<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1947</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210527">May 27, 2021</action-date><action-desc><sponsor name-id="S383">Mr. Sullivan</sponsor> (for himself, <cosponsor name-id="S353">Mr. Schatz</cosponsor>, <cosponsor name-id="S363">Mr. King</cosponsor>, <cosponsor name-id="S385">Ms. Cortez Masto</cosponsor>, and <cosponsor name-id="S288">Ms. Murkowski</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the position of Assistant Secretary of Commerce for Travel and Tourism, to statutorily establish the United States Travel and Tourism Advisory Board, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Visit America Act</short-title></quote>.</text></section><section id="id75eecd567a3a4b298274ba278476b717"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="id05ef7e55e7b146e980afcd6b84ca4916"><enum>(1)</enum><text>to support the travel and tourism industry, which produces economic impacts that are vital our national economy; </text></paragraph><paragraph id="id619367ef7b634d0aa406e29a1cd44fb8"><enum>(2)</enum><text>to address the recent decline in the percentage of international travelers who visit the United States; and</text></paragraph><paragraph id="iddabf609f81144c72954e87fe120c1c72"><enum>(3)</enum><text>to establish national goals for international visitors to the United States, including—</text><subparagraph id="id60731541DA3E40EF984EB4DB60762A9C"><enum>(A)</enum><text>recommendations for achieving such goals and timelines for implementing such recommendations; </text></subparagraph><subparagraph id="id8A24121EBAEF44329BF77FF0991C93E2"><enum>(B)</enum><text>coordination between Federal and State agencies;</text></subparagraph><subparagraph id="id0DB793FF3C2C4FBFB16C46849CA30F65"><enum>(C)</enum><text>the resources needed by each Government agency to achieve such goals; and</text></subparagraph><subparagraph id="id6dd7db96d2ad4277863800e1f12062f7"><enum>(D)</enum><text>national travel export goals.</text></subparagraph></paragraph></section><section id="idad667437126a4681a6aebfedc903f4e0"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id584C45181DD64325B18580B6A57E250D"><enum>(1)</enum><text display-inline="yes-display-inline">the national goal for international visitors referred to in section 2(3) should reach 116,000,000 per year by 2028;</text></paragraph><paragraph id="idCD7F451D1FD943C2ABF03267A59DE457"><enum>(2)</enum><text>the national goal for travel exports referred to in section 2(3)(D) should reach $445,000,000,000 by 2028;</text></paragraph><paragraph id="id798224baaeba4e908d957fa46aaece97"><enum>(3)</enum><text>the travel industry is an essential part of the United States services exports with respect to both business travel and leisure travel;</text></paragraph><paragraph id="idF1081A7C8C0548D29423B20D2793CF2A"><enum>(4)</enum><text>the promotion of travel and visitation by Brand USA is vital to increasing visitation and articulating the visitation laws of the United States; and</text></paragraph><paragraph id="id0FEDABE58EC840E69B387D787EC09D57"><enum>(5)</enum><text>there is an urgent need for a coordinated travel and tourism industry response and strategy in the event of unforeseen circumstances leading to a decline in travel or tourism. </text></paragraph></section><section id="iddd422775e65c48b684258501dd3b6584"><enum>4.</enum><header>Assistant Secretary for Travel and Tourism</header><text display-inline="no-display-inline">Section 2(d) of the Reorganization Plan Numbered 3 of 1979 (93 Stat. 1382; 5 U.S.C. App.) is amended—</text><paragraph id="id7B4D52E22DC2438D998866EF88786D5D"><enum>(1)</enum><text>by striking <quote>There shall be in the Department two additional Assistant Secretaries</quote> and inserting <quote>(1) There shall be in the Department 3 additional Assistant Secretaries, including the Assistant Secretary of Commerce for Travel and Tourism,</quote>; and</text></paragraph><paragraph id="idF00F2DCF1038459DB6AAA6655810B7BF"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCC583428B6AD4C3AA65A6CD09F39A6BD"><paragraph id="idF93B105DA7DD4EC3813592C130169204" indent="up1"><enum>(2)</enum><text>The Assistant Secretary of Commerce for Travel and Tourism shall—</text><subparagraph id="id686C15D9643246C4AB32F4D9CC212F9D"><enum>(A)</enum><text>be appointed by the President, subject to the advice and consent of the Senate; and </text></subparagraph><subparagraph id="id042E676ABBFB4E71902CF52DA36EBCFA"><enum>(B)</enum><text>report directly to the Under Secretary for International Trade.