which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20220119" legis-day="20220118">January 19 (legislative day, January 18), 2022</action-date><action-desc>Reported by <sponsor name-id="S338">Mr. Manchin</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To amend the Omnibus Parks and Public Lands Management Act of 1996 to provide for the establishment of a Ski Area Fee Retention Account, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ski Hill Resources for Economic Development Act of 2021</short-title></quote>.</text></section><section id="id1e31bb66eaec4991aaaf6494122651bf" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>2.</enum><header>Establishment of Ski Area Fee Retention Account</header><subsection id="id80d54da5f97948339bfa9446e0d17319"><enum>(a)</enum><header>In general</header><text>Section 701 of division I of the Omnibus Parks and Public Lands Management Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/16/497c">16 U.S.C. 497c</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb83703387cf6401c85be61f72fe26231" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><subsection id="id1b21c3ec67be4dff867c1c05fde4cde9"><enum>(k)</enum><header>Ski area fee retention account</header><paragraph id="ideeedba578f4a459597aa91d1d4e135ea"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id470ace726bdc4f00b424d7b6d8aaacfa"><enum>(A)</enum><header>Account</header><text>The term <term>Account</term> means the Ski Area Fee Retention Account established under paragraph (2).</text></subparagraph><subparagraph id="ide862e8fc9a9c4c9eb0f00af7846d222b"><enum>(B)</enum><header>Covered unit</header><text>The term <term>covered unit</term> means a unit of the National Forest System that collects a rental charge.</text></subparagraph><subparagraph id="id97255B981F6B4B9495AC2FDC941C9133"><enum>(C)</enum><header>Program</header><text>The term <term>Program</term> means the Forest Service Ski Area Program.</text></subparagraph><subparagraph id="ida9af66b7ca744a6bb43be1c55b5590b4"><enum>(D)</enum><header>Region</header><text>The term <term>region</term> means a region of the Forest Service.</text></subparagraph><subparagraph id="id321e4157c90944b094cf46f9fa9533f2"><enum>(E)</enum><header>Rental charge</header><text>The term <term>rental charge</term> means a permit rental charge that is charged under subsection (a).</text></subparagraph><subparagraph id="ida75b23dc0c8149bb95721946562afdab"><enum>(F)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></subparagraph></paragraph><paragraph id="id44b4066f4db74f73b85a5780678ea454"><enum>(2)</enum><header>Establishment</header><text>The Secretary of the Treasury shall establish in the Treasury a special account, to be known as the <quote>Ski Area Fee Retention Account</quote>, into which there shall be deposited—</text><subparagraph id="idac454dbde4f4430e8b511e3e5984e68c"><enum>(A)</enum><text>in the case of a covered unit at which $15,000,000 or more is collected by the covered unit from rental charges in a fiscal year, an amount equal to 60 percent of the rental charges collected at the covered unit in the fiscal year; or</text></subparagraph><subparagraph id="id82ba934aa86d44f98cbedb1c184317ce"><enum>(B)</enum><text>in the case of any other covered unit, an amount equal to 75 percent of the rental charges collected at the covered unit in a fiscal year.</text></subparagraph></paragraph><paragraph id="id24a21eeab8a34d839f753db0f29384f0"><enum>(3)</enum><header>Availability</header><text>Subject to paragraph (5), any amounts deposited in the Account under paragraph (2) shall be available to the Secretary for use in accordance with paragraph (4), without further appropriation, and shall remain available until expended.</text></paragraph><paragraph id="id446fa5815459404f97373ff535d6d5a1"><enum>(4)</enum><header>Use and distribution of amounts in the Account</header><subparagraph id="ida66c437ce7464f859a82ef8667f8bc77"><enum>(A)</enum><header>Distribution of percentage amounts</header><text>Except as provided in subparagraphs (B), (C), (D), (F), and (G), 75 percent of the amounts deposited in the Account from a covered unit at which the rental charges were collected in the preceding fiscal year shall be available for expenditure in accordance with subparagraph (E) at that covered unit.