><subclause id="id6EB81049ABE34960B675C0802370F356"><enum>(II)</enum><text>by striking <quote>, and (II)</quote> and all that follows through <quote>delivery services</quote>;</text></subclause></clause></subparagraph><subparagraph id="id65250394138048829FCF80889E0F8308"><enum>(B)</enum><text>in subsection (e), by striking paragraph (6); </text></subparagraph><subparagraph id="id98AD9844B31E4D0CAEC68B10B1089687"><enum>(C)</enum><text>in subsection (l)(1)(A), by inserting <quote>before January 1, 2022,</quote> before <quote>women during pregnancy</quote>; and</text></subparagraph><subparagraph id="idAC03D70AC17247CDB79703902570FC35"><enum>(D)</enum><text>in subsection (ii)(1)(A), by inserting <quote>that was in effect as of January 1, 2022</quote> after <quote>pregnant women</quote>;</text></subparagraph></paragraph><paragraph id="idB263363195624DAD8A97EDAE48C7677C"><enum>(2)</enum><text>in section 1920(b)(1)(A), by striking <quote>that the family income</quote> and all that follows through <quote>income level of eligibility</quote> and inserting <quote>that the woman is eligible for medical assistance</quote>; and</text></paragraph><paragraph id="idFD2C4356EF10474D8FE7C1D0369FF727"><enum>(3)</enum><text>in section 1937(a)(2)(B), by amending clause (i) to read as follows:</text><quoted-block style="traditional" id="idF1073CEB87B548B291F8774C66C6CD7D" act-name=""><clause id="id489F3ACA0C4141F78F3B29571891F0D7"><enum>(i)</enum><header>Qualified pregnant women</header><text display-inline="yes-display-inline">The individual is a qualified pregnant woman (as defined in section 1905(n)(1)).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idD9D554B38DA8497EA87A2B8B9E422C4F"><enum>3.</enum><header>Extending continuous Medicaid and CHIP coverage for pregnant and post­par­tum women</header><subsection id="idE6D9E2EA38F44FAAADF80690A04F355A"><enum>(a)</enum><header>Extending continuous Medicaid and CHIP coverage for pregnant and postpartum women</header><paragraph id="id143C6C5BCED14B3E929AF45C3850FFDE"><enum>(1)</enum><header>Medicaid</header><text>Title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) is amended—</text><subparagraph id="idE7413425B6554617A59DC1EDADCC7065"><enum>(A)</enum><text>in section 1902(e)—</text><clause id="idC05FECD4575C486DAF9D87AB4200A2E4"><enum>(i)</enum><text>in paragraph (5), by striking <quote>60-day period</quote> and inserting <quote>365-day period</quote>; and</text></clause><clause id="id273F287F1E1A4EEAAA7D9D815EE6E0E1"><enum>(ii)</enum><text>in paragraph (16), by striking <quote>At the option of the State</quote> and inserting <quote>Before January 1, 2022, at the option of the State</quote>;</text></clause></subparagraph><subparagraph id="id34CD75B7310E41C889DD9ECECBDAF470"><enum>(B)</enum><text>in section 1902(l)(1)(A), by striking <quote>60-day period</quote> and inserting <quote>365-day period</quote>;</text></subparagraph><subparagraph id="idBAD8AAB900DA4376B7BB38A430168B34"><enum>(C)</enum><text>in section 1903(v)(4)(A)(i), by striking <quote>60-day period</quote> and inserting <quote>365-day period</quote>; and</text></subparagraph><subparagraph id="idA65E7889E97D43398FC4BFA5B4CBD827"><enum>(D)</enum><text>in section 1905(a), in the 4th sentence in the matter following paragraph (30)— </text><clause id="id4AB6B1E97C7F4E85B620248F6A210298"><enum>(i)</enum><text>by striking <quote>60-day period</quote> and inserting <quote>365-day period</quote>; and </text></clause><clause id="idC69717F18DBA4364BDE5F1AC32CEDE0E"><enum>(ii)</enum><text>by striking <quote>subdivision (B) following paragraph (30)</quote> and inserting <quote>subdivision (B) following paragraph (32)</quote>.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id873C5DC6332542B6B116861FA5BBCA29"><enum>(2)</enum><header display-inline="yes-display-inline">CHIP</header><text display-inline="yes-display-inline">Section 2112 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397ll">42 U.S.C. 1397ll</external-xref>) is amended by striking <quote>60-day period</quote> each place it appears and inserting <quote>365-day period</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA6B126C3CDAD4D12AE7B82624CBF6262"><enum>(3)</enum><header>Conforming amendment</header><text>Section 1938(b)(2)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-8">42 U.S.C. 1396u–8(b)(2)(C)</external-xref>) is amended by striking <quote>previous 60 days</quote> and inserting <quote>previous 365 days</quote>.