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="ide06a368b9b4e48adbaf0aac2c36b89d4"><enum>5.</enum><header>Responsibilities of the Assistant Secretary of Commerce for Travel and Tourism</header><subsection id="id99E1FF4BA583430CA43D4FD57D314671"><enum>(a)</enum><header>Visitation goals</header><text display-inline="yes-display-inline">The Assistant Secretary of Commerce for Travel and Tourism (referred to in this section as the <quote>Assistant Secretary</quote>), appointed pursuant to section 2(d) of the Reorganization Plan Numbered 3 of 1979, as amended by section 4, shall—</text><paragraph id="id6e3fd880d1ad46ee9c124a89a8e4c9eb"><enum>(1)</enum><text>establish an annual goal for—</text><subparagraph id="idC6CAA791C0324C7EAF7E16B24B465930"><enum>(A)</enum><text>the number of international visitors to the United States; and</text></subparagraph><subparagraph id="idCCAE915015104564858BD471F695DB5B"><enum>(B)</enum><text>travel exports;</text></subparagraph></paragraph><paragraph id="id227ddd3067e24829887a8cd33088e7b4"><enum>(2)</enum><text>develop recommendations for achieving the visitation goals established pursuant to paragraph (1);</text></paragraph><paragraph id="id43fcaca26bb64c349bacbfd844c95270"><enum>(3)</enum><text>ensure coordination between—</text><subparagraph id="idb9ea20a64c2b44eab9e89ad5c9dd2121"><enum>(A)</enum><text>the Department of Commerce, the Department of Homeland Security, the Department of State, the Department of Transportation, the Department of Labor for policy development and recommendations for utilizing:</text><clause id="id6C306D8AD076405387D22BE326EF6A24"><enum>(i)</enum><text>the National Travel and Tourism Office;</text></clause><clause id="id188E8501ECDD4FEB85EB690A8E4FCBD7"><enum>(ii)</enum><text>Brand USA;</text></clause><clause id="idAE8BD185E9C048DB9948BFB04D3B2DC5"><enum>(iii)</enum><text>the United States Travel and Tourism Advisory Board;</text></clause><clause id="id23F22A2D895B44AEA5D6D406743E127A"><enum>(iv)</enum><text>the Task Force on Travel and Tourism established by Executive Order 13597 of January 19, 2012; and</text></clause><clause id="idB914CED03AE74F12A5D65D7ED3362A89"><enum>(v)</enum><text>travel industry partners, including public and private destination marketing organizations and travel and tourism suppliers;</text></clause></subparagraph></paragraph><paragraph id="id77ba06d04578415eb4bf4cc2ddbbe66a"><enum>(4)</enum><text>establish short, medium, and long-term timelines for implementing the recommendations developed pursuant to paragraph (2); and</text></paragraph><paragraph id="idec4996c813104d7fa4a379a4b4bd9c39"><enum>(5)</enum><text>conduct Federal agency needs assessments to identify the resources, statutory or regulatory changes, and private sector engagement needed to achieve the annual visitation goals.</text></paragraph></subsection><subsection id="id17a4a1c39cc14692b5eea06e18e64dd3"><enum>(b)</enum><header>Visa adjudication</header><text>The Assistant Secretary, in consultation with the Secretary of State and the Secretary of Homeland Security, shall—</text><paragraph id="id1b738afc66dc4ae0baec5dded282b2fd"><enum>(1)</enum><text>provide support for improving visitor visa processing with respect to—</text><subparagraph id="id64B95ACF6CEB4C4F89D6EAC276AC583B"><enum>(A)</enum><text>the maximum time for processing visas, by visitation type;</text></subparagraph><subparagraph id="id627d2684c3eb4062b0ce689913c87f00"><enum>(B)</enum><text>regulatory and policy changes needed to meet the visa processing goals referred to in subparagraph (A), including changes regarding technology, processing centers, and training; and</text></subparagraph><subparagraph id="id02fb401ca7a2452b91ebc0669afb9aba"><enum>(C)</enum><text>streamlining visa applications and adjudications, including application design and data collection procedures; and</text></subparagraph></paragraph><paragraph id="id8e98101cc8bf447cabbecfcae0736169"><enum>(2)</enum><text>explore opportunities to establish pilot programs to integrate technology into the visitor visa adjudication process, including video conferencing and biometrics.