</text></subparagraph><subparagraph id="id9af61a4fc3884c42ad6a23045998301f"><enum>(B)</enum><header>Reduction of percentage amount</header><text>Subject to subparagraph (C), the Secretary may reduce the percentage of amounts available to a covered unit under subparagraph (A) if the Secretary determines that the amounts will exceed the reasonable needs of the covered unit for the purposes described in subparagraph (E) in the fiscal year.</text></subparagraph><subparagraph id="id1c8879a7cee24ea8a3006bf22b32d6b3"><enum>(C)</enum><header>Limitation</header><text>The Secretary may not reduce, pursuant to subparagraph (B), the percentage of amounts available under subparagraph (A)—</text><clause id="id9826da59f7f340fe821a4a9854532af4"><enum>(i)</enum><text>in the case of a covered unit described in paragraph (2)(A), to less than 25 percent of the amount of rental charges deposited in the Account from the covered unit in a fiscal year; or</text></clause><clause id="id19c1e6f825004b9997e0dd09cc8c39a5"><enum>(ii)</enum><text>in the case of any other covered unit, to less than 40 percent of the amount of rental charges deposited in the Account from the covered unit in a fiscal year.</text></clause></subparagraph><subparagraph id="id70603321452848d2a1b2c6a536438ff7"><enum>(D)</enum><header>Distribution of reduction amounts</header><text>The Secretary may make any amounts in the Account remaining as a result of any reduction in the percentage of amounts under subparagraph (B) available to other covered units or the regions in which the covered units are located for the purposes described in subparagraph (E), taking into consideration the following factors:</text><clause id="id613c37ec445d45fdbf22c58a1e4ee45b"><enum>(i)</enum><text>Any backlog in ski area permit and Program administration in the covered units, including—</text><subclause id="id229D6D3B3C3D4914B989D2DEFAD779A8"><enum>(I)</enum><text>the number of proposals for ski area improvement projects; and</text></subclause><subclause id="idFF999A6AF1C047AB8ACA5E0E2030C3B1"><enum>(II)</enum><text>the processing of proposals for ski area improvement projects.</text></subclause></clause><clause id="id1bc50408002a4649aeb80f2f48e414ac"><enum>(ii)</enum><text>Any need for services, training, staffing, or the streamlining of programs in the other covered units or the region in which the covered units are located that would improve the administration of the Program.</text></clause><clause id="id291ca29dc1324097b3772f64b96782c5"><enum>(iii)</enum><text>Any need for wildfire preparedness, planning, and coordination in and around ski areas.</text></clause></subparagraph><subparagraph id="id7e55efe5741749ee9602fcd79537ee12"><enum>(E)</enum><header>Authorized expenditures</header><text>Amounts distributed from the Account to a covered unit under this subsection may be used for—</text><clause id="id36cc6f8efc7f472b96abf48a9e9b68dd"><enum>(i)</enum><text>ski area special use permit and Program administration in the covered unit, including—</text><subclause id="id8512A6257314450DA2C43E906D90A033"><enum>(I)</enum><text>the processing of proposals for ski area improvement projects; and</text></subclause><subclause id="id8F5FDA9D5E0F48C89517EAB9F116DD4D"><enum>(II)</enum><text>staffing and contracting for that processing and related services in the covered unit or in the applicable region;</text></subclause></clause><clause id="idbdf64cedd0674685bb3b519eebe75bb4"><enum>(ii)</enum><text>staff training for processing of ski area applications and administering ski area permits in the covered unit or the region in which the covered unit is located;</text></clause><clause id="idd474d16114b64c429dbd3609f9d9065b"><enum>(iii)</enum><text>interpretation activities, visitor information, visitor services, and signage in the covered unit to enhance the ski area visitor experience on National Forest System land; and</text></clause><clause id="idbfef016df51a4db993721ce5eb4fe18a"><enum>(iv)</enum><text>wildfire preparedness, planning, and coordination in and around ski areas in the covered unit or in the applicable region.