which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the National Institutes of Clean Energy.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Institutes of Clean Energy Act of 2021</short-title></quote>.</text></section><section id="idA1B827B786644738938AA513DDF20BF8"><enum>2.</enum><header>National Institutes of Clean Energy</header><subsection id="id1EC14727407940E2906D210AAED57358"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idEF596486C4C24B9E97D46CC83D5205AC"><enum>(1)</enum><header>Advanced energy technology</header><text>The term <quote>advanced energy technology</quote> means a technology that—</text><subparagraph id="idDADB3F487B6F47E792EC39A1FBD2A273"><enum>(A)</enum><text>reduces greenhouse gas emissions with high conversion efficiency; </text></subparagraph><subparagraph id="id8E3F674D25E545CE9BEF1475190428C5"><enum>(B)</enum><text>minimizes energy, water, and material resource use; </text></subparagraph><subparagraph id="id91935d6d69524cec86cc689632f318e2"><enum>(C)</enum><text>was produced by or helps generate a renewable energy source; and</text></subparagraph><subparagraph id="id0c774b50209c4a88870ffa1002ed97ce"><enum>(D)</enum><text>minimizes environmental harms to or negative public health impacts on frontline, vulnerable, and disadvantaged communities.</text></subparagraph></paragraph><paragraph id="id1e46baace32f4b5e9323de030ae6535a"><enum>(2)</enum><header>Frontline, vulnerable, and disadvantaged community</header><text>The term <term>frontline, vulnerable, and disadvantaged community</term> means a community—</text><subparagraph id="idE87447A4A8914895AEC23E3DEA3C5755"><enum>(A)</enum><text>in an area described in section 301(a) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3161">42 U.S.C. 3161(a)</external-xref>); and</text></subparagraph><subparagraph id="id6FB99C48D0CE44D680D701C670573161" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>in which climate change, pollution, or environmental destruction have exacerbated systemic racial, regional, social, environmental, gender, and economic injustices by disproportionately affecting Black, Brown, and Indigenous peoples, other communities of color, migrant communities, deindustrialized communities, depopulated rural communities, the poor, low-income workers, women, the elderly, the unhoused, people with disabilities, or youth. </text></subparagraph></paragraph><paragraph id="id5E98ED83473D4CE584FA94CE70943FF9"><enum>(3)</enum><header>Institutes</header><text>The term <quote>Institutes</quote> means the National Institutes of Clean Energy established under subsection (b).</text></paragraph><paragraph id="idB52A68174CA94F3BA61AE05F8E828645"><enum>(4)</enum><header>Land-grant college or university</header><text>The term <term>land-grant college or university</term> means—</text><subparagraph id="idB55432C39FCF4ED685E707C81B5DA012"><enum>(A)</enum><text>an institution that is eligible to receive funds under the Act of July 2, 1862 (commonly known as the <quote>First Morrill Act</quote>) (12 Stat. 503, chapter 130; <external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301 et seq.</external-xref>) or the Act of August 30, 1890 (commonly known as the <quote>Second Morrill Act</quote>) (26 Stat. 417, chapter 841; <external-xref legal-doc="usc" parsable-cite="usc/7/321">7 U.S.C. 321 et seq.</external-xref>), including Tuskegee University; and</text></subparagraph><subparagraph id="id28d45ae266ac4f72ab518a63c71deee3"><enum>(B)</enum><text>a 1994 Institution (as defined in section 532 of the Equity in Educational Land-Grant Status Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/382">Public Law 103–382</external-xref>)).</text></subparagraph></paragraph><paragraph id="id4e0ae95a2ca74af79246acfb79f918d1"><enum>(5)</enum><header>Minority-serving institution</header><text>The term <term>minority-serving institution</term> means an institution of higher education described in section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>). </text></paragraph><paragraph id="idcc62d3caab784d3199b9bf6b6d4a09a0"><enum>(6)</enum><header>Renewable energy source</header><text>The term <term>renewable energy source</term> means energy generated from a renewable source, including the following renewable energy sources:</text><subparagraph id="idde4e687a3ee24e24837543c36a8e22e6"><enum>(A)</enum><text>Solar, including electricity.</text></subparagraph><subparagraph id="id9755e62be4be42e9b0b549473ceac479"><enum>(B)</enum><text>Wind.</text></subparagraph><subparagraph id="idfd9f880b4640496c8be13fa485abfbd6"><enum>(C)</enum><text>Ocean, including tidal, wave, current, and thermal.</text></subparagraph><subparagraph id="id359b6704876b45c08d4e5fe61cb8d1ff"><enum>(D)</enum><text>Geothermal, including electricity and heat pumps.</text></subparagraph><subparagraph id="id9e0f1ca9c244490fb63610633729c803"><enum>(E)</enum><text>Hydroelectric generation capacity achieved from increased efficiency or additions of new capacity at an existing hydroelectric project that was placed in service on or after January 1, 1999.