<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 1941</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To direct the Director of the Office of Management and Budget to standardize the use of core-based statistical area designations across Federal programs, to allow between 120 and 180 days for public comment on any proposed change to such designations, and to report on the scientific basis and estimated impact to Federal programs for any proposed change to such designations, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section id="id622e5934-ec40-445d-9471-bda8f5f0795d" section-type="section-one" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Metropolitan Areas Protection and Standardization Act of 2021</short-title></quote> or the <quote><short-title>MAPS Act of 2021</short-title></quote>.</text></section><section id="id8d10df03680444f8a985ce83dbf9b64c" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id3f0122a4722a4b5e892bffa2a347d059" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Federal programs use core-based statistical area delineations to determine the delivery of Federal services, benefits, and funding to people in the United States, such as in criteria for eligibility or distribution.</text></paragraph><paragraph id="idfe27ca4b0f5848d2bece299859d55ebb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Core-based statistical area delineations provide a nationally consistent set of standards for collecting, tabulating, and publishing Federal statistics for geographic areas, and they are not intended for any public or private sector non-statistical uses such as program administration or service delivery.</text></paragraph><paragraph id="id53a0418b156b47138ca0859b34cc080b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">Updates to core-based statistical area delineations may cause widespread disruption to the delivery of Federal services, benefits, and funding to people in the United States based on the reliance of Federal programs on these delineations.</text></paragraph><paragraph id="id9206b819e55940f88fb3ea699afdc02c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">There does not exist any comprehensive list of Federal programs that rely on core-based statistical area delineations. Such a list is valuable for the study of how Federal services, benefits, and funding are distributed to people in the United States.</text></paragraph><paragraph id="id3ee38e012c7e41eb81dd6dff467fe9b6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">Increased transparency on the impacts of any update to core-based statistical area delineations may be overly burdensome due to the anticipated variety of Federal programs that rely on these delineations. Any requirement for complete disclosure of these impacts prior to implementation of new delineations may unintentionally cause the existing delineations to ossify.</text></paragraph><paragraph id="id73bf61d65b1e4788ab2a4740ba046116" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">In order to prevent any disruption to service delivery of Federal programs based on updates to core-based statistical area delineations, and ensure the independence of Federal statistical policymaking, Congress must sever the link between future updates to core-based statistical area delineations and any automatic impact on Federal programs that rely on these delineations.</text></paragraph></section><section id="id94b14a4f77774143a5e28cb9bf67b2d2" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="no-display-inline">This purpose of this Act is to ensure—</text><paragraph id="id2f855819d2244f89a27771251a58d2b0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">transparency in how core-based statistical area delineations are used in domestic assistance programs; and</text></paragraph><paragraph id="idb00ff90b400a4f4aa6fd8686d43f6b2a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">independence of the Office of Management and Budget in establishing and updating core-based statistical area delineations.</text></paragraph></section><section id="id399ee2d02f9840b38ace65c8c256638f" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id6e4ef9d95d0f43f4ae4d8b4143e8cef5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given the term in section 551 of title 5, United States Code.</text></paragraph><paragraph id="idf4c9042d25b44133bd9d6bbec1d1e7bd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Comptroller general</header><text display-inline="yes-display-inline">The term <term>Comptroller General</term> means the Comptroller General of the United States.</text></paragraph><paragraph id="idc8569881bf3e4144af624f9a106b0038" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Core-based statistical area</header><text display-inline="yes-display-inline">The term <term>core-based statistical area</term> has the meaning given the term by the Office of Management and Budget in the Notice of Decision entitled <quote>2020 Standards for Delineating Core-Based Statistical Areas</quote>, published in the Federal Register on July 16, 2021 (86 Fed. Reg. 37770), or any successor to that Notice.</text></paragraph><paragraph id="id28841ea68180433aa996f634af32c18d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="idfced71c2699f4531abba429db6abd85a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Domestic assistance program</header><text display-inline="yes-display-inline">The term <term>domestic assistance program</term> has the meaning given the term in section 6101 of title 31, United States Code.</text></paragraph><paragraph id="id68d703b671f942f3bcc01a97ba3a4e51" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Open government data asset</header><text display-inline="yes-display-inline">The term <term>open Government data asset</term> has the meaning given the term in section 3502 of title 44, United States Code.