<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1962</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210607">June 7, 2021</action-date><action-desc><sponsor name-id="S364">Mr. Murphy</sponsor> (for himself and <cosponsor name-id="S373">Mr. Cassidy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act to provide grant funding to States for mental health and substance use disorder parity implementation. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H254D44B025004DC9BC811AC7DFB83DA2"><section section-type="section-one" id="HCD5032441D994DEAA6178687038B83EC"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parity Implementation Assistance Act</short-title></quote>.</text></section><section id="HF3F6F7789804470CA49D20AD328A6466"><enum>2.</enum><header>Grants to support mental health and substance use disorder parity implementation</header><subsection id="H48E3DF6D85694AE68D7906C1012AB5F4"><enum>(a)</enum><header>In general</header><text>Section 2794(c) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-94">42 U.S.C. 300gg–94(c)</external-xref>) (as added by section 1003 of the Patient Protection and Affordable Care Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HDD199566DFDF40EFB2A459D580BE27DD"><paragraph id="HF8B25D43AA534FE58272E94FBAF1B673"><enum>(3)</enum><header>Parity implementation</header><subparagraph id="H804ECEC1570B480288B64A6A36F33400"><enum>(A)</enum><header>In general</header><text>Beginning 60 days after the date of enactment of the <short-title>Parity Implementation Assistance Act</short-title>, the Secretary shall award grants to States to implement the mental health and substance use disorder parity provisions of section 2726, provided that in order to receive such a grant, a State is required to request and review from health insurance issuers offering group or individual health insurance coverage the comparative analyses and other information required of such health insurance issuers under subsection (a)(8)(A) of such section 2726 regarding the design and application of nonquantitative treatment limitations imposed on mental health or substance use disorder benefits.</text></subparagraph><subparagraph id="HC984CACDBD204FCA977E0490FB14CBBB"><enum>(B)</enum><header>Authorization of appropriations</header><text>For purposes of awarding grants under subparagraph (A), there are authorized to be appropriated $25,000,000 for each of the first five fiscal years beginning after the date of the enactment of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8D137FB1A1924C0F902BF02F34BD6234"><enum>(b)</enum><header>Technical amendment</header><text>Section 2794 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-95">42 U.S.C. 300gg–95</external-xref>), as added by section 6603 of the Patient Protection and Affordable Care Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>) is redesignated as section 2795.</text></subsection></section></legis-body></bill>