</text></paragraph></subsection><subsection id="id834769ed8ac54520a1faeff41c4b3248"><enum>(c)</enum><header>Domestic travel</header><text>The Assistant Secretary shall—</text><paragraph id="ide6bac49ed70844f3ae1a8160a0ed7f36"><enum>(1)</enum><text>conduct a study to better understand domestic policy options for supporting competitiveness with respect to the strengths, weaknesses, and growth of the domestic travel industry;</text></paragraph><paragraph id="id67b11c4f9e5b4dc8958e7355b710fedd"><enum>(2)</enum><text>develop recommendations and goals to support domestic tourism, separated by business and leisure; and</text></paragraph><paragraph id="id05ce581c87d24bf0a13a6c6c13e01b63"><enum>(3)</enum><text>engage public and private stakeholders to support domestic tourism.</text></paragraph></subsection><subsection id="idd02c69d837f64d92b75ea9fb39ad654e"><enum>(d)</enum><header>Workforce</header><text>The Assistant Secretary—</text><paragraph id="id506894a7aca64355b929c5dde4f8964b"><enum>(1)</enum><text>in coordination with the Secretary of Labor, shall provide timely and reliable workforce data regarding workforce and labor market needs;</text></paragraph><paragraph id="id134ac9bdba444eaeafa1de92cb5c1a92"><enum>(2)</enum><text>shall work to improve tourism industry data collection by the Bureau of Economic Analysis; and</text></paragraph><paragraph id="ida3966e578bf24dedbfd728525e43d12b"><enum>(3)</enum><text>shall provide recommendations for policy enhancements and streamlining.</text></paragraph></subsection><subsection id="idc50ae42113044067b9f5e58ed2df621d"><enum>(e)</enum><header>Travel export promotion</header><text>The Assistant Secretary, in coordination with the Director General of the United States and Foreign Commercial Service, shall work to promote and facilitate travel exports abroad and ensure competitiveness by—</text><paragraph id="id13b2c5427d0144a4aaf9ab9d0b0877e0"><enum>(1)</enum><text>participating in and organizing meetings, incentives, conferences, and exhibitions;</text></paragraph><paragraph id="id44d0ed4a1da7490f841593c304afb813"><enum>(2)</enum><text>emphasizing rural and other destinations rich in cultural heritage or ecological tourism, among other uniquely American destinations; and</text></paragraph><paragraph id="id51CB514F6B6342B2A540CE6B84ACB6DE"><enum>(3)</enum><text>promoting sports and recreation events and activities.</text></paragraph></subsection><subsection id="idb099e74db8644fb8b2f196061df58ad5"><enum>(f)</enum><header>Travel security</header><text>The Assistant Secretary shall investigate and provide recommendations regarding utilizing and expanding existing security programs to better meet the needs of the United States travel and tourism industry, including—</text><paragraph id="id4bf53de2677a4544a8b332b4ffb1dbf7"><enum>(1)</enum><text>the Visa Waiver Program authorized under section 217 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187</external-xref>);</text></paragraph><paragraph id="id7d0316ac24d5465eb115a1190c34a031"><enum>(2)</enum><text>preclearance operations;</text></paragraph><paragraph id="id86a2cb563f204924a77995f45d0c68f2"><enum>(3)</enum><text>the Trusted Traveler Program;</text></paragraph><paragraph id="id89fa0c596b844a76926ede19bf816136"><enum>(4)</enum><text>the biometric entry-exit control system required under section 110 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (division C of <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1221">8 U.S.C. 1221</external-xref> note); and</text></paragraph><paragraph id="id2C939C89ACF4407D8E80D75AA3B76728"><enum>(5)</enum><text>the establishment of a system to provide increased resilience to travel during pandemics.