</text></clause></subparagraph><subparagraph id="idcefd5b90782e49469601578180493492"><enum>(F)</enum><header>Expenditure for other purposes</header><text>If any amounts remain in the Account after all necessary Program expenditures have been made under subparagraph (D), the Secretary may use the amounts for other purposes in accordance with subparagraph (G).</text></subparagraph><subparagraph id="id0689aab4434347f79aa2263daa2a9769"><enum>(G)</enum><header>Other recreation permit administration, visitor services, and other purposes</header><text>In addition to any amounts remaining in the Account described in subparagraph (F), 25 percent of the amounts deposited in the Account from a covered unit in which the rental charges were collected shall remain available for expenditure at that covered unit or the region in which the covered unit is located for—</text><clause id="idb1743cce819d4d58a603bf54017b0f4e"><enum>(i)</enum><text>administering non-ski area Forest Service recreation special use permits;</text></clause><clause id="idadf7e44fecf0411b9b0d457cd1b12c3c"><enum>(ii)</enum><text>avalanche information and education activities carried out by the Secretary or nonprofit partners;</text></clause><clause id="idaf21493b601e4028a44d8495dab06ed1"><enum>(iii)</enum><text>recreation management, maintenance, and services; and</text></clause><clause id="iddbf2e43d22a54e42ae9391a39c327242"><enum>(iv)</enum><text>administration of leases under—</text><subclause id="id79CE455E5C8648BB9217187CD8C707FA"><enum>(I)</enum><text>the Forest Service Facility Realignment and Enhancement Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/16/580d">16 U.S.C. 580d</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/54">Public Law 109–54</external-xref>); and </text></subclause><subclause id="idCBA81A3988D942F58BFF917908EC1E10"><enum>(II)</enum><text>section 8623 of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/16/580d">16 U.S.C. 580d</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/334">Public Law 115–334</external-xref>).</text></subclause></clause></subparagraph><subparagraph id="id763c9e90c65146e38a79a7088f3f7332"><enum>(H)</enum><header>Limitation</header><text>Amounts in the Account may not be used for—</text><clause id="id3eaa3011e52b478d9be6c4314e1fb71e"><enum>(i)</enum><text>the conduct of wildfire suppression outside ski area permit boundaries; or</text></clause><clause id="id46819325bff04bdc8af0e1c9b5db48aa"><enum>(ii)</enum><text>the acquisition of land for inclusion in the National Forest System.</text></clause></subparagraph></paragraph><paragraph id="ida5cd46b11a624d1abf961435fe710959"><enum>(5)</enum><header>Savings provisions</header><subparagraph id="id3df280eb95fd4dc084395ddfaf0759d0"><enum>(A)</enum><header>In general</header><text>Nothing in this subsection affects the applicability of section 7 of the Act of April 24, 1950 (commonly known as the <quote>Granger-Thye Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/580d">16 U.S.C. 580d</external-xref>), to ski areas on National Forest System land.</text></subparagraph><subparagraph id="idffa4ce83e7fe42a6829cdd1116c51fd2"><enum>(B)</enum><header>Supplemental funding</header><text>Rental charges retained and expended under this subsection shall supplement (and not supplant) appropriated funding for the operation and maintenance of each covered unit.</text></subparagraph><subparagraph id="id2a028f7ef9314c4ca0dfa6b76d2a09e4"><enum>(C)</enum><header>Cost recovery</header><text>Nothing in this subsection affects any cost recovery under any other provision of law for processing applications for or monitoring compliance with ski area permits or other recreation special use permits.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ideef1325761e045daa8bd2cb7a10958ef"><enum>(b)</enum><header>Effective date</header><text>This section (including the amendments made by this section) shall take effect on the date that is 60 days after the date of enactment of this Act.