<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1930</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210527">May 27, 2021</action-date><action-desc><sponsor name-id="S361">Ms. Hirono</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Personal Responsibility and Work Opportunity Act of 1996 to clarify that citizens of the Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau who are lawfully residing in the United States are eligible for certain Federal public benefits.</official-title></form><legis-body><section id="id91391241456A46ACA29C03775B2E8882" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Compact Impact Fairness Act of 2021</short-title></quote>.</text></section><section id="idF0CFDD2EFD364384B781EB4A2AA9FD82" section-type="subsequent-section"><enum>2.</enum><header>Expansion of Federal public benefit eligibility for citizens of Freely Associated States</header><subsection id="id7F6370DAD79F417F94E178B72DC6DCBC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 402 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1612">8 U.S.C. 1612</external-xref>) is amended—</text><paragraph id="idEE3786D7D3C2439985E3A45DB5194B23"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(2), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB996708ACC9643D9B6FF6BB90FA9DC93"><subparagraph id="id23E638DF68614AFC8B3D546AD558F147"><enum>(N)</enum><header>Exception for citizens of freely associated states</header><text display-inline="yes-display-inline">With respect to eligibility for benefits for any specified Federal program, paragraph (1) shall not apply to any individual who lawfully resides in the United States in accordance with the Compacts of Free Association between the Government of the United States and the Governments of the Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id541FB006F3354458B5F0E39C4B3EBF98"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(2)(G)—</text><subparagraph id="id0F20A596FC80480DAE6AAB111E286EBA"><enum>(A)</enum><text display-inline="yes-display-inline">in the subparagraph heading, by striking <quote><header-in-text style="OLC" level="subparagraph">Medicaid exception for</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subparagraph">Exception for</header-in-text></quote>; and</text></subparagraph><subparagraph id="idE86DE509E09F40A5BAE328833AE95253"><enum>(B)</enum><text>by striking <quote>the designated Federal program defined in paragraph (3)(C) (relating to the Medicaid program)</quote> and inserting <quote>any designated Federal program</quote>.</text></subparagraph></paragraph></subsection><subsection id="idCDABFD2E51A945DF9473A636D85066A2"><enum>(b)</enum><header>Exception to 5-Year wait requirement</header><text>Section 403(b)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1613">8 U.S.C. 1613(b)(3)</external-xref>) is amended by striking <quote>, but only with respect to the designated Federal program defined in section 402(b)(3)(C)</quote>.</text></subsection><subsection id="H391C01678D1442D0831EB0EA45DE6DB0" commented="no"><enum>(c)</enum><header>Definition of qualified alien</header><text display-inline="yes-display-inline">Section 431(b)(8) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1641">8 U.S.C. 1641(b)(8)</external-xref>) is amended by striking <quote>, but only with respect to the designated Federal program defined in section 402(b)(3)(C) (relating to the Medicaid program)</quote>.</text></subsection></section></legis-body></bill>