</text></paragraph></subsection><subsection id="id934ff522a2ab4e09ab82a794ad6525f6"><enum>(g)</enum><header>Recovery strategy</header><paragraph id="idC32EB25D8A8F4F3688AAC5F00A493690"><enum>(1)</enum><header>Initial recovery strategy</header><text>Not later than 60 days after the date of the enactment of this Act, the Assistant Secretary, in consultation with the United States Travel and Tourism Advisory Board and travel industry partners, shall develop and implement a COVID–19 pandemic recovery strategy to assist in the United States travel and tourism industry to quickly recover from the travel restrictions necessitated by the pandemic. </text></paragraph><paragraph id="idD93ADC0DE4AF4D29B8B2783FCBA92B5C"><enum>(2)</enum><header>Future recovery strategies</header><text>After assisting in the implementation of the strategy developed pursuant to paragraph (1), the Assistant Secretary, in consultation with the entities referred to in such paragraph, shall develop additional recovery strategies for the travel and tourism industry in anticipation of other unforeseen catastrophic events that would significantly affect the travel and tourism industry, such as hurricanes, floods, tsunamis, tornadoes, or pandemics.</text></paragraph></subsection><subsection id="id633D8FC555DE437F94055AC34CF4A330"><enum>(h)</enum><header>Reporting requirements</header><paragraph id="id931f23501cac445299c0b62307086b8a"><enum>(1)</enum><header>Assistant secretary</header><text>The Assistant Secretary shall produce an annual forecasting report on the travel and tourism industry, which shall include current and anticipated—</text><subparagraph id="ide5b24bc4ace24f2dad0de8add887329a"><enum>(A)</enum><text>domestic employment needs;</text></subparagraph><subparagraph id="ide0c5c5a9a69e4659b8a302ec93cef79e"><enum>(B)</enum><text>international inbound volume and spending, taking into account the lasting effects of the COVID–19 pandemic and the impact of the recovery strategy implemented pursuant to subsection (g)(1); and</text></subparagraph><subparagraph id="ide03d77c526c54eedbefb2a2ebdf715d9"><enum>(C)</enum><text>domestic volume and spending, including Federal and State public land travel and tourism data.</text></subparagraph></paragraph><paragraph id="id8b98a0d46a7949de9a41ccd5e0caf6b5"><enum>(2)</enum><header>Bureau of economic analysis</header><text>The Director of the Bureau of Economic Analysis should update the Travel and Tourism Satellite Accounts quarterly, including—</text><subparagraph id="idc2372666aba141f0885309f966afe659"><enum>(A)</enum><text>State level travel and tourism export data;</text></subparagraph><subparagraph id="idefcc8397969347ada2de9dfa01c40bc0"><enum>(B)</enum><text>travel and tourism workforce data for full-time and part-time employment; and</text></subparagraph><subparagraph id="id14cdafb5fe0a45a7888b0826a8350fe7"><enum>(C)</enum><text>Federal and State public lands visitation and spending data.</text></subparagraph></paragraph><paragraph id="id57e5a32df40244d8ad2d6b212993f792"><enum>(3)</enum><header>National travel and tourism office</header><text>The Director of the National Travel and Tourism Office shall—</text><subparagraph id="id33DF3C85409D429F8017E965640D6E1D"><enum>(A)</enum><text>report international arrival and spending data on a regular monthly schedule; and</text></subparagraph><subparagraph id="idE5EB942A3245462396F6C173762E1BBB"><enum>(B)</enum><text>shall include questions in the Survey of International Air Travelers regarding wait-times, visits to public lands, and State data, to the extent applicable. </text></subparagraph></paragraph></subsection></section><section id="id1e1d304519bf41328331b5332ec4b086"><enum>6.</enum><header>Travel and tourism strategy</header><subsection id="id7cd42e2e8e9247eb90a81e05333c704d"><enum>(a)</enum><header>In general</header><text>The Secretary of Commerce, in consultation with the United States Travel and Tourism Advisory Board, shall develop and submit to Congress a 10-year travel and tourism strategy, which shall include—</text><paragraph id="id81B97695D5014DABB128BF2ED409B343"><enum>(1)</enum><text>the establishment of goals with respect to the number of annual international visitors to the United States and the annual amount of travel exports during such 10-year period;</text></paragraph><paragraph id="id78EA7F3723684D7B9F9FE7AC203E64FE"><enum>(2)</enum><text>the resources needed to achieve the goals established pursuant to paragraph (1); and</text></paragraph><paragraph id="id881511F58ADD4ACF865D6F03F1980311"><enum>(3)</enum><text>recommendations for statutory or regulatory changes that would be necessary to achieve such goals.