</text></paragraph></subsection><subsection id="id88DFFAAA0B9E4B89BF57D988D40DBF11"><enum>(b)</enum><header>Requiring full benefits for pregnant and postpartum women</header><paragraph id="id42556F25197545D5AC6972514E86F49A"><enum>(1)</enum><header>Medicaid</header><subparagraph id="id19BF0935C6C1451EB9894661799AE533"><enum>(A)</enum><header>In general</header><text>Paragraph (5) of section 1902(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/24/1396a">24 U.S.C. 1396a(e)</external-xref>) is amended to read as follows:</text><quoted-block style="traditional" act-name="" id="idD60EEF71613B4E9A9E0FD036DE7E8468"><paragraph id="id32075EAF271B400B9E4B730A8530D2AD"><enum>(5)</enum><text display-inline="yes-display-inline">Any woman who is eligible for medical assistance under the State plan or a waiver of such plan and who is, or who while so eligible becomes, pregnant, shall continue to be eligible under the plan or waiver for medical assistance through the end of the month in which the 365-day period (beginning on the last day of her pregnancy) ends, regardless of the basis for the woman's eligibility for medical assistance, including if the woman's eligibility for medical assistance is on the basis of being pregnant.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="idFCF99B347A3D4468855A88388A130288"><enum>(B)</enum><header>Conforming amendment</header><text>Section 1902(a)(10) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)</external-xref>) is amended in the matter following subparagraph (G) by striking <quote>(VII) the medical assistance</quote> and all that follows through <quote>complicate pregnancy,</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC857E2FCD4034EF881446EE72F5B7A04"><enum>(2)</enum><header>CHIP</header><text>Section 2107(e)(1)(J) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)(J)</external-xref>) is amended— </text><subparagraph commented="no" display-inline="no-display-inline" id="id88CF7F590AF04DE0BACC70026F09AE86"><enum>(A)</enum><text>by inserting <quote>, before January 1, 2022,</quote> before <quote>(16) of section 1902(e)</quote>; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id5124174983A34098A46F3CB2D4B978BC"><enum>(B)</enum><text>by striking <quote>(relating to</quote> and all that follows through the period and inserting <quote>(relating to the provision of medical assistance to pregnant women during pregnancy and the 365-day postpartum period under title XIX).</quote></text></subparagraph></paragraph></subsection></section><section id="idA782D26DFD044B6C932C45F60FBA8DAB"><enum>4.</enum><header>Medicaid coverage of services provided by doulas, midwives, and lactation consultants</header><subsection id="H18139BCF12044D24891F34CAB738C940"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended—</text><paragraph id="HDF181C4FAAA24CED8FEF1EAEEB65BCEC"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HAFE9675D121E45BB9BBD6856A36E7A24"><enum>(A)</enum><text>in paragraph (30), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H66B8CF5C5A6447C1858FA978C2F968D8"><enum>(B)</enum><text>by redesignating paragraph (31) as paragraph (32); and</text></subparagraph><subparagraph id="HE3A2C529BEDE49F0B1205F39DBDA3F78"><enum>(C)</enum><text>by inserting after paragraph (30) the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H12A35844F6D04651AFFCF7F13B22F89A"><paragraph id="H29C1A6F929F343C9A74EA80CF1447268"><enum>(31)</enum><text display-inline="yes-display-inline">services, including— </text><subparagraph id="idD9FA8FF1EF0345FC8889FF6A704912E5"><enum>(A)</enum><text display-inline="yes-display-inline">prenatal, delivery, postpartum, and lactation consulting services, provided by doulas, midwives, and lactation consultants (as those terms are defined in subsection (jj)) to the extent