</text></paragraph></section><section id="idd9705917b3534d55a57c396a1318ef62" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Non-propagation of core-based statistical area delineations</header><subsection id="id464BC5C01CC642F18F369E14A71DED80" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/63">Chapter 63</external-xref> of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idddabab8decd542cea715f1bc761c5461" changed="not-changed"><section id="id2faf000f52fe494387b0ff1150216158" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6309.</enum><header display-inline="yes-display-inline">Non-propagation of core-based statistical area delineations</header><subsection id="idA3C2E6777DAF4969846B11F00F48443D" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning on the date of enactment of the <short-title>MAPS Act of 2021</short-title>, and notwithstanding any other provision of law, any change to the standards of core-based statistical area delineations pursuant to section 3504(e) of title 44—</text><paragraph id="id6914c834586a49bbb78e2dc0c376fef1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">shall not propagate automatically for any non-statistical use by any domestic assistance program, including any such use as required through—</text><subparagraph id="id70cc9d0bebc345f1b3f7ef449d08f1b7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">statutory reference to any core-based statistical area delineation; or</text></subparagraph><subparagraph id="idfa08a25a1e8c4438984885266dd37cf0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">administrative or regulatory reference to any core-based statistical area delineation; and</text></subparagraph></paragraph><paragraph id="id970117ca83484efb8223a6bc99ec8787" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">shall propagate for any non-statistical use by any domestic assistance program only—</text><subparagraph id="idD4B2F0BE244247E3830786619D5FC8B2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">if a relevant agency determines that such a propagation—</text><clause id="id7D38AC6764BC49E8BAC92B82BB759198" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">supports the purposes of the program; and</text></clause><clause id="idBC44C28F728449A1BCA46095FF5D23EC" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">is in the public interest; and</text></clause></subparagraph><subparagraph id="idBFE43756F5E7447996B4426210D67C16" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">through affirmative adoption through notice-and-comment rulemaking pursuant to section 553 of title 5.</text></subparagraph></paragraph></subsection><subsection id="id7D74DE0EFCFD42169EAC5EEA9C797DD9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">The definitions in section 4 of the <short-title>MAPS Act of 2021</short-title> shall apply to this section.</text></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="idC9AD8F8E3E124B409B398C44A8D99450" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Technical and conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/63">chapter 63</external-xref> of title 31, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/31/6308">section 6308</external-xref> the following:</text><quoted-block style="OLC" id="idd6c756c9-5cab-4783-aceb-2b0c3ef0c8fa" changed="not-changed" display-inline="no-display-inline"><toc changed="not-changed"><toc-entry level="section" idref="id2faf000f52fe494387b0ff1150216158" changed="not-changed" bold="off">6309. Non-propagation of core-based statistical area delineations.</toc-entry></toc><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection></section><section id="id0160b7d1a0264e6a9386db47a97d6897" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Transparency of non-statistical uses of core-based statistical area delineations</header><subsection id="idf034111505a5483baa660cbe9918d40c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 6102(a)(2) of title 31, United States Code, is amended—</text><paragraph id="ide3f53f24bc4842b288ed2422b8d4fa06" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (G) as subparagraph (H);</text></paragraph><paragraph id="idd2c084df8cf14a54837c8e3ae3686d13" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (F), by striking <quote>and</quote> at the end; and</text></paragraph><paragraph id="idce667690f5b14d4c96063698f34e6ece" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (F) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id764cd7c055464d489677a39384f5a9c3" changed="not-changed"><subparagraph id="idb27dcdbc4c57414b92394f0e08a44866" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">uses of core-based statistical area (as defined in section 4 of the <short-title>MAPS Act of 2021</short-title>) delineations (as chosen from standardized categories of uses determined by the Director), for purposes including prime recipient and subrecipient eligibility for, and distribution of, any Federal service, benefit, or funding; and</text></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idd2351947b3034a728e279fa676cf8909" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Content requirements</header><text display-inline="yes-display-inline">In collecting and reviewing the information required under section 6102(a)(2)(G) of title 31, United States Code, as amended by subsection (a) of this section, the Director shall include as standardized categories—</text><paragraph id="id82323c9cdae94491b7013e4095b86dff" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">whether the most current core-based statistical area delineation has been affirmatively adopted pursuant to section 6309 of title 31, United States Coded, as added by this Act;</text></paragraph><paragraph id="idd44d695bad8b4271854d10b4448dbb01" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">which historical core-based statistical area delineation was maintained, in cases where an updated delineation has not been affirmatively adopted pursuant to section 6309 of title 31, United States Coded, as added by this Act;</text></paragraph><paragraph id="id8bef4698ca424ebf8aa59ed1a27be8ad" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">what purpose the core-based statistical area delineation serves, including—</text><subparagraph