</text></subsection><subsection id="idf2c9c978b798487b8d761354119ba9b5"><enum>(c)</enum><header>Implementation</header><text>The Secretary of Agriculture shall not be required to issue regulations or policy guidance to implement this section (including the amendments made by this section). </text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id8bab83952a9f46ec955cdf821ccda946" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ski Hill Resources for Economic Development Act of 2021</short-title></quote>.</text></section><section id="id337fb8340e4a42fdbc34d46a62b71612" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>2.</enum><header>Establishment of ski area fee retention account</header><subsection id="id5f272eadf08643dc946faf8d94afc6ed"><enum>(a)</enum><header>In general</header><text>Section 701 of division I of the Omnibus Parks and Public Lands Management Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/16/497c">16 U.S.C. 497c</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id89BDDEBCF3514527BB3A600900DBBB30" changed="added" reported-display-style="italic" committee-id="SSEG00"><subsection id="id1939f2ec11f54b6d930042fcad88646a"><enum>(k)</enum><header>Ski area fee retention account</header><paragraph id="id40a7a7c9a9714fd0aa0554eb29914e9c"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id3fd0fba69ed54226892e27bb76863c9c"><enum>(A)</enum><header>Account</header><text>The term <term>Account</term> means the Ski Area Fee Retention Account established under paragraph (2).</text></subparagraph><subparagraph id="ide7ef96ea07444afc87b6d20e5c194873"><enum>(B)</enum><header>Covered unit</header><text>The term <term>covered unit</term> means the unit of the National Forest System that collects the ski area permit rental charge under this section.</text></subparagraph><subparagraph id="id73F3E73C845F4FDFA8FD2CED5DB5449B"><enum>(C)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture.</text></subparagraph></paragraph><paragraph id="id8c7a2c83f14d4445bc2ea4becc8acfbc"><enum>(2)</enum><header>Establishment</header><text>The Secretary of the Treasury shall establish a special account in the Treasury, to be known as the <quote>Ski Area Fee Retention Account</quote>.</text></paragraph><paragraph id="idfd53653af8b2489b8083eebe5cb7c5d7"><enum>(3)</enum><header>Deposits</header><text>Subject to paragraphs (4) and (5), a ski area permit rental charge collected by the Secretary under this section shall—</text><subparagraph id="id703318c6fa52487cbb2fe808fcd813b9"><enum>(A)</enum><text>be deposited in the Account;</text></subparagraph><subparagraph id="id8c6fd9fb82e74b3da2e311d07c261d57"><enum>(B)</enum><text>be available to the Secretary for use, without further appropriation; and</text></subparagraph><subparagraph id="id3b5659deca8a4582a29ad913db1f3bfa"><enum>(C)</enum><text>remain available for the period of 4 fiscal years beginning with the first fiscal year after the fiscal year in which the ski area permit rental charge is deposited in the Account under subparagraph (A).</text></subparagraph></paragraph><paragraph id="id77d293b67220410d832197faf0e078ec"><enum>(4)</enum><header>Distribution of amounts in the account</header><subparagraph id="id22d58d8ecc554440834f73b81809030d"><enum>(A)</enum><header>Local distribution of funds</header><clause id="id6B519A0CD64A40AF874463071B8EEEA4"><enum>(i)</enum><header>In general</header><text>Except as provided in subparagraph (C), the Secretary shall expend 80 percent of the ski area permit rental charges deposited in the Account from a covered unit at the covered unit in accordance with clause (ii).</text></clause><clause id="idfda8eb9831734890876297e038014bb0"><enum>(ii)</enum><header>Distribution</header><text>Of the amounts made available for expenditure under clause (i)—</text><subclause id="id05A9FA626FCB4A5FB7F557AAA7BBB63D"><enum>(I)</enum><text>75 percent shall be used at the covered unit for activities described in paragraph (5)(A); and</text></subclause><subclause id="id481342ca5b79488db1e3506b9439c6b5"><enum>(II)</enum><text>25 percent shall be used for activities at the covered unit described in paragraph (5)(B).</text></subclause></clause></subparagraph><subparagraph id="idc0e5f08b2d6f4ca99e6fd511981b7ecf"><enum>(B)</enum><header>Agency-wide distribution of funds</header><text>The Secretary shall expend 20 percent of the ski area permit rental charges deposited in the Account from a covered unit at any unit of the National Forest System for an activity described in subparagraph (A) or (B) of paragraph (5).