authorized under State law; and</text></subparagraph><subparagraph id="id53DF8D8D58354D77927962EADEDCBEE0"><enum>(B)</enum><text display-inline="yes-display-inline">services included in the components of postpartum care identified by the American College of Obstetricians and Gynecologists in Committee Opinion Number 736 published in May of 2018 (or any successor opinion or publication); and</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H9FA2720064C042CAA4708E559136CC3C"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H47E70E641E4A4CE2BBEC8A11BE94CE0E"><subsection id="H61455504D85F4B64B2AB483839717EB5"><enum>(jj)</enum><header>Doulas and midwives defined</header><text display-inline="yes-display-inline">For purposes of subsection (a)(31):</text><paragraph id="H0F747245F54E44E69C2DB81D5E1DDA23"><enum>(1)</enum><header>Doulas defined</header><text display-inline="yes-display-inline">The term <term>doula</term> means an individual who—</text><subparagraph id="H96499A4CF57F40F9B0F54AC835107DDD"><enum>(A)</enum><text display-inline="yes-display-inline">is certified by an organization, which has been established for not less than 5 years and which requires the completion of continuing education to maintain such certification, to provide non-medical advice, information, emotional support, and physical comfort to an individual during such individual’s pregnancy, childbirth, and postpartum period; and</text></subparagraph><subparagraph id="H2231FBE1B45C4C6384FE3183BAAB16FB"><enum>(B)</enum><text>maintains such certification by completing such required continuing education.</text></subparagraph></paragraph><paragraph id="H65F6C202048B4604BECCBDCF4F1DF998"><enum>(2)</enum><header>Midwives defined</header><subparagraph id="H0FBEC0779CC34DC589A2258C03E841F2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>midwife</term> means a certified midwife, certified professional midwife, and Tribal-recognized midwife.</text></subparagraph><subparagraph id="H065EADC85EAD4DDCA1C27C094D69C7FA"><enum>(B)</enum><header>Certified midwife</header><text>For purposes of subparagraph (A), the term <term>certified midwife</term> means an individual who is certified by the American Midwifery Certification Board to practice midwifery.</text></subparagraph><subparagraph id="H98B5820CD9634EC9A00B383728F5378A"><enum>(C)</enum><header>Certified professional midwife</header><text>For purposes of subparagraph (A), the term <term>certified professional midwife</term> means an individual who—</text><clause id="H3956BC8C8CB14A22A721631D046D892B"><enum>(i)</enum><text>is certified by the North American Registry of Midwives to practice midwifery for normal, low-risk pregnancies and childbirths;</text></clause><clause id="H3EFB497B6B3F4014BEF8C7885A60E1ED"><enum>(ii)</enum><text display-inline="yes-display-inline">completes—</text><subclause id="H8BAB510455554AED9568F42B871C5D15"><enum>(I)</enum><text>a midwifery education program accredited by the Midwifery Education and Accreditation Council or any other entity recognized by the Department of Education; or</text></subclause><subclause id="HB05F964B1A2D44D682A8772B9BEB4140"><enum>(II)</enum><text display-inline="yes-display-inline">the requirements to obtain a Midwifery Bridge Certificate from the North American Registry of Midwives; and</text></subclause></clause><clause id="HE8DD059E287F47CC86C0779DB3E18CD1"><enum>(iii)</enum><text>maintains the certification described in clause (i) by completing any required continuing education for such certification.</text></clause></subparagraph><subparagraph id="HBA980276141446D6A87211C142A2FA34"><enum>(D)</enum><header>Tribal-recognized midwife</header><text>For purposes of subparagraph (A), the term <term>Tribal-recognized midwife</term> means an individual who is recognized by an Indian tribe (as defined in section 4 of the Indian Health Care Improvement Act) to practice midwifery for such tribe.