which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, to require the Secretary of Transportation to provide States applying for distracted driving grants an explanation of the eligibility decision with respect to the State, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H3E99835B978D443A9E65DC17CA15446A"><section section-type="section-one" id="H13AC2012718143A790E6ABB8A4A5CAF2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>States Afforded Funding Extensions To Oppose Driving Recklessly In Vehicular Engagements Act</short-title></quote> or the <quote><short-title>SAFE TO DRIVE Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HB3A9B09B1BB9436A9665A468F2B2CFAF"><enum>2.</enum><header>National priority safety programs</header><text display-inline="no-display-inline">Section 405(e) of title 23, United States Code, is amended—</text><paragraph id="H5ECB22B9CE31459DB7F8251D67E3B639"><enum>(1)</enum><text>by striking paragraph (6) and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H23180B46C57B42C99AB8A3D38895AC32"><paragraph id="H0650FF0138AC4C3EAB8DB8198D58E675"><enum>(6)</enum><header>Additional distracted driving grants</header><subparagraph id="H078A2C49EEAC49D7AE506358FF11E7CC"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), the Secretary shall use up to 25 percent of the amounts available for grants under this subsection to award grants to any State that—</text><clause id="id134BE2DF15514D6F87F1AE8EBF4E53AB"><enum>(i)</enum><text display-inline="yes-display-inline">is otherwise ineligible for a grant under this subsection; and</text></clause><clause id="idA8C3D04C8C914355A2D16EC867C35996"><enum>(ii)</enum><text display-inline="yes-display-inline">certifies that the State has enacted a statute that—</text><subclause id="HB8483BC269A64A079552F90D659AC944"><enum>(I)</enum><text>is applicable to drivers of all ages;</text></subclause><subclause id="HB743E1A98FB54F1088492174E775AC86"><enum>(II)</enum><text>makes a violation of the statute a primary offense; and</text></subclause><subclause id="H168B5C89DB5C49D49F4795BD355C97FD"><enum>(III)</enum><text>prohibits—</text><item id="H712CAFDD3095431483A1CA8075DF4AFD"><enum>(aa)</enum><text>texting; or</text></item><item id="H2DD7C693AA78415181E713604F5B1C71"><enum>(bb)</enum><text display-inline="yes-display-inline">non-navigational viewing of a personal wireless communications device.</text></item></subclause></clause></subparagraph><subparagraph id="H9DEA9083166C4B2DB7358227146628EF"><enum>(B)</enum><header>Use of grant funds</header><text>Notwithstanding paragraph (5), amounts received by a State under subparagraph (A) may be used for activities related to the enforcement of distracted driving laws, including for public information and awareness purposes.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HF398FF042AD843DB9F6CB48414DAC8ED"><enum>(2)</enum><text>by redesignating paragraph (9) as paragraph (10); and</text></paragraph><paragraph id="H7B1CBFC69A2E4B1099EA77CCA866B45E"><enum>(3)</enum><text>by inserting after paragraph (8) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HD779AA8AB8154A97A807F2886C69BE6A"><paragraph id="H7DB492BF636F4AB5A2A1735A3EC12BEA"><enum>(9)</enum><header>Determinations of grant eligibility</header><subparagraph id="H34B558F9365346658B976A2056483988"><enum>(A)</enum><header>Explanation of determination</header><text>In making an eligibility determination in granting or denying an application of a State for a grant under this subsection, the Secretary shall provide each applicant State with an explanation of that determination, including an explanation of whether each section of the statute submitted with the application met or did not meet the requirements for a grant under this subsection.</text></subparagraph><subparagraph id="H3EA9892147654CED9A2732003710DFFA"><enum>(B)</enum><header>Availability of determination</header><text>Not later than 60 days after granting or denying an application for a grant under this subsection, the Secretary shall make the explanation under subparagraph (A) publicly available on the website of the Department of Transportation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