</text></subparagraph><subparagraph id="iddf1438c8d5f14b02a7473c28f1500e6d"><enum>(C)</enum><header>Reduction of percentage</header><clause id="idf91b24e2329144a5abaa37bae071b137"><enum>(i)</enum><header>Reduction</header><text>The Secretary shall reduce the percentage otherwise applicable under subparagraph (A)(i) to not less than 60 percent if the Secretary determines that the amount otherwise made available under that subparagraph exceeds the reasonable needs of the covered unit for which expenditures may be made in the applicable fiscal year.</text></clause><clause id="id9c48bbb3057a4099969ebb0da7e0cb5c"><enum>(ii)</enum><header>Distribution of funds</header><text>The balance of the ski area permit rental charges that are collected at a covered unit, deposited into the Account, and not distributed in accordance with subparagraph (A) or (B) shall be available to the Secretary for expenditure at any other unit of the National Forest System in accordance with the following:</text><subclause id="id0b6b9349f7e04008b95094f63de8c10d"><enum>(I)</enum><text>75 percent shall be used for activities described in paragraph (5)(A).</text></subclause><subclause id="idd2edc7aadbae40e3b4885f3879befcd4"><enum>(II)</enum><text>25 percent shall be used for activities described in paragraph (5)(B).</text></subclause></clause></subparagraph></paragraph><paragraph id="id1674523161924872989b23baba95cbe1"><enum>(5)</enum><header>Expenditures</header><text>Amounts available to the Secretary for expenditure from the Account shall be only used for—</text><subparagraph id="id89e5ca1ee6fe461592d126601993d25e"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idE3C0E45C75D9403BB2ABF4B33BD7421D"><enum>(i)</enum><text>the administration of the Forest Service ski area program, including—</text><subclause indent="up1" id="id5951549BB52440BE9C4EEAA437B528AE"><enum>(I)</enum><text>the processing of an application for a new ski area or a ski area improvement project, including staffing and contracting for the processing; and</text></subclause><subclause indent="up1" id="id9F48EF622C054F60832968D13A610DB2"><enum>(II)</enum><text>administering a ski area permit described in subsection (a);</text></subclause></clause><clause indent="up1" id="id074990D741F9476999B796C51760EC91"><enum>(ii)</enum><text>staff training for—</text><subclause id="id4D43B5073B5A4356A64163EA22DFFC68"><enum>(I)</enum><text>the processing of an application for—</text><item id="id95E05EBE61DF44FBB4D139D056E864BE"><enum>(aa)</enum><text>a new ski area;</text></item><item id="id3A658D88B6FB463DAFCFA0DF68E313B1"><enum>(bb)</enum><text>a ski area improvement project; or</text></item><item id="id87F322E3397146A7A03597FDD224ACFC"><enum>(cc)</enum><text>a special use permit; or</text></item></subclause><subclause id="id69254DA2268A4CCF8EA2C27A2A1FE991"><enum>(II)</enum><text>administering—</text><item id="id4F12C53E2675413782E4BCB56EB41528"><enum>(aa)</enum><text>a ski area permit described in subsection (a); or</text></item><item id="id765E4D65EBC642518B7043D5DE3E8CF7"><enum>(bb)</enum><text>a special use permit;</text></item></subclause></clause><clause indent="up1" id="idA32F9C46285647FE8B20B2D163451C93"><enum>(iii)</enum><text>an interpretation activity, National Forest System visitor information, a visitor service, or signage;</text></clause><clause indent="up1" id="idBBD5EE276D1F46E0B875D00387CF36A7"><enum>(iv)</enum><text>direct costs associated with collecting a ski area permit rental charge or other fee collected by the Secretary related to recreation;</text></clause><clause indent="up1" id="id4B4DD777C5A845F9A8564F1B985A3506"><enum>(v)</enum><text>planning for, or coordinating to respond to, a wildfire in or adjacent to a recreation site, particularly a ski area; or</text></clause><clause indent="up1" id="id99350C4F374C4E069EBEE03ACDA9169C"><enum>(vi)</enum><text>reducing the likelihood of a wildfire starting, or the risks posed by a wildfire, in or adjacent to a recreation site, particularly a ski area, except through hazardous fuels reduction activities; or</text></clause></subparagraph><subparagraph