id="id78b42a4e13d149a18c67a4fc31d86fb8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to determine eligibility for any Federal service, benefit, or funding;</text></subparagraph><subparagraph id="id8d087c21035f4517a1be2be26e54426e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to determine distribution of any Federal service, benefit, or funding; and</text></subparagraph><subparagraph id="id43db062c3e4b4933ae8ff400b1a91bd5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">any other standardized category of purpose determined by the Director; </text></subparagraph></paragraph><paragraph id="ida9c1919a3cd546c78a7688d7741a9e12" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">whether the use of core-based statistical area delineation directly concerns any—</text><subparagraph id="idea2e312f1a534b4faa2d94d75f059b97" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">prime recipient of any Federal service, benefit, or funding; and</text></subparagraph><subparagraph id="idfed448e00bdd48e7833c7b176a2edb46" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">subrecipient of any Federal service, benefit, or funding; and</text></subparagraph></paragraph><paragraph id="ida041af87f3d94d91834643edfc80f026" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">the date when the information collected in this subsection was last updated.</text></paragraph></subsection><subsection id="idd6ad2796f1534480beb9c32764bddb77" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Accessibility requirements</header><text display-inline="yes-display-inline">The Director shall ensure that the information collected and reviewed under section 6102(a)(2)(G) of title 31, United States Code, as amended by subsection (a) of this section, shall be—</text><paragraph id="id76a34b1552504654bed03114368c6af1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">publicly accessible as an open Government data asset;</text></paragraph><paragraph id="ide09e10e68f994e28a74e8808ed4002cf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">presented in a user-friendly visual format with search and download capabilities;</text></paragraph><paragraph id="id31e088e47d744e7fb9c74877706228cf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">easily discoverable by the public on relevant government websites; and</text></paragraph><paragraph id="ided89ccbdbb2d411fbd8718ff93b06024" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">updated not less frequently than once every year.</text></paragraph></subsection><subsection id="id75dc881d588344afa2c7e85ec023b334" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Implementation timeline</header><text display-inline="yes-display-inline">The requirements of this section shall be fully implemented not later than 2 years after the date of enactment of this Act.</text></subsection></section><section id="id885c13865909416c83ef709dd215f726" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Independence, integrity, and accountability of core-based statistical area delineations</header><text display-inline="no-display-inline">Section 3504(e) of title 44, United States Code, is amended by—</text><paragraph id="idfee19602bcf34d2888323b39bcc1535d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (8)(B)(ii), by striking <quote>and</quote> at the end; </text></paragraph><paragraph id="idDCBBC8CBDBBD414CAF46B0AD10D0616E" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (9)(B), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id2bba754821ed4a6fa125cad365be78ad" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id94be56c118204184b92173f5f256ec13" changed="not-changed"><paragraph id="id60a2d3f74de84ede91a9e028b8ca8ea3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(10)</enum><text display-inline="yes-display-inline">ensure that any change to the standards of core-based statistical area (as defined in section 4 of the <short-title>MAPS Act of 2021</short-title>) delineations pursuant to this subsection shall—</text><subparagraph id="id06740831f30b4128806552396335ecae" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">be accompanied by a public report that explains—</text><clause id="id3f8187f85ce44036b56f7ce38ea7e880" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the scientific basis, criteria, and methodology for such change to existing standards, including clear quantitative thresholds for determining any future statistical re-delineations; and</text></clause><clause id="id49474ac4fe91470c910c34a3e80c5875" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the opinions of domestic and international experts in statistics and demographics, including government experts at the Bureau of the Census and other relevant agencies, who were consulted regarding such change to existing standards;</text></clause></subparagraph><subparagraph id="idc74b51dee4a14558b0e21932012e1a9d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">not be influenced by any non-statistical considerations such as impact on program administration or service delivery; and</text></subparagraph><subparagraph id="id2803521c23e9498bac15cdd04faaed9b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">not propagate automatically for any non-statistical use by any domestic assistance program (as defined in section 4 of the <short-title>MAPS Act of 2021</short-title>).</text></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section id="idb8935a24d40b4cdf8629bc88c7b4ea24" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Comptroller general report</header><text display-inline="no-display-inline">Not later than 3 years after the date of enactment of this Act, the Comptroller General shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Reform of the House of Representatives a report that—</text><paragraph id="id8164b550d95f4c0f9e28716229ad2939" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">assesses the completeness, timeliness, quality, accuracy, accessibility, and usefulness of the information reported pursuant to section 6 and the amendment made by section 6;