</text></subparagraph><subparagraph id="id5d8fe6cd593f40a5923db5ae24223007"><enum>(F)</enum><text>Hydrogen derived from a renewable energy source. </text></subparagraph><subparagraph id="ided5b596c43114a0099acd71fe079e4eb" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text>Thermal energy generated by any of the sources described in subparagraphs (A) through (F). </text></subparagraph></paragraph></subsection><subsection id="id7D178DD463064E0FA8B4C7FD224454AF"><enum>(b)</enum><header>Establishment</header><text>Not later than January 1, 2025, there shall be established the National Institutes of Clean Energy, which shall be an agency of the Department of Energy.</text></subsection><subsection id="id0F242A753E5F4157B1D76A6C9C379269"><enum>(c)</enum><header>Activities</header><paragraph id="id805850A472334FE59FCEE1B2F31FB964"><enum>(1)</enum><header>In general</header><text>The Institutes shall—</text><subparagraph id="idCAC6021BFC444C61A4388FAF605515C8"><enum>(A)</enum><text>invest in clean energy science, climate science, innovation, and research and development to reduce emissions and build climate resilience; and</text></subparagraph><subparagraph id="id2E1F54AC63724656B4A338BCC443258A"><enum>(B)</enum><text>support—</text><clause id="id703D0A98AF3840108D38CCC368B9B729"><enum>(i)</enum><text>clean energy research areas, including—</text><subclause id="idBAD44C1271364BD5BE426EAFFAE11B5F"><enum>(I)</enum><text>demonstration projects for clean energy and climate research and development priorities, including microgrids, energy storage, electric vehicles, and advanced energy technologies in hard-to-decarbonize sectors, such as the aviation and shipping sectors; and</text></subclause><subclause id="id252BBC99DB714ED8A18B17E5EAF8A46E"><enum>(II)</enum><text>clean energy research areas that are underrepresented in existing Federal research and development funding, such as long-duration grid storage;</text></subclause></clause><clause id="id617bac269bd14543a6c3084af5f154f4"><enum>(ii)</enum><text>research and development projects focusing on the impacts of energy production in frontline communities, including communities of color and low-income communities, that have been disproportionately impacted by environmental injustices; and</text></clause><clause id="id35B2B42455B04B1199AE8BAA915C61A1"><enum>(iii)</enum><text>research and development projects focused on impacts of clean energy and energy production on job loss, job creation, and workforce development, particularly in heavily unionized workforce sectors. </text></clause></subparagraph></paragraph><paragraph id="id6016AF71816A43F19F0D7D9F90FC166C"><enum>(2)</enum><header>Priority</header><text>In carrying out paragraph (1), the Institutes shall give priority to—</text><subparagraph id="idD4E346C6E5A04A05A16D4D900480A78B"><enum>(A)</enum><text>the development of technologies that will—</text><clause id="id7DFB0C40E2074F988D534670151E2C24"><enum>(i)</enum><text>minimize environmental harms to or negative public health impacts on frontline, vulnerable, and disadvantaged communities; </text></clause><clause id="id4BB23C970C1244D0BACBFF04C2C73F34"><enum>(ii)</enum><text>improve the public health of frontline, vulnerable, and disadvantaged communities; or</text></clause><clause id="idb2d7d598f1a94186885e09f9631c0ec0"><enum>(iii)</enum><text>create high-quality jobs with strong labor standards in frontline, vulnerable, and disadvantaged communities; </text></clause></subparagraph><subparagraph id="id873ce597274a42578292e4cfb475ceab"><enum>(B)</enum><text>research and development of advanced energy technologies; </text></subparagraph><subparagraph id="idBBAAEE71B2404966B7BE4CD9D883347C"><enum>(C)</enum><text>climate science and innovation and clean energy technology;</text></subparagraph><subparagraph id="id0ae3c8a09cf84f3daaf1198de647515b"><enum>(D)</enum><text>research and development that will be conducted at—</text><clause id="idACED984E6E544E18909D846EE9134AA5"><enum>(i)</enum><text>public universities and colleges; </text></clause><clause id="id2605F39E1DA8469E8CF757F6CFA38978"><enum>(ii)</enum><text>land-grant colleges and universities;</text></clause><clause id="id4D3FE36CD9B443708BFA3A491E632402"><enum>(iii)</enum><text>minority-serving institutions, including historically Black colleges and universities; and</text></clause><clause id="id5D320D3D058643BE8B9B22DB88AAA456" commented="no"><enum>(iv)</enum><text>consortia comprising 1 or more of the entities described in clauses (i) through (iii); and</text></clause></subparagraph><subparagraph id="id72c4827b04924ca696f3280469206767"><enum>(E)</enum><text>research and development in geographic areas that have seen the worst job losses between 2016 and 2021, including rural areas and areas impacted by deindustrialization.</text></subparagraph></paragraph></subsection><subsection id="id6F95AD06849446C1B0B110E170F34BF6" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $400,000,000,000 for the period of fiscal years 2022 through 2031 to establish and operate the Institutes. </text></subsection></section></legis-body></bill>