</text></subparagraph></paragraph><paragraph commented="no" id="id97C953D523184BC5A9F5DE9B085E2D71"><enum>(3)</enum><header>Lactation consultant defined</header><text>The term <term>lactation consultant</term> means an individual who is a specialist who—</text><subparagraph commented="no" id="id22C9D87A34C849EBB1C7292270C3F447"><enum>(A)</enum><text>is trained to— </text><clause commented="no" id="id612D1569BC274CB4B65A74DF0FBB17F4"><enum>(i)</enum><text>focus on the needs and concerns of a breastfeeding mother and baby; and </text></clause><clause commented="no" id="idD9C1FF6B7CF241579962D3E8F798160E"><enum>(ii)</enum><text>prevent, recognize, and solve breastfeeding difficulties;</text></clause></subparagraph><subparagraph commented="no" id="id55076C486DB0454E984F591BC81DAEFA"><enum>(B)</enum><text display-inline="yes-display-inline">is certified by an organization, which has been established for not less than 5 years and which requires the completion of continuing education to maintain such certification, to provide lactation consulting services; and</text></subparagraph><subparagraph commented="no" id="idC52AD7FED4084CA9A56D871B2AE062B0"><enum>(C)</enum><text>maintains such certification by completing such required continuing education.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF49E95E147A94532BA4F9D85F3E71B55"><enum>(b)</enum><header>Requiring mandatory coverage under State plan</header><text>Section 1902(a)(10)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)</external-xref>) is amended, in the matter preceding clause (i), by striking <quote>and (30)</quote> and inserting <quote>(30), and (31)</quote>.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="idD6AF680F6EE54C7388B10ADEB904891C"><enum>5.</enum><header>Increased FMAP for additional expenditures</header><text display-inline="no-display-inline">Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>), as amended by section 4, is further amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id5595DC63C7374B6C9043F5ABBE9A6820"><enum>(1)</enum><text>in subsection (b), by striking <quote>and (ii)</quote> and inserting <quote>(ii), and (kk)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id787170F352504AEABD4F274865F27300"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" act-name="" id="idF0D42E7E91CA4FF7975D611830B6FCF3"><subsection commented="no" id="idF352096799314CB4B3F690326943D183"><enum>(kk)</enum><header>Increased FMAP for additional expenditures for medical assistance to pregnant and postpartum women</header><text>For calendar quarters beginning on or after January 1, 2022, notwithstanding subsection (b), the Federal medical assistance percentage for a State, with respect to the additional amounts expended by such State for medical assistance under the State plan under this title or a waiver of such plan that are attributable to requirements imposed by the amendments made by the <short-title>Improving Coverage and Care for Mothers Act</short-title> (as determined by the Secretary), shall be equal to 100 percent.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H8C7D32FC9A614BF6AA101C67F904509A"><enum>6.</enum><header>Effective date</header><subsection id="HAFE769E4651144EEA77E1044F2E97144"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subsection (b), the amendments made by this Act shall apply with respect to medical assistance furnished on or after January 1, 2022.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H6815BE9BA15C4ED8AD4F27CEE1812830"><enum>(b)</enum><header>Exception for State legislation</header><text display-inline="yes-display-inline">In the case of a State plan under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) that the Secretary of Health and Human Services determines requires State legislation in order for the respective plan to meet any requirement imposed by amendments made by this section, the respective plan shall not be regarded as failing to comply with the requirements of such title solely on the basis of its failure to meet such an additional requirement before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of the enactment of this Act. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of the session shall be considered to be a separate regular session of the State legislature.</text></subsection></section></legis-body></bill>
