<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1935</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210527">May 27, 2021</action-date><action-desc><sponsor name-id="S370">Mr. Booker</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to provide for an extension of the period of eligibility under the Department of Veterans Affairs training and rehabilitation program for veterans with service-connected disabilities by reason of school closures due to emergency and other situations, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H1FC4EE44D4A04061938CE1567DF9869D"><section section-type="section-one" id="HAC3E027AC6154B1EA31CC0E0159E0A91"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veteran Readiness and Employment National Emergency Extended Deadline Act of 2021</short-title></quote> or the <quote><short-title>VR&amp;E NEED Act of 2021</short-title></quote>.</text></section><section commented="no" id="H00DEB49C621F49B5A1E7BC66AF369771"><enum>2.</enum><header>Extension of period of eligibility by reason of school closures due to emergency and other situations under Department of Veterans Affairs training and rehabilitation program for veterans with service-connected disabilities</header><text display-inline="no-display-inline">Section 3103 of title 38, United States Code, is amended—</text><paragraph commented="no" id="H997C0AEE123443D1845B1B80BCCE92C7"><enum>(1)</enum><text>in subsection (a), by striking <quote>or (g)</quote> and inserting <quote>(g), or (h)</quote>; and</text></paragraph><paragraph commented="no" id="HE4DBA061508341DF94D5ED991C0B5540"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="USC" display-inline="no-display-inline" id="HB3D209B0A5024725A751027135E227D6"><subsection commented="no" id="H0CF551EA6E1043478B32CEB102FE85F4"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HCAEE52B14FF74561AF973B4ACFC54587"><enum>(1)</enum><text>In the case of a veteran who is eligible for a vocational rehabilitation program under this chapter and who is prevented from participating in the vocational rehabilitation program within the period of eligibility prescribed in subsection (a) because of a covered reason, as determined by the Secretary, such period of eligibility—</text><subparagraph commented="no" id="H85F6C4AF97DC498DBA3B6CD26F681EA9" indent="up1"><enum>(A)</enum><text>shall not run during the period the veteran is so prevented from participating in such program; and</text></subparagraph><subparagraph commented="no" id="H3C7B803A6797410D918265613CCC6EA3" indent="up1"><enum>(B)</enum><text>shall again begin running on a date determined by the Secretary that is—</text><clause commented="no" id="H49B732CCD3854A02AFA038705D3F05C2"><enum>(i)</enum><text>not earlier than the first day after the veteran is able to resume participation in a vocational rehabilitation program under this chapter; and</text></clause><clause commented="no" id="H84BEFAA7E1B0457EB41ACFA9CDAAE4D6"><enum>(ii)</enum><text>not later than 90 days after that day.</text></clause></subparagraph></paragraph><paragraph commented="no" id="HB6DE8D4A0E214A4FA50808367E57ECD9" indent="up1"><enum>(2)</enum><text>In this subsection, a covered reason is—</text><subparagraph commented="no" id="H99CC2C53083041CF9EFBE09251E0CCE4"><enum>(A)</enum><text display-inline="yes-display-inline">the temporary or permanent closure of an educational institution by reason of an emergency situation; or</text></subparagraph><subparagraph commented="no" id="H4C9264E7E96641348106600E438B8D4C"><enum>(B)</enum><text>another reason that prevents the veteran from participating in the vocational rehabilitation program, as determined by the Secretary.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