</text></paragraph></subsection><subsection id="idd03e3e3f07aa454e81a2f7e30f0fa35f"><enum>(b)</enum><header>Interagency coordination</header><text>The Secretary of Commerce shall coordinate an interagency strategy with the Secretary of State and the Secretary of Homeland Security for—</text><paragraph id="id3B42F3D5882544919A4BA388E3927155"><enum>(1)</enum><text>identify impediments to reaching the goals referred to in subsection (a)(1); and </text></paragraph><paragraph id="idD75A2244811E44E087CAE94A47E7A980"><enum>(2)</enum><text>recommends solutions for overcoming such impediments.</text></paragraph></subsection></section><section id="id2ccbc26559d34a0ba1d2231b651f4022"><enum>7.</enum><header>United States Travel and Tourism Advisory Board</header><text display-inline="no-display-inline">Section 3 of the Act entitled <quote>An Act to encourage travel in the United States, and for other purposes</quote> (<external-xref legal-doc="usc" parsable-cite="usc/15/1546">15 U.S.C. 1546</external-xref>) is amended—</text><paragraph id="id426B6833AECA41808D452B31E7F222FA"><enum>(1)</enum><text>by amending the section heading to read as follows: <quote><header-in-text level="section" style="OLC">United States Travel and Tourism Advisory Board; Advisory Committee for Promotion of Tourist Travel</header-in-text></quote>; and</text></paragraph><paragraph id="id448412C36FEC4C33BA41B4F98942715D"><enum>(2)</enum><text>by striking <quote>The Secretary of Commerce is authorized</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5E0E7C4C300B41748CBE2F4C406846ED"><subsection id="id719E3CEECA434AEDA21FFAF9AFA54FA8"><enum>(a)</enum><header>United States Travel and Tourism Advisory Board</header><paragraph id="id9AEC3015254544E6B801E3C7A8AE80FE"><enum>(1)</enum><header>In general</header><text>There is established the United States Travel and Tourism Advisory Board (referred to in this subsection as the <quote>Board</quote>), which shall be composed of not more than 32 members, who shall be appointed by the Secretary of Commerce for 2-year terms from among companies and organizations in the travel and tourism industry.</text></paragraph><paragraph id="id56521B28638340E58976F7A52227D027"><enum>(2)</enum><header>Executive director</header><text>The Assistant Secretary for Travel and Tourism shall serve as the Executive Director of the Board.</text></paragraph><paragraph id="id57DE74941E1F4ED487D624A5F9D13457"><enum>(3)</enum><header>Executive secretariat</header><text>The National Travel and Tourism Office of the International Trade Administration shall serve as the Executive Secretariat for the Board.</text></paragraph><paragraph id="idC153C3E9EF67425CB3BD27D37110FE55"><enum>(4)</enum><header>Functions</header><text>The Board shall comply with its Charter, including—</text><subparagraph id="id02C54B1BF22A438E814B26EBC50066B1"><enum>(A)</enum><text>serving as the advisory body to the Secretary of Commerce on matters relating to the travel and tourism industry in the United States;</text></subparagraph><subparagraph id="id37A7566321BB4133B2871D79FED9C035"><enum>(B)</enum><text>advising the Secretary of Commerce on government policies and programs that affect the United States travel and tourism industry;</text></subparagraph><subparagraph id="idECC87C84580E456CB6903C9AC323286A"><enum>(C)</enum><text>offering counsel on current and emerging issues;</text></subparagraph><subparagraph id="id2B101D6CDF16405784D8FBDB86CA4325"><enum>(D)</enum><text>providing a forum for discussing and proposing solutions to problems related to the travel and tourism industry; and</text></subparagraph><subparagraph id="idCFA3C38443F745C1BBE9B4453D8070F4"><enum>(E)</enum><text>examining the domestic travel and tourism industry as an economic engine.</text></subparagraph></paragraph><paragraph id="idC9AFEEC718F94F0DB4AD401572294F35"><enum>(5)</enum><header>Recovery strategy</header><text>The Board shall assist the Assistant Secretary in the development and implementation of the COVID–19 pandemic recovery strategy required under section 5(g)(1) of the <short-title>Visit America Act</short-title>.</text></paragraph></subsection><subsection id="idDC705A1419514A5D800ECA3D82602CBA"><enum>(b)</enum><header>Advisory Committee for Promotion of Tourist Travel</header><text>The Secretary of Commerce is authorized</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