indent="up1" id="id467EFA1AD68546128E74A02E33036F21"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idA9D3151B5AFE417BB97EFD65739E7222"><enum>(i)</enum><text>the repair, maintenance, or enhancement of a Forest Service-owned facility, road, or trail directly related to visitor enjoyment, visitor access, or visitor health or safety;</text></clause><clause indent="up1" id="idDF9B638134C849B79BA80D167F28AC25"><enum>(ii)</enum><text>habitat restoration directly related to recreation;</text></clause><clause indent="up1" id="id6BBC5B5347914260A8E40185F4293981"><enum>(iii)</enum><text>law enforcement related to public use and recreation;</text></clause><clause indent="up1" id="id46EA6F3D0BA349D58CEDDB9F7EBCD452"><enum>(iv)</enum><text>the construction or expansion of parking areas;</text></clause><clause indent="up1" id="id134EF3DF064144968BFE423D4D44D333"><enum>(v)</enum><text>the processing or administering of a recreation special use permit;</text></clause><clause indent="up1" id="id4A3401D9FEAF4560BF56CA2A673B0D77"><enum>(vi)</enum><text>avalanche information and education activities carried out by the Secretary or nonprofit partners;</text></clause><clause indent="up1" id="id169C1250004C446691FAE2A282DB4A59"><enum>(vii)</enum><text>search and rescue activities carried out by the Secretary, a local government, or a nonprofit partner; or</text></clause><clause indent="up1" id="id4C24ADC7EE0B408DB3150CB8B42707C8"><enum>(viii)</enum><text>the administration of leases under—</text><subclause id="id5FCC29A8671E471E8891A0AFC167685B"><enum>(I)</enum><text>the Forest Service Facility Realignment and Enhancement Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/16/580d">16 U.S.C. 580d</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/54">Public Law 109–54</external-xref>); and</text></subclause><subclause id="id382FF7A908754254BF5A2ADBB05F7878"><enum>(II)</enum><text>section 8623 of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/16/580d">16 U.S.C. 580d</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/334">Public Law 115–334</external-xref>).</text></subclause></clause></subparagraph></paragraph><paragraph id="idad154a374ae7472f8b123791a744883f"><enum>(6)</enum><header>Limitation</header><text>Amounts in the Account may not be used for—</text><subparagraph id="id1725a62ecf9e408b92e0220af562f130"><enum>(A)</enum><text>the conduct of wildfire suppression; or</text></subparagraph><subparagraph id="id9c1d93e3b7b54e4c8eca6de2e411ac06"><enum>(B)</enum><text>the acquisition of land for inclusion in the National Forest System.</text></subparagraph></paragraph><paragraph id="id8e59c7e679b54289b9bbe097ed51dcbf"><enum>(7)</enum><header>Effect</header><subparagraph id="ida089a28726ed4253af1e4b48edab0283"><enum>(A)</enum><header>In general</header><text>Nothing in this subsection affects the applicability of section 7 of the Act of April 24, 1950 (commonly known as the <quote>Granger-Thye Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/580d">16 U.S.C. 580d</external-xref>), to ski areas on National Forest System land.</text></subparagraph><subparagraph id="idcf4ad7f7f44a49af9ffe6a076f1c0161"><enum>(B)</enum><header>Supplemental funding</header><text>Rental charges retained and expended under this subsection shall supplement (and not supplant) appropriated funding for the operation and maintenance of each covered unit.</text></subparagraph><subparagraph id="idb2f7f47b5399498f9e4ffb04b678693b"><enum>(C)</enum><header>Cost recovery</header><text>Nothing in this subsection affects any cost recovery under any provision of law (including regulations) for processing an application for or monitoring compliance with a ski area permit or other recreation special use permit.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idaf83b289877e4e6793c59d95fca3e3c3"><enum>(b)</enum><header>Effective date</header><text>This section (including the amendments made by this section) shall take effect on the date that is 60 days after the date of enactment of this Act.</text></subsection></section></legis-body><endorsement><action-date date="20220119" legis-day="20220118">January 19 (legislative day, January 